Ok...i think i figured out how i was going to fill in the form for my income. the only question I have is do i count my ex-wife as a dependent since we joint filed...or is she not considered a "dependent?"

So on question 16 this is how i did it (household size):
a. yourself and the person you are sponsoring in this form -- 2
b. your spouse (she is the one I'm sponsoring) -- 0
c. your dependent children under 21 -- 1
d. sponsored any other persons un an 864 (ex-wife is now citizen)-- 0
e. any other dependent on my latest tax return (step-son) -- 1

household size for form 4


now the only other thing that I am unclear about....my ex was brought here on a K1...her son on K2....she got her citizenship...so that means that her son would also be a citizen now right? Or do I count him on line D and not E? I am assuming that the 864 has always been on the hook for 10 years (i think my ex's AOS was in 2003)


I just wanted to make sure I was reading the stuff right and not reading too far into it?

The last question is on question 18....do I put my 2009 income here even though I havent filed my taxes yet or just put my 2008 amount?

I hope someone can provide me with some input here. I would like to have the AOS sent off soon too (probably same time as the DS-230 package)

I just sent in my I-864 and I just entered my 2009 income (not the transcripts) Then I included 2008,2007 and 2006 transcripts.
Thats about all you can do if you have not filed for 2009. Right!

National Visa Center (Dept of State)Police Clearance Confusion

Hi everyone. So my wife got approved at the USCIS and now the case is at the NVC. My attorney wants my wife to send the police clearance certificate from Fiji, where she leaves right now so he can send it to the NVC. Question is does the National Visa Center get the police certificate or does it go to the US embassy where my wife will interview. The police station down there will not give her the police clearance and said that they will mail it directly. Not sure where it will get mailed.


Hello islander, someone can correct me if im wrong but i will be sending my wife's police clearance in to the NVC with the DS-230. That is weird that they will not give it to her. Is that her home country? So, they won't even send it to your attorney so that he can forward.?

hello Amit-N-Melody, I have the same problem. My agency has lead me down the wrong path.
I filed I-130 for my wife in the Philippines. It was approved. Then I filed I-129F. It was also approved.
How can I switch over to the CR1 or IR1 visa process.
I am at the point now of sending in my I-864 Affidavit of Support

K3 is dead. Read the thread about the special notice. It's right in this forum. The visa path open to you is CR1, not K3.


Hello pushbrk, now the fog is lifting. I have been searching and found out the the k-3 visa is obselet. My visa service agent has lead my down the wrong path.
I see now that i should be going for the CR1 route. Hope that I can switch over.

You were not on a K-3 path but were on a parallel path... now that the I-130 is approved the I-129F will be administratively closed and you will follow the IR/CR path. Your K-3 path is now closed.

No, that is not correct. The K3 visa requires both petitions but the CR/IR requires only the I-130. Again, read carefully. The K3 visa does not use the I-864. If you submit an I-864, it will be for a CR1 or IR1 visa process. K3 is dead. Forget about K3.


I sure that you are right about K3 dead. So I should have not sent in and received approval for the I-129f. Does that mean that they will automatically process us for the CR1/IR1?
So, if I was on the path of K3, then they would be asking for I-134 Affidavit of Support. Is that correct?

Thanks for your response. However, when I go to the page showing that my Affidavit of Support fee has been paid, I am directed to click on link
(go to the Affidavit of Support processing instructions). That takes me to only the I-864 download forms.

What's happening with you guys when you're trying to check out the status of you IV processing fee?

It's been telling me that the application is unavailable due to maintenance and to try again later. I've been trying all day.
I even tried calling the phone number and all I get is a busy signal.


Im having the same problem. Its been down at least since early Friday morning.

When were your packages delivered to NVC? You need to wait 8-11 days from then for a case complete, barring any RFEs.

Hello sachinsky, This is March 18, Thursday. MY package arrived yesterday at NVC. So then I should not hear anything for about a week to 10 days. Right?
Will they send me an email (barring any RFE's) telling me that the package has been sent to American Embassy in Manila. And also, do they set the appointment date for the medical and interview for the spouse? Or does the Embassy set the appointment date?

Is it manditory? No, but it is a VERY good idea "just in case." Im getting ready to send my wife all the stuff I sent the NVC...actually the only thing she doesnt have is the AOS.

hello chrisjoy, if you have ur messenger set to always save your chat messages you can print out for each date that you chatted. by the way, i looked at your time line and see that you just started. DOUBLE CHECK ABOUT THIS BUT, as of Feb 1st the K-3 visas are not an option for you. I believe the process has been changed to cr1 or ir1. In your case it would be CR/1 since you have not been married for more than 2 years. and i believe that you will not be filing the I-129.
In my case I started out with the K-3. Now it is IR/1 since we have been married more than 2 years.
In your time line, change your visa type to IR/1, CR/1 and it will show a different path. It will not show submitting the I-129.
This is a better way to go anyway.

My first reply definetly applies to the I-864 Affidavit of Support. In the instructions it specifically states obligation even in case of divorce. However, I could not see the same obligation in the instructions of I-134 Affidavit of Support.
Which AOS was used? I may have jumped to conclusions about the obligation.

my understanding of this is: Once the petitioner has made a contract of Affidavit of Support, it stays in effect even in the case of divorce. The green card has no bearing on the matter. The petitioner is obligated to support the beneficiary until U.S. Citizenship is aquired or the beneficiary has worked under the SS system for 40 quarters.
If I am wrong about this, someone please correct me.

For the American to get married in the Philippines, he will have to go to the American Embassy in Manila and get an AFFIDAVIT OF LEGAL CAPACITY TO MARRY.

I read some conflicting notes about what the counsular needs regarding a divorce decree. I am a USC petitioner and my finace CO is Egypt. I have been divorced for 7 years and all I have a copy of the divorce decree. VSC just sent us our NOA2 but I heard the CO in Egypt requests for a "certified copy of divorce decree." What do I have to send my fiancee for her interview? And what do they mean by "certified copy"?

I have only a zerox copy of the judgement that has the Judge's signature and official INK stamp (State of California) at the back with the words : I xxxx xxxx, the Clerk of the Superior Court of the above entitled county, do hereby certify that the foregoing is a full, true and correct copy of the original on file in my office, and that I have carefully compared same with the original. Question: I am in Nevada. Can I get my copy certified to send to NVC.

Most likely I will use FedEx as I have had problems in the past with USPS. Also, lately they have been suffering from severe budget cutbacks, so that doesn't give me peace of mind when dealing with a parcel as important as this.

If you are reading older information, it is true we used to send our I-129F petitions directly to Vermont or California. The USCIS established the Texas Lockbox to be more efficient. Contractors open the mail, assemble your file folder, deposit your check, and generate a receipt then assign it to a service center. The place to file any USCIS form is always near the last page of the instructions for that form and the USCIS website (forms page). Always trust USCIS over conflicting reports you read elsewhere.

The instructions clearly state that all petitions are sent to the Texas lockbox facility.

Hi all, I am currently preparing the I-129F and I am reading conflicting information about which processing center I need to send it to. Some places say it depends on where I live (Nevada, in which case it would be the California Service Center) and other places have the blanket statement "send it to to the Texas Service Center if you live in the U.S.". Obviously I don't want to get this wrong, so can anybody here tell me with absolute certainty which processing center a Nevada resident needs to send the I-129F? Thanks so much for your help.

I have been to Hawaii several times, and it's just like going to any other state. You don't go through customs or immigration at all. All they check for is that you aren't transporting any exotic fruits or animals to/from Hawaii.

I made it to the States! We are getting married on 5th February and we considering going to Hawaii for our honeymoon. However, my K-1 expires on 15th February so would I have a problem getting back into mainland USA given that Hawaii is an American state would the boarder control still consider me to have left the country? Plus as I wouldn't have a marriage license yet (as it takes two weeks to get it) I wouldn't have the documentation verifying that I did indeed get married within the 90 days do you think that it is best left? As I really don't want to risk it! It has already been such a struggle getting here and I know there is more to go with the status adjustment. Please could you kindly advise?
