IR-1 / CR-1 Spouse Visa Process & ProceduresI-864: Need a little clarification
QUOTE (Surf2Salsa @ Jul 6 2009, 09:40 AM) <{POST_SNAPBACK}>
It is strongly recommended that you supply 3 years of tax returns, a current employment letter and recent pay stubs.
In my tax practice I recommend to clients with immigration interviews to also bring (in addition to the tax return copies) the last 3 years of tax return TRANSCRIPTS.

Regardless of the minimum requested documentation and requirements, providing sufficient proof of income and income stability is good idea.

Good luck!

There is no point in sending both a copy of the tax return and a IRS Transcript, they both show the same thing. one or the other is what is needed.

I included the last 3 years of IRS Transcripts, rather than copies of the return that way I did not have to include all the W2's and schedules.

I did include a letter from my employer stating when I was hired my annual salary and that my employment was ongoing.

IR-1 / CR-1 Spouse Visa Process & Proceduresform DS-230 SS card?
It is not a good idea to leave any question on the form unanswered. It is asking you if you want a SSN automaticaly issued to her after her arrival in the US.

You have two choices 1. say yes you want a SSN and once your wife his in the US it should arrive in the mail in about 4 weeks OR 2. say no you dont want a SSN issued. Then once your wife has arrived she will need to complete the SSA5 form and then go in person to your local SSA office and apply for a SSN that can take anything from 2 weeks to 2 months.

IR-1 / CR-1 Spouse Visa Process & ProceduresQuestion about form I-90

yes I've read the instructions and I know they said I don't need to send photographs (but I also know that there's different requirements for every case whether the card was stolen, destroyed, lost or had never been received) so maybe they need pictures in my case... plus that website had confused me! failing to send all the required documents will result in a delay in issuing a new card for me sad.gif

I'm assembling an application for a replacement for my green card that I've never received (the application comprises form I-90 and supporting documents)... my question is: do I have to send identical photos of me along with the application? I have read form I-90's instructions and they never mentioned anything about Photographs but on this website they said that I need to send two photographs! so I'm actually quite confused, and I don't really know whether I need to send pictures or not... plus I'm also confused about the photo requirements; should the picture show the right side of my face (sided picture) or a regular one is fine (face faces the camera like this)?

If you go and read the Instructions for the I-90 form on page 2 at the bottom under Biographics it tells you that you do not need to include photos.

http://www.uscis.gov...m/i-90instr.pdf

Belive me you do not need to send photos.... if they were needed for some cases then it would say that on the instructions. You sould stick to the CORRECT instructions available from the USCIS website. If you are finding that you are unable to follow the instructions then you need to hire someone who can help you..

For lost or missing Greencards you can e-file the I-90 and you only need to include your A# and the payment. USCIS will confirm from your A# that you have been approved for the Greencard and will then issue you a new one.

Its simple if you just follow the instructions given by USCIS.

IR-1 / CR-1 Spouse Visa Process & Procedureshow to remove conditions ?
QUOTE (Fiaz & Brenda @ Jul 12 2009, 06:18 PM) <{POST_SNAPBACK}>
Thank you for help .

Your timeline shows that you have not yet been approved for a visa to enter the USA. The Cost of removing conditions may well change before you have to file. Once you enter the USA on a CR-1 you do not file for Removal of Conditions until 90 days before the expiration of your greencard. That will be 2 years -90 days from the date you enter.

You would be better to check on the requirements nearer the time you need to file.

Hi ALL
We are submitting the DS-230 and AOS to the NVC.
Could someone guide us on what happens next?
We need clarity on the steps or process that follows.
Any detailed user Guide available? Please help.

Once NVC have got the DS-230 and the AOS they will review the documents once that is done the case will then be complete and then a Interview date will be assigned and the case will be sent to the embassy for the interview.

What hapens at the embassy you will be using I do not know but they will have a website with full information about visa processing.

He has been here since Tuesday. Do you think I would be rushing it by taking it by taking him to SS Administration office today?

Yes you are rushing it.... if he arrived only 3 days ago they will not even have his details entered into the system yet. The brown envelope has to be sent to USCIS and then all the details input into the system. SSA use the SAVE system to verify immigration status before they will issue a SSN you have to give USCIS some time to input the info.

On the visa application Form DS-230 (expires 7/31/2007), you saw the following offer:

"Do you want the Social Security Administration to assign you an SSN (and issue a card) or issue you a new card (if you have an SSN)? You must answer "Yes" to this question and to the "Consent To Disclosure" in order to receive an SSN and/or card."

I checked yes for my husband to receive a SSN, so I am just wondering how long will it take for my husband to receive his SS card?

If it has not arrived within 3 - 4 weeks of his entry, then go to your local SSA office and request one, they will be able to check if one has been assigned and if not they will get one set-up for him. Just remember to take his passport with the visa in it.

What was your status in the US before you left? How did you enter the US initially?

I had my interview in february at the San Francisco office to change my status. I haven't heard anything since then. I entered the US as a fiancee.

If you were applying for adjustment of status and you left the US without AP or a greencard then you have abandoned your application for AOS and will need to file for a spousal visa from your home country.

Your spouse will need to send a I-130 to USCIS to get the process started. Sadly you will have to wait for the CR-1 visa before you can enter the US.

You can not apply for Advance Parole after you have left the US you must have the approved AP with you when you depart.

The IR-1 visa is good for only 6 months, just like the rest of them. The green card that is received after entry on an IR-1 visa is valid for 10 years. Big difference there. The immigrant must enter within 6 months of receiving the visa.

Your wife could theoretically leave immediately after arrival- at her POE she'll get a stamp to go along with the visa that acts as a temporary green card for one year. If you wait for the actual card it'll be about a month I believe.

I have heard differently. I have been told that she MUST remain in the U.S. until she gets the permanent green card. Not that we are planning for her to leave the U.S. immediately. The plan is for her to stay for awhile even after receiving the permanent green card.

I know people who came into the US to activate the greencard process and left 5 days later to go back to the UK to finish college and then return 3 months later, they had no problems at POE and their greencards were waiting on them when they got back.

So there is nothing to stop you from leaving the US once you have entered and activated the greencard process. The I-551 stamp that is put on your visa is a temp greencard stamp and it is good for both international travel and employment in the US, it is valid for 12 month. Your actual greencard will arrive at the address you gave within 3 months.

IR-1 / CR-1 Spouse Visa Process & ProceduresTravelling to the US with Visa before I intend to use it
QUOTE (Yvie_and_Brett @ Jul 28 2009, 05:57 AM) <{POST_SNAPBACK}>
A few facts so you can understand our position:

1. By the looks of things, I should have my CR1 by the end of next week.
2. My husband (USC) and I intend to visit the US on a househunting trip 4-8 weeks before our Big Move. He's still securing a job offer, so we don't know where we'll be moving to yet. When he has a job lined up, then we'll go looking for a house.
3. The US address used in our application was his parents' address in WY, but we have no intention of moving to that State, we'll be going to FL or TX.

My questions are:

* Can I travel on a passport with a valid immigrant visa in it WITHOUT actually using it and triggering the green card, etc as we won't be moving to the US for at least a month after that visit? I'm from the UK, so I qualify for VWP.

* Does it actually matter if it's triggered or not, seeing as we can file a change of address and have his folks forward on the Green Card/SSN info anyway?

* Is it better to trigger the GC/SSN on my househunting visit so I already have my paperwork when I arrive in the US? It could be quite handy to able to sort out my Drivers Licence and a bank account without rattling around the house waiting for the mailman to bring them.

* Are there any possible complications I need to be aware of?

We're in the enviable position of having our Visa approved within 3 months of posting our petition, but we weren't expecting it to happen so soon and now things seem to be happening in the wrong order, so I'm getting myself worried about it all. I'd be very interested to read your comments and suggestions.

If this would be better posted in another forum, please feel free to move it smile.gif

You would need to activate your CR1 visa when you enter the US on your next trip.. When you are at the POE the immigration officer will stamp your CR1 visa and that will become a temp Greencard and is valid for international travel and employment in the US. You Actual greencard will be mailed to the address you give at the POE. So it would be mailed to that address and if that is a family address they can hold on to it until you are here in the US for good.

The only thing you will need when you use the temp greencard stamp is the passport it is in. Also you will not need to complete and I-94 when you return to the USA as you will be a premanent resident.

Happy house hunting..

I was planning for my wife to fill out the Choice of Agent form, scan it, email it to me and I would send it to the NVC from my US address.
I decided to confirm that with the NVC. Customer service agent said they wouldn't accept the scanned copy but email would be ok. She said email is the fastest option and if you send the email then sending the original form via snail mail is not required. So my wife is going to send an email and attach the scanned paper form just in case.

- Andrew

All I did was write a email with all the info, Name, date of Birth, case number, email address for both myself and my parents and emailed it to NVC for both my parents it did not matter that it came from my email address. I never sent anything by snail mail to them and I had no problems.

I spoke to a NVC officer last night about the AOS bill and I also asked if we needed to send the DS3032 by snail mail if we had emailed it to NVC, The officer told me that the DS3032 in email form sent from either of the email addresses on file is acceptable and no we did not need to mail the hard copy as well.

So we are just going with the emailed DS3032 and hope for the best.

You only take documents to the interview that the NVC did not request. The NVC forward all the papers and documents to the embassy for the interview, they are returned to you at the end of the interview.

Get all the documents together, download the DS-230, complete the DS-230 and send it and all the required documents to your husband. better for him to mail to nvc than you. or if you want to send it get your husband to save the coversheet to file and then email it to you so you can print it out and include it with the packet.

When you pay the fee for the I-864 and the DS230 it generates a coversheet with a barcode, you must print that off and iattach it to each of the packets.

NVC will not accept the packet without this coversheet.

National Visa Center
ATTN. DR
31 Rochester Avenue, Ste 100
Portsmouth, NH 03801

(barcode)

(Checklist Letter Response)

CRI
(Beneficiary's name)

Do you think that this will suffice? I hope so unsure.gif

They will not accept the DS-230 until you have paid the fee. It will be returned to you in the next week or so. This happened to my friend she used the cover sheet from the RFE as she had not paid the IV bill and was hoping to pay it at the end of the month. NVC will not work on the DS-230 if you have not paid them to do so.

I would call NVC today and speak to an officer.

The only way you are going to get a IR1 Greencard is if your arrival in the USA is AFTER your 2nd wedding anniversary. It could be the day before your anniversary and you would not get a IR1, you would only get a CR1.

As your visa expires before your 2nd wedding anniversary you will have to enter the US and get a CR1. You could contacy the embassy and request an extension becuse you want to wait until after your 2nd anniversary, but I doubt they would class that as a valid reason for extending the visa.

My IR-1/CR-1 petition was approved on March 11, 2009 while my son's petition was approved on April 21, 2009. And my husband received the AOS Processing Fee Bill Invoice on March 27, 2009 for my petition. From that period of time till May 2009, I received and submitted the Choice of Agent and Address form to NVC; that was the only letter I received from NVC since I appointed my husband in Washington as my agent. Last month he called NVC upon receiving an e-mail from them; they asked us to submit the page 2 of the DS-230 form together with the original copies of our marriage certificate, birth certificates of me and my son likewise our photos. My husband told me he already mailed it within the last week of July. What is next after this? Why is it that when i checked my status with USCIS it says, case received and pending?
Thank you for whatever info you can give me. God bless!

IR-1 / CR-1 Spouse Visa Process & ProceduresIR-1 OR CR-1
QUOTE (kerran @ Jun 15 2009, 12:28 PM) <{POST_SNAPBACK}>
What is the difference between an IR-1 and a CR-1?

CR-1 = Conditional Resident, Married less than 2 Years at time of entry to US (2 year Greencard then needs to file for Removal of Conditions)

IR-1 = Permanent Resident, Married more than 2 Years at time of entry (10 year Greencard)

There is nothing you can do but wait for the email with the instructions for the DS-230 and the IV Fee Bill. You can make sure you have all the documentation and the form completed so once the IV Bill is paid you just need to print off the barcode coversheet and mail the package to NVC.

IR-1 / CR-1 Spouse Visa Process & ProceduresWife traveled to the philippines with an expired green card help!

Well I guess she was only speaking with some sort clerk at the embassy that did not understand what was going on. They called her and asked if she she realized her visa was a two year conditional visa then told her basically that they could not longer issue the letter, and told her she needs to file the I-751 and if and when we get a letter of recite that they accepted the application she can use that to get the boarding letter.

I know now the application states we must apply for removal of condition. Somehow I missed that or got confused we made a mistake we did not know I filed that over three years ago. If you want to help and have useful information I would appreciate any help but I am upset enough you don't need to point out mistakes I know I already made.

Will be submitting the the application as soon as I get the information I need from her fedex.

Kent

I am sorry this has turned out this way. Form what you have said it sounds like as soon as you get the NOA1 for the Removal of Conditions, extending her greencard by 12 months they will be able to issue her with the boarding letter.

I would get that filed as quickley as you can and make sure you include a very detailed letter as to why you are so late in filing. At least you are not having to start from the begining again.

Well so far what has happened is she went to the embassy in Manila they are giving her some sort of Boarding Pass letter so she can come home. We still have to get though customs but she will get a ticket with a POE here in Minnesota.

You are very very lucky.. As soon as she gets home get that Removal of conditions filed ASAP and dont forget the include a letter explaining why you are late filing.

Good Luck

Hi,

Im an Ir1 visa holder and i traveled to US, stayed there for 20 days but had to go back to my home country because my mother got sick. Till then I hadnt recieved my GC.

Now, I'm planning to go back to the USA. Will my PoE serve me as a temporary GC while re entering, althought my GC had been delivered to my husband in USA. The PoE states "upon endorsement serves as temporary I-551 evidencing permanent residence for 1 year".

I asked a lawyer for help and he told me that my visa has expired and I cannot re enter with this PoE, I'm confused :S

Best if hubby Fed ex you the GC. No idea wht your lawyer is talking about unless the stamp in your PP is no longer valid once you get the GC.

You do not need to get your husband to FED EX your greencard, it could get lost in the mail. The visa and the IR-1 stamp in your passport are valid for 1 years from the date you first entered the USA, you said you entered in April 09 so the visa and stamp are still valid. You do not need anything else to enter the USA.

The issuing of the Greencard does not void the stamp in your passport.

IR-1 / CR-1 Spouse Visa Process & ProceduresGREEN CARD AND SSN
My Parents arrived on a IR-5 visa 5 weeks ago, They have just got their "Welcome to America" letters and a email update to "Card production ordered" They should have their Greencards this week we hope. As for the SSN they both checked the box onn the DS230 but nothing has arrived, I took them to the local SSA office 10 days ago to find out what is happening with the SSN, the SSA had no trace of them. They had to complete the SS5 form and they are now waiting for their SSN, they were told to allow 4 - 6 weeks for them to arrive..
