Hi All, I received what I guess is my NOA1 with a National Benefits Center application number. Has anyone else received this? Is this normal and how do I check my case? There is no date for biometrics. Will I get a new letter? I went to the USCIS website and it says that my case number is not valid. Sorry for all the questions. I am just freaking out a little.


The appointment letter arrives later, you can check your case status on uscis.gov, make sure you include the asterisk after the NBC, it should look like NBC*001234567 , without that it won't work.

You most likely will not have an interview for ROC.  They will just approve it and move on to the N-400 application.  You may or may not even see your 10 year GC before you become a USC.  So you will briefly be a non-conditional LPR and then a USC.  But it will look like you went from conditional LPR to USC as you may not have a 10 year GC yet.  Yes, they will approve the ROC and then continue with the N-400.  Which happens first is anybodies guess.  If the N-400 gets to someone before the ROC, they will see that the ROC is still pending and may have to track down that file and combine the two.  If the ROC gets to someone first then it gets approved like any other ROC and there may or may not be an interview.  So it really depends on the timing, but either way you will become a USC at the end of the process.
 
You can have your interview for USC and the civics test before your 3 year anniversary as a LPR, but not the oath ceremony.

Right, but a conditional LPR can still file the N-400. The form's qualifications does not distinguish between conditional and non-conditional LPRs. USCIS will be forced to adjudicate both concurrently, and approve the I-751 before approving the N-400.
 

 

 

based on what you're saying seems like I'll have to do both interviews on the same day, and I'm guessing it'll be after 11/13/13 because that's when I'm officially eligible for citizenship

Actually if Ryan had not split this tread from the original, I doubt you would have received any responses--he is just doing his job as a moderator here on VJ. 
 
I would wait and see IF they ask for a copy of the extension letter.  Like you state, they have access to your file and can see that you did file for ROC and how long ago that was.  You are allowed to file for USC 90 days before the three year mark based on marriage, that is what you did.  Most likely you will never see a 10 year GC and go from conditional LRP to USC.
 
Just relax and enjoy the wait.

How can you go from conditional LPR to USC without the 10 year green card? My understanding is that the I751 has to be approved before or at the same time of the N400, at least that's what the USCIS says in this page...

Had the interview today, the officer was very nice. He processed the i751 first, then proceeded with the N400. Very few questions asked, my husband was there but he didn't ask him to be in the interview room. Took the Oath there too.

The process took the whole day. We got there around 10 am and the interview was scheduled for 10.30am, but The officer called me in at 3pm, then the Oath at 4.30pm, we left a little bit past 5pm.

I'm so happy I'm done with inmigration !!!

I wish a lot of luck, and please tell us how you did on your interview

So here's my story. I had a tourist visa since I was a baby, while in college enrolled in an exchange program that required a student visa, met my current husband while I was attending school and we got married in March 2010 in our home country (he's a naturalized us citizen). Filed for AOS around august 2010 and got the conditional green card in nov of that year. We filed for ROC in october 2012, went for the biometrics and got a RFE in May of 2013, we replied in June 2013 and still no 10 year green card. After several calls, in september I found out we where randomly selected for an interview. Before that, around mid august the window to apply for citizenship opened, and since I've read here that sometimes it helps expedite the I751 I filed for it.

Now I have the interview for citizenship on Dec 9, but still no word on the I751, my husband took the day off and it's going with me that day, but I'm wondering what should I expect? I've heard that most likely they've already approved my I751 and will just do the N400 interview or that they might do both things at the same time. What should I take with me? I got all my passports since I was 8 years old (my mom can't find the other ones), recently dated proofs of life and car insurance, bank statements from august until now (already sent prev months with the applications), car title with both names, pictures of vacations and the itinerary for our Christmas trip overseas.

Am I missing something? Any advice? Thanks in advance!!

A September filer just popping in to ask just how long the oath ceremony takes? My letter says to report at 8:30 am - just wondering how long to take off work that day.

Took the Oath today in a group of 30 people, about 30 mins the whole thing, but it can take more if the group is larger.

Just passed the test and waiting for the Oath Ceremony in an hour of so, we've been here for over 6 hours and counting. My i751 was adjudicated prior to the N400.

I'm so happy I'm done with the uscis !!

Hi all -  Hoping to officially join the August filers soon. We're just waiting on our 2012 transcript and we'll be able to mail it in.
 
Question for those who are applying after 3 years based on marriage...in part 7 of the application it asks about trips taken outside of the US in the last 5 years. Obviously Sifa was still in Kenya up until Feb. 2010. What did you guys put in part 7? The number of days outside the US before moving here and then N/A on the trips if he hasn't traveled outside the US since getting here 3.5 years ago? Just wondering since he technically has been out of the US quite a few days in the last 5 years but not since moving here!


I put everything for the last 3 years, they put 5 years because most people apply after being LPR for 5 years unless they're married to an USC

I got mine in 7 business days.


 

 

I tried that and I always get an error, don't know why... I finallyy got to a person and then she wasn't getting tone for my fax machine, had to hang up, got to a friend's house to use his fax machine and finally got them. I know I could have requested them by mail, but I really want to send this package on tuesday when my window to apply opens, my foreign passport expires in december and I don't want to spend almost $300 on a new one if I can just get the citizenship and get an US one. Currently the processing time for the N-400 is less than 4 months, if I send my package soon I might get the interview sometime in november

How did you guys get the tax return transcripts? I told my husband to get them and now he's handing me some stuff from the social security administration that I'm pretty sure has nothing to do with this... I've been on hold with the IRS for 1 hour now, will they be able to fax me the transcripts?

I'm getting ready to file on 08/14 based on my marriage to an US citizen and being a resident for 3 years. I got the green card on 11/12/10 and currently waiting for the response on the ROC, they asked for additional evidence on  05/02, which I mailed, but they claim they haven't received it yet, I have a receipt with signature just in case and already opened a service request to have the issue looked into. I'm hoping this doesn't become a problem.

 

Here's what I'm sending:

 

- N-400 Application completed

- Copy of both sides of green card and 1 yr extension letter.

- 2 Identical photos with the A# in the back.

- Check for $680

- Copy of husband's certificate of naturalization.

- IRS tax transcripts for 2010, 2011 and 2012.

i just came back from Europe yesterday with the extension letter and no issues. I usually get a warm welcome from immigration officers, but one time the officer asked me "where is your husband?" in a very nasty tone and had some guy in customs check all my luggage. I guess he found it weird that I only traveled for 3 days to visit my mom for her birthday... who knows!

Yeah, I guess so. But don't worry -- USCIS still managed to screw me, the US citizen husband. The date of our interview just so happens to overlap with a science conference I'm scheduled to attend at the National Institutes of Health, which means I won't be able to meet with scientists there who might want to hire me. Basically, I'll miss the job interview, the main reason I wanted to go. We thought about rescheduling, but found out we'd be put at the back of the line again! ohmy.png

 

 

 

 

I hope I am wrong with my calculations. I've been waiting for the site to update with July's numbers. Maybe Dallas will pick up the pace soon! We will all get there sooner or later, it's just a matter of how to stay sane while we wait!

 

 

Yesterday I found out that we are in line for an interview in the Newark Field Office too, we don't have a date yet but I'm assuming is going to be after yours since we sent everything after you and I'm a november 2012 filer. Please let me know how yours goes... 

 

I have like 10 pages of possible questions that I printed because he always gets my birthday wrong and it's clueless about certain things in the house because I take care of the bills.

Has your case been transferred to Newark too? Karen's extension was set to expire on Nov. 2 2013, but now it's extended until August 2014.

They just told me they haven't received my RFE response, my lawyer says that sometimes they misplace packages in a mail room and it takes forever... I just sent my n-400 so whichever comes first is fine

I believe that after (or near, please check) the 1-year anniversary of your filing the ROC, you are eligible to file for citizenship - and they have to review your I-751 during the citizenship interview.
 
I believe you guys are already eligible to file.  LIke others have said, you can get the I-551 stamped on your passport for travel. 
 
Obviously not an expert, but thought that'd help.
 
 
 









That's right. I've been waiting for an answer on a RFE replied more than 60 days ago and nothing yet. My extension expires on 11/12/13 and I'm sending my n-400 package this monday, hoping It'll help expedite the ROC process

I put a service request yesterday since it's been 90 days since we sent the request for evidence, they sent me this response:

"Your Petition to Remove Conditions on Residence (Form I-751) has been randomly selected for an interview. We are awaiting scheduling information from your local district office. If you wish, you may schedule an appointment with your local office by visiting our web site at www.uscis.gov. You must use the InfoPass Appointment Scheduler prior to visiting your local office."

So I'm guessing we are part of the "lucky ones". On 09/16 I have to go for the biometrics for the N400 and since I'll be in the area I will get my passport stamped and see if they have any updates on the interview date.

You mean they lost the package or something? What does it mean they didn't receive it?
I sent mine with tracking and it was delivered, I saw it on usps website.


USCIS claimed they haven't received it, but the tracking shows when it was delivered and that it was signed by somebody there. My lawyer said sometimes the leave files in a mail room and months can pass before they get to an officer.

I got RFE on 05/08 and I replied on 07/23.(Due date was 07/29..) Still no response, so I am guessing for an Interview. I am going to apply for my citizenship on 25th August ,as it opens on that day. Let see what happens with ROC.

 

 

I got a RFE around the same time you did, replied just 3 weeks later and still no answer, last time I called USCIS they said they haven't received it yet, seems like we're on the same boat. I sent my N400 last week and hope it'll expedite the process.

Wow! That's ridiculous. Have you tried calling another number?


I set up a call back and they called me like 2 hours later just to tell me that "they'll look into it". I don't trust a single word they say !

I called yesterday again to see the status and got an email today saying that they haven't received my RFE package! I looked up the tracking number and it shows who signed for it and everything. I just called to provide that information and the hold time is 106 minutes!! really?!
