K-1 Fiance(e) Visa Process & ProceduresNOA2 expiration date!!!

I just got my NOA2 hard copy letter. I thought the thing was supposed to be for 4 months.
But on my letter it says...
Valid from 2/23/2010 to 3/22/2010.

What should we do? Should we be worried about this?

Hi, I was reading this coz I'm getting my stuff ready for interview and I thought this paragraph may help...it's from Manila Embassy K1 Visa guide...Seems like it's normal....Good Luck!

4.1 NOA2 EXPIRATION DATE - Don't be alarmed if the visa interview is scheduled after the NOA2 expiration date because the Consular Officer (CO) at the Manila Embassy will automatically revalidate the petition by extend the expiration date in four months increments until all actions are finalized . No actions by the USC and/or beneficiary are required.

K-1 Fiance(e) Visa Process & Proceduresscanned copy ok? g-325a

Ok, now I have seen this question posted before but different answers have been posted.

1 page or 4 pages of the G-325a?

This is a little gem on VJ. So far, the best answer is 2 copies of each (2 for the petitioner and 2 for the beneficiary). The 4 page requirement was for an older dated form. I think the 2 page answer is in the post from Gary's chat with the VSC director here:

Should be the original. Do you really want to be sitting here 3 months from now (pacing and waiting) and then receiving an RFE for the original signed version? Best to get er done right the first time. :D

K-1 Fiance(e) Visa Process & ProceduresI-129F Address Doesn't Fit

My fiance's address doesn't fit on the form I-129 in both Part B question 2 and question 15 and it won't fit by handwriting either. Should I go ahead and put see attached and include a supplement sheet?

You can handwite it if your handwriting is good. I had to write my fiancee's by hand because of those long addresses in the Philippines. Some folks here have also done a supplement sheet. Both work fine.

awesome thanks for the input guys

The money order wait is nothing! Wait till you start seeing people all around you get NOA2s....even those that applied after you and you start wondering if you checked the wrong box, or left something out....(some folks in from Dec/Nov are still waiting...someone from February just got theirs in 29 days)

The journey is just beginning....

The California Service center recieved my K-1 Visa Application on monday, and they bearly cashed the money order yesterday, does anyone know why they delay cashing my money order? and is this going to slow my NOA 1 down? sorry im just excited and impatient >=0)

Uhh That is fast. Mailed my 129F on Tue, Jan 26, they received it on Wed, Jan 27, I got hard copy of NOA1 in the mail on Jan 30, and they cashed my check Feb 3 (a week later than received).

Wow! You must have been lucky and got a good rate! 7500 P is about $166 for a week. Right now Bayview is posting about $60 for their daily rate. Did you use a travel agent or did Claudeth find that deal in PI? Inquiring minds want to know...

I got both...it was free....and arrived to me in less than a week. Is supposedly just what the CO at the embassy wants to see, so it works for me too.

I ordered mine on the phone last week and forgot about them. Then yesterday I checked the mail and had 3 letters from IRS. that's motor vehicle ,i put no on mine they never said anything

There's a big difference from being arrested than getting a speeding ticket. The USCIS and NVC will look at nationwide police arrest records. IF you were arrested then you would show up as flagged name on the nationwide FBI namecheck. Currently having DUIs in your past is not a big deal with USCIS or NVC. So why worry about not listing them and then risking RFEs or worse, denials for lying on your petition?
~Johnny~MaleUkraine2010-03-10 18:08:00
K-1 Fiance(e) Visa Process & ProceduresK1 visa petitioner application
If you don't disclose them, then they will likely appear on your FBI namecheck and you'll likely get an RFE for additional info. Maybe not but they do look primarily at past police records and history. But as already mentioned, this doesn't make you ineligible, just be aware that if you don't mention them, then they will likely find out, especially if they are police arrest records.

First thing...just FYI...NEVER mail original certified versions of certificates, documents and/or decrees to USCIS. You may not ever get them back. They tell you in the instructions that copies are fine, but should be backed up by originals at the interview.

OK....you should make sure that your fiance(e) has these original documents at the interview in case the CO requests to see the originals. Sometimes they ask, sometimes they don't. But better to be safe than to have to rescedule an interview.

I sent a copy of my passport, ALL pages, and I sent a copy of my birth certificate. I just wanted to make sure there were no doubts.

Good luck!

;) Don't be condescending when you call. Speak politely but do not make them feel like they are gods. Have your way, too.

You said that you are going to attend Wilma's interview. Be mindful. The AOS is also quite expensive. :P You are next in line.

So, what's the charge for all these tips?? :P

Yeah, I planned on being there for Wilma's interview, and we are having a Vegas wedding (her aunt lives there and she's hosting the wedding...but she wants an Elvis wedding...ohhh no..another story..nevermind). Her mom is also going with her to Manila for St Lukes... but yeap..you're right...those dollars add up fast! Then the AOS is another $1,010 ....and SoCal is not the cheapest place on earth to live. Wilma keeps begging me not to be there for the interveiw coz she wants to save money for the rest of our journey....so this part may still change soon.

Not true unless that's the new protocol.

I gave the call center a ring on October 8 last year. The girl asked if I already had my medical exam. I said no. She gave me October 27 for my interview. I negotiated by saying that my man and I were intending to attend his sister's wedding in NY on October 24 so she should let me have an earlier interview date. She said, "All right. Since you will still have your medical exam, I'll schedule your interview on October 20."

Yes, I got it that way. I took the medical exam exactly seven days before my interview.

Thank you!! You just made my day...well USCIS also helped with their earlier msg too...:) I was going by the the Manila guide on VJ (which is very dated) that has a 43 day wait for interviews.

I haven't read of anyone being asked for it during interview. But I suppose it might be nice to have, maybe overkill since they are supposed to already have it their hands when they interview you. More important to have all originals of copies supplied for 129F (receipts, birth certificate, boarding passes and such).

How long ahead did you have to get your interview date? Or did you get you interview date set yet? I have read that USEM Manila is scheduling them 40+ days ahead.

Not enough information.

Whether your felony matters depends on whether it was for something like domestic violence. If it was a sex crime, your petition (not application) would have been denied instead of approved. The impact of the overstay depends on it's length. 180 to 364 days carries a 3 year re-entry ban with 365 days or more a 10 year ban.

K-1 Fiance(e) Visa Process & ProceduresGood Interview NO CENOMAR

My Fiance (Dinah) an OFW, went for her interview at the Amercian Consulate (Kuwait) all went well, except they have not recieved the OFFICIAL CENOMAR from NSO. We went to the e-census website when her aplication was aproved last month, however, it takes 6-8 weeks by registered mail.

Long story short after a few hours of the interview process she was given the reject form by the consualte simply saying we will contact you as soon as we receive the documents from NSO.

My question, it, do they only require Filipinas to have documents sent directly to the consualte? It
seems like an aplicant from any other country with a notarized anullment document and court papers would not require a direct communication from NSO to the consulate.

I am not crying too hard as we feel blessed, I29F 2nd NOA 90 days no RFOs.
The reason she remained in Kuwait during this process is we figured a small emassy in a small country would be less of a hassle than the one in Manila.

Dinah and Dave

You can get the CENOMAR sent directly to you. It's still an official NSO printed document so the consulate should accept it. You can even get it expedited but that will cost you some dollars. On the eCensus website you can see about ordering one. You can order using credit card, only if you order is being shipped outside the Philippines.....kinda funny you can't use credit card for one delivered into Philippines (unless it's BDO or Unionbank)....and the price is way more for the version shipped outside Philippines. But if you're willing to pay $20 for the CENOMAR and about $60-80 for 2nd day FEDEX, you can have it delivered in about a week instead of 6-8 weeks.

Good luck!

K-1 Fiance(e) Visa Process & ProceduresWill we be able to use the I-864 form for the K-1 Visa?
Excerpt from DoS website:

http://travel.state....2994.html#Forms

Should K-1 fiancé(e) visa applicants use the I-864 or the I-134?

Since fiancé(e)s are nonimmigrant visa applicants, they should use the I-134. They will need to submit an I-864 to U.S. Citizenship and Immigration Services (USCIS) when they adjust status to conditional immigrant in the United States after they are married.

K-1 Fiance(e) Visa Process & Proceduresgot a mail from NVC stating CASE NUMBER
You can call for an interview, now is still a bit early, but keep this in mind, the call center PIN cost $18 and is good for 3 calls to schedule an appointment. With an NVC received letter dated Mar 6, likely you were mailed out this week...but still chances are very good that they have not processed your file yet at USEM Manila. You'd be better off calling the NVC and seeing when it was shipped to Manila. Give Manila about a week from the shipping date to get your file into their system. They WILL NOT schedule anything until you're file is in their system. Also, having the NVC letter does not always mean your file has been shipped. Need to confirm that with NVC.

You can do the medical without appointment. And also if you wait for an appointment letter from Manila, you could be waiting a while. Their website says 3-5 months wait for appointment letter. Some people on VJ have gone through the whole process and have received their appointment letters after they've arrived in USA. And the letter basically just says...you can schedule an appointment now...

Did you call them and give your email? Or did they just transfer it from USCIS?

You can start calling USEM in about a week and start requesting an interview appointment. Or you can wait for their appointment letter, I hear that takes a few months longer.

Hola Johnny!
Trip was good but I got really sick the day after I arrived! Experienced first hand the joys of a Costa Rican Farmicia. Strange concept to walk in without a prescription and walk out 5 minutes later with antibiotics, Asthma inhaler and cough syrup with codiene (all for $16)... Vanessa nursed me back to health...

They're not really stealing your money bro - just sort of using it for awhile. What's $1010 between friends?

K-1 Fiance(e) Visa Process & ProceduresIncreased VISA fee has taken effect!!!

You sent a check for $455 for the I-129F petition - this is paid to the Department of Homeland Security. What is being discussed in this thread is the proposed increase for the Visa Interview fee - This is paid to the Department of State. Currently the K-1 interview fee is $131 but it has been discussed that this fee will be increased to $350 fairly soon.

USCIS didn't "steal" your money, but don';t think you're done paying yet. Still have medical fees, interview fees, AOS fees, etc...

Alan

Welcome back Alan! Hope your trip was good! I don't know man...I think they're stealing my money with that $1,010 AOS fee...

Wait a minute, I'm so confused. What is this talk about $131. I sent a $400 check to the USCIS when I filed I-129F. They never said that was too much. Did they just steal my money or something? I'm so confused.

Celine, That's a different fee you paid. And I hope it was $455 not $400... but you paid for the USCIS I-129F Petition fee. The fee we were talking about is the Department of State Visa fee (specifically for the K1). Right now it's $131 but is expected to hit $355 at any time. You pay this fee before the interview at the US Embassy.

Hello Approved,

Have you received your NVC notice yet or not? I got NOA2 for the case which was approved on March 3rd. I am still waiting to hear from NVC.

Hello Approved,

that fee seems to be for the immigration visa. Since you have filed K-1, it should still be $131.

Regards,

 Approved.....Your link is to the I-130 "Immigrant" Visa. If you follow the Islamabad links to the non-immigrant visa, the fee is still $131 for the I-129F (K1 Visa). Your, profile sig says that you have the I-129F visa track.

The DoS link is also for the I-130 Visa. So far the fee is still unchange and I'm hoping that it will stay like that a few more months...

K-1 Fiance(e) Visa Process & ProceduresHi, im new here.

Regarding your son, if your US fiance is the father of your son, then your son is already a US citizen - derived through his father's citizenship - and does not need a visa. He needs proof that he is a US citizen and will then get his own US passport and be allowed to enter and live in the US as a citizen. Your son's father needs to obtain this proof by applying for a Consular Birth Abroad at the closest US Consulate or Embassy, which will 'register' your son's birth as a US citizen. That will make the paperwork a lot easier for you as you will only need to pursue the K-1 visa and not the K-2 as well.

Good luck - and don't be afraid to ask questions - the only dumb question is the one that wasn't asked and needed to be :) .

Thanks for that clarification! I wasn't sure since the child was born out of country.

Thankyou, Yeah i have been looking at the links you gave me. All very informative.
Have you done the process all yourself or have you used the help of a lawyer?
Were hoping to do it all ourself but really dont want to miss/forget anything as we know that it can delay the process if we do.
Its still the K1 that we need to apply for right? For me and our son? Or is it the k2. Im so confused about which one applies.

K1 for you, K2 for your child. Most folks here on VJ have done the process themselves. If you're comfortable reading, and following instructions, and you don't have any unusual issues then typically a lawyer is not needed. It really depends on your comfort level and how much "patience" you have...

K-1 Fiance(e) Visa Process & ProceduresProof of ongoing relationship

What application are you sending? I129F?

If so, you do not NEED to send cards and letters. You must provide proof that you have met in person within the past two years.

Sending proof of relationship at this juncture is optional. However if you choose to front load to some degree, then copies of cards and letters are certainly a good thing. And pictures, receipts, boarding passes, etc...

As a minimum you need to send in I129F, G325A's, Letters of intent, proof of meeting in person.......

Do some more reading and get familiar with the process and its requirements!

And complete your profile and information so its not a guessing game!

Good Advice. Also I suggest you read the guides about submitting your petition..

Your IRS tax return or better still the IRS tax transcript is key. Paycheck stubs or summaries are next best. Proof letter is last. Dont fret it.

 If you have proof of income, tax transcripts are free, tax forms, W2s, Pay stubs, all free and good evidence of salary and employment. My company as well doesn't do these letters as described, but I kept my initial letter of employment when my job was offered to me a few years ago. It states position and wage and it matches my tax forms and W2 and paystubs. Just gather as much as you can and you'll be fine.

Congrats Sicaria !

You can also call NVC @ 603-334-0700. They are EXTREMELY busy so the best time to call is early morning ( they start answering the phone at 7:30 am EST ) or late night ( they stop answering at 11:40 pm EST ) Have your receipt number ready when you get thru ( WAC # )
I understand about being anxious ! My NOA2 was approved on 4 March and on the USCIS website I had a "touch" on 8 March ( I am thinking it is when it was sent to NVC ). So I thought it couldn't hurt to try and call last Friday night....... got thru after 49 minutes on hold .... and they said they had not rcv'd it yet. Tried again this morning ( EARLY ) and was on hold 5 minutes ..... still not in the system :( I keep telling myself I won't call again until this Friday ....... but Wednesday IS just around the corner !

Yeah, I got through to NVC today and spent 40 minutes doing the busy-redial bit. Finally I get a human being and she seems nice. She asked my WAC # and then asked my Name/DoB and my fiancess's Name/DoB...then she confirmed my email (which she already had in her system), then told me my file was received on Friday March 12th. She said ..so how can I help you.. I said umm can I get my case number...she said just a second...then my ATT iPhone DROPPED the call!!  I tried an hour after that to get back in but the system was too busy. So, I'll try later...but at least I know they have me in their system and have my email.

K-1 Fiance(e) Visa Process & ProceduresWhat is a "certified copy" of divorce decree?

This doesn't make sense. I highly doubt you could get it notarized as the notarization is an authorized person (notary public) witnessing the signature put on the document. There is usually not a signature being put on, although in my case the court officer did sign it, there wasn't anyone around to witness the signature therefore it cannot be notarized.

You can take it out of the courthouse to get it notarized, but then the notary public will not notarize it as they did not witness the signature.

Reading this site I have come to realize notaries and notarization has to be one of the most misunderstood concepts in the USA.

Yeah, I see it misused a few time here on VJ. A notary is only an official witness that the person who signs a document IS the person that signed the document AT the time of signing. Doesn't do any good for example in the case of a 10 yr old divorce document. It must be Certified, in this case, Certified means that the state or county has certifed the document to be true and legal, and usually has a state seal or stamp.
