Waivers (I-601 and I-212) and Administrative Processes (221g)K-1 denied...now what?
I had no idea that something like that, that might have only been done once ever, could end up with a deny and ban. That is totally lame. Trying something once or twice doesn't make for a bad person or turn someone into a threat to America wacko.gif Especially in a situation where it was years ago... or infrequent. That just baffles me. It's not like Americans get banned for 3 years for doing these things, so why does it matter the other way around? blink.gif

I am really sorry to hear about the ban, and I wish you two the best of luck working it out! star_smile.gif

US Embassy and Consulate Discussiontax transcript question
Thanks for all your fast replies guys, and sorry I posted in the wrong section. I will have him get a copy of this years return to go along with the w2, that should work I assume? Tax paperwork pretty much baffles me, I'm glad I asked about this instead of just giving him the w2 alone smile.gif

Thanks again.

Right now he can't find a copy of his return. but we do have the w2 for it. Would just the w2 be acceptable you think along with the 2 transcripts?

No - W-2's are simply supporting documents for a Tax Return (one is no good without the other). The 2008 transcript might be available soon - would be worth a call to see - usually takes several weeks to become available in their system when a person recently filed.

Funny how dad misplaced such a recent return though... lol (was only 12 days ago..)

Lol yeah, he found returns from the past 20 years but not this years. We are in the middle of moving at the moment too... So they might be lost in the shuffle of thinks. Thanks for the help! We should be able to get a copy of the return @ the place he files his taxes with then. I should have just assumed to do that anyway I guess smile.gif he's just super busy with the moving... I hate to bug him with this.

US Embassy and Consulate Discussiontax transcript question
Hi guys! Hopefully this will be my last question regarding the whole financial support part of the K1 process tongue.gif

My dads co sponsoring with me... and I ordered the 3 year tax transcript thing for the both of us. They took forever to get here, like almost a month, and we've been waiting on them as one of the last things on the checklist. but anyway!! Mine are all fine, but my dad didn't file the 2008 taxes til the 15th... so the 2008 transcript says "no record of filing" He DID file, just not in time for the transcript.

Right now he can't find a copy of his return. but we do have the w2 for it. Would just the w2 be acceptable you think along with the 2 transcripts?

Thanks for any help/advice smile.gif

K-1 Fiance(e) Visa Process & ProceduresAnother proof of relationship/pictures question :D
QUOTE (reeses16 @ Sep 16 2008, 10:26 PM) <{POST_SNAPBACK}>
Good luck filing. You have tons of great evidence. My advice is to pic a few pics 6-10 max (you can give the rest to your SO to take to his visa interview). You both need to be in the picture, the point is to prove you met. If you don't have any, make sure its clear that you are at the same landmark/attraction.

When he comes in November, use the time date stamp on the camera. And take pics together. Even if that means you have to do it yourself.

Thank you smile.gif

I wasn't planning on sending all our pics... we just have a lot to choose from i guess!

We got engaged the last time he was here, so all the times before then we weren't really thinkin "ooh this would be good for the government!" in everything we did (and in every pic we took!). I kind of wish we did now lol. At least now we have more of an idea of what we need... so we can save everything from his November trip and take more appropriate pictures!

QUOTE (Haole @ Sep 16 2008, 10:46 PM) <{POST_SNAPBACK}>
ALLS you have to do is prove you've met in PERSON in the last 2 years. Emails, chats and phone calls are good for the interview later but don't hold water for proving you met in person.
A couple pics with BOTH of you plus travel records and required documents is all you need.

Thank you smile.gif
That response eases my mind a little.

K-1 Fiance(e) Visa Process & ProceduresAnother proof of relationship/pictures question :D
Ok so, we haven't filed our petition yet, but I am starting to gather things together. We are planning to file in November when he comes here. At first I thought to myself that we had SO MUCH proof of meeting and relationship... then I read more and more of other peoples experiences.... and RFE's.... now I am not sure blink.gif and at the same time I think i am over-analyzing everything too much tongue.gif

We have been together a little over a year now smile.gif He has made 4 trips here to me, and I have flown there once. We text constantly... but do not use the phone. We use Ventrilo for at least 3 hours a day for voice chat... which kind of sucks because there's no real way to log or show names and numbers. I have a giant MSN log starting from April 2007.

So I am going to state what we have, and I would love for any kind of advice or enthusiastic words! I'm sorry though because I know these kind of posts are made a lot... and I will bless you with another devil.gif but anyway, here's what we have.

We have scanned pics of all our passport pages... stamped as well as blank (just in case!), Plane ticket stubs for most all of his trips here and my trip there, train tickets to and from London to Paris with our names and dates on them, printed out e-cards, a couple snail mail cards, some money transfer receipts, I've got an ATM receipt from Paris as well as my online bank statement showing it, My engagement ring receipt with both our names on it, the cards from all the flowers he's sent, a signed receipt (he signed) at a hotel here we stayed at, some more of my bank statements showing purchases in England while I was there, receipts for parking at the airport when i picked him up, print outs from my old phone bills showing the hundreds of texts i do a month... and a few other receipts showing i was there, and he was here.

Now, in addition... we have a good 50+ pictures of us together. Since we do a lot of things alone... one of us has to take the picture, so they are all either really close up shots of us... or we have some pictures of us separated with the same background behind us. I am kind of concerned that some of the pictures of us would be void because we aren't together in them (like me in front of the eiffel tower, then one with him) and because a lot of them you can't see a good background. So to sum it up, I'm a little scared they will say... "how do we know when this was taken?"

When he comes to visit in November, I am tempted to take a picture of us holding up a newspaper just to be safe! laughing.gif
I just wonder... if we do that, get it printed... then mail in the petition, would that picture be too recent to the filing?

I don't know, my brains all scattered with this, and I am just really nervous that while we DO have quite a bit of proof... is it enough? We will be together the week we mail it in... so we have one last chance to toss some stuff in smile.gif

thanks for being patient with me biggrin.gif

I would take the same precautions coming to England as people reccomend for those visiting the US and bring evidence of your ties and intentions to return to the US. Our immigration people can be just as pedantic as those in the US.
I know of one instance were they sent back a friends US fiancee. She was coming for a stay of 3 months at the time and had no job back in the US so that may have been a factor. I am also not sure if they had started their K1 at that time.

hehe yeah, the 2 times i have flown there was pretty stressful.. so ideally i would like to avoid as much stress as possible. And, like everyone else here, I'd like to not mess up my chances of seeing my fiance when the visits are so far and few! I will arrive as prepared as i can with helpful documents i guess biggrin.gif

I know a lot of people ask about their fiance coming to visit the US while they have the k1 pending, but what about the other way around?

My fiance and I decided to not take the chance of him being turned away here and for me to go visit him in London this April. I have flown to England twice now, and both times I kind of got hassled (maybe... overly questioned is a better term), which makes me think that I might get even more hassled when I say I am visiting my fiance instead of my boyfriend. But I intend to be honest, and I am going to assume its a bright idea to take my NOA1 notice with me too wink.gif I am just worried it will all work against my favor. worry=my middle name kicking.gif

I suppose to get straight to my question, has anyone had any issues going to visit their significant other in their country while the K1s pending? Or is this just an issue i made up in my head so I will lose sleep biggrin.gif

There is no restriction on a US citizen traveling to visit fiancee in their home country.

Note if your fiancee fears travel while k-1 is in process, they can always use Shannon or Dublin Ireland as a connection to the flight to the USA, those airports pre-clear persons traveling to the USA, is if a denial of entry happens it would happen there, a much shorter distance from home.

This topic is asked about so often it is a FAQ: http://www.visajourn...cation.html#4.6

K-1 Fiance(e) Visa Process & ProceduresI-134 question
QUOTE (GueraKristina @ Apr 1 2009, 04:56 PM) <{POST_SNAPBACK}>
My parents were iffy about bank info too, your dad can write a letter to the bank asking for all of the stuff that instructions askfor, but he can put in BOLD that he doesnt want his account number on the letter that they return to him with the requested information. That way, immigration gets what they want/need, and your dad can be more comfortable, and you can get your approval.

The reason why they ask for bank info is because the whole point of the I-134 is to prove that the fiance will not become a public charge. They need to make sure that if you cant make the money, that someone can give it to the intending immigrant so that they will not become a public charge, thus thats why they ask for the bank info.

Yeah, I told him that he could put it in an envelope and seal it if he wanted. I think he's more concerned with me seeing his balance and stuff, rather than the government. Money is a very private thing to him. But like I said, he's willing to do it, was just wondering if it were completely necessary smile.gif

K-1 Fiance(e) Visa Process & ProceduresI-134 question
Forgive me if this has been asked a million times blush.gif

I'm working on grabbing the last parts of the affidavit of support evidence. My step dads a co-sponsor. The London embassy website asks for:

-----------------------------------

* notarized copies of his or her latest federal income tax return;

* a statement from his or her employer showing salary and the length and permanency of employment;

* a statement from an officer of a bank regarding his or her account, the date the account was opened and the present balance;

* any other evidence adequate to establish financial ability to carry out his or her undertaking toward the applicant for what might be an indefinite period of time.

----------------------------------

Is the bank letter only for those using the bank assets as part of meeting the requirement? Or is it needed for everyone? He'd rather not disclose any banking info, but will if needed. I'm just curious if not sending it would cause a problem.

For the record...I plan on using (for the both of us) 3 year tax transcripts, copy of 2008 w2s, employment letters, and some pay stubs.

Maybe not so germane to the OP's question, and I agree with the other posters suggestions about writing next to / under the actual image, is another use of common day technology.

My Alla, being the intelligent woman she is (and one of the many reasons I love her so), on her flight to Moscow from Kiev, after we had met, did the following.

The Ukraine customs had stamped her boarding pass with the Ukraine stamp but most of it including the date was on the section that the airline would tear off and keep.

So thinking quickly, she took out her digital camera and took a picture of the entire boarding pass prior to the gate.

I then used this image plus a copy of the short stubby piece with part of a stamp on it, as part of our Proof of Meeting section of our K-1 petition.

Just a suggestion.

Phil

K-1 Fiance(e) Visa Process & ProceduresQuestion About Proof
QUOTE (Rhiann @ Apr 2 2009, 01:47 PM) <{POST_SNAPBACK}>
On some of my boarding passes, there isn't a year shown, or even a date (since they took the date stub on me a few times).

Is it okay if I write on the photocopies (or next to the photocopied tickets) the dates since it doesn't show it?

I'm unsure if this is a no-no for them or not.

Oh, and during one trip with my fiance we went to Vegas, would you consider hotel reservations for that DURING my trip to see him good proof?

heart.gif

Some of my boarding passes were missing the date on them too (maybe just the year though), for the same reason. I wrote on the photocopies (next to the ticket) the dates they were from. Then, behind that was the supporting evidence of the trip, like some receipts showing that i was there during that time.

So, my advice is just include whatever you can to support that those boarding passes were the valid ones smile.gif Scans of your passport pages with the stamps from your trip are good to support it.

And yeah, hotel reservations are good proof in my opinion smile.gif Anything to show that the both of you were in the same place at the same time, within the past 2 years is what they like. So if you have those, and he has some receipts with his credit card or anything from that trip to vegas too... even better.

K-1 Fiance(e) Visa Process & ProceduresIs it possible to have the fiancee visa packages sent to my post office mail box?
QUOTE (Aya&John @ Apr 8 2009, 05:11 PM) <{POST_SNAPBACK}>
My fiance and I are filing a k1 visa for me to move with him to the US. We have met online 9 months ago and we meet in person a few weeks ago. I have moved a lot in cities in my country and I had a lot of my mail lost before, so I got a mail box to where I get all my mail near where I currently reside now. While we filled the papers together when he was with me (he hasn't sent the papers yet) i wrote the address where I live now and wrote my mail box address on a piece of paper and asked to receive the visa papers on it. My question is: Is it possible to really receive the visa package to my mail box at the post office? It is serious and we desperately want to be together... Please answer and real life stories about the k1 visa even if not related exactly to my question would be really helpful.
Thank you!

I wasn't sure what to mark down for my address with the petition, because we don't have a mailbox, but i knew they needed a physical address too. So, I gave them both (assuming they'd know why i gave them a PO box address). The mail ended up at my house (thanks to the friendly mailman) and the PO box part was ignored. Later i just did the change of address thing online, and now everything's been coming to my PO box instead. I think you might have better luck where you wrote down a note asking for the mail to be delivered to your po box though smile.gif

Just keep an eye out for your mail, and if by chance the NOA1 comes to your house, just do a change of address and you should be set. I hope your NOA1 gets sent to the right place and nothing happens to it. Good luck!
