IR-1 / CR-1 Spouse Visa Process & Proceduresquestion aobut Affidavit of Support for wife and stepdaughter
Affidavit of Support: K2's don't require their own separate I-864 with supporting documents (tax returns, etc). Make sure they are listed in section 9 of the K1's I-864, and provide a photocopy of the K1's I-864 with the K2's paperwork. You don't need to include copies of the supporting documents with the K2's paperwork. You won't get an RFE if you do happen to provide a separate I-864 with supporting docs for the K2. It's just not required.

There is also a forum you can read over its called (Calling all K-2 AOSers - past and present) may help

IR-1 / CR-1 Spouse Visa Process & Proceduresquestion aobut Affidavit of Support for wife and stepdaughter

Hi,
my husband is filling out the form I-864 for me and my 16 year old daughter.
Our question is now:
in line 9. it says: Do not include any relative listed on a separate visa petition
We had to fill out a seperate form I-130 for me and my daughter and we have two case numbers.

But if you fill out the AOS you will have to come to the addition of household members and if you fill out two forms that would be 4 and we are only 3.
on one AOS there would be my husband and me..so two members
and on the other AOS there would be my husband and my daughter...so two members
and both AOS together would be 4 members...or are we just thinking wrong?

Would be nice to get answers :-))

K-1 Fiance(e) Visa Process & ProceduresCertificate of Citizenship information in regards to I-129F and G-325A question

Thanks for the information! I obtained my citizenship through my parents ... but I'm not sure if this is 'naturalization' or not ...

I received mine through my father he was in the military and my mother was German My Certificate is A Certification of Report of Birth of a US Citizen. Certificate was from Department of State. Well guess we may have different documents.

K-1 Fiance(e) Visa Process & ProceduresCertificate of Citizenship information in regards to I-129F and G-325A question

After staring at the I-129F form a bit more, it would seem that in my case it's not necessary to have 'Naturalization' checked; the layout is a bit confusing.

I am a naturalized citizen too my I-129F and G-325A where approved. You are correct to put yes and give certificate number that is in the top right corner of your naturalation certificate. On the G-325A in the file Number Box that has a A in it I typed NONE and it passed.
Good Luck

K-1 Fiance(e) Visa Process & ProceduresPetitoner may move soon

Hi there,

This has probably been asked already but I can't seem to find anything about it on here - probably haven't looked properly.

My Fiance (Petitioner) could be moving soon, and I was wondering if he had to send in the change of address information, if it would slow our process down? We are waiting for NOA2 (still early days) and don't want there to be a chance of the process being delayed. I have been told by numerous people that it won't, but just need to triple check on this. :)

Has anyone recently done this before their NOA2?

Thanks in advance for the responses.

I changed my mailing adress from a apartment address to a Post Office Box, I believed all I did was called USCIS to have it changed. Did not change the processing time at all and I did it in the early stages too,

K-1 Fiance(e) Visa Process & ProceduresMailing Address vs Residential Address - A Problem???
I had the same problem when I first applied for K-1 visa for my wife physical address different then mailing.
after my initial application that I submitted I used physical address (had mail box but never used). I then sent a seperate letter that my mailing address was different. In the letter I put my physical address and told them I did not receive mail there but received my mail at a post office box, recommend that you give full address then full mailing address. I would put this signed letter in with your K-1 visa packet and list it on your cover sheet so they see it, then wait for for I-797 for acceptance and see what address if not correct call service center.

K-1 Fiance(e) Visa Process & ProceduresNOA2 received - Traveling before Green Card

Once she gets her visa it isn't a visit, its a move!  wink.png

When you apply for AOS also apply for the EAD and AP (they are free if done at the same time).  The EAD (work) and AP (this allows travel while waiting for the green card) will arrive between 2 and 4 months after filing.  My wife got hers in 2 months.

The green card will arrive between 4 and 8 months (depending if there are issues)

Until she has her AP or green card can't leave the USA without issues returning.

Thank you Hank_. That's what we would probably do. I will keep all the paper work ready when she gets here and submit it as soon as possible so we can get some sort of response before we travel.

FYI, she may have time to come to the USA before activating her visa BUT do not go to another country and get married beforehand!  Traditional marriage or no... She needs to be married in the USA.  Even "non-registered" marriages or family ceremonies should wait.

Thank you NikiR. Yes, I myself do not want to anything that is not by the books and that is why I want her to come to States before we travel anywhere.

K-1 Fiance(e) Visa Process & ProceduresNOA2 received - Traveling before Green Card

Hi so just like the person before me stated you'd have to apply for AP (Advanced Parole) with your AOS (Adjustment of status) after you two are married here in the states. Otherwise she can't leave until after getting her greencard. My fiance is from India & we plan to have a wedding reception/ceremony there as well. Probably before he even comes to the states but after the visa is approved. Maybe you two should consider doing that as well, it might be easier. Good luck with whatever you decide! smile.png
P.s. I forgot to mention that the beneficiary has 6 months before they must enter the USA after visa approval. So you could have some time to travel to India smile.png

Thank you so much for this information.

We are actually planning to do a traditional wedding when we travel to India towards the end of the year. I wanted her to come to the States so we can legally get married before we travel and since the whole visa process is taking longer than expected, I am just trying to find out of ways to get around the situation we may be in regarding her re-entry.  I didn't know we had six months after her visa approval. That is indeed great. Thanks again and good luck to you as well !! :)

K-1 Fiance(e) Visa Process & ProceduresNOA2 received - Traveling before Green Card

Once your fiance comes over after receiving her visa, she will need to apply for AP along with AOS. AP will allow her to leave the country while she waits for the green card. FYI, the green card can take anywhere from 3-12 months to receive after applying for AOS, so applying for AP with AOS is your best bet. Still, keep in mind that it still takes about 2-3 months to be granted AP. If she attempts to travel outside of the US without AP or a green card, she will be denied re-entry, as the K-1 visa only grants a one time entry into the US,

Thanks a lot for this information. :)

K-1 Fiance(e) Visa Process & ProceduresNOA2 received - Traveling before Green Card

Hi Guys,

Just wanted to throw this question out and see if anyone is aware of anything recently regarding this question.

We just received our NOA 2 and wanted to know if it would be okay to travel for my fiancee before she has her green card. Our plan is that she will visit me in US once she gets the visa, we will get married and then apply for AOS as soon as possible. However, knowing that it can take up to 4-5 months or may be more for her to receive anything official, we wanted to find out if it would be okay for her to travel. We have planned our marriage towards the end of this year and we will be going to India since that is where her family lives.

any suggestions/recommendations on what needs to be done for her travel would be greatly appreciated.

Thanks.

K-1 Fiance(e) Visa Process & ProceduresNOA2 copy and I134 to Fiancee

Original of the I-134, like said a signature is required.

NOA2... never read anywhere that the embassy asks for that, after all they have your ORIGINAL file from USCIS.

What does your embassy instructions letter state for required documents and forms?  That is what you follow, to the "letter".

Thanks Hank_. I was just curious if they would ask for NOA2 original at the interview. You are right, they should have the original from the USCIS, didn't think about that.

We do not have anything from Embassy yet, still waiting for our case to be received by NVC. Just want to get ahead and be prepared for the stuff that we can complete so the process is not delayed any longer.

NOA2 copy OK

134 has to have original signatures.

Thank you !!

I-134 must be original because of the signature. As far as NOA2 I think you would want to ask that in the country specific forum.

Thanks for this information. I am gathering the information on NOA2 from some of the members who are from AU. Thanks.

K-1 Fiance(e) Visa Process & ProceduresI-134 for 2013 - only letters and space

I started filling another affidavit of support since there is this new version since 12/17/2012. And in the for example Middle name i should put N/A and it is not allowed, for State also, for annual income only numbers (example 55700). Should i put only numbers like that 55700 or what, and leave middle name and state blank?

Here is the link for the example form on VJ.

Also, if you go to the "Example Forms" section on this site, you will find all sample forms which may give you ideas of how they should be filled in. Hope it helps !!

K-1 Fiance(e) Visa Process & ProceduresWhen to send I-134 and supporting documents to Fiancee?

i say 2 weeks prior to interview date is adequate time to send it off, via fastest method available.

For the medical, from what I've read (haven't gotten there yet myself) you NEED the Nvc number. No ifs ands or buts.

Police report, may depend on jurisdiction but I don't *think* you need the number for that.

It's okay to send it now.. Interview is only 1-2 months off.

Most official documents that embassies need have a validity of 6 months.

Thanks a lot for the information guys !

K-1 Fiance(e) Visa Process & ProceduresWhen to send I-134 and supporting documents to Fiancee?

We got our NOA2 on June 28th and now waiting for our case to go to NVC with many others. In preparation for the interview for my fiancee, I was trying to put some documents together and had some questions.

1. Our case hasn't even reached NVC yet and we don't have a case number and are not sure when will the Consulate receieve it. Would it be too early to send the I-134 and supporting documents to my fiancee? Should I send them once we receiev the case number from NVC?

2. Is case number from NVC is required to schedule medical or to get Police certificates in Sydney?

3. How long back the medical and police certifications can be considered valid?

Thanks in advance for any help/information anyone can provide.

Thanks

K-1 Fiance(e) Visa Process & ProceduresURGENT-Packet 3 Contents

I got your email, but there's a lot of questions there - there was no short answer I could send you.  Also, we've had a fairly busy week ourselves.

Most of the answers you are looking for are posted elsewhere on this website, or will be sent to you by the Consulate when the time comes.

Bear in mind that I am not an expert at this (far from it!) and that your experience may vary depending on your personal circumstances, country of origin and so on.  The best I can do is to relay our experiences to date.

1. We have not communicated with the NVC by phone or email at all.  We applied in September last year by sending the I-129F and evidence to an address in the USA.  We got our NOA1 in October 2012 to say it had been received.  In May 2013, our NOA2 was mailed to my fiancee's address in the USA.  Around 12 days later, she received a second letter stating that our case had been transferred to the NVC (NVC receipt).  These letters were scanned and forwarded to us by family because she has been living here with me in Australia for the past 18 months.  Around 5 days after the NVC receipt was sent by mail, we got an email from the US Consulate in Sydney which included our case number and our Packet 3 instructions with everything you need to know including the checklist I was looking for in our post above (this thread).  From then on, we were dealing only with the US Consulate in Sydney.

2. The case number arrived in an email with more instructions on how to complete Packet 3 and a request that we return form DS-230 Part I as soon as possible.  We did so, then began gathering the documents required to assemble Packet 3, to be sent the US Consulate in Sydney.

3. The Packet 3 instructions were sent via email because we elected the email option wherever possible.  The Packet 3 documents are then sent by you TO the Consulate when you are ready to be interviewed.  You should ALWAYS keep your current address information up-to-date regardless.

4. The answer to this is more or less answered by my reply to Question 1.

5. Packet 3, as far as I understand, is the list of documents and evidence that you compile.  So it includes copies of birth certificate(s), passport, police clearance, medical records and all the forms requested in the Packet 3 instructions which are sent to you (probably by email) by the US Consulate in Australia (probably Sydney).

6. No.  After the I-129F was sent in September last year, all we have done is to keep our contact information (address and email address) up to date.  Then came the NOA1, the NOA2, the NVC receipt and finally the Packet 3 instructions.

7.  The NOA2 is yours to keep.  The I-134 and supporting evidence forms part of Packet 3, which you must assemble and send back to indicate you are ready to be interviewed.  We completed Packet 3, which took us several weeks, sent it (with some help from the people who replied to this thread - thank you all!) and that was just last week.  We got an email notifying us of my interview date today, with the interview set approx 3 weeks from now.

I can understand what you mean about wanting to keep the process moving smoothly.  It has been almost a year since we first applied.  212 days to get the I-129F approved and 300 days between sending off our I-129F and getting our final interview date.  Hang in there!

Hope this has helped.

- Jonathan

Thanks a lot Jonathan. I realize you had to spend some time reading/writing this response and I apologize for taking so much time of yours.

I am just concerned seeing others stumble upon not doing little things correct which then delays the entire process so just want to keep myself on top of everything.

I sincerely appreciate your response. Thanks again. I will follow your suggestions and try to keep everything organized so the process is smooth altogether.

Thanks,

Priyank

Fantastic news!  We just received Packet 4.

So we sent Packet 3 from Perth on July 4th, they received it 9:30am July 5th and they responded to us on July 10th.  A nice speedy response!  Interview date is for July 30th....Praying that all goes well!!  Thanks for all the help and feedback everyone!!

Very happy with the news!! dancin5hr.gif

Congrats, it seems you should be done by the end of this month.

I did send you a message couple days ago but it seems writing in the forum is the best way to get in touch.

Hope you wouldn't mind me being naive but since you already have a packet 3 documents (and now packet 4), I just thought may be you can answer few quick questions for me if it is okay with you ?

We recently got an approval for our I129 application. My Fiancee is in Sydney.

Now we are waiting for our case to be received by NVC. What process did you follow?

1. Did you have to call NVC to get your case number?

2. What happened after you received your case number from NVC?

3. Was packet 3 sent to your Fiance(e) ? Was it send via e-mail (someone recently mentioned this so just wanted to be sure) or was it sent via regular mail? I have to change my fiancee's address in AU since she has recently moved but if the packet is sent via e-mail then I may not have to worry about it.

4. Were you guys notified when your case got to NVC and when it left NVC and received by Consulate?

5. What documents were included in packet 3?

6. Did you guys have to send anything to the Consulate before receiving packet 3?

7. Did you include original NOA2 and original I134 when you sent it back to the consulate?

I would greatly appreciate if you can share this information. It has already taken us so long to get approval and I do not want to delay the process by missing a step in the process and want to get it done right the first time.

I hope I am not asking for too much.

Thanks for your help.

K-1 Fiance(e) Visa Process & ProceduresOriginal letter affirming your desire to marry your Fiance(e)

Same letter of intent, but add that you continue to support the K-1/I129F. signed and dated originals, from both of you.

You can use the original one but it would be best to give it a current date and at the bottom state that you still intend to marry your fiance.

I think I would also address it to the Consulate rather than the USCIS like you did with the one submitted with the I-129F.

Thank you guys for the information !!

I have updated the letters with Consulate address and the date and have also added that I am basically reaffirming my original intent to marry. Thanks again !!

K-1 Fiance(e) Visa Process & ProceduresOriginal letter affirming your desire to marry your Fiance(e)

Hi guys,

I was going through a checklist for the list of items that I need to send to my Fiancee for interview and just had a question for one of the items.

On VJ website, under K1 Guidelines after getting NOA 2, step 3. mentions the following:

Send an original letter affirming your desire to marry your fiance(e) and your continued support of the K-1 Visa. Sign and date the form. This will be similar to the letter you provided with the I-129F, but dated much closer to the interview (it will have most likely been several months since you submitted your I-129F).

I looked at the example forms but I only see the sample for (Fiance(e) Letter of Intent). Will it be the same one for the interview? Did anyone else use anything different? Do you have a sample?

Thanks,

K-1 Fiance(e) Visa Process & ProceduresSpecific bank amount required with I-134?

If your salary is enough to meet the household size you're supporting (you and your fiance) then that's fine.  You need to be making at least $20k a year.  If you don't make that much, you can use a joint-sponsor to cover it - a family member or friend.  See the link above about assets - that same link has information about joint sponsors.

That sounds much comforting. Thank you so much for your response on this !!

pacharyaMaleAustralia2013-07-26 11:06:00
K-1 Fiance(e) Visa Process & ProceduresSpecific bank amount required with I-134?

No, not if you're offering support via a job.  You need to make sure your income meets the poverty guidelines for your household size. So, if that's 2 people, you need to be earning just shy of $20k annually.

If you're doing the sponsorship with savings (or a combination of savings and income, if your income is too low) then you need to have 5 times the difference that you don't have in income. So, for a household size of 2 with $0, they'd need 5 x $20k in the bank, or in other liquidable assets.

These are the numbers you should go by:

http://www.uscis.gov...00045f3d6a1RCRD

It's mentioned in conjunction with the I-864, but the numbers should be the same.  You'll be doing the I-864 at AoS after you marry, anyway, so pays to be aware of the requirements.

Again, this speaks about the other form, but it does a better job of explaining the 5 x thing better than I can (and once a spouse, it only needs to be 3x): http://travel.state....nfo_3183.html#6

Thank you for your response. I am sorry, I am little slow when it comes to numbers. I currently live with parents and I do not have any dependent. Parents own the house. I do not have any other assets other than my salary from work and the bank balance. Will I face any issues?

Hi guys,

K-1 Fiance(e) Visa Process & ProceduresTravelling from a different country after the visa is issued

It is a visa for ENTRY to the United States, it is not a visa for EXIT of Australia. Doesn't matter where she enters from, or when, as long as it's during the visa validity period (which is 6 months max, can be less depending on medical expiration).

I advise entering before the visa is close to expiring. Though it shouldn't matter, I have read of an instance or two where the CBP officers screw up the entry stamp thinking you're supposed to have at least 90 days left on the visa before entering, or that you have to get married before the visa expires (it's the I-94 expiry) etc etc.

Thanks for this information and advice !!

K-1 Fiance(e) Visa Process & ProceduresTravelling from a different country after the visa is issued

Hi fellow VJ members,

I had couple of questions:

1. My Fiancee lives in Australia, she will have her interview in Sydney. Once approved, how long does she have to get to US? I have often heard that once issued, Fiancee visa has 6 months validity. Is this something mentioned on USCIS or Travel website? Of course we can always check how long is it valid for once she gets her passport with visa stamp on it but just wanted to know beforehand if possible.

2. Once the visa is issued, she wants to go and spend some time with her family in India before she permanently moves to US. Would this be a problem that after getting her Fiancee visa in Australia, she lives in India for couple of months and then she comes to the States.

If anyone can give this information, would greatly appreciate it.

thanks

K-1 Fiance(e) Visa Process & ProceduresConfusion about signing I-134

Where does it state to sign in your full name? I cannot find that in the instructions. The instructions simply say it will be rejected if not signed. Sign with your normal signature that you use on everything else you sign.

The other box is not an option. They want you to do as it says and type your full name in that box as an acknowledgement that you have read page 2, Sponsor and Alien Liability. That is something separate from where you sign and date the form.

Under the "Execution of Affidavit" it says the I-134 must be signed in your full name. That is what got me confused.

Hi guys,

I was going through the I-134 instructions and wanted to clarify something. The instructions for this form state that the form must be signed in your full name. Does it mean I have to write out my name with my middle name and last name in signature space? or just sign it the way i normally would sign something with a short signature? I do see that there is an option to put your name at the bottom where you acknowledge the liability statement but just wanted to confirm before we submit it.

K-1 Fiance(e) Visa Process & ProceduresPackage 3 papers from petitioner

Shoot! Of course you're right! I meant once we get the package 3! My brain is so deep fried with this process I'm sorry for the mix up!

No worries !

Yes, the paystubs can be sent after getting the packet 3 since they can just be scanned and e-mailed and don't need to be signed. But I-134 needs to be with original signature so just make sure you receive that as soon as possible to send it with packet 3. Good luck !!

Can my fiancé email the pay stubs once we get an interview date since they want the most recent ones? They aren't signed or anything.

I believe the 1-134 and supporting documents (paystubs being one of them) would need to be submitted together before the interview. Please refer to the original instructions for Packet 3.

K-1 Fiance(e) Visa Process & ProceduresProblems Saving Forms--DS 156k and Others

I don't have a printer; so, I want to fill out the forms and save them to be printed later, but I can NOT save them.

Example DS 156k:  I have downloaded and when I open it, I get a message at the top "Click sign to fill out and sign this form.  When you are done, you can save a copy by clicking "Done Signing".

I have click Sign, but can't find where the "Done Signing" is to click.  I have also tried many other ways to save the form after filling it in, but wasn't able to.

I have seen where it says to Save a copy, but when I click it, I get a message that Adobe Reader can only save a blank copy.

Any suggestions?

Thanks

If none of the suggestions offered by other members work, try updating the Adobe Reader to 11.0.3. This recently happened to my Fiancee and I had to ask her to do the same which then let her save the form in PDF. hope this helps.
