Thanks for the sites, there are a few there that i didn't know about. I live in NYC, so JFK is where I fly out of. I hate seeing tickets for 300$ then find out there is 700$ worth of taxes. How could that even be possible! I thought oil prices were falling.

My question is: Would taking photos from our ceremony help or hurt? On one hand, I could see them helping, because that REALLY helps to establish our relationship. In a perfect world, the interviewer would be familiar with the local customs, however I really have no idea how this situation will be viewed by the embassy.

Has anyone had any experience with this?


Yeah, I have to agree that it would be a bad idea to show pictures of the ceremony. Don't make them question anything.

On the I-129F and G-235A where it asks for the address of your fiancee, if she lives in Bangkok would I fill that out for both the "town or city" and the "state or province" boxes or just for one box? What do most people do? I'd hate to get a RFE because of something as minor as that.

I received the NOA 1 and it was on fancy paper and very official looking. 4 months later I got an e-mail stating that "On February 23, 2009, we mailed you a notice that we have approved this I129F PETITION FOR FIANCE(E). Please follow any instructions on the notice"

About a week and a half later(March 4th) I got what I thought was the NOA 2, but now I'm not sure. It is a standard size white paper that looks like it was typed and printed on a computer. Not anything like the NOA 1. It states:

Dear Petitioner,
The State Departments National Visa Center has recently received an approved I-129F petition filed on behalf of your fiance'. This letter is to let you know that within a week the petition will be forwarded to the appropriate visa-issuing post where your visa interview will take place.

Our records show that you filed the I-129F petition for:

Name........Gives her name
INS Receipt Number......Gives #

Barcode is here

Case Number......Gives #

Your fiance' will soon recieve a packet with instructions from the consular section on how to apply for the K1 visa at that post and what documents will be required.

I appreciate all the responses...we all do what we can. My fiance and I have a relationship that we involves communicating everyday by phone, YM and texting. Like many people, I work and get limited vacation time. Once a year is about all I can manage for a two-week stretch. I would hope that is understood by the interviewer. I guess we will have to try and provide amble evidence of our relationship outside of a visit more than once a year. I was just hoping to get confirmation from someone in a similar situation (fiance in Thailand) that had success despite only 1 or 2 visits in the last 2 years.

by the way - this site is amazing! I've read through many different posts and couldn't find one to fit this question exactly... I did find several asking about working in the us illegally and the majority of the answers said to put down the employment anyway because it's better to be honest. So, the main point of my question(s) above is whether or not his employers will be incriminated in anyway due to the way in which they paid him(under the table) as it were...


Your fiance was not "employed" by these companies.

Does a K1 visa over ride a 10 year ban?

Correct - you'll need it for AOS.

Presumably you received your first NOA (NOA1) ; did you move recently?

If you did not move - USCIS should be able to see why the NOA2/Approval Notice was not delivered (undeliverable, etc) - In cases like yours - if you didn't move - I've seen USCIS re-issue the approval notice without you having to file the I-824.

I haven't moved. I called and talked to an operator and a supervisor and they both said "it is standard policy to have to file the I-824 form" and to pay the fee. They also said it was sent out, which leads me to believe that the post system lost it. You would think that for a paper that is kind of important they would send it with something other than regular mail, which is not the most reliable.
How long can I wait to file the I-824? If I were to wait until she came and we were ready to file AOS, would that be too long?

There is still time for it to come. Hope you don't end up like me tho. They said they sent me form I-797 on 2/23/09 a few weeks went by and i still didn't have it so I called, they said wait 30 days and call back. 30 days was up yesterday, so I called back today and they said to file form I-824 and pay a 340$ fee!!! So I have to pay because they either screwed up or the mail system screwed up. (I didn't move either)

That's a maximum.

The USPS isn't that bad. At least 3 days will probably pass.

If you really want to obsess over it, take into account that nothing really moves on Sunday (USPS or USCIS).

Nothing gets mailed out of the service centers on Saturday OR Sunday (so if it's dated on a Friday, probably not sent out until Monday - as was my case).

If you live in a rural area, count on a couple extra days of transport/processing. My experience with tracking shipping leads me to +1 day for transport between facilities, +1 day at the facility. If there are several stops for you, then several days will be added.

Some people may rag on you for being obsessive, but there are other people who spend entirely TOO MUCH time thinking about all these little things. Once you have it, it won't seem like it actually mattered all that much after all. Don't let your hair fall out over it, but don't think you're alone. smile.gif

There is a thread in the K1 progress forum barely a month old on the same topic. I'd look for it, but it sounds like you have more obsessive energies for the subject than I do, so I'll let you spend a few minutes looking yourself. smile.gif


Since I know Danny and his situation, I would just add (in reference to the bold text above) that it DOES matter, at least for those of us petitioning through Bangkok Thailand. To get the police certificate in Bangkok they ask for the NOA2 letter. And getting the certificate takes approx. 10days or longer. Hence Bangkok filers do have a real interest in getting their NOA2 letter from USCIS as quickly as possible, so that it can be forwarded to their fiances.

Danny - in our case we got the CRIS NOA2 email on Jan 14 and the hardcopy letter came in the mail on Jan 20 - 6 elapsed days. Pretty much standard I think.
(It didn't matter a whit since we then promptly got stuck in AP@NVC, but hopefully that won't happen to you!)

Calling the service center is a waste of your time. I'm in the same boat. I have the e-mail saying the notice was sent out, but I never received it. I called and was told to wait 30 days then call back. After 31 days I called back and was told to pay the 340 bucks, I talked to a supervisor and was told the same thing. Basically it's our problem, because "they did their job"

I'm going to wait until AOS to get it.

That's true, but I threw in a few things that pointed towards a bonifide relationship as well. ie. a few pics, and 2 copies of envelopes to me from her. I was approved with no RFE.

When your first starting this process it seems really stressful and hard but looking back it was pretty straight forward, I found that the guides and example forms on here really helped a lot.

The USPS is unreliable. The USCIS sends the important NOA 2 via regular mail, because of this, or other factors, you may not receive your NOA 2. If this happens call the USCIS, explain to them that you didn't receive this paper, they will then tell you to send them 340$ and they will send you a replacement (via regular mail!)


Or yours will come in a few weeks.

Same thing happened to me. I called a few times and was always told that I had to pay the fee, there was no other way. I'm about to go through the AOS process now. I plan to send a print out and send the e-mail saying the petition was approved and a letter stating that the NOA2 never came, I tried to call, etc... and that is why I'm not including it in the AOS package. Some people have done this and it worked. If it doesn't work, I'll get an RFE then I'll pay the money. If it does work I saved 340 bucks.

I also called my fiance using a calling card. If you contact the calling card company they can provide you with a list of the phone numbers you have called using the card. I was able to request the information with my calling card and wasnt a problem. Are you using a rechargable card with the same pin each time? So just provide them with ur calling card number, and pin number, and they can email you all the activity on your account. Yes the k1 requires proof of meeting, but you should also show proof of an ongoing relationship. If you are unable to get a complete list from your calling card company I would provide it anyhow. Does hurt your process in any way so why not?

I put about 50 used calling cards in a zip lock bag in the packet that was used at the interview. The interviewer pulled the baggie out of the package and handed it back to my fiancee and said that this was not proof and she didn't need it.

What I did was once or twice a month I would call direct, that way the numbers were on my cell phone call logs.
