I didn't have a signed letter of intent from my fiance (for the I-129 F application packet) so I wrote one from myself and also had the pastor who will be marrying us write a letter stating our intent. Do you think this will be an issue? He was back in Malawi, so it would literally be months before I could get something with his actual signature on it.  Do you think they'll RFE us on that?

 

More than likely, yes you will receive an RFE.  You have included a statement of intent to marry, which is evidence that YOU are legally free and willing to marry.  You do not have a statement that says your fiancé is legally free and willing to marry.  The statement from the pastor is not enough, USCIS needs more solid evidence.  They need to hear from your fiancé that he has the intention of getting married.  The letter of intent is what they are looking for.

My fiancée would be approved and a visa granted on that day. So she has initiated her son's visa via this process. So now the boy has up to 6 months to enter the USA. if to go beyond this initiate a follow behind for a year, or just file for family member to arrive later. Funny I didn't see  the part about delaying the k-2 for a total of one year. I will look at the link sent perhaps others have some more info. I do understand if a 130 is filed, it could take years. the idea was to get set up and then the boy follow later, but it could be more than 6 months due to the school year.

Went on the USCIS website today to find a Request for Evidence was sent out 7 days ago but have not received it.  Is a Fiance Letter of Intent mandatory?  Had a lawyer do the paperwork for us but never saw or signed this letter of intent.  I'm going to see her in 11 days again, she lived here with me for the time allowed and I lived with her in Brazil for four months.  I think that alone would show intent. This is all very frustrating.  I forgot to add she is in Canada right now, has duel citizenship.

 

No, living together with her only shows evidence of a relationship.  It is not clear at all from your relationship that you actually intend to get married.  USCIS needs to be 100% clear that both of you do in fact have intent to marry each other...this is why they need a signed letter of intent.

OK you're right; that's what the paper says. It is in the instructions on the I-129F for the K-1 state you are to copy all visa pages and that the passport is valid for 5 years OR a copy front and back of your birth certificate/naturalization document. The instructions on the I-130 for the CR-1/IR-1 ask for a copy of your birth certificate/naturalization document with out saying what sides to copy AND a copy of your unexpired passport with no mention of pages. That's just stupid; why on earth wouldn't they be the same US citizenship proof standard? Why would married or single make any difference?

 

So if you sent your birth certificate copy and you only want to send your passport copy to prove time together you wouldn't need all the visa pages; just the relevant stamps showing time together with a short written explanation of the stamps relevance. Confusing!!!!

 

KayDeeCee I don't know what to tell you. The only petitioner info I sent was passport bio page and one visa page from when we got married. The passport only had 3 years validity. I sent more info about our yet to be born child than about myself. Our case was approved with no RFE, checklists or AP. This just shows that in the end the whole process rests on the CO's discretion. 

 

Don't misinterpret the I-129F instructions pertaining to using the US passport as proof of citizenship, which says:  In place of any of the above, you may submit a copy of your valid, unexpired U.S. passport issued with a validity period of at least 5 years. You must submit copies of all pages in the passport.

 

Validity period refers to the period of time from issue date to expiration date.  It does not mean the passport has to still be valid for another 5 years...the instructions do not say this.  This is a common misunderstanding of the meaning of validity period.

You won't have any problems with filing the I-129F petition for fiance.  The only issue I see is your fiancee will be quitting her job before she travels to the US with you after Christmas.  It may affect whether or not she is allowed into the US.  She may have a visa already which allows her to travel, but remember a visa doesn't guarantee her the right to be here.  If CBP questions her at the POE and find out she quit her job, they may refuse her entry.

hey guys, my fiance is mailing me a package of documents today but before he does i want to make sure that he and my co-sponsor, his sister, filled out everything properly!! would u please answer me these..asking specifically about the form I-134, http://www.uscis.gov.../form/i-134.pdf here is the form if you guys would look at it and tell me please!

 

1.    at the beginning of the form it says "if you are not a US citizen based on your birth in the United States..." and there is A to E to fill out and then number 2 also, but my fiance is a USC by birth and so is my co-sponsor so they clearly don't need to fill that but do they just leave those blank or write "none" or what?

 

 

 

2.   then there is nr 3 on the form and it says "this affidavit is executed on behalf of the following person" so i know for sure that my co-sponsor writes me down but does my fiance too? or does he leave that blank? im just a bit confused, we got a co-sponsor cuz his finances aren't enough

 

3.   then nr 10 it says "i have submitted a visa petition to USCIS on behalf of the following person - so here it's just my fiance, the USC and petitioner that writes me down and my co-sponsor states "none", right?

 

4.    ok so my biggest question is about nr 11 on the form...it asks to state how you will support the person basically, as far as it comes to my co-sponsor, do u think putting this would be good? 

" I will assist my brother, the USC petitioner, with any financial need that may arise regarding his alien fiance and her stay until she can get her own job"  what do u guys think about this? 

if it's not good, what else can my co-sponsor write there?  

 

and also..what should my fiance write in his nr 11 on the form?? what about something like "i will provide my foreign fiance with room and board and support her financially" or no?? i have no idea how to put this! i would really appreciate you guys' help!!

 

1.  If your fiancé was born in the US, then you leave a through e blank.  You put the birthdate of your fiancé in the spot "resided in the US since..."

2.  You are the one listed in number 3 on BOTH forms.  Your fiancé is sponsoring you, so he lists you.  Your co-sponsor is also sponsoring you, so you are listed as well on your co-sponsor's affidavit of support form.

3.  Your fiancé will list you on number 10 of his form, and the date submitted would be the NOA1 date of the I-129F form.  Your co-sponsor will write NONE.

4.  Number 11 does not apply to K visa cases.  Both your fiancé and co-sponsor will leave it blank and write below:  N/A K-1 VISA PROCESS.

There are a couple of issues here.   You are in the Philippines which means the USC must have traveled to be there with you.   For the first step of the process of proof of having met the pictures together are secondary proof.  What you want is proof that you were in the same place at the same time.   For that you can use the USC passport stamps showing when they came to the Philippines and perhaps hotel receipts, or other documents that show you were in the same place at the same time.   Tickets to shows etc are good as well.   Dates are less important so long as it's in the last two years.   HOWEVER,  Manilla can be a tough place to interview at so you'll want to do a little more than satisfy the proof of meeting requirement.   You would want to 'front-load' your petition.   Later at your interview you'll need to prove that the relationship is real to the CO officer.  In Manilla and other high fraud countries that puts additional burden on you the Petitioner.   One good approach to overcome this submit your proof of relationship with your I-129F and then bring updated documents to the interview with you.  This is commonly referred to as front loading.  So what we did and others have done is put together as much documentation as you can that shows you have a real relationship.  I would suggest organizing it in and building a table of contents for it all with number pages.   For example,  if you met online and you can print some chat logs from early on that is part one.  If you use facebook and you changed your relationship status print those out for both of you with dates.    If you have sent physical mail back and forth include copies of that correspondence.   If money has transfered for support then receipts from the money transfers and some chat logs about what the money was used for.   If money was used for a sick relative for instance than copies of the paid hospital bill and a note of thanks for example.   You time together is key, pictures together.  Chat logs from before you met about making plans.   Chat logs after about what you liked and didn't like.   Anything that shows support from your families is great.   And so on.  Good Luck, PM me if you want more details

 

I agree with most except saying that Manila can be a tough place to interview.  Manila is actually a very easy consulate to interview at.  That's not to say you shouldn't be prepared, but you shouldn't be worried that there's a high chance of denial because most are approved.  When my wife had her interview, everyone was approved that day.  The entire atmosphere of the embassy was relaxed, the COs were so nice and the interview was more like a conversation with old friends. 

 

We did front-load our petition, but not by much.  I think we included around 30 pages of relationship proof.  There were no issues whatsoever with our case.

Well...this is even more confusing now.  The online form gives three choices: IV Address Registration, Immigrant Visa and Nonimmigrant Visa.  Simple so far...   When I select Nonimmigrant Visa I must then select a category: Business/Tourism, Study in the USA, Working in the USA, Crew (Airline, etc) or All other Visas.  When I select All Other Visas, the next page wants me to choose Treaty Trader or Treaty Investor (E1 or E2 visa) or E3, NAFTA, or Victims of Human Trafficking.  None of these apply.  So I go back and select Business and Pleasure and get the options of B1 or B2 visitor visas for business, pleasure or medical.  None of these apply.

 

So I went back and selected immigrant visa instead of nonimmigrant and continued...where it took me to a long list of visa types where the K! visa IS listed.  So I selected it and continued.  Everything was looking good until it got to the page where I had to fill in our DS-160 Confirmation Number.  Well how can I do that if I am still in the process of trying to fill out the darn DS-160 form?  By the way, NO WHERE does it have a selection that says D-160.  So I am stuck in a catch 22 situation.  I have NO idea what to do now.  I cannot fill out either Immigrant or Nonimmigrant.  What do I do?

 

First you need to fill up the DS-160 online application here:  https://ceac.state.gov/genniv/

 

When you finish the DS-160, you will get a confirmation number.  Now you can complete your online profile, where you select IMMIGRANT VISA followed by K-1 VISA, and you can enter in the DS-160 confirmation number.

I am not really very good in researching online thats why I always end up typing questions on the forum. Just to give you a brief backgrounder. My fiance has a kid from another woman and we have a kid too. We are currently processing our K1 visa (no Noa2 yet) and CRBA for our kid. do you have any idea how much should be his annual income to support 3 people ( me, our kid and his another kid but is currently in the states). Sorry to confuse you all, I just want to make sure that whatever amount hes making can really support us to avoid denials on the interview stage. Need your help. 

 

Your fiancé needs to have an income that meets 125% the poverty guidelines for a household size of 4, which is $29,812.

There will be two different income guidelines to follow. For the K-1 (Affidavit of Support form I-134) you or your fiance will need to show that they meet 100% of the poverty guidelines for a family size of 4. (your family size would actually be 4 if you include both children - you, him, child 1, child 2). For a family size of 4 at the 2014 guidelines that's: $23,850

 

 

USEM requires 125%, not 100%.

I received an NOA1 this week. My fiance is from Mexico her name is (for example)

 

Jane Mary Doe.

 

On the NOA1, her name was spelled Jane Doe which is incorrect, right?

 

Should I even bother calling to clarify this? Her name in a First Name Last Name basis is Jane Mary.

 

Although I indicated on the G325 her middle name as Mary, I was under the impression her full name Jane Mary Doe would be listed.

 

What a headache. Will I delay my case trying to fix this, or should I address this later?

 

 

 

The NOA1 doesn't list the middle name, only the first and last.  Using your example of Jane Mary Doe as her name, then the last name should have been Mary Doe...not just Doe (since in Mexico there are 2 last names).  By this example, there is no middle name.

 

You should be able to correct this at the embassy stage.

Thanks, I did search the previous posts.  This is dealing with AWA and an appeal is not likely.  Basically in order to win an appeal and get your petition approved, you need to prove that either 1) you were not convicted of any specified crimes against a minor, and/or 2) you pose NO risk at all to the beneficiary.

 

If you have not been convicted in the past, it should be fairly easy to submit evidence disputing the fact.  However, I don't think that is your situation.  Your only option left would be submitting evidence to prove you are NO risk to your fiancé.  There is a huge difference between LOW risk and NO risk.  You have to prove that you pose NO risk, which that in itself could be very difficult to prove.

I received a denial letter for K1 petition today in the mail. At the end it says, if I disagree with the decision, I can file I-290B to appeal but it must be filed within 33 days from the date of the notice. If it's not filed within those days, the decision is final. I was out of the country and just received the notice today dated August 27. I will need to use Attorney's help this time as I don't want to re-apply for the petition as I am sure it's a no go again. Should I wait until the decision is final or that's not possible to appeal a final decision? The time is too little for me! I am freaking out. 

 

What was the reason for the denial?

After reading a thread here, I realized that I may have made a mistake in my I129F, specifically, the translations I supplied for my fiance's documents were the photocopies, not the originals I got from her.

 

What I read was that translations should always be the original.

 

I suspect this would cause an RFE, so is there anyway I could contact USCIS and send the originals while the file is waiting to be adjudicated?

 

Translations of what?  What documents of your fiancé did you send?  The only thing needed from the beneficiary at this point for the I-129F petition is:  a signed letter of intent and a signed G-325A form with passport photo.  No other documents are needed from the beneficiary.  If you did send  more than was requested, it is likely that it won't be looked at and it certainly won't be a basis for denial or RFE.

It's normal for them to change letters with an accent mark to a letter without one, because in English we don't have accent marks on our letters.  In the case of my wife, they also changed the ñ to n.  No problem at all.

Hello all, I'm new here and I've been reading a lot of forums just to prepare myself for this whole process. I just had a doubt on the 34A. question on the I-129F form asking "describe the circumstances under you have met." What I wrote in those small three lines was

" I met xxxx at the bar he was working at during my internship in Porto Alegre, Brazil." I mean that really was all that I could fit anyways. I know I could have attached another paper but I thought that was sufficient enough to answer how we met... but I think I interpreted the question wrong. 

 

So I was thinking that I was suppose to just describe how we met. I've been researching more and I see many users saying that we have to describe how we met in the past two years. Since it didn't specifically say describe all the circumstances that you have met in the past two years I didn't put this down. I was living over there when I met him and then went back two more times. I'm just freaking out now because I feel like I didn't answer that question well after reading what many other users wrote and now I'm scared they are going to make me do it again. Can someone direct me to the right track to eliminate this doubt? Thank you advanced!

 

The only thing required of question 34 is a statement from you of when and where you met.  That is describing the circumstances of how you met.  Simply this:  WE MET ON [DATE] AT [PLACE].

Good day to all Il try to make this short ok so I just heard of k1 visa no one helped me fill it out I did it my self here's the issues ..I was married I have 2 small kids I SENT my divorce decree (copy ) to uscis no where on that app did it ask me do I have kids am confused ..if an officer asks my fiancé at the interview do I have kids of course he ll tell them I do but is this a prob ?? Will they see in the decree I have kids on tax return ??? I didn't get a RFE or noa2 either still waiting just really confused I will be asking every question on vj wish I knew about this site before I swear I will be on here for ages helping ppl with ? ... Ok so what you guys think about my kids will this affect the process ? Thanks guys

 

You are not required to list your kids at this point in the process (assuming you are the petitioner).  You only need to declare your kids when you are submitting the I-134 and it is for helping determine your household size.  Of course your kids will come likely come up in the embassy interview, but its just so that they can tell if you have a bonafide relationship or not.  Relax, you did fine.

 

Are you stating that you didn't declare children on the I-129f forms?
Because it does ask if you have children on those.

 

It asks for children of the beneficiary.  The petitioner does not need to declare children.

You have waited so far only 3 months.  The average USCIS processing time is 6 months, so this is not taking any longer than normal.

hi guys. im taking about 50 photographs of me and fiance to the interview....there is a few of me and his family. is 50 too many or no? 

 

also...i have fiance's initials tatted on my wrist which i did over a month ago and he got my name on his arm not long ago also. do u think photographs of these tattoes are good evidence? 

i obviously have mine on me so that can be easily proved but when it comes to my fiance he has posted the photo on facebook and people liked it and commented it so i took a screenshot of that, 

do u think that could be good proof? or should i not bother with this lol and it's silly?

 

I don't think 50 is too much at all, however just because you bring 50 doesn't mean they will look at all of them or even any of them.  We brought 2 albums, with probably close to 200 pictures total, and we only showed a few to the CO.

 

Photos of a tattoo don't prove anything.  It's better to have pictures of you 2 together, alone, with friends, and with family.

i have no idea,lol...do they? im wondering because we have sent in some relationship evidence with our I129F package so i just want to know if i should bring the same evidence (plus more) to my interview or no? cause we sent in greeting cards and boarding passes etc to USCIS, should i take the very same cards and boarding passes with me to the embassy?

 

Yes, the embassy receives the entire petition you sent in.  You should bring originals of copies sent in your petition, plus evidence you have accumulated from the time you filed.

So, I was anxious and thinking all was moving well

 

Apr 26, 2014 Documents filed at Lewisville TX lockbox

Aug 9, 2014  Account transferred Tx to CA

Sept 9.2014 Receive Notice Case was transferred on August 11 back to TX

 and then BAM!!

 

Sept 16 -"we mailed a notice requesting additional evidence or information in this case"

 

Called on Sept 17 and Tier 2 officer showed no information having been uploaded about the letter or what the RFE contained

 

I am en route to my partner in the DR...and have no way to receive mail or respond. Is it true that RFE are a good sign? or is this a ominous roadblock? I was concerned when case got move around the country - but I understand that is kinda normal.

I hope you will be back home in time to receive and respond to the RFE.  You have a limited time to reply to the RFE, and if you fail to respond your petition may be denied.

 

If you have a copy of your I-129F petition packet, you can scan through it to see if you have missed anything.  Other than that, its just wait for the letter in the  mail to see what your RFE contains.

You don't need to send any chat logs for the initial I-129F petition, just a few pictures will be fine.
