1.it can define where you can live afterwards for a couple of years as long as you have a green card,as far as i know ( correct me vets if I' m wrong) as long as you have a green card you have an obligation to live in the states at least 6 months a year or else you'll be abandoning it.if you apply for k-1,when you arrive in the states you'll be applying for adjustment of status,when it gets approved you'll get a two year conditional green card,so at least for the first two,three years,you cant LIVE in any country other than states.

2.define costly,engagement and spouse visas are priced almost equally,but in engagement you pay a big chunk a couple of times and spouse visa a couple of dollars here and a couple there many times.of course marriage is more convenient for the petitioner and the beneficiary because as soon as you arrive in the states you'll get your green card but keep in mind,for a marriage visa you'll have to prove a bona fide marriage,in k-1 you can sum it up with boarding passes,tickets,pictures,emails,but in marriage visas you are required actual legal evidence that you got married and actually lived together for a period of time.

Hey everyone,

I just said goodbye to the one I love after a amazing 3 weeks together. The plan is that I wont see her for nearly 6 months. We both are finishing school and she has a lot of wedding planning to do. We're currently in the K1 proces (September 2010 filers) aiming that our wedding will be on Augst 6. 2011 and me leaving to be with her in July.

Now Im really down with that time that we have to be apart. This is the longest we havent seen eachother, herefor almost 4 months. Now my question is to see how long other people havent seen there beloved ones, hopefully it will make me feel better.

actually he shouldnt use their address,the way texas proceeds things is they sent packages to service centers that are not as busy.at the moment considering how slow vermont is,there is a chance that they might send more packages to california rather than vermont.
OP stickt to texas lockbox,where they decide to send your package is completely up to them and out of your control

if you have received noa 1,then it will take you five months,give or take ( usually give ) a couple of days
PS: i just saw that you havent,keep in mind the snow has slowed down the mailing system and what not,i would relax if i were you.you have a long wait ahead of you,dont stress yourself from day one

ok people who are aware of my problems with packet 3,know that a couple of weeks ago,i had almost given up completely. because our packet three in no way shape or form was ready.
well my fiance stepped up and somehow managed to get everything in place and mail it to our friend who will mail it to m e,i will have it all ready by the end of the next week.our embassy gets slot ready for iranian beneficiaries on the 9th of each month,and our noa 2 expires on march 17th.now my question is,if we send in our packet 3,and they receive it after march 9th with no slots ready,would that make us eligible for an automatic expanding of noa 2 validity date?

AP is inevitable for male beneficiaries from all over middle east,not just iran.if you read the instructions that they have on their website carefully,they state that all iranian beneficiaries HAVE TO go through AP,its just that for females it wont take that long.it can take up to 6 months but it doesnt necessarily mean there is something wrong,its normal.

With respect to "other assets" Does a house that is being purchased under mortgage count towards assets? or does the US Gov't see that house as being owned by the bank?

since you can get different loans with the house,the primary residence does count as an asset

see what got me confused is,i talked to an airforce member in the beginning of the process here,and he told me that the way they calculate being over or under guidelines is different for active duty military members.according to him it was not calculated with adjusted gross income.

You don't use "taxable income". If he filed a 1040 or 1040A then you use "total income". If he filed a 1040EZ then you use "adjusted gross income".

If he's active duty US military then he needs 100% of the poverty guidelines. Otherwise, he needs 125%.

If he's using assets (like cash in the bank) to offset a shortage in income then he needs 3X the shortage in assets. In other words, a shortage of $3K would require $9K in assets. Most consulates will consider your fiancee just as they would your spouse for the affidavit of support.

Many people recommend having updated letters of intent for the interview. The consulates don't usually ask for them, but they might if it's been a while since the petition was originally sent, or if circumstances have changed that might make them want confirmation that the petitioner still wants to go through with the marriage. In most cases, the fact that the petitioner is submitting an affidavit of support is enough confirmation for them.

Also many consulates use the 125% income number ($18,212) for K petitions as this is the income requirement for Adjustment of Status. Check with the consulate/embassy where the interview takes place for clarification.

thank-you you just made my point.....theres nothing an attorney can do that would speed up the process....but theres many things you can do too speed it up...like not waiting on the paper trail...... :yes:

of course if you find a good lawyer it will give you peace of mind for a price,but we need to remember websites dont always replace lawyers,so,i PERSONALLY always suggest people who ask me to have a good lawyer at hand in case they need consultation

well thats always a good question and i agree with the answers given you......so heres my deal, i filied myself,,,my brother hired a attorney,, i got my NOA-1 ina few days my brother ask how i got mine so fast, i said go ask your attorney!!! then ask yourself who's really going to have your interest at heart your attorney or YOU!! will you do the short cuts to speed your process or will your attorney just follow the paper trail, then pick the one YOU LIKE the best....... :thumbs: :yes: obtw....i'd rather spend my money on her airplane ticket... :rofl:

thats a wrong answer to give,you having filed yourself has absolutely nothing with the reason you got your noa 1 so early.there is nothing an attorney can do that would speed up the process

nope,as far as im aware the bombings are nothing unusual in pakistan since taliban has been a long lasting issue there.AT THIS POINT,the only expedites that would get accepted are 1.the ones for humanitarian reasons like japan or haiti 2. military deployments 3.terminal illnesses.

in reality security checks for men from middle east who have served in the national guard or army ( even the mandatory 2 years ) can go anywhere from 2 months to years.

I got an RFE Friday, and turned it around as fast as I could, took a half day off work yesterday to print some photos and send the response out to CSC by USPS Express Mail.

However, the web page where I can login in at www.uscis.gov shows my application was last touched 10/18/2010. But if I got an RFE mailed to me on 3/14, that can't be correct.

Is there a precedent for this? Should I delete that account, and chew my fingernails instead of checking it obsessively for updates?

might as well.we got approved on the 130th day ( most of the cases from CSC get approved a good 20 days before the 5 months mark ) ,and guess what,we found out nearly a month later,and received our noa 2 a month and two weeks after we got approved.
i emailed CSC to tell em we are over the five months mark and they told me we have been approved and that our case is at nvc already.by the time we got noa 2 and nvc letter ( both at the same time,plus,get this,we got two noa 2s ) our case was at embassy

2.it depends on the embassy,but since your country is considered high fraud,bring as much evidence as possible
3.there is no such thing as KINDA married,its simple,your fiancee was married,she got divorced and filed for you when she was free to marry,thats all they care about.
4.you gotta work with what you got,what did she pay for her tickets with,credit or debit card?if so get a copy of a statement showing she purchased tickets to Nigeria and that her entry stamps match the ticket dates
