Hello All!

This is my first post here and I have much to ask about. I have an appointment at the embassy next week to submit my I-130. However, there are a few things I am not sure about. I hope someone here can help me.

1.) Can I file the froms I-485 and I-765 with form I-130 if I file them all together with the form I-824??

2.) If I can submit them together, what do I write on I-765 where it says "current visa status" and I-485 for visa issue date?

3.) On form G-325, the year boxes have 0000 inside them. How am I supposed to write a year clearly with these graphics interfering with the view? Can I white them out?

4.) If I recently was married and have not started to use my married name (having not submitted anything to the government), should I use my maiden name?

5.) In general, how does the petition work with I-485 etc.? Can he enter once I-130 is approved, then waits in the USA while I-485 is processing??

6.) All the medical tests will be conducted before he can come to the USA, correct?

7.) After all is said and done, THEN we submit I-751 and I-94 when he is in the country and a I-485 has been processed??

8.) For the joint sponsor on I-864A, do I need an original copy of their birth certificate? or is a photocopy alright?


Thank you ahead of time to anyone who can help clear up all this confusion.....

So maybe someone here may understand if there is something i can or should do??

Originally I attempted to submit my I-130 at the embassy abroad, i was a resident of the country for 2 years and only JUST left the country to return to the USA. so i sort of qualified for submission. however, once i attempted to submit, the embassy employee decided to reject my submission and told me to submit it through the US. :crying:

The thing i am wondering about is this:
The embassy employee told me on the day i attempted to submit, "SOMETHING has been processed here today at the embassy."
When I asked what, he gave no answer. it was also very noisy at the embassy and he was a low speaker.
Next he said, "You will be contacted." I asked, "WHEN??" again he gave no answer. and i could not hear anything he was saying. :wacko:

So, something was done, and someone would contact me. but everything is a big question mark. Who, What, and When? Anyone have any clue what may have been done?? Does anyone know if i should try to call the NVC to ask about this, or call USCIS?? if you call the embassy they make you use a 3rd party phone service and pay money just to ask visa questions. :help:

when you filed your taxes every year abroad you have to claim your income but it is not taxed by the us gov. you should have done the 1040 plus and extra sheet (forgot the name) that you would have written your japanese income on. that would be your tax stuff. i assume your income is at least or almost $30,000 in japan. which would be enough. i think.

just bring photos of your wedding, with families, and other vacations etc. stuff that shows you have been together a long time.

and the embassy will be REALLY busy on the visa days. so be ready for it.

Does anyone know exactly what they check for at the physical exam?

i imagine, blood tests, std tests, if you are over weight etc. and then your immune records or course.

but do they check for medical hisotry things? do they check for things like stress?? what medications you are on?
do they check into all conditions you may have? all doctor visits and records???

does high blood pressure or liver diesease disqualify you???

Hey Everyone!

I was wondering if anyone can elaborate to explain when this happens?

If you married abroad, then submit an I-130 Petition, when will your official status change to "married"? That is, if you have not gone and registered the marriage or anything in the USA.
I would like to know how long or when you are officially seen as married for reasons like bank accounts, credit cards, tax returns, and health insurance etc etc.

Will the status be changed by the government when your spouse receives their visa abroad? or when they enter the USA at the POE? or as soon as they are issued a SS number?
Are you responsible for changing your status yourself???

If anyone can help clear this up it will make my life MUCH easier!!

yes, you really should look up the basic guide.
there are 2 sets of packages you send to the NVC. AOS and IV. Pay them and follow the online instructions from the government site.

most places you have to send the PCC to the NVC who then forwards it to the embassy. that may vary from country to country.

i translated the birth and marriage certs myself from japanese to english.

it does not really matter too much who does it as long as they sign and certify it.
you can also take your translation to a lawyer or police department and pay money to have it notarized.

we only notarized our marriage cert at the tokyo usa embassy.
the embassy website also had downloadable translation forms that all you had to do was write in the information. it was really easy.

see if the embassy website has that for you too!

the tokyo website translation forms you can download are not complete 100% every line of translation. it was fill in the blank. some stuff was omitted and they accept that. but that form came from the embassy itself so they have to accept it.

we also got some mail 1 month after we had finished all the paperwork. you don't want the paper stuff from NVC because it takes them a long time to send it. email is best.

but as long as you pay the bills online you should be okay. you can print the cover letters online too.

transcripts are best to do because you use a LOT less paper. and you can request multiple copies of each statement so you don't have to photocopy anything. if you have time do the transcripts

make sure it's state and fed returns :)

like others say, don't expect anything less than 5 months. the fastest the USCIS goes is usually about 50-60 days. that is if that goes fast. most people take closer to 100 days at the USCIS.

you can get through the NVC is about 1 months if you have all your documents ready early and sent in right away. and if nothing goes wrong. odds are there will be some bumps in the road though.

estimate about 7 or 8 months.

i checked 4 days before the AVR date and saw a tokyo package at that time. nothing else went to tokyo for days and days after the AVR date.

until you are married you cannot file for the CR-1 visa (green card for spouse).
you can apply for the fiance visa, but it takes almost as long and costs money.

and if you currently have not applied for any visa you can come and go from the usa at your leisure.


maybe your fiance can go live with you for awhile in canada. if he meets a residency requirement maybe you can file in canada and the process would be a LOT faster. check your local embassy to see what you need to do to file there. it is highly advantageous to file abroad if you qualify.

if you wait a day or two and call the AVR it should say case complete! you can also call and confirm with an operator if you like!

you usually do not submit the AOS until NVC i THINK. but sometimes the USCIS may request you to provide it if they feel like they need to see evidence. i had submitted my AOS to the uscis, when apparently i did not have to.

you can claim assets like a car, house, and i think savings.

a co-sponsor can be anyone, parent or sibling, friend, etc. as long as they make enough to meet the gap.
