Seems I asked this question a tad prematurely. I've found most of the information that I need.

She has to include the court and police records for the three DUIs. No idea how to actually get this information, I assume her lawyer will know. I further assume that although the first DIU was over ten years ago, and is now officially off her record, she still has to include details of it...

It doesn't look as though the IMBRA stuff will actually stop the application, its only there for my protection. I feel all warm and safe now :)

one more question...

There is a section on the I-128F regarding the IMBRA that says under some circumstances, charges and dispositions relating to crimes must be submitted. One of the specific conditions is "crimes relating to a conrolled substance or alcohol on three or more occasions, and such crimes dit not arise from a single act"

I'm guessing that the three DUIs that she has count as three such alcohol related crimes, does she have to include the charges and dispositions of all three DUIs? they are going to be hard to find, the earlier two were years ago :(

might well have to speak with a lawyer about this. just wondering if anyone has any experience?

btw: why are you traveling on a B-2 instead of under the visa waiver program (VWP)?



I presume you're on a B2 because of business?



A B-2 is the tourist half of the B visa, and the OP hasn't yet answered this.
VWP-eligible people who have a B visa usually have a good reason for it. I wonder if the good reason might not wind up being another item in their case for them to investigate with a lawyer. ie, if he holds it due to a conviction or other immigration problem in his past, that will have an impact on today's case.

Why hasn't anyone suggested that he work all this out with a lawyer, in a consult. There's enough misunderstanding in this thread to make it worthwhile.


Sorry, meant to say... I'm here on a B2 because I wanted to stay more than 90 days. I'm basically living in Tahoe for the whole winter improving my meagre snowboarding skills :)

No prior convictions, no prior immigration problems, no backruptcies, not even any points on my license :)

Talking it through with a lawyer would be very wise, and I do intend to do just that. The problem is that it costs money - a resource that gets drained during a winter not working. I'm currently getting as much information as I can, plus a range of experiences from people who've been through it, so that when I finally sit down with a lawyer its not all just going to go over my head and be wasted

okay, so more questions, after having talked it through with my lady

If we get married now, her mother will go nuts. most likely excommunicate her directly. Her mother wants us to wait until she's out of rehab before we do anything, whatsoever, at all. Which I suppose is kind of sensible mother advice, even though the girl in question is 34... and given that her mother has done a lot for her during this whole DUI/rehab process, annoying the mother would be very ungracious

My question is this: Would another, more sensible option be that we file now for K1? If we kick the process off while she's still in rehab then the first 3.5 months of the wait will be mitigated by the fact that we can't be with other anyway. leaving only X months of horrible torture, where X can be anything that an enlightened government wishes it to be...

IF we went this route - filing K1 now, then me heading back to the UK at end of April - would she be able to visit me in the UK when she gets out of rehab in August? would I be able to visit her? or are all visiting rights terminated until I get the K1 and fly over? Would it be best to not file anything until i'm physically back in the UK?

Now for some more information, just to complicate matters further...

My girlfriend is currently in a rehabilition program - she got caught for a DUI just after christmas, and being her third DUI in ten years (the previous ones were 8 and 9 years ago), she was given a choice - 120 days in county jail or 120 days in rehab. Naturally she chose rehab... but she doesn't come out of rehab until early August. I'm not entirely sure if she can actually get married while the courts have control of her, and if we did get married she'd have to file the paperwork from rehab.

I'm due to fly home at the end of April. We had previously agreed to meet up again in August, get married, and take it from there. Reading your responses so far, leaving the US would be the least sensible thing to do. But that puts us both in a tough position, because I'd have to survive until August, and even when she came out we'd have to survive until we could both get jobs. which for me, would mean waiting for the EAD to be approved

I guess my main question is this: If I leave at the end of April, then re-enter the US for a week or so in August under my current B-2 , marry her in Vegas, file for AOS and EAD... do we really stand a chance of getting approval? or am I likely to get denied, barred from the US and thrown into guatanamo bay?

7 months seems a long time to wait to be allowed to marry, but faced with the logistical difficulties of marrying while she's in rehab, and balanced against the outright dodginess of coming back for a week or two in August then getting married, I'm at a loss to know what I should do for the best

It sometimes feels like I'm living in a soap opera, all I know is that I love her dearly, want to spend the rest of my life with her, and that at some point in the distant future i'll look back at this period of time with a smile saying "it was worth it" :)

I am reasonably clear, now, on my options. Coming back in August and marrying would be fraudulent, and therefore highly dubious (and probably too nervewracking for me to attempt!), whilst marrying immediately would render me unable to work for a number of weeks/months leaving me and my girlfriend in debt. And as an aside, marrying immediately would mean I would have to stay in the US for good while, and effectively desert my UK friends and family...

I think that despite the delay, the K1 visa would be preferable.

One more question, however.. once I return on a K1 visa, and the marriage is done, do I still have to wait the months/weeks until I can work? If so, I have a lot of saving to do :(

I apologise if this is a naive question, or if this is not the correct forum for such a question, but I'm in a bit of confusion

My girlfriend (a US citizen) and I (a british citizen, here on a B2 tourist visa, the first 6 month allowance of which ends 26th May 2007) wish to marry. In fact, we wish to be together for the rest of our lives.

I have heard from various sources, most of which themselves are US immigrants from central and south american countries, that the quickest route is to simply "get married in the US, then file the paperwork". After reading through most of your site I can't find any such route...

If we were to get married now, with me on my B-2 visa, would I be able to stay in the US and work? If I can't work immediately then I'll be broke before long. If I go back to the UK, work for a few months, come back in August - again on my B-2 visa, then get married, I assume i'll be breaking my visa conditions.

We are fully committed to each other, and we are prepared to wait, and I'm anxious to do everything correctly - my question is, would it be foolish to enter into a 6-12 month process of filing for a K1 visa when all we legally have to do is "get married in the US, then file the paperwork"?

Basically, I'm to consider my stay in the us to be an extended vacation, with my UK address as my 'current' address. Since i'm not working here, am living in a rented condo, etc, this isn't where I "live", for any value of the term.

As far as intended address goes, I'm able to write "To be determined" in the street address box, then "San Francisco, California" in the Town/city boxes.

And I should put my G/f's current address in rehab as the mailing address, as this can be changed later, albeit at the expense of some b*allache :)

Hello again : ) Just going through the paperwork I need to fill in for the K1, and I have a few questions about the addresses...

1.
The I-129F part B, question 2 asks for the alien fiance's current address. I'm in the states until the end of April, and I'm not entirely sure whether the package will be mailed before I leave (we have to wait until Malia's police and court paperwork turn up). Do I put my (I'm the alien, by the way) address as my temporary address in the states, or as my address in the UK?

2.
Pretty much the same question for the g-325a, the words "until present" are used... i've been at this address since november, so its definitely got to go down, but is it the last address, or shall i put my prospective UK address down (its my folk's house)? I assume that have different most recent addresses on the I-129F and the G-325A forms will cause a hiccup?

3.
I-129F part B question 14: Address in the US where your fiance intends to live.
Well, my g/f is currently in rehab and will be out in August, after which she'll probably come to the UK as a visitor for a few months, so its no use putting her address down. What on earth do I put down here? her mum's address maybe? Is this important? can I just put "unknown"?

4.
And finally, the NOA etc will be sent to my g/f's rehab address, I assume, since that will be the current address of the petitioner on the I-129F. When she gets out of rehab is it possible to change the address?

By the way - "hope they'll believe the I-94 stamp"???? Yeah, you'd better hope they believe it. If they didn't, they wouldnt' believe any passport markings, which is their primary evidence favorite!

As with all other possible evidence - could all of it be faked? - yeah, of course. But you have to look at all your options reasonably and be confident that they'll do the same. There will be ample evidence that you were here - you've got it all in front of you right now I think. You're fine!!!! Save the panic for later.


Its okay, i've got plenty of panic in me to last for later as well :)

I've got a ton of stuff now; as well as everything i've mentioned I've got the 5 month condo lease, season lift passes for two local ski resorts, flight itinerary, 6 photos of us both together, including one where we're both holding a newspaper with the date showing, bank and credit card statements ...

But as far as proving that Malia was here as well... well, she lived in the house next door for 18 years, is it worth including a bill or two from her, or will they check her addresses anyway?

The airline luggage tags are also good, they have the date, your name and destination on them. Could always be used as back up if you're really worried and still have them.

Just going through my evidence, scanning it in and photocopying it, when I noticed to my horror that some of the ink has rubbed off my boarding pass stub, so that the '2' in '27 Nov' is completely gone. You can just about see it if you hold it up to the light and squint, but any scanning/photocopying/photographing misses it completely.

Is this a case where I should send in the original? or just photocopy it and put a note on it saying "Sorry, the 2 has rubbed off" and hope they'll believe the I-94 stamp?

(or is this another case of thinking/worrying too much?)

Hello again :)

So over the last few days I've been putting together my k1 package on behalf of my fiancee, and I'm just debating one last little point

In august she'll definitely be moving house, and almost certainly back to her mums house. I've done some research on changing addresses, and it seems to be a point of weakness in the system, and stands a good chance of delaying things. added to that, the last thing she needs when she comes out of rehab is to try to communicate with a government agency - if anythings guaranteed to turn one back to drinking, its that! :)

SO my question is... can i just put her mums address on the I-129F question, left hand side at the top (part A question 2), and all the way through the rest, put her current address (G-325A, letterheads, etc), then put a note in the coversheet explaining the difference, and asking them to please send everything to her mother? it sounds like question 2 is the one that goes into the mailing address in the system.

As an aside, this site has been an absolute godsend. You just know that the human race will be okay when people are this willing to share information and experiences. All of you deserve to feel damn proud of yourselves :)

I didn't hole punch it at the top, though. I briefly imagined myself as a clerk sorting all this ####### out, and I figured that the most enjoyable part of filing each submission would be to wedge it all into a hole puncher and give it a good old smack. I didn't want to steal their thunder.

I'm in kind of the same boat as you. My USC lover has 3 DUIs and we've been stressing about the paperwork. Court copies are easy enough to get - as long as you just want the disposition, but if you call the cops and ask for certified police reports they demand a subpoena - way too much expense for us at the moment, especially since that the 3 DUIs were issued by two different counties, and the CHP.

even getting normal/uncertified police records involves a barrage of questions about why, and a continued barrage of suggestions that court records should be enough.

Anyway, we're just going to file with the certified court records and see what happens. In the meantime my g/f will pursue the police and round up copies of her records, in case we get an RFE on the issue. I reckon that the delay caused by an RFE when we have the papers will be less than the time spent waiting to get the papers in the first place, and no one seems certain that you actually need them for DUIs anyway.

If the fact of their marriage didn't, for any reason, come up within the first moments of the interview, the officer might think there was an attempt to misrepresent, and things could go very badly.

when it says you must have met in the last two years, it means that you have had face-to-face contact in the last two years, not that you first met each other within two years.

you could have intially met and fallen in love 10 years ago, but as long as you've been together in the same place, within the last 2 years, you've satisfied the condition.

Pon told me that they never looked at the evidence while she stood in the window, so they must have looked at it prior to being called to the window. Her interview was on June 30... So this is pretty fresh information.

I leave on the 23rd EVA air out of SFO for BKK... Then we get to play the waiting game for the interview on the 30th at 7am.... At least we will be together, that is the good part, and also it will be nice to get away from work and all the house choirs. good.gif

I cannot believe all of the stuff I had to do to get everything ready. But it is all good now, work done, packed and waiting for my flight. I really enjoy reading all of the stories written here they are a comfort and sometimes a good laugh, thank you all. Also thank you all for the support, and information. 4. I saw the F1 visa on your passport, but it was for only 3 weeks, why was it so short?

We were together, 7 months, when we had our interview.


Wow, ok, that makes me feel better, we met last Nov. in person (two trips to TH total) , so we have 8 months now but we waiting for an interview date, so it will be longer by then...

Plenty of chat logs, some text messages, some phone calls ( most of them are on a phone card, doesn't show real numbers) and of course, pictures from the two trips there.

I use Cthai it is an online phone card and they sent me a printout of every call I ever made on there system. Over a years worth of calls 45 pages, it was really cool and saved me a lot of time and headache....

about the interview it was a women who spoke thia and english she said she was very nice and they where joking she only asked 2 qestions how many times did i come to thialand ?
where did she meet me? for the most part she said she was worried for nothing i hope everey buddy getts the good news too

oh and i would have reported how many got a visa but my wife was the second person called and the first to get a visa so she left before they had a chance to change their mind.
