I've been following your posts for quite a while and just want to chime in once again.

I don't think you should worry about Anh's name in I-94 or her K visa, you guys are over them now and her I-94 and K1 (?) visa will not be valid for any much longer anyway.

If she wants to change her last name, the AOS is the time when she can do so. Just put whatever name she wants in the AOS form and once she gets it approved, the GC will come in the new name. The copy of marriage certificate (even if it doesn't come with the new last name) will be sufficient as a proof of her new married name.

Same ordeal with EAD. The only thing that's a bit confusing here is her SSN. Since she already got an SSN (I believe she got this before you guys got married ?? ), then I suggest you guys to go to the nearest SSA and show them your marriage certificate and ask if she can change her last name. Just make sure that the new name will match with the one in her AOS and EAD paperwork.

Other option is send the stuff using USPS. More risky, but almost no charge to the receiver. Hubby sent me webcam using USPS when I was still back in Jakarta, it arrived safely in 10 days and I only had to pay around Rp 4,000 (40 cents USD).

Sending package using FedEx, UPS, DHL will always cost the receiver a fee. I think they called it "importation" fee, the amount depends on what type of things that you send. Cost me around $4 when hubby sent stuffed animals (3 of them), I believe more valuable things will cost more.

Correct me if I'm wrong, but I don't think you can 'transfer' your case from Montreal to Vancouver or vice versa unless maybe if you move ?? They have their own jurisdiction based on where you live, Vancouver handles cases from the west part of Canada and Montreal does the east.

I called them and got my receipt number from them. They told me that my petition was received on June 20th and that is when they mailed out my receipt notice. When I told them I haven't gotten my notice in the mail they told me that I can't file the 129-F without proof of the reciept notice ( which I have never received) I asked them if they could send me a copy of it and they said probably not and that it would take 30 days if they could. I also asked them if there was a way they could track the mail and they said no. They told me that since I live in an apartment complex that I might not get the immigration stuff because my name isn't on the mail box.

####### am I supposed to do now? Snail mail usually doesn't take 7 days ( or does it) so it seems like I am SOL.



This entire time I have been checking the mail and not even realizing that it won't be coming here.


Not to burst your bubbble, but I <mistakenly> hired a <worthless> attorney for a K1 years ago, and although they acted as my Agent, I still received copies of everything direct from our lovely Government. Maybe others can chime in on this, but I am sticking with you still getting the NOA1 and in a short while I am sure....


I second that. We hired a lawyer for our K3 process (he is an extremely good one though :thumbs: ) and we got all the "original" NOA and our lawyer got "copies". I think the NOAs that USCIS sent to our lawyer had some words like "this is the copy for the official attorney/representative" or something like that.

My suggestion would be to check with your lawyer and see if he/she receives it, but keep inquiring to your local post office and USCIS to get one for yourself.

To the OP: I hear ya... my hubby also never did any research about this whole immigration process, he just relied on my info and our lawyer (when we did K3). His excuse was that he was always tired, he worked hard all week, etc etc, so I can understand how you feel. I think men sometimes just do things differently than we women do, they take things not as seriously, so sometimes this can come across as "lack of caring". My advice will be try to relax and not to worry too much... (F)

Oh, and like everyone else here has said, USPS is not really that bad, takes usually 3-5 days for regular mail.

Sorry to hear abt your problem. I agree that UPS sucks !! Never really had "major" problems with them, but they seem to be the only courier service that cannot find our apartment address for some reasons. One time they even sent my husband's packet to his ex-wife's home saying that that's the only address under my husband's name that they could find in our state while my husband has lived in his current address for over 4 years !!! :wacko: Good thing that his ex was nice enough to keep the packet until we can pick it up.

For international, definitely use FedEx or DHL ! I think there are some rumours that for FedEx is better for US shipments and DHL is better for Europe, but I tried them both shipping back and forth from my home country to US and never had problems !

In this case filling as single won't get him too much into problem as he won't be owning IRS anything, if anything else and he has to change his status to Married while being audited, IRS actually would have to send him a bigger refund check assuming his wife overseas income is not overboard like being in (UK or EU countries i would say, but for most other countries i doubt the spouse income will be high enough to create any major headache)

Filing single while you are married will only put IRS in advantage. My income back then was not high enough to even be considered here. If they audit us, we will be waiting for them to send us some checks. I doubt that they will though :P

Filing married while you are single is another story.

My hubby filed as single during our K3 process, mainly due to his "laziness" of getting the ITIN and stuff :P No problem at all with IRS or with USCIS. When we did AOS, the officer didn't even look at the filing status for the previous year, she mainly concerned with how much he made and how many dependents he had.

There are some advantages of filing married, even if it's separately, but I just want to share my experience that we didn't have any problems even with filing single.

I second what Yodrak said. We were married in Canada and my K3 visa was issued by Vancouver consulate. Howerever if you choose to wait for the IR1, then the visa (and interview) will be done in the country of citizenship.

I also got denied for B1/B2 visa prior to my K3 application. During my K3 visa interview in Vancouver, the officer didn't even look at it and didn't ask any questions pertaining to this denial. I did check the box indicating that I was denied a visa before and didn't encounter any problems. My advise is just try to relax and be honest. Good luck !

Congrats for the visa ! I went through Vancouver for my K3 and they were very nice and responsive to my inquiries. For AOS, make sure you keep copies of all your docs, and keep the vaccination paper too (I mean the one that they gave you during your medical). I submit a copy of my vaccination paper that I got from the doctor in Vancouver and went in smoothly in AOS. My AOS interview is less stressful, at least hubby were there with me, and I spent longer time waiting in the consulate than in the district office.

NVC forwards your documents to Montreal, since you are filing for a K-3. Vancouver does not handle K-3 visas. So, no, you do not have a choice in that one, sorry!


Last time I checked, Vancouver does handle K3, in fact I got my K3 from Vancouver. The only thing that Vancouver does NOT do is CR-1.

I cannot speak for K1, but I think it should be the same with K3. I got my K3 from Vancouver Consulate, went home to Indonesia to resign from my job, etc etc, then flew to US. No problem at all. I would say you can enter the US from wherever you want regardles which country issues your visa as along as it is genuine and valid.

AFAIK X-ray envelope is never sealed. Just don't open the one that said "DO NOT OPEN" and make sure you take it with you in your carry-on luggage. When you arrive at the POE, you will need to give this "do not open" envelope to the POE officer.

I agree with what other posters suggested, it might better off if you move to Canada, maybe stay there temporarily to visit and take care of your fiance ? I don't think his illness will prevent him from immigrating here, but you might want to consult with lawyer to be sure.

I had my med exam in Vancouver, it was a male doctor at that time (not sure if they have other clinics now). No in-depth exam, and there is a female nurse with me inside the room the whole time I had my exam. They also gave me a paper sheet to cover my whole body after I undressed, nothing "exposed"... :)
