You may also want to look at attorney Laurel Scott. She is very good with waivers, and her prices are fair. She does a chat each week where you can ask questions for free. I know of many who have used her and have nothing but good things to say about her. She also has financing available.

I know that most lawyers (who are experienced with waivers) charge upwards of $5000. Don't bargain hunt if you need a lawyer for a waiver. I did my husbands waiver without a lawyer, and depending on the reasons for the waiver, it can be done without a lawyer if you don't mind the work of gathering information.

My hubby had been to the USA many times prior to us filing for his visa, but in trying to cross in Dec 2002, he was denied. We did the process from Canada,with me there with him quite alot of the time. Since we had been married since 1999, that may have made things somewhat simpler in proving the validity of the relationship.

All I can offer is that my hubby had an issue back in 1988, and although he did not apply for a Canadian pardon, I successfully filed the I-601 waiver for him, which enabled him to receive his spousal visa. You should go on and file for your visa and research as much as possible the I-601 waiver.If you feel comfortable doing the filing and documentation yourself then by all means go for it. if you feel more comfortable with a lawyer make sure to find one well-versed in waivers.Keep in mind that Canadian waivers filed at the consulate for the fiance and/or spousal visa are sent to the Vermont Service Center which is rather slow with waiver processing.

Ah. I think I see...

You waited a good while for your NOA2 and interview and the visa was denied (for reasons you don't need to rehash here) but there were medical issues. If you don't mind, who had the issues? The USC or the beneficiary?


My mom (I am her caretaker) had the medical issues. I was back and forth between the USA and Canada and my full-time presence was needed to care for my mother. Due to that I was unable to work, so my husband was supporting he and I from Canada.

BTW..I knew from the onset that the visa would be denied and hubby would need a waiver. I enlisted my senator from the start of the process, and informed him that when I got to the waiver I would be requesting an expedite. IMO if you have compelling reasons it is essential to get your senator (congressman was useless..tried him first) involved early. Too many people wait until the last minute to get their elected rep imvolved. I was in contact with the senators office for almost a year leading up tp the waiver filing, so they were well-versed in the particulars of our case.

I got an expedite request approved for my husbands waiver due to severe financial hardship and medical issues. I asked my senator if he would submit the request. He agreed that we more than met the criteria for an expedite, and he recommended that it be granted. I prepared the expeidte packet with the suporting evidence and my senators office submitted it for us.

Thanks, good to know. Next time I make it into Atlanta proper, I will stop in at a Publix. I know that the ones here in Stockbridge/Morrow/McDonough/Forest Park area that I have been in don't carry them. Ah, crumpets! hehehe, or I may just drive to Locust Grove again - it's closer than Atlanta and I can take back roads there and back and not have to worry about I-75 traffic;-). Again, thank you.

It all worked out great in the end, so no problem. MTL was super nice about everything when we went to the interview. I had the waiver prepared so at least I didn't get shocked by not knowing about the waiver and denial.


Luckily for us my senator was able to expedite the waiver. Next week hubby goes for citizenship interview!

Hubbys waiver was for mischief (broke store window) in 1988, no time served, just had to pay a fine.

To be safe make sure to have all documents relating to the offense so the CO has all the information needed...BTW, in hubbys case the incident occured in Montreal and he was required by the consulate to have them translated.

(2) Criminal and related grounds.-

(A) Conviction of certain crimes.-

(i) In general.-Except as provided in clause (ii), any alien convicted of, or who admits having committed, or who admits committing acts which constitute the essential elements of-

(I) a crime involving moral turpitude (other than a purely political offense or an attempt or conspiracy to commit such a crime), or

(II) a violation of (or a conspiracy or attempt to violate) any law or regulation of a State, the United States, or a foreign country relating to a controlled substance (as defined in section 102 of the Controlled Substances Act (21 U.S.C. 802)), is inadmissible.

(ii) Exception.-Clause (i)(I) shall not apply to an alien who committed only one crime if-

(I) the crime was committed when the alien was under 18 years of age, and the crime was committed (and the alien released from any confinement to a prison or correctional institution imposed for the crime) more than 5 years before the date of application for a visa or other documentation and the date of application for admission to the United States, or

(II) the maximum penalty possible for the crime of which the alien was convicted (or which the alien admits having committed or of which the acts that the alien admits having committed constituted the essential elements) did not exceed imprisonment for one year and, if the alien was convicted of such crime, the alien was not sentenced to a term of imprisonment in excess of 6 months (regardless of the extent to which the sentence was ultimately executed).

Multiple criminal convictions.-Any alien convicted of 2 or more offenses (other than purely political offenses), regardless of whether the conviction was in a single trial or whether the offenses arose from a single scheme of misconduct and regardless of whether the offenses involved moral turpitude, for which the aggregate sentences to confinement were 5 years or more is inadmissible.

My hubby had to have the RCMP fingerprint check done, and I called the PMs office and expained the situation, faxed them his interview letter and had the prints within a week after that. BTW..if you are dealing with a criminal record, are you aware that there is a good chance the visa will be denied and a waiver will have to be filed? Just don't want you to be blindsided by that in case you didn't know.
