Does a immigrate who has a I-R1 visa, do they have to travel to the contential US for  their 3 years of residenty or can they do  their 3 years in a US terrority like  Guam?

On the DS-260, you only put people who are applying for visas, so your wife and daughter. It's actually the same thing on the old DS-230, just the wife and daughter. That question isn't referring to US citizens travelling with the beneficiaries.

 

As for the employment question, just put "unemployed", then the dates Oct 2009 to present. That's what I did for mine as I was unemployed at the time.

 

Sorry but your wrong...on the DS-260 you cannot put the word "present". it won't let you, I tried, it has to be the year...maybe on the DS-230 you could but not on the DS-260.

I have some questions on my wife's  DS-260. 

 

I petitioned  for my  wife (IR-1) and her daughter (IR-2) and they were approved.

 

On the old DS-230  I had down:  me, her daughter, and our new born son, since it said who will accompany you to the United States.

 

But on the DS-260 it says  who will immigrate with you to the United States:  I take it I should just put her daughter?  Me and our son are both US citizens, we will accompany my wife, but we will not immigrate to the United States.      Is my thinking correct?

 

And on the employment question, my wife's last job ended in Oct 2009 and since then she has been with me at home, as a homemaker.    do I need to put that down under employment?   If I do not there will be a gap in her timeline from Oct 2009 to present?

I adopted my step son. I did it with a lawyer for $1,000 plus fees, a total under $1,200. There are lawyers who specialize it in and don't charge much, because it is seen as a "good thing to do".

In my case we had the bio father sign off on parenting rights. It was simple for us because my ex was already heading back to phils anyway. Otherwise you will need to advertise in your local paper for a period of time. Not a big deal, but getting the signature is preferable as it totally takes away any concerns forever.

I would use a lawyer again. Just to make sure you do it right, and don't leave any question about who the legal parent is.

I'm in the same situation, my step daughter has n/a on her birth certificate where the father's name is suppose to be, bio father left when she was 5 months pregnant and never came back and has not been in touch with his daughter at all since then, she was born 2008.
I plan to adopt her when I get visa's for my wife and the step-daughter. So I take it we have to advertise in the paper about her pending adoption before we go to the US? What happens if we do not advertise?

Ok, heres my story I am married for about 3 1/2 years now to my wife. Every year I go back home to visit her and stayed for a couple months. June 2011 I got my US citizenship and file a petition for her, and the problem is she got pregnant by some guy (her ex or co worker she wont tell me). But i really love her so i decide to continue the petitions or im just fool? Anyways the baby was born on November 2011 and on her birth certificate shes using my last name and im the father, even though im not her biological father. On my petition paper it was only my wife name and I told my lawyer the baby was born and ask my lawyer what to do. My lawyer told me just to wait until we got some paper works. My lawyer filed 2 different of petition 1 is I-129F for Fiance and the 2nd is I-130. I got my approval letters about 2 weeks ago now, my lawyer told me I have 2 choices, try to get the k3/k4 visas or wait for the I-130, so I told her let me try the k3/k4 because I did some research about it, and I found out that my wife can come here in US while waiting for a green card. So I send the approval letter (I-129F) to my wife in Philippines, but when she went to do US embassy they told her she cannot do the K3/K4 anymore because the I-130 is already been approve. So my lawyer told me just to wait for the letters from NVC (National Visa Center). It will take about 1 month then im going to pay a fee of 500+ i think it was 400 something and 90 something dollars. Today i received a letter from NVC but not the papers works yet, its just a notice that they receive my application and everything. And my question is do I have to file a separate paper works for my wife daughter which is only 4 months old. Its friday night here so i wont be able to ask my lawyer until monday. Thank you


I think you are nuts....second of all get your name off that birth certificate, if she fools around on you once she will do it again.

Not sure when the timeline starts. Is it from date that visa was issued or when POE was done.

 

I also have that same question...why does a child need a green card. I'f I'm  correct  after 3 years the child becomes a U.S. citizen?  So why do we have to pay the $165 for a child?  My step daughter will be only 5 when her visa is done, and she won't be working at all.  What will happen if I do not  pay her $165?  But only pay  for my wife?

The few that I have read of going through Guam didn't have any issues, and it didn't take very long, plus the airport is not all that large.

 

You will still go through customs at the first airport within the USA proper (territories don't count for this)

 

I plan to have Guam as my POE, we will be spending 1-2 months there on vacation before going the US mainland.  So I take it we will go customs at Guam since we will be spending sometime there.

That is because Guam is not on VJ list of POE's.  I have asked to have Guam put on that list, but so far it has not been done.  My POE will be Guam also.

I will be filing form I-130 for my wife and her step-daughter soon and on the I-130 line #18 it has "address where your relatives intend to live". I live with them now in the Philippines and want to move to Guam with them after the visa is approved, but I do not have an address there on Guam. I have not moved yet to Guam. Will this cause a problem when I fill the I-130's?

What my plan is..I live in the Philippines now, but maintain my Wisconsin residence. I plan to move to Guam after the Visa is approved and change my residence to Guam, I do not have an address there yet, so going to find a friend over there, if I cannot find someone then I plan on using our hotel address where we will be staying for the first 2 weeks or so and then doing a change of address when we find our permanent address on Guam.

After your I-130 and your I-864 forms have been submitted, and during your interview you give the interviewer a new address where your relatives intend to live, (change of address per say) will this be a problem? Has anyone done this?

I want to use my sister's address in Wisconsin on the I-130 and the I-864 forms, then before the interview travel to Guam and find a place to live. I want to give the Guam address as where my relative intends to live and cancel the original address on the I-130 and I-864 forms which is the Wisconsin address.

Does this makes sense or will I get in trouble with the interviewer for doing this?

I understand what you're saying. If they ask you why you are here in Guam, you tell them why you are there in Guam. Vacation, visit family before you go to Wisconsin or whatever your reason may be. It seems a bit more confusing if you would constantly be changing addresses imo.


I understand what your saying, I just say will vacation on Guam. So can i just live on Guam then vice going to my intend to live address in Wisconsin?

Your POE has no bearing on your application or interview.

I would say the great majority of applicants don't even know their POE during their interview.



I have heard that when you use a US address on your I-130 like my sister's address in Wisconsin your POE will be for the continental US.
If I fly to Guam with her visa with the POE being the continental US along with my Wisconsin address (where we intend to live) Guam immigration will ask us why are we here in Guam and not the continental US, immigration may not let us in to Guam.

So to avoid any confusion, I want to do a change of address during her interview so the POE will not be the continental US. Guam is a territory of the US but not part of the continental US.

Does this make sense?

Yes I also made an appt with info pass, and will be bringing all docs that I will submit with my I-130 and our G-325A. will be bringing the original docs and one copy of each along with  some additional docs that they  are not asking for, just in case they do  lol.  This NOA1 you will get after you file.

After our interview my wife and I were talking about settling in Guam instead of going to the U.S. mainland.
