I'm sure it's a given but just to make explicit:

one has to be a LEGAL resident of the third-party country, to be able to do the process from there wink.gif

K-1 Fiance(e) Visa Process & ProceduresTraveling on Tourist visa while waiting for a Fiance visa
QUOTE (dalmatino @ Nov 3 2007, 05:40 PM) <{POST_SNAPBACK}>
Julezabelle, I don`t see how denying a tourist visa to me or any of people in similar situation is making US any safer. In regular circumstances I would be allowed a tourist visa - but the very fact I have a fiance there is resulting with denial.
How is that helping US to stay any safer from terrorists?

You are right - US is not obligated to permit this. But I think in 21.century it would be a shame if it was not allowed.
It is allowed in the whole world. So how it would be if US as one of the most civilized countries haven`t allowed it?
It is kind of sad and ironic that with all that progress and development and civilization today in the 21.st century people can`t see each other when they want to. But have to wait for months. Don`t you agree?

of course it's a shame, but unfortunately that's not an argument

it's a shame we have to spend money on making our homes secure because some people are thieves, but they are, so we do

it's a shame we need costly and lengthy trials because some people don't tell the whole truth even when they've sworn to, but they don't, so we do

likewise, it's a shame we all have to wait so long, and the procedure is so difficult, but some people try to cheat, and so we all suffer
the USCIS has NO WAY to know the cheaters from the sincere, other than the procedures they have in place, so the best thing we can do at present is get through those procedures as smoothly as possible
while, of course, agitating for change in any way we see fit, but then I think that's any right-thinking person's duty, about all manner of things, just anyway wink.gif

also, it's not 'allowed in the whole world'; many countries have strict immigration/visiting policies, so I'm not sure what you're getting at there

no one's at Texas anymore for K1; petitions sent there are forwarded to California, and have been for some time

where did you send your petition? so far three service centres have been mentioned; we only need Nebraska for the full house laughing.gif

K-1 Fiance(e) Visa Process & ProceduresMy fiance got bar for 5 years after deportation..
something's still not adding up for me here... from everything I've heard, a conclusion of 'intent' formed from something like that - too many clothes and personal belongings upon arrival - should result in no more than a denial of entry; there's no PROOF after all, just a suspicion... what on earth would make them add a five year ban on for that? anyone ever heard of anything like this before? I thought bans were for specific offences - visa overstays and the like

and yes, OP - all the very best with it; it sounds like you've got a difficult path ahead sad.gif

K-1 Fiance(e) Visa Process & Proceduresbaseless rumors? or is it true?
I don't think comparisons are very helpful, actually (other than with those who filed right around us); if we're supposed to 'be happy' because others are worse off, then we can ALL be happy that we're not living without clean water, like almost half the world's population, or displaced by war, or whatever... of course a bit pf perspective won't do anyone any harm, but the OP was simply checking if her experience was normal, not having a whinge

K-1 Fiance(e) Visa Process & Proceduresbaseless rumors? or is it true?
in judging the possible truth of a rumour, I always like to consider its source... so, Ursa: where did you here this about the files being transferred from CA to TX? I've certainly not heard anything about that, and it doesn't sound right to me, but knowing where you heard it would be helpful

as for the time scale - I can only repeat what everyone else has said; it's been quite a long time for quite a long time! if you want to talk to people about specifically CSC-related issues, there's a thread here - however if you start reading from the beginning, I would urge you to approach with caution, as it's a very popular thread and moves on quite quickly, so the stuff at the beginning is VERY much out of date wink.gif

secondly, if you want to see the historical trends in the processing times, go here - the NOA1 to NOA2 timeframes are the second lot of graphs on the page

I'm about to hit four months since NOA1, and I don't expect an approval for at least another month... probably more like two; it's just how long it's taking these days, unfortunately
StillThePrettiestFemaleAustralia2007-11-09 01:27:00
K-1 Fiance(e) Visa Process & ProceduresOne Question
I don't know, Rob & Jin; I see your point, and it's good, but surely this is where we come down to that VERY tricksy notion of 'intent'... if someone is coming to visit his online girlfriend for the first time, and IF they get on well THEN they will consider marriage, is there intent at the border? I would say not... whether immigration would see it that way is another issue, but I would say that at the moment of entering the country the person could sincerely say that they have not arrived for the purposes of marriage

of course I will hurriedly add the disclaimer that this is me thinking aloud more than anything, so the OP should make up his own mind (after extensive research!) and NOT see what I've said above as advice, but it's an interesting one, with more legal 'outs' than most of us have had

K-1 Fiance(e) Visa Process & ProceduresHow to get K-1 urgently? My american fiance is in hospital!please HELP!
if he filed in July I would have thought he'd have had a case number by now... you say you haven't even got an NOA1? that's very strange, as you say

who was the appointment with, that he took the attorney to?

regardless, if any case is worth a medical expedite, this sounds like it... I sincerely wish you every success in this endeavour; I can imagine you're going mad knowing that he needs your help in such an ongoing way and you're not able to be there for him... I hope it works out for you, and quickly smile.gif

K-1 Fiance(e) Visa Process & ProceduresRegarding moving from Australia to the USA.
if you're using an Australian passport, you should be able to enter the US on the visa waiver program... there are no guarantees, of course; if they suspect you're intending to stay, they could turn you back at the border, so make sure you watch what you say, particularly about your boyfriend... a few bits of evidence tying you to Aus (rent statements, a letter from your employed saying when s/he expects you back at work, etc) would be good too
StillThePrettiestFemaleAustralia2007-11-23 08:48:00
K-1 Fiance(e) Visa Process & ProceduresRegarding moving from Australia to the USA.
no go, unfortunately; you MUST have met in person within two years of when the I-129F is submitted; there are waivers on religious grounds but they're close to impossible to get, from what I hear

seems like you should make your trip in March a visit only, and then go back home to Aus to wait it out while your fiance files the I-129F on your behalf... this is surely prudent behaviour anyway; much easier to know whether you want to spend your life with someone when you've actually met them, however well you've gotten to know them over the net and phone wink.gif

you'd do best to start with the new members' guides, found here
they contain links to FAQs, visa comparisions, and all manner of information you'll be needing...

when you've read them through and you have questions about the details, then you might want to continue asking questions here... otherwise everyone's just repeating the information that's already there smile.gif

all the best with your petition smile.gif

K-1 Fiance(e) Visa Process & ProceduresHELP!SO CONFUSED!!
the post is not difficult to follow; and clearly the OP's first language is not English
perhaps you could keep that in mind

there are only a few 'it's, and to me they're used perfectly clearly - she applied for an extension of the tourist visa; got an extension of the tourist visa; applied for a second extension, never received a paper copy of said extension, but called USCIS and they said the extension was granted, and the website backed this up
therefore the problem the OP is asking about refers to the absence of a paper copy of the approval for the second extension of the tourist visa, despite being told verbally that said extension had been granted, and receiving the same information from the website

there! no 'it'! I hope that's helpful

logitech, I strongly recommend you fill in your timeline; while by no means foolproof, it will give you some broad indication on when you should expect your NOA2, based on other people's data... you can search timelines for information about others in the same timeframe as you (use the 'Immigration Timelines' link at the top of this page), and there are threads specifically for filers by particular month, as well as service centre, in the sub-forum of this section

hope that's helpful smile.gif

...his belongings... can only come with him or after him - not before and he has to provide the shipping company with a copy of his approved visa and the I-94 document that US immigration put into his passport when he enters the US.

where did you get this information? I've done extensive enquiring and it's the first I've heard of that...

K-1 Fiance(e) Visa Process & ProceduresProcessing times- CSC vs VSC
I'd be VERY surprised if there was still a '2½ month difference in timing'; everything we've seen in the last few months would indicate that the wait times are approximately even now, as Dan + Gemvita said...
StillThePrettiestFemaleAustralia2007-12-07 12:34:00
K-1 Fiance(e) Visa Process & Proceduresjust curious about timelines
I think it's also worth remembering the sheer scale of the job here - with literally thousands of files, and multiple adjudicators, working at different speeds and (as said above) each encountering different things that take more or less time to check with each case, it's just impossible for cases to get processed STRICTLY in the order they were received... I think they do a pretty good job of keeping it fair, but there's bound to be some small discrepancy, and I have no problem with that; it would probably take more time to keep them all in strict order than to just process them wink.gif

using VJ as a guide, the service centres seem to be processing petitions from a six week period at any given time, with a few laggers from earlier on... for example, it seems to be late June to early August just at present smile.gif

K-1 Fiance(e) Visa Process & ProceduresGet the Ball Rolling?
I always used to think that having an 'official' engagement was a bit nonsensical, if the two people already knew what they wanted - and in some ways I still think that, for people who live in the same country/city/house... but for people in our situation it can make quite a big difference (such as that between saying 'yeah, let's go for it' over the phone, and having a lovely white gold and garnet engagement ring put on your finger at dusk, on the Charles Bridge in the middle of Prague, on your fiancé's birthday laughing.gif wink.gif )

K-1 Fiance(e) Visa Process & Procedureswhat's exactly the difference
it's the subject of much study, and in fact there has been a call for papers on the issue

submissions so far have included speculation on whether it has to do with:

- whether there's an R in the month

- the phase of the moon / state of the tides / possibly both

- something about birds flying south for winter

- an 83 year old woman called Edna, who lives in Florida; if she wins at bingo there are approvals that day

- a magic dog (one of the more out-there theories)

- a 'lucky dip' type arrangement, where all the files are thrown into a central pool, and then USCIS employees use one of those crane things like you see at funfairs to grab one out

if you have any thoughts on the matter, the deadline for submissions is April 1 smile.gif
