Hi all. Our petition was lost before and sent another one to Vermont Office the other day. They better not to lose it this time.
I noticed some people mentioned they received email notification before receivng a hard copy. Does it apply to anyone who put an email address on I-129F?

No, you sign up for an account on USCIS.gov and enter in your case number (the one on the back of the check that is cashed or you can get it from your NOA1) Then you can check the status online of your petition.

Best of luck smile.gif

Quicker isn't always better and in this case...your gut instinct is probaby right...you even wrote "Scary" in the title...

K-1 Fiance(e) Visa Process & ProceduresDated Pictures
I literally just wrote on the back of each one and then put the 6 or so pictures in a zip lock bag and stapled the bag to a piece of paper.

No bonding, scrap booking, labeling, etc. (You can if you are bored though) Make it easy and quick for them to view the picture.
Simply writing on the back is sufficient.

my problem that i have no pictures betwen me my fiance and my family we have pictures with each other no more so i want to know if that will make a problem in my interview or no?

It may...
Depending on how strict the embassy is where the interview will be taking place, they may require to see pictures and since you have none...it could pose problems.
Will you be seeing one another between now and the interview? If so, bring a camera and snap away smile.gif

K-1 Fiance(e) Visa Process & ProceduresMoving to the US while waiting for NOU2
Be prepared to spend some time apart.

If you must go back in August, then he cannot follow you. He has to wait in Canada. When you are approved your NOA2, he then must start getting documents for the interview, like his police report, medical exam and then he has to attend the interview and it must be in Canada.

As Kathryn said, his belongings cannot enter the States before his move.

He can visit you while you wait, that's not a problem but he'll need to show ties to Canada, like a letter from his employer stating he's coming back to work, mortgage or rent agreements showing he still has financial responsibility in Canada.

Our entire process took just over 6 months. We filed on December 5th and I got my visa in hand on June 27. This is the legal and right way to go about things. It's so worth it....6 months compared to the rest of your lives together is nothing.... I haven't seen my Nick in 4 long months...he arrives Thursday and then we drive down to begin our lives. luv.gif

Stay strong, visit when you can and find patience.

I wish you much luck!!! star_smile.gif

I know My petition was approved because I received a letter from the NVC saying that they received an approved petition and that they would forward it to the proper embassy.

and about the NOA2 letter, I called and they said it would take a month for them to assign a person to my case in order to resend the letter. So who knows.

You will need the NOA2 to adjust status for the green card.

Hmm....I hope they work it out quickly for you!

QUOTE (Gemmie @ Jul 16 2008, 09:01 PM) <{POST_SNAPBACK}>
Part C (questions 2 and 3) is about criminal convictions. How are you supposed to answer if you have none since it's just check boxes?

We left it blank and don't want a RFE...

You will most likey get an RFE.
Question 2 specifically states:

Have you ever been convicted by a court of law (civil or criminal) or court martialed by a military tribunal for any of the following crimes:

*gives list of crimes here*

Then it has a box that you check either YES or NO.

For no criminal convictions you would have checked NO. Be prepared for an RFE.

Good luck.

QUOTE (Kazan @ Jan 17 2008, 02:17 PM) <{POST_SNAPBACK}>
Look like this has been well covered! I laughed too when I first saw the Embassy juggle with it. She is a non-immigrant but when you marry and go to adjust status she will be now immigrating. So they are saying, treat the K visa like an immigrant visa without the official title.

I believe it really is.

It's a one time entry visa on the purpose of getting married and living in the states. What is that other than immigrating to the States?

Work visas, travel visa, etc. are non-immigrant visas, you aren't intending to live there permanently, just stay for awhile for work or visiting.

Moving to another country to marry or because you are married and staying there, to me, indicates immigrating to the U.S.

I think they need to change the definition.

smile.gif

It's non-immigrant with immigrant intent. If it was "really" an immigrant visa, then no AOS would be necessary.

In order to be classified as an family based immigrant visa (and qualify for permanent residency upon arrival) you must establish a qualifying family relationship... For an I-129F petition for fiance(e) that is not possible since no family relationship exists... therefore it can only be a non-immigrant visa..... It is not stupid it is actually quite logical. If not I presume we would see incredible abuses as the possibility exists that many would enter, get the permanent residency and never marry....

Also true, I never thought of it like that smile.gif

The whole entire grounds of coming here on the K1 is to get married, that is what you are swearing to do when you file. It's stupid.

Yes, you are swearing that you'll get married in the U.S. but that does not necesarily mean you will reside in the U.S. after the wedding. After you getting married you could as well decide to go live on the foreign fiance's country or move to a third country.

K-1 visa allows a person to enter the country marry and then adjust status to immigrant, they are not an immigrant unless they marry, file adjustment, and receive green-card. Immigrants receive green-card NON-Immigrants do not.

QUOTE (Danielle-Justin @ Jul 23 2008, 11:10 AM) <{POST_SNAPBACK}>
That link was helpful, except she lives in Nova Scotia. However, I was able to send her here and she's taking care of that.

So its a Canada-wide background check, thats it...thats all she needs to say? And a printout or form will be given to her afterwards?

One other question while I'm thinking of it, what are the general accepted forms of evidence for I-134? I only ask because I was hoping for those that have made it through the interview, especially canadians, and what they brought.

I know that this sticky is helpful, but just want some further clarification.

Duh, I just assumed she lived in Ontario, sorry about that! LOL

As for the background check, it will take a few business days and then she will go back to the station and pick it up. They will charge for it as well. Mine was $25.00.

As for the supporting documents for the I-134 just check out the guides Here and read up on what to send her after NOA2. We used a letter from Nick's employer, some pay stubs, 3 years tax returns, a few bank statements, etc. At the interview, they only took the I-134 and the letter from Nick's employer. They didn't want the rest but I would bring it anyway.

K-1 Fiance(e) Visa Process & ProceduresLong-form and police check - Canada
Yes, what she wants to get is a criminal background check, name check, it's all the same. It's surprising that the lady at the station would act all vague like she didn't know. If your fiance explained what she needed it for, it shouldn't have been a problem. She wants a Canada wide background check.

To your second question, yes, she needs the long form. So she wants to visit Here, she will request the long form birth certificate and they will mail it to her. She'll need to fill out some info online in order for her to get it.

Best of luck. smile.gif

That type of thing is totally secondary. You should take them to the interview. At the I-129F petition stage, they just want to see proof that you have met at least once in the past two years. Boarding passes, itineraries, stamps in each others passports, hotel receipts, car rental agreements, copies of credit card statements showing you have been to one another's country, etc. etc.

Nick and I did add 2 cards in our initial petition, I photocopied them and kept the originals. I also put in about 6 pictures and 2 emails.

They also don't like any jewelry, anything that will reflect light basically.
Also, beware of shimmering eye shadow make up, again the light factor comes into play.

You really can't tell what you are wearing on top, a plain tshirt is just fine and tuck your hair behind your ears if it is long.

You are absolutely right... I shouldn't need to lie.

"You didn't have to know your fiance for 2 years prior to filing, many people get that mixed up." --- I got this mixed up.

I met her in Dec 2006 and filed a petition in March of 2007, that was perfectly the right timing. I thought I have to meet the person in 2 yrs that is mainly the reason why I lied. I know that I am a badddd liar.

This thing is very highly sensitive but as a first time petitioner, I am so clueless and didn't understand the procedures. I didn't read much on this board before going doing the steps. Now, it is a baddd mistake. What is the correction to this prob? Will I need to refile and forget the old one?

Thanks.

Sweetheart, I'm sorry.
You must be completely beside yourself. It was a mistake, mistakes happen.
Take comfort in your fiance, in your love, in your relationship. Work through it together.
I don't know what will happen now. You could get married and file for a K3. I have seen people who were rejected a K1 and successfully file a K3 or CR1.
You may want to wait it out though, you could explain to them you misunderstood the requirements. They may be lenient.
I wish you all the best in whatever direction this journey takes you.

K-1 Fiance(e) Visa Process & ProceduresFear of it not working out
That is the risk of long distance love when it finally comes time to be together.

Follow your heart. If it works, it works and you'll be happy. If it doesn't, you'll pick up the pieces and move on and eventually, you'll be happy again.

Don't you think she's worth that risk?

If we treated everything in life that way..."Oh what if this happens, what if that happens, I shouldn't do this because this could happen"... etc. etc. etc. we'd never get anywhere or take any chances and we wouldn't be happy. Some people don't follow their hearts and they heed to their own fears and end up living a life that they don't want.

Take the risk, follow your heart and keep true to you. Only you can make you happy and if you both want to be together, you both just have to go for it and work each day to make it work.

All the best.

Different POV.

It never hurts to have a consult with a COMPETENT immigration attorney. We did.

A good attorney who knows their stuff will consult with you for a nominal fee or sometimes no fee. Some will do phone consults. They know the 'right' questions to ask you about your life and your relationship - the questions posters on VJ might not be aware of that may yield a 'devilish detail' about your case.

We consulted with an attorney prior to filing. He told us we didn't need him. A good immigration attorney will tell you likewise if they detect nothing inordinate about your case, because they are too busy working for people who really need them to try to 'make a fee' off those people who can handle the paperwork independently.

A quick consult is always good peace of mind to have.

If the lawyers only serve to complicate matters then it's gonna be best to do it ourselves.
