Just send photocopies to USCIS you need to keep the originals for embassy if you are filing K1 or for the NVC if you are filing CR-1/K3

If my understanding is correct... it appears to be "expedient" NOT to submit any petition until after my fiance arrives in the U.S. ... we obtain a valid marriage certificate... and then submit the appropriate CR-1 paperwork to get the ball rolling.

Please feel free to fill in the gaps if I am missing anything here.

Yes, your fiancee comes to the USA on visitors visa (does not mention the word marriage/fiance on entry, if she doesnt mention it they won't ask but it is important she doesn't lie to them) you marry and file for the CR-1 and CR-2. She stays with you until the date on I94 says she must return or until she is required to return for medical and interview, whichever comes first.

I have a suggestion, consider the K3, without involving another country, I married in USA and we filed while I was there our petition took 67 days between NOA1 (date they received our petition) until offered interview date, we have decided to wait for the CR-1, even if your petition took longer you could get married and she could stay with you until it was time for medical and interview in SA, normally B2 for 6 months and unless there are complications you may only be apart a few weeks. If complications do arise then consider a third country.

When they ask for your uscis number you have to give the one for your I-130 and then you will listen a message about it.
I think they do process together, mine for example had the NVC number attached to it faster than the K3.



Two different case numbers NVC has no record of the I-130, automated response it doesnt exist and when I spoke to an operator they dont have any record of the I-130.

We received approvals for both the I-129 and I-130 on March 16th. Called NVC trying to get case numbers, they told me the case number for the K3 and said it was forwarded to the embassy on 26th March but they say they have no record of the I-130 yet. Have USCIS not sent it? Is it lost? Is anyone else in the same situation? Anyone got any suggestions or advice? We were hoping they would both be processed together and could abandon K3.

I have same dilemma just different embassy. I have seen previous posts saying you can continue with both but if I send the checklist back to the Embassy saying I have all the documents when in fact they are all in USA now just waiting to be sent to the NVC for the CR-1 is that a lie?
I read here that by continuing with both you can get an earlier interview scheduled for the K3 from the embassy and when case is completed with CR-1 at NVC you can ask them if they can change your already scheduled K3 interview to the CR-1.

You didnt say which country your husband is a resident in right now. Italy? Denmark? If your husband is resident in Italy and you will be using the Italian Embassy then you wont need a translation of your marriage certificate.

For the AOS one third of your savings will be counted towards amount required to meet the poverty guidelines, they will accept his income if it will be continuing from the same source and if need his savings/assets can also be counted but only one fifth for him I think. There is aslo the possibility to use a co-sponsor if that is not enough.

We have also a situation where both our assets need to be used.

We know it isn't good to cancel the date. But as things are getting kind of delayed at NVC and my husband still needs to get his police certificate, we are not too sure. Does anyone know the medical for K3 and CR-1 is same or different?

Does certified copy mean take a copy of the original and get the issuing agency place a seal to confirm it? Do we have to notarize it as well? If there is an affidavit with a birth certificate, does that need to also have the seal from the issuing agency? For a certified copy of the affidavit, can we just notarize it?

Sorry for too many questions at once. Please help.

As soon as the status shows paid you will be able to print out cover sheet.
Not sure about DS-3032, we didnt get one, we just got AOS and IV bill by email we paid them both and as soon as status changed to PAID it allowed us to print out cover sheet. Not that it matters still waiting for Police Certificate before I can send all docs.
By requesting a copy from issuing agent you will normally receive a certified copy with their stamp/seal on it.

Ok now I am worried, just waiting for my police certificate from England before sending everything to NVC (still waiting for it after 4 weeks but thats another story) my divorce decree is on D37 too just like yours except it says Newcastle County Court and in the bottom left corner says - Certificate making Decree Nisi Absolute (Divorce) but a copy of this was sent to USCIS when I-130 was filed and we were approved without mention of it being wrong.

We were 34 days between NOA1 and NOA2 but I have seen some done in 22 days and some can take months, timeline data is based on the average which is why they say 55 days for you, hopefully if no complications you should get through much quicker.

You have to file the I-130 first, when you receive your NOA1 for that you can then file the I-129 for the K3 if you want.
The K3 may be processed a few weeks earlier than the CR-1 because once approved documents don't go through NVC, for the past few months USCIS have been approving 129's and 130's at the same time. If she arrives with CR-1 you are done for 2 years if she comes on K3 you will need to adjust status which can take a while.

Yes, I think I had to re-enter details to log on again once 1st transaction went through but apart from that it was quick.

Yeah, I have the email that signifies that we can pay the IV bill, The AOS fee has been there around for sometime, now we are ready to pay both. To my realization, my husband can't pay it both at the same time. We just have to wait for the AOS to have a PAID status, then we'll pay the IV bill.

Just trying to hit two birds at one shot. lol

But as soon as the two bills shows as paid, can we send the AOS package and IV package at the same time in separate folders? Someone here, did the same thing?


I could pay both at the same time (two separate transactions but paid them both within 2 minutes of each other)

For USCIS you only need photocopies of all docs including marriage cert, originals/certified copies for NVC.
We sent copies of birthcertificate for both of us and photocopy of every page in my (beneficiary) passport

The NVC will forward all the orignal/certified copies of the documents to the embassy she doesn't need to take any.

Did you apply for an ACPO (now needed for UK for all visas) this maybe what they are missing, they don't except the old style police certificates from the UK anymore.

Try other banks, I guess I was lucky, the first bank I went to to open an account as a non USC wanted my passport and something with a US address with my name on process took about 15 mins ( they actually put my passport number in the space where it said SSN (the bank clerk made a quick phone call I assume to someone higher up in the bank before they did this) I received check book and visa debit card around a week later.

My wife is in India and she has lived in UK for year and a half and we have to do the PCC for UK. I thought she already got the papers but found out that she had the CRB clearance. We have already ordered for the ACRO clearance........ and this might take around 7-10 days. In the mean time I am hoping for the IV bills to appear online and sending the DS230. Should I send the package without ACRO , but with CRB clearance. Will this create a RFE........

Has anyone had success sending in the CRB UK papers instead of the ACRO......with the DS230?

Any advice will be appreciated

No, only payment page, when you have your invoice idenification number you can sign in using online payment site this will show when payments are being processed or paid and allows you to print out cover pages to send with your docs, but you must call NVC for case status.

I answered yes on DS-230 and still waiting, they said 6-8 weeks wait for SSN. Perm Resident Card arrived within 2 weeks.

I was under the impression you need to send original and notarized copies of everything from old divorce decrees, birth place certificates, and the marriage certificates rather than copies. Also I noticed that you were approved very fast.. Is this the new norm nowadays? The timeline shortened up or did you file expedite?

No, you only send copies to USCIS (as these are not returned) you will need originals/certified copies for the NVC (these are returned at interview).
Uscis seem to have speeded up since February especially at CSC.

We have a lawyer, our case is not complicated but I suppose we have peace of mind knowing we can call him and he can deal with any problems that could arise.
We actually found this site because of him, he has a link on his web page for VJ.
He may slow things down a little by eveything having to go through him, but so far we have been lucky. apart from the intitial questionairre that we filled in for him at the start of our case we havent had to fill anything in, he completes all the forms and sends by email, if they require a signature we print them off and send them straight back to him, so far we have only done this once for the intial filings. I am just waiting for one more document to arrive so that I can send all docs required by NVC directly to him. It works for us, but I agree there is so much information on this site that you could do it yourself.
