Yes you can use your disability income as income on the I-134

Means Tested Benefits Cannot Be Considered Income

Q: Can a petitioner's or joint sponsor's SSI benefits be counted as income?
A: No. SSI benefits cannot be considered when computing the sufficiency of the I-864 (A sufficient I-864 is one that meets the minimum income requirement).

Q: Can disability benefits be considered as income?
A: Yes.

Q: Can Social Security Benefits (not SSI) be considered as income?
A: Yes.

Q: Can income from unemployment benefits or worker's compensation be considered as income for I-864 purposes?
A: UNEMPLOYMENT BENEFITS: Unemployment benefits are normally temporary in nature and would not meet the criteria of sustainable income. Such benefits should therefore not be considered for I-864 purposes.
WORKER'S COMPENSATION: If the sponsor can demonstrate that s/he will return to previous employment at the same salary level (or a level that meets public charge concerns) upon completion of medical treatment, worker's compensation could be counted toward the current year's income. Like unemployment benefits, worker's comp is generally of a temporary and finite nature.

I am a Veteran with a service connected disability. Last year (2006) I did not work, therefore, my income tax return for 2006 will be for $0.00. I do however, meet the 125% poverty level of income required if you count my tax-free disability pay from the Veterans Administration.

Does anyone know if this will be a problem. Is this income acceptable? Do I need to start delivering Pizzas at night for Dominoes to meet the income requirement? or Possibly use a co-sponsor or alternate sponsor... I just do not want my $0 tax return to throw up a red flag.

Well... I did... but the "Bangkok Hospital" in Pattaya, supposedly the "good" hospital... has already made mistakes... They signed in the wrong places, (signed for vaccinations she had not had yet) and gave her the polio vaccination 2x... because they gave her the polio vacc alone and then later realized that another vaccination only came paired with the polio vaccine... so, while they have tried to be helpful... they have not inspired much confidence...

I am filing the I-129F for Suphee's K1 visa next week, but I am currently visiting her here in Thailand. She told me that she did not think she had any of the vaccinations on the DS-3025 that I pulled off the US Embassy website for Thailand. So... over the last 4 days, she has had all the vaccinations on the 3025 that I printed from their website...

My question is:
Which of the shots are in a series?

I searched VJ for Vaccinations related RFEs and it looks like others have been required to get a second round of the Td or Tetanus & Diptheria and also the Varicella or Chickenpox. She just had round one ... so I think she needs round 2 for both in 4-6 weeks.

Are there other vaccinations that need another round? I am just trying to help her as much as I can and prepare her for what to expect.... (she was not happy getting these shots) :)

She was just thrilled to hear that she gets to go back in 4-6 weeks for a few more.

Soooo....

I received my NOA1, but never heard anything more from them.... In fact, according to the USCIS, my case has not been updated since the last touch on 5/8/07 yet I received a letter today mailed on 5/24 (from the NVC) saying that they had received the approved I-129F and would be sending it to Bangkok within the week.... so.... I am very happy that I have been approved so far, yet confused why the website was not updated and why I never got an NOA2. One better, I have the email confirmation of my address change from the USCIS, yet the NVC letter went to my old address... oh well.... I am still happy. :)

I just saw your thread. Your timeline looks similiar to me. I received a letter from NVC dated 21 May. I still did not get a copy of NOA2. I see you stated you got yours on SAT. Did you also get the an NVC letter prior to getting your NOA2? If so, I am hoping I get mine this week. This past week I had her send Ds-230 and Ds-2001, passport copy and picture to the consulate. We decided to do this prior to receiving packet 3. I've read that some guys have done this before. I've also read, but don't know if its true, that if they receive it by a cut-off date around the middle of the month, they will assign an interview date for the following month. If not, it will be for the month after. So, we are trying to get one for sometime in JULY rather than August.

We never got an NOA2.... or a packet 3 for that matter... I got the same letter from the NVC dated May 24 and contacted the EMbassy in Bangkok around MAY 29 and they said that they had already received the packet from the NVC... you might try contacting the embassy now and ask if they have received it yet... the online update (for me) still says my packet is in California...GOOD LUCK!!!

We never received our packet 3... They sent it 2 times but Suphee never received the mail so they finally emailed it to us and she took a bus to the Embassy the next day - but they would not accept it so she mailed it when via DHL when she returned home. The embassy updated the interview website about a week later and we were on it. :) I do not expect to see that packet 4 either... so we will prepare without it.

Delivered today but no one was there to sign for it....big surprise, haha. This happens alot at the Texas center, right? I'm thinking it will be okay tomorrow.



I sent mine a while back... and it was forwarded to California... apparently Texas does not handle the I-129F... Mine was received in California about 3 days after Texas signed for it... I still do not have my "snail mail" notice of the NOA1, but I was able to get my "WAC#" from the back of the check (online banking picture) ... so... Best of luck to you.... Looks like we are both waiting in NC :)

Let us hope for quick replies.... I was soooo happy when I finally mailed my packet...

My big surprise was on the morning I was going to mail the packet. I had not noticed that it said on page 2 of the I-129 to write the address of your significant other in the native alphabet for their country if they do not use Roman letters....

Guess what... I can not write in THAI! :wacko:

So... after panicking a few minutes and kicking myself for not having Suphee write her address for me a few days earlier when I was still in Thailand, I remembered the local Thai restaurant... they of course congratulated me and said 'Of course one of us would be glad to write the address in Thai for you..."

I can have it sent by 2/18/07, but didn't want to worry about them "getting around to it" after the 2/18 time frame... also figured they would have the mysterious I-129F "2010 expiration" form available somewhere... but I have yet to find it even after clearing the cache on firefox and safari web browsers...

I am preparing my documents to file for the K1 visa and I started reading and I noticed on the top of the I-129F it reads:

"OMB no. 1615-0001; Expires 12/31/06"

Just above the BOLD LETTERS "I-129F, Petition..."


At the USCIS website it has the following:

What you wrote is exactly what they are asking for, specific dates, specific places you met IN PERSON. So your paragraph is virtually verbatim what they are asking for, and you just need to make sure your passport stamps match those two meetings, and dig out any documentation for the two trips to Thailand, proof you were in her city, and/or proof you were together at those times. The site guide has a great list of items which suffice for this evidence. Plane tickets, ATM receipts, hotel bills etc. to name a few.

I am assembling my I-129F packet and am trying to follow the K1 guide but was wondering do we really need a full page on the declaration....---->

4. Declaration of how you met in person in the last two years. This should be a single typed page regarding question 18 of the I-129F. Make sure to sign and date it.

My short description seems to fit in the box on the I-129F and was thinking that having an extra attachment is just something else for them to misplace....

Has anyone just said something like:

"I met my fiance in August, 2005 while vacationing in Thailand when I walked into the salon where she worked. After a few days, I asked her to dinner. We dated for 3 months. I returned to the USA to work. We kept in touch. Later, in December of 2006, I returned to Thailand, we were engaged, and now I want her to come to the USA to marry me."

I am not sure what else I am expected to say... Sure, I love her, she is amazing, we have similar interests, we can't wait to be together all the time, blah blah blah... but none of this technically describes how we met...

Learn to write your fiancee's name and address, and her family member's names, in Thai. It will score you points.

You don't have to be able to understand what you wrote, just be able to scratch it out. Or write it with your computer. (Although I have found it handy at times to have learned enough of the Thai alphabet to be able to figure out a few familiar words when I see them written in Thai - such as 'soo-khaa'.)

I am filing today... and I thought I had looked through everything thoroughly... I just found on the second page #16... "If your fiance native alphabet uses other than Roman letters, write his or her name and address abroad in the native alphabet.".....

Nice.... I left Thailand where I was visiting Suphee 2 days ago and missed reading this line...

I think I am going to have to make a trip down to our local Thai restaurant and have the owner fill this in for me at lunch...

Quick question...

On line 10 of the I-129F, it reads "Give number of certificate, date and place it was issued"


My (Florida) birth certificate has date issued "date" but this is only for this specific birth certificate... In other words, when my dad obtained my original birth certificate in 68, it would have a different date issued date.

Years later, I applied for additional copies of the certificate and the date now reads x/x/2002.

If I ask for additional copies of my birth certificate (for records) then I will have yet a third "date issued"...

Am I reading too much into this... or just put the "date issued" that appears on this one in my hand and they understand that the same "certificate number" could be issued repeatedly with different "issue dates"??? :help:

You should always check the USCIS website for your forms to make sure you have the latest version... (or atleast a version that is still acceptable)....
