No. As a divorced alien, you will be applying based upon having been a permanent resident for 4 years and 9 months.



We did have a post not long ago from someone who applied after 5 years because she (I think it was a she) and her husband had gotten divorced after the I-751 was granted, and at the interview the AO told her they needed her to submit all that proof that the marriage had been legit, and that they have the right to review all past decisions (like her K-1 and her green card) at the time of adjudicating the N-400 in order to make sure she hadn't committed immigration fraud at any time in the past.

Actually in my case, its kind of complicated, I used to have a sharing account with my husband, and he abused it by deposit a fraud check in and took away 3000 cash from the bank, even now it is still negative balance on the account.

and recently, the detective just called me regarding this case, my husband may be physically arrested if he doesnt return the money to the bank. (I was also finacially involved due to my name is also on the account, but the main reason police came to us is due to the fraud check)

I really hope we will be fine since at that time when we got married, he was a fine person. It feels so hurting to look back...

I was wondering

1. he is unemployed right now, will this affect the I-751 application?
2. if he is physically arrested, whats going to happen to me?

I've been in this forum for a while, and posted twice, including this time:)

I have a question regarding the I-751 filing dates, in my case

my 2 years card was issued on August 26th 2005,
so I'm going to submit my I-751 on May 26th 2007, which is the first day of my "90 days" period.

I read some good luck fellows had their I-751 approved in 2 or 3 months, I was wondering does this "2 or 3 months" including the 90 days period or not?

In my case, if I submit my I-751 by May 26th 2007, does that mean if I'm luck enough, my application will be approved around August 2007? or even if I sumbit all my paper work the first day of "90 days", I still have to wait until August, then my I-751 will be reviewed?

Long time, indeed!

First of all, please use the date calculator mdyoung gave you to find the CORRECT date to file your petition.

It is very unlikely that your I-751 will be reviewed immediately or even within that first 90 days, but there is NO WAY to tell. When the Service Centers devote some time to I-751s, they will suddenly speed up. Then they go to work on something else and I-751s slow down again.

You should expect that it will take 3-18 months for your I-751 to be adjudicated. Your status does NOT expire during this time; yoiu must keep your expired card with the extension letter you recieve and just wait. There is no way to track your individual case online or over the phone, so you just mail it and wait.

People are receiveing different instructions and there is no way to know which ones will apply to you. Watch your mailbox and respond to ANY letter you get from USCIS and follow their instructions. It's not rocket surgery, but you have to follow their directions.

If a year goes by and you want to apply for US citizenship, you may do so even if you do not yet have a decision on your I-751.

But please, mail it in the correct dates---if you send it in too early you have just thrown away $205 that could go to charity. :)

I have another question, its regarding the credit card statement.

I added my husband's name under my account, so he also got a card as an authorized card holder, but his name doesnt showed on the monthly statement, so I was wondering except the credit card itself, what other evidence regarding this we can show to the immigrant office.

(PS: if anyone here remember me, probably know the reason that I can not have a sharing account with my husband, thus, credit card is probably the only financial prove I can show)

Hello, all:

I just have a complicated problem.

Finally I solved some of the problems I had with my husband from last year, and now I got a new problem...

just few days ago he admitted to me he made someone outside preganent...for almost 5 months!!!!!!!

I know that girl, she's been friends with us since I know my husband...it's a long story...

Anyway, this time there is no way I am able to keep this going. We talked night after night, and finally we both agree we will wait until my condition has been removed. finally we used to be the cloest...

the situaltion now is

I'm going to submit my I-751 package after May 24th this year, which is few weeks from now. The baby will be born around April.

We both are not very sure
1. is the birth of the baby going to affect my case?
2. if it does, in which way? (does the baby has to get a birth certificate as soon as he is born?)

I'm so overwhemed now and can not think about any other issues or problems...

Anyone can give me some suggestions? I really appreciate that.

I was told that the total income for me and my husband has to be more than $30000, I'm not sure if that has anything to do with our I-751 filing, because my husband lost job last year, and I worked part time, our total income may not be able to reach $30000.

What do you mean by how is the format organized? I made a cover letter (there are examples in the sticky post) and listed all of the evidence. I then organized it with the cover letter on top, then the actual application, then the evidence in same order as the cover letter.

Is that what you are asking?

Oh and yes to copies. I do send in actual photos though, because its just as easy (and I get doubles free usually) and I don't have a color printer.

Hello,

I have a question about the credit card statement.

I have my husband added to my credit cards accounts years ago when we got married, I was told credit card statements can be evidence to submit, my questions is my husband's name is not showed on any of the credit card statements. I called the credit card company, they said they will only have the main account holder's name in there,

1. in this case, I guess I can only submit the copies of our cards instead of the statements, or any other way I can show them?

2. I read some threads, people were talking about letters from credit card company, I was wondering what type of letters do we need, what letters the card company will be able to provide?

3. we are going to submit packages by the end of May, we brifely went through what we have so far...
we have

joint tax statements,
joint health insurance,
joint utility and phone bills,
Lease agrrement,
joint credit cards,
AAA cards,blockbuster cards...so on
Photoes with my husband's big family
support letter from friends
greeting cards from parents and friends
Misc....

what we lack of is join bank account statement from 5/06 to current, (we only have our joint bank account statement from 8/04-5/06) due to some reasons, we are unable to have a joint bank account together, will this cause a problem, any suggestions?

we travelled to Chicago few months ago together, I was going to attach that as an evidence. My question is we booked our tickets online, and we dont get the regular tickets excpet half of the checking receipt, I was wondering what shoulde we submit, is that half check in receipt enough? (it has name, dates, city, gates, time and seat number)

do we also have to show the tickets order confirmation printed from internet?

I was oversea for the past a few days, and got email notification about card ordered on 7/18
then on 7/20 got email saying approval letter has been send out, on 7/23 I received my green card.

So far I did receive my card but havent got the approval letter yet (which was send out on 7/20 based on the email), I was wondering if that matters?

Are they actually in the Bank West building by the intersection of E 17th St. and N Main St.? It looks like they only have underground parking, did you find parking spots easily? it seems they always have weird processing updates. offically was told they are processing December cases, but folks send over cases during Feb and March 07 mostly got card within 2 months or 3 months...and then CSC seems getting slow down again after eastern, dont know if anyone send over April got proved recently.

getting NOAs and Bios doesnt gurantee without interview. But I think it will be fine
for most of the cases, since interviews happens rarely.

It seems there are two offices in orange county CA, one in Santa Ana, one in Laguna Niguel,
It seems some people filed in Santa Ana, while others filed in Lagua Niguel. We live in
Anaheim and yet we filed with Laguna Niguel. I just what to know if that makes a diference?

Good question. But I thought the address provided for CSC in the instructions of I-751 is Laguna Niguel.

Any way, updates from us: package re-delivered to CSC on 06/11/07, check cashed today. I can see a receipt number written on our check, but I still can not track case status using this number on USCIS website yet. Any body possibly know why?

The receipt number on the check is different with the one u'll get later from the NOA, and the one on NOA is the critical one for future status tracking.

Update: our package got returned today :crying: , bcoz we mailed form I-751 revised on 8/1/2006, and there is a new version revised on 2/5/2007. Husband downloaded the form a couple of months ago. We were so focused on getting all the evidence together, did not even notice there is a new version. sigh :(



It almost happened on us too, we took our package to the law office and then they refilled the form for us due to the one we had was the old one.

Just resend it and wait for few days more, it happens, you will be smooth in the following "transactions":)

Hi tomjerry,

Can you ask your attorney whether they mailed it with priority or certified mail? I think usually you will get a tracking number either way. But it has been only a few days, I don't think there is any thing to worry about.

I was told we suppose to get a receipt from USCIS as soon as they received it, usually you will get sth like that after 2 or 3 days after filed. We mailed out our package on May 29th, till today we havent got anything yet.

Nearly 6 years ago, my fiancee spent a couple of days in a psychiatric facility. His business and first marriage were failing and smoked pot, staying up for multiple days, all of which resulted in his hospitalization. During his medical exam, he answered 'no' on the questionnaire because he panicked. But he did mention his hospitalization to the doctor during the medical exam, saying it was for depression - which it kinda all boils down to. He was told he'd need a psychiatric doctor to meet with him to ensure he wasn't a threat to himself or others. In reviewing the medical notes from the hospitalization, the psychiatrist said he'd have to include the marijuana use in his report but would try to phrase it as favorably as possible.

He is going to call the clinic that performed the initial exam and ask if he can change his answer on the questionnaire because we don't want to compound the problem by lying. (Anyone know if that's even possible?)

Based on your experience, what does this mean for us? Will it be an automatic three year ban because he used pot ever, not an issue because it was more than 3 years ago and he hasn't used it since, or a permanent ban because of the connection to a psychiatric episode?
