Hello,

My appointment for CR1 visa interview was set for next month.
However since I recently started working I do not intend to go back to my country now. I am willing to re-schedule it for either August or September.

However at the Consulates website I came accross with this paragraph:

'Important note: Many immigrant visa files include documents with validity expiration dates, and most types of security clearances expire within three months. Please make sure that the security clearances for the applicants will be valid on the new interview date before rescheduling. Also make sure to bring new copies of expired documents to the interview.'

Does anyone know what are these security clearance specifically? And how can I know when they expire?

And secondly, I read the text of the new Senate legislation and came accross with a startling information.
I do not know if CR1 visa holders will be effected by the new legislation. It says the Conditional Residence period is going to be 6 years. And Conditional residents will not be able to get Federal Higher Education Grants (FAFSA) anymore but just loans.

What do you think? Will these conditions effect us (legal immigrants)?

If it does then it will mean rewarding illegality/breaking of laws and punishing law-abiding people more.

I need help on my question about re-scheduling and the expiration dates of security clearances and also I need your opinion on the new situation if the Senate passes this legislation as it is.

The cost of flying back to your country for CR1 can be overlooked if you have relatives there to visit. You can both get your interview done and visit your family members in your native country.



I don't see where there is a huge difference in cost financially. Where there is a difference is the amount of time spent on one or the other. Personally we weighed it out not monetarily, but emotionally and the amount of stress one or the other might cause for the entire family. CR-1 you have the added wait for the interview, do a few extra bits of paperwork through your process, but when that visa is in hand it is done for the next 21 months. K-3 you can either adjust status, or travel back for your CR-1 (added flight means added money). For the K-3 toss in the adjustment time, travelling for your appointment and the cost that might entail, and also the fact if you need two incomes the stress of financially just getting by. Maybe it is a good idea to compare the two financially side by side, there is something for you to do while you wait. ;)

I rescheduled my interview too. The consulate confirmed it and told me to consider that e-mail as the new appointment letter. I did not even need to show the appointment letter (the old one) at the embassy. They have already a list of people who will have their interviews on the paper...the security guards who let you in.

I clearly remember reading a post here on visajourney some time ago. One AOS applicant was issued a 10 year green card although the couple were married for less than 2 years. I think the immigration officers have some discretionary power over this issue.

No issues. You will obtain an IR-1 and gain immigrant status on entry without conditions, if you have been married 2 years or more.



So this is automatic and there is nothing that I have to do to switch the case type from Cr1 to Ir1?

For the interview the correct visa will be issued depending on how long the marriage is at the time. If you are married less then 2 years at time of visa issuance you will be granted a CR-1 visa. If on entry with the CR-1 you have then been married 2 years or more, you will be granted immigrant status without conditions and be issued a 10 year green card. You do however often have to bring this to the officers attention on entry so the correct immigrant status will be granted.

Why did not you contact the embassy/consulate that issued your visa right away when you found out that it was CR1, not IR1? It seems to me that it is mainly the embassy's mistake. And the immigration officers at that POE did not correct someone else's mistake.

It is interesting how these people work. They give 10 year PR cards to CR1 visa holders and 2 year to IR1... It is dumb.

Hi Folks,

My wife arrived Newark POE on IR-1 visa but she wan't given any I-551 stamp on her passport. Just a red circular CBP stamp with IR-1 written on it by hand. Is this right ? Did the officer forgot to put one on ? Also she was told that she will get her Green card in mail in 46 months. I never heard that before. What's up with this 46 months thing ? Need help please!!!! Usually the green card arrives within 2-4 weeks after the entry into the USA.


It has been over 3 weeks since my entry and no card in sight yet. They sent me a dry 'welocme notice' last week and that is all. By the way I checked from USCIS website that my SRC number+1 got his/her card a few days ago. It seems that in Texas they do not work according to the principle of 'first come-first served'...

I had submitted our k1 visa paperwork to Nebraska on February 21, 2006. I was notified by my U.S. Michigan Army National Guard unit that I was being transferred to a different unit that is preparing to go to Iraq. Well this is where the problem resides, a group of us are on "alert" status for Iraq, I have yet to receive my orders but we are training for the mission and supply is coming through very promptly for items that would normally take months to receive.

I contacted my congressman, his office submitted the emergency expedite paperwork back around March 14, 2006. Anyone know of my chances to bring my fiancee and her daughter over from Guangxi, China to the United States prior to my deployment scheduled for July 2006? I have a home set up for them, family members within minutes (my sister lives across the street from me) from our home. I would love to start a family with my fiancee (soon to be wife, I hope) prior to the deployment. I'm 43, my fiancee is 39, we both would like another child before we get older.

Anyone know of anything else that could be done to expedite the k1 visa process?

Yesterday I saw a post/timeline...they got their k3 visa in about 1 1/2 months from the date of their NOA1.
I hope you get a speedy processing. :)

By the way can not you meet halfway in Iraq? I do not think Iraq has a stringent visa policy. It does not even have a viable government apart from the occupation arrangements.

We've recently applied for the K-1 and everything should be fine in that department.
I was wondering if, after I get the visa, and if I wanted to do two trips to the US to move more stuff cheaply (those damned international movers are insanely expensive), I could enter the U.S. twice: the first time on the VWP, then go back to my country to fetch more junk, then enter the U.S. on my K-1.
I know the K-1 needs to be used within 6 months of issuance (right?), and that would not be a problem. Would what I'm describing be a problem?


I do not know about VWP. But you have to show your passport to immigration officers on entry right? Do you have a choice/preference or is it up to immigration people to acknowledge the visa?

I used my K1 and had to go back to my country to complete my military obligation and the visa became useless. One entry only

It is the requirement of Adjudicator's Field Manual for Affidavit of Support.

However, you may specify in the cover letter or so about this recent bank a/c open thingie. Another things is since she is very well above the poverty line this year, it is positive to you both as well.

Right answer. ( at least for your situation ) Marital assets can freely pass between partners and / or be held separately ( even in community property states) So long as he obeyed any laws regarding his income in his country . It would be just like you choosing to to file separately and he was here earning money. He could hand you money at anytime and not incur any tax consequences to either of you ( assuming we aren't talking huge sums)

So I guess the first thing that comes to my mind is you didn't declare it right? SO you didn't pay taxes on it? So then how can the IRS consider it income if it wasn't taxed? It's all fine and well to say it should have been declared and so it should count, but it wasn't and now you want to use it to your benefit.

I'm not a tax accountant or a tax lawyer but I think this would more count towards assets and not income. In my opinion

I was not required to file as I mentioned I didn't make enough to file, however when I thought about the money that was sent,it made me think "should it have been declared as income or not" not trying to get around paying what I owe per say... was just a question to for go any pitfalls... and as I mentioned I am wondering if the INS would question me on this and state that is should have been declared as income and therefore I would have been required to file as this amount (even though was minimal) put me over the limit of not being required to file for 2009....

Hi VJ members. I asked about scheduling flights earlier this month on determining if a loved one from Morocco could land at JFK, go through baggage claim and their POE interview ( arriving at 03:45 pm) and make a conecting flight at 6:30 pm. Flight attendent with Delta said yes, she saw no problem him clearing interview....making a connecting flight at 6:30 pm.

As some of you know, today my husband is traveling home to the states and from tracking his flight....they had a 2 1/2 hr delay in leaving Mohammed V airport in casablanca. His arrival should have been 3:45 pm and it is scheduled estimated runway time 6:12 pm. He would have missed his connecting flight, probably at his expense. I'm glad we decided to opt for him staying overnight :thumbs: in NYC to avoid chancing this.

Just wanted to share with everyone delays do happen. Plan your trips wisely.

This is good to know... However, What if you have filed for a IR-1 visa which of course includes the I-130, would the person be allowed to travel to and from the USA in this scenario? :blink:

I see from your timeline that he had an interview back in 2009 and was in AP then and then was out of AP on 1/12/09 and visa approved 01/16/09 but wasn't issued as he couldn't leave in the 6 months that is required to exit the country. Why was he in AP then, and why now again?

Regarding your question, I have heard of Beneficiarys being allowed to enter the USA on a Tourist Visa as long as they show strong ties to their country BUT I have also heard the opposite and they had to turn around and go back! I don't see why if someone is in the process of an Immigrant Visa, why they would take a "chance" and stay in the US and abandon all of the hard work and money that has been put forth and why the "powers to be" doesn't take this into consideration!!! :bonk: Yet again, we are dealing with the Government here! :hehe:

Sit back, calm down and take a few deep breaths! If all she asked for was your Husband's Tax Info that is simply what you need to gather and provide to the CO, did you neglect to include this in your documents that was initially submitted?
As far as another interview, I am not sure other than when you take the Tax info back to them. I am sure that all is fine and to put your mind at ease, call them and don't give up or let them off the phone until they provide you with an answer.
Just tell them what happened today and you want to be sure of what to expect. Once that you find out what is what then you will be able to relax and concentrate on what you need to do!

Gathering the info that they are asking for shouldn't be a problem correct? The sooner that you get this to them the sooner this stage will be all over with and you and your Husband can be re-united!:D

Here is some info taken from the the DOS website that may help you with your question. The section that specifically talks about the Beneficiary is in RED. IMO, it is beneficial if you have a co-sponsor although it isn't always possible for some and there are a few consulates that DO NOT accept Co-Sponsors.

Yes, except with form I-864EZ. The sponsor's income is totaled first. Personal assets and/or the income and assets of household members who have signed an I-864A are totaled next. Usually the sponsor must present evidence of location, ownership and value including liens and liabilities for each asset listed. The consular officer must find that the financial value of the asset can be converted to cash within one year to support the sponsored immigrant without undue harm to the sponsor or his/her family.

What Cash Value of Assets is Needed?

The total net value of assets, less liens and liabilities against them, must equal five times the difference between the sponsor's income and 125% of the poverty level for the household size

Sponsors of spouses and children of U.S. citizens must only prove assets valued at three times the difference between the poverty guideline and actual household income.

Sponsors of orphans who will acquire citizenship after admission to the United States must only prove assets equal to the difference between the poverty guideline and actual household income.

What can be used as assets?

Assets easily convertible to cash can be savings, stocks, bonds and property.

Can the immigrant visa applicant count assets that he or she owns that are outside the United States, such as real estate or personal property?

Yes, under the following conditions:

  • The assets must be convertible to cash within 12 months
  • The applicant must show that the assets can be removed from the country where they are located. Many countries have limits on cash or liquid assets that can removed from the country
  • The net value of assets is at least five times the difference between the sponsor's income and 125 percent of the poverty guideline for the household size.

I would call the NVC on Tuesday (Monday is a National Hoilday) and tell them your situation and if the person that you speak with is even a tad bit unsure ask to speak to a supervisor and get a direct and definite answer. You can also call a Tax expert and they may be able to help you as well!

I am from the Philippines, I came to Germany through command sponsorship because my husband is in the army. Before I came here he already filed a visa petition for me. I got here Nov. 2009. February 2010 we applied for a tourist visa while my case is still pending because we needed to go to the US for awhile and I got approved but the passport never arrived, it got lost in the mail. Neither the consulate nor the Deutsche Post took responsibility, so basically we suck it up and burdened all the expenses on getting a new one plus the dime wasted on applying for the toursit visa. Anyways my case was completed and ready for further processing at the NVC April of 2010 but we are still dealing with my lost passport. Finally got a new one August 2010 so we continued with our visa prpocessing Sept 2010. My case was originally in the Philippines since I was still there while my husband filed the petition and we had it transfered here in Frankfurt. I finally had my interview at the USC frankfurt last February 9, 2011. Everything went smoothly, staff was so nice and friendly, no hassle, it even felt like it wasn't an interview, more of a formality. Then the consular officer said, everything seems to be in there and I should expect my visa and other documents in the 2 weeks.
2 weeks had passed and no visa in the mail. So I contacted the consulate, worried that my documents is lost in the mail again. Tried calling first but didn't get anyone to pick up so I emailed them. Got a reply that says, your case is sent electronically to Washington for further administrative processing and they are still waiting for a reply before they issue my visa. I keep thinking why I am put on AP...all our documents are there, my husband and I have been together for almost 7 yrs, been married for 3 yrs. We have 2 daughters ( 4 yrs old and 6 months old) I been living in a US military base for more than a year now. No criminal records whatsoever. My husband called the the consulate and DOS, both didn't tell him why I was put on AP. I am at a lost here. I don't even know how long I have to wait AGAIN! My husband is living for school to the US in April and we really want to be in the US and meet his family.
Any thoughts on this....anyone?

We have 2 daughters ( 4 yrs old and 6 months) I been living in a US military base for more than a year now. No criminal records whatsoever. My husband called the the consulate and DOS, both didn't tell him why I was put on AP. I am at a lost here. I don't even know how long I have to wait AGAIN! My husband is living for school to the US in April and we really want to be in the US and meet his family.
Any thoughts on this....anyone?

It is the truth, not a judgement. USCIS does not care. The circumstances are that they had sexual intercourse, that is the way it happens. If you do that (and who doesn't?) then she MAY get pregnant and you MAY not like the consequences or particulars of where she gives birth, the timing etc. Make your bed and sleep in it. Or have sex in it, whatever you want. Deal with it.

When did it become "harsh" to tell an adult to live with the decisions they make? :unsure:

That's what they do at the interview. The method used is to give you a denial slip indicating ineligibility due to section 221g of the immigration act. That slip should then have a box checked indicating they need an affidavit of support.

HOWEVER, most consulates won't give you an interview UNTIL you send them a checklist indicating you have the financial papers (I-134 package) in your possession. Some don't give an interview until after you SEND them the I-134 package. So, pay close attention to the instructions they give you. Do not lie and tell them you have something you don't have. They don't like that at all.

The bottom line is, there will be no visa without an affidavit of support and supporting documents from the petitioner AND (if the
petitioner is not qualified) a qualified sponsor.

Good Heavens. I thought you were working on your other topic, RE: your letter. Now I'm seeing this post which very much annoys me.
You know what? My fiance is on at the USAF Base in Iraq. Just this morning he called to tell me there has been bombings in Baghdad and its not safe to travel. If its not safe, then military will NOT let the contractors off base to go home! And guess what?? I get to deal with it and so does he. That's the way it is. In fact, if we did get our NOA2 now, and he was scheduled for interview there is a very good chance he wouldn't make it because of situations such as this!!!

And while this is tragic in Russia,and SEVERAL OTHER COUNTRIES whom have been terrorized, there is not one day I don't worry he'll call me during our very limited 3 min phone connection before we lose signal just to say they're going to bunker and he'll call when its safe! That happened on Christmas Morning Al, and you have no idea what I went through for 3 days of silence until he called. And still, I don't get on the forum to whine and complain about it, or grab at straws for an expedited case file.

What you say here is a mockery of the US Govt. for attempting to use this tragic event of others and seeminly selfish of you to even think this is a way to get YOUR BRIDE here any earlier then the rest who wait patiently! Especially, for those who have remained calm, waiting for the day they see their [future] Husband or Wife come home from a war zone and knowing their life is on the line!

I think it was already stated by Bob and Jim that an Expedite is for the USC and it requires a hardship / emergency.

We didn't need this... it was offensive.
