Actually, he is no where near having to worry about an appeal. It sounds like USCIS hasn't even gotten their returned petition yet. If I'm wrong OP, then please clarify. After your papers are sent back to USCIS, the USCIS will send you a NOIR( notice of intent to revoke). This will let you know why you were denied, and they will give you 30 days to respond with more evidence. Getting the NOIR will take approx 6 months from when the USCIS receives the petition back. They will let you know when they have it. From that point it takes about 6 months. It took them almost 9 months to send us out NOIR. IF the USCIS doesnt think your response is good enough, they will then revoke their original approval and give you a certain amount of time to then file an appeal to them, which will then be looked at by the board of immigration appeals. If they reaffirm their original approval, it will then be sent back to the embassy for another interview. I hope this clarifies things for you

Have you tried to get one? did it not work?

I personally have not tried, but have found out over the years, that a visitor visa from a MENA country is very, very hard to get. There must be super strong ties to the home country, (job, property, lots of money etc) so that the consulate is certain the one looking for a tourist visa will return to their country. Morocco is a high fraud country. A man looking for a tourist visa when he is married to an American shows the consulate that they have more reason to stay in the US, than to return back to their home country. This is why it is practically impossible for someone with an American spouse to get a visitor visa to America. A positive outlook is great, as you need one to get through immigration. Being realistic is another thing. Getting a visitor's visa for a young Moroccan man with an American wife is impossible. It's a fact, not an opinion. You could still try, but you will just lose your monies :(

Visitor's visa from Morocco is very difficult to get. With an American wife...impossible.

So, you can't see the red pen underneath it? Well, it would only take you an hour to get some new photos right? Apposed to waiting 3 months and getting an RFE for new photos and then having to wait some more. If you are the non USC, this might be better for you to do. If you are the USC, they don't care as much about your mistakes since the petition is for the foreigner.

I'm the USC....but think I will take new photos on the way to the post office!! LOL thanks alot!

I didn't send originals with the I-130 and got approved. The originals go to NVC (as stated above). You will be happy that you waited to send the originals to the NVC, because then you have everything closer to ready to go.

So I sent out aos last week....and didn't send tax transcripts (did send copies of my taxes and w-2's)....the guides said transcripts were optional....but now I see otherwise, so will probably get rfe for that....then, I just sent iv package last night, and went over and over it, and see that I made 2 mistakes....forgot to write case number on every page :unsure: and I only wrote my husbands name on the back of his photos....didn't write the case number...this morning I saw someone got an rfe for not putting name and case number on the back of the photos. I feel so stupid, and we were moving so fast, and I have messed it up...

I am sorry you are going through this...that being said...TRUST YOUR GUT!....I know you love him, but personally, I would not tolerate sneaking around....and yes, you can have a heart to heart with him...but he will only work hard to convince you there is nothing going on....him staying in NY right before your marriage??? Even if they are only friends, it is very fishy...my husband wouldn't spend time alone with another woman, only if friends, out of respect for me, and I feel the same way about hanging around with men. But only you know your relationship, but please, trust your gut on this one...

I just realized that my tax transcripts include my pension in my income, so I have to include it on my I-864 or the income won't match up. I guess I will have to list it under employer because I don't know where else I could put it and also show the income.

Sounds like he is pretty familiar with the process. Why do you suppose that is? Are you older than him? Don't care myself, it only seems to be a trend in Moroccan male fiances, though it is totally opposite local custom and tradition.

The K-1 process (fiance) offers little in the way of real advantages, maybe none, but it does get the foriegn person here faster, if his goal is to get to the USA in the quickest route, that is it. If his goal is long term, it won't matter and K-3 or CR-1 may be more advantageous in the long run. It will take 9 months for the fiancee visa, or thereabouts, so is he worried about another 3 months? He is marrying you for life, correct? 3 months is a big problem?

In dealing with Morroco it is best to be very thorough, especially when the circumstances go against local customs and traditions, such things are seen as "red flags" that cause a question of the reasons for the relationship. Read the guides carefully and check the regional forums for people with experience in exactly your type of situation

I am going to say something probably controversial but with good intentions. If you are older than him, especially if you are of an age where you are not likely to have children with him, if you have religious differences, and he knows a lot about this process and he is in a big hurry to get to the USA, and not so big a hurry to marry you, you better be very careful of what you are doing, for your own sake. Morroco is considered a high fraud country and they don't choose those by throwing darts at the map. Please. If I am out of line, so be it. I said nothing to hurt the process and hope gave some good advice.

We don't care much about him coming to the US as much as we want to be together. That is the main point. We would love to get married in morocco, but I am the one not wanting to wait the year to be with him. Being apart is very very hard. I don't have a bank account, and to get a money order from a bank, you need to open an account. So I was going to get my money order for my K-1 Visa at the store. Its called a money gram money order, and it has the name of Wells Fargo bank on the money order. Never believe your fate in someone else's hands. It is in YOUR hands. Study all you can about this process, study all you can about your consulate, prepare everything correctly, thoroughly and document everything. Keep a copy of everything...and you will be fine. What this "someone else" thinks of you, your fiance and your relationship is based on what YOU provide. Failing to prepare is preparing to fail.

I couldn't agree with you more!! So many people here like to blame 'the process' or the 'co' or whoever they can rather than themselves when things go wrong. If you provide them with all the "right" information in "good enough quantities", then there's no reason for them not to believe you.

Cash receipts when I draw out money over there
Credit card receipts from flowers I bought her for her birthday (which is on Sunday btw so hope she doesn't read this, it'll ruin the surprise lol)
Ummm... There's a few other little things, but think that's most of it.
I'm also going to print out FB and MySpace pages of comments, and status that shows us being together (OK, that can be easily faked, but it just supports the rest)


I feel pretty good now, because I sent every single little piece of evidence that we have. I sent about 60 photos of me with him, and his family and friends. I sent every email, snail mail, engagement ring reciept, chat logs, phone bills......We feel like we have such a strong package, that how could they not see a genuine relationship....Thank you guys for the encouragement!!

Thanks for the advice. You know, my fiance and I have talked that if they don't approve the K-1, I will just go there, and get married in Morocco. Is there any way the government can deny you being with your spouse? Ouadia (that's my fiance) seems to think if we are married, we have the right to be together, so pretty much, they can't say no. We discussed this alot when we were deciding what to do for the next step in our relationship. We both have such a strong faith in God, so we know, if this is what God wants for us, it will happen. I have heard Morocco is difficult, but he has three friends who have been through the process, and each of them said it took about 6 months from beginning to end. But I do think it depends on who does the interview.....OY VAY!!

My fiance printed out the forms, and filled out these sections in arabic. Then he sent them to me. That's what you need to do. I hope this helps!

I went to Morocco from april 1, 2009 to april 22. And for a round trip, total price I paid was $398.......from Iberia's web site.....That was a miracle, because I can not find any other flight for the next year under $1000!!!
