K-1 Fiance(e) Visa Process & ProceduresHelp!we can't receive emails from USCIS!?
QUOTE (*Giuly and Rocky* @ Nov 4 2008, 01:13 PM) <{POST_SNAPBACK}>
Hello everybody! We asked for expedite process on the 7th of Oct and never heard about them..tonight we called USCIS and they told us that they already sent us the email (to the right email address) but we never received it!! They said they will send it again but I'm worried big time we'll never be able to get it...We checked everyday even the SPAM email cuz we have yahoo account...anybody experienced of it? Thank you for your help!

After a week of signing up with the USCIS to check online for the status of my application I forgot my password. The system asked for my email to send me the correct password. I gave my email, but didn't receive any email. I thought I mistyped my email so I did it again, and never got any email from them.
Could it be a problem with their email system? sad.gif

QUOTE (FranziskaS @ Apr 9 2009, 05:04 PM) <{POST_SNAPBACK}>
I just returned from the US being an Au Pair for 18 months. On your fiancee's DS-2019 on the very bottom left of her document it will show you if she is subject to the HHR. I wasn't. If I am informed correctly, the HHR only applies if the applicant is financially supported by a German company/government, because they want the applicant to work in Germany and contribute with the knowledge they paid for.

Good luck with everything,

Fran

I have a question. on the G-325A form, on the employment history part, did you put down working as an au-pair in the U.S. or how did you do it? Thank you.

K-1 Fiance(e) Visa Process & ProceduresBrainstorm on my next step after NOA2
Hello fellow VJers,

I received my NOA2 last week and then NVC letter on Saturday. So my guess is that the Rio embassy will receive my case this week. Now I am just thinking about my next step.

1. my girl is going to the federal and state police to get the police certificates this Wednesday. From the forum, I know it is going to take 2 weeks to one month. So the question is, should I wait for the police certificate and then submit packet 3 OR submit packet 3 now even though she hasn't received packet 3 yet and wait for the police certificate? I am afraid the police certificate can come later than the interview date if I submit the packet 3 right now.

2. She hasn't received packet 3 yet so I just want to confirm what to send back to the embassy. From the PDF instruction, I need to submit,

DS-230 Part I
DS-2001
Copy of pages that have personal info
one frontal picture (American passport picture??)

Does it look right to you guys?

3. What number did you guys call to know if the embassy receive the case or not? My girl called the embassy and all she heard were tons of prompts and can't get to anyone from the embassy.

Thank you all!!!!!!

K-1 Fiance(e) Visa Process & ProceduresHelpful Note
Hey guys,

For those forms that you can't input anything from the computer, such as form I-134, you can download a free eval version of Adobe 7 Professional from www.download.com. Then open up Adobe 7 Pro and then go to "form" tab and you can type whatever you want on the form! Just a helpful note so you don't need to handwrite anything. Who use pen nowadays anyway?

hi gang,

I just emailed the Rio embassy (by the way, it is way easier to email them than calling them) and receive the reply within 30 minutes. They just receive my case from the NVC today and ready to sent the packet 3 to my girl next week. We are on the right track!

woohoo, our K1 is granted on Monday. She is picking up the visa now and coming during Christmas. I just want to thank everyone for your help.

By the way, if you follow my story, you know we didn't receive the visa on the interview date because of her fingers. So everyone, please taking care of your hands so that the finger prints are visible.

She was so disappointed during the Interview date because we spent a lot of hours preparing the documents and never think about her hands!!

I seen this one coming, no offense but why do you insist on finding a filipina and why so much younger than yourself? Maybe finding a Filipina more mature with commonalities would help? I understand why you dont want an American woman but theres plenty of foreigners in the U.S to choose from and you can probably save a fortune in not having the expense of flying half way around the world. IDK Just some suggestions, yes im with a Filipina but i didnt go looking for mine i was sent to work in the Caymans and met her that way.

35 years age difference?

Dude, not sure how this answered the man's question. Most of us are on this site to support each other, not question how someone fell in love with someone. Happy for you that things worked out for you. Maybe next, give a brother some love and support..

Of course you want to bring some extra money with you, unless you have a credit card. This will be a long journey, you may want to buy snacks or drinks along the way. Also make sure sure the the flight your taking excepts cash for snacks in flight..

Flights also get delayed - you may need money for a hotel/taxi, ect..

Always better to be prepared...

K-1 Fiance(e) Visa Process & Proceduresmy application
1. Payment as required by USCIS. Use a personal check so you can track the payment. Money Orders are also accepted.
2. Cover Letter (see example). Should include a description of what your are petitioning for (I-129F), a table of contents (list everything in the packet). If you need additional room to explain your case, attach a separate sheet (list the attachment on the cover sheet). Make sure to sign and date the cover sheet.
3. Form I-129F: Petition for Alien Fiance(e) (see example)
4. Declaration of how you met in person in the last two years. This should be a single typed page regarding question 18 of the I-129F. Make sure to sign and date it.
5. Original statements (from both the US Citizen and foreign fiance) certifying an intent to marry within 90 days of entering the US on a valid K-1. (see example)
6. Proof of having met in past two years. (click here for examples)
7. G-325A filled out by the US Citizen signed and dated (see example).
8. One passport-type photo (see specification) of the US Citizen. Write the full name of the US citizen on the back. Place in a plastic bag and label the bag "Photo of <Insert US Citizen's Name>". Attach the bag to a sheet of paper and place behind the corresponding G-325a.
9. G-325A filled out by the foreign fiance(e) signed and dated (see example).
10. One passport-type photo (see specification) of the foreign fiance(e). Write the full name of the foreign fiance(e) on the back. Place in a plastic bag and label the bag "Photo of (insert foreign fiance(e) name) ". Attach the bag to a sheet of paper and place behind the corresponding G-325a.
11. Copy of the Birth certificate (front and back) for the US Citizen or a copy of ALL pages of the US Citizen's passport issued with a validity of at least 5 years or a copy of the US Citizen's naturalization certificate (front and back). This is used to establish citizenship.
12. Copy of final Divorce Decree(s) or Certificate(s) for the US Citizen and/or foreign fiance(e) if either has been previously married. If the previous marriage of the US Citizen and/or foreign fiance(e) ended due to the death of their spouse then include a Copy of Death Certificate(s) documenting that fact.
13. Proof of Legal Name Change if either the US Citizen and/or foreign fiance(e) is using a name other than that shown on the relevant documents. You must give USCIS copies of the legal documents that made the change, such as a marriage certificate, adoption decree or court order.
14. In regards to Section C Question 2, if applicable provide certified copies of all court and police records showing the charges and dispositions for any specified conviction(s) (in accordance with the IMBRA). See section 9 of the I-129f instructions for more information.

*Please note, while you are allowed to submit an I-134 Affidavit of Support with the I-129F package, it is not required and the embassy may eventually request that you submit the same information again to ensure that it is still valid. Typically the I-134 Affidavit of Support will be filled out by the US Citizen and sent to the fiance(e) for the K1 interview. It is not required to be sent to the Service Center with the I-129F (and not recommended). Some Consulates require extra information to be included with the Affidavit, so you need to hang onto it until you have learned whether or not there are additional requirements. These will be listed on the OF-167 "financial support" document the fiance(e) receives from the Consulate. You can also refer questions to the newsgroup about experiences regarding the Affidavit. (Also go and look at question 4.3.1)

FAQ Note about evidence of having met in person. You need to send copies of evidence that you and your fiance(e) have met personally within the previous two years. Items such items as photos, copies of passport stamps, copies of airline tickets, help prove this. In the past many petitioners faced a delay when the USCIS (INS) sent them a request for additional evidence or information. In addition, the I-129F indicates the USCIS (INS) wants "original statements" from the US Citizen and foreign fiance(e) regarding mutual intent to marry within 90 days, plus "copies of any evidence you wish to submit to establish your mutual intent". ("Original statements" can be a simple letter stating that you do indeed intend to marry within 90 days. Each of you can write such a letter, or a single letter can be written and signed by both of you. See an example here)

K-1 Fiance(e) Visa Process & ProceduresNBI Clearance and Police Clearance
You must bring the following documentation when you come to the Embassy for your interview:

1. PROOF OF PAYMENT. After making your payment at the bank and scheduling your appointment online,
you will be issued a confirmation receipt. Please bring this receipt with you. If you make your appointment
via the call center, please bring your bank receipt to the interview. For further information, please consult:
http://www.ustraveldocs.com/ph.

2. REQUIRED DOCUMENTS. It is important that you submit ALL of the following documentation to facilitate
the processing of your application. You may be asked to return for another appointment if you fail to
bring any of these documents:

a. PASSPORT. You must have a passport valid for at least six (6) months. If you do not have one, you
should apply in person at the Department of Foreign Affairs - Office of Consular Affairs (DFA-OCA),
Aseana Business Park, Bradco Avenue corner Macapagal Boulevard, Paranaque City. Applicants may set
an appointment by going on line at www.passport.com.ph or by calling 02-737-1000. The DFA web site is
http://www.dfa.gov.ph.

b. DS-156 NONIMMIGRANT VISA APPLICATION. Each applicant must submit two (2) completed
copies of this form. Download form at http://travel.state....orms_1342.html.

c. DS-157 SUPPLEMENTAL NONIMMIGRANT VISA APPLICATION. Each applicant must submit
two (2) completed copies of this form. Download form at
http://travel.state....orms_1342.html.

d. DS-156K NONIMMIGRANT FIANCE(E) VISA APPLICATION. Each K1 applicant must submit one
(1) completed copy of this form. This form is not required for K2 applicants. Download form at
http://travel.state....orms_1342.html.

e. BIRTH CERTIFICATE. Your birth certificate should be a copy issued by the National Statistics Office
(NSO) on security paper (not from the Local Civil Registry Office). If applicable, you should also submit
NSO birth certificates for all your children, even for those who are not applying for a visa. You may call
the NSO Information Center at 02-737-1111 to inquire on securing a birth certificate or visit their web site
at http://www.census.gov.ph. If the NSO does not have a copy of the birth certificate, you must obtain a
statement about its unavailability from the NSO and obtain a certified original copy (not an extract) of the
birth certificate from the local registrar in the town where you were born.

f. NBI CLEARANCE. Applicants aged 16 years and older must have a valid Record Clearance for Travel
Abroad Purposes from the National Bureau of Investigation (NBI). Clearances should be in the applicant’s
current name, birth certificate name, maiden name and any aliases or nicknames used, including different
spellings you have used of those names. For immigration purposes, an NBI clearance is valid for one (1)
year from the date it was issued. The NBI web site is http://www.nbi.gov.ph.

g. OTHER COUNTRY POLICE CERTIFICATES. Applicants aged 16 years and older must also present
police certificates from other countries where they have lived for six (6) months or more after reaching the
age of 16. As with NBI clearances, foreign police certificates should be obtained in any maiden names,
aliases or nicknames used while in the country in question, including different spellings you have used of
those names. Country-specific information on how to secure police certificates is available on the State
Department’s web site at http://travel.state.gov/visa/fees/fees_3272.html.

h. COURT AND PRISON RECORDS: Applicants who have been arrested, charged or convicted of a crime
must present copies or transcripts of court or prison records relating to the crime or offense.

i. MILITARY OR POLICE SERVICE RECORDS: Applicants who served in the military or police should
present certified copies of their military or police service records.

j. EVIDENCE OF A MEETING PRIOR TO THE PETITION. You and your petitioner must have
physically been together at some point within two years before the petition was filed. Proof of this meeting
should be submitted unless the U.S. Citizenship and Immigration Services (USCIS) waives this
requirement. A few photographs of the applicant and petitioner together during the specified time may
serve as evidence of this requirement. You may visit the USICS web site at
http://www.uscis.gov/portal/site/uscis for further information.

k. EVIDENCE OF A GENUINE ENGAGEMENT. You must be prepared to show documents that you
have a genuine relationship with your petitioner and a clear intention to marry. Letters, e-mails, phone
records, bank records, photographs, or other evidence of a genuine fiancé(e) relationship should be
submitted.

l. PROOF OF TERMINATION OF A PRIOR MARRIAGE. If applicable, official documents (divorce
decree, annulment decree or death certificate, etc.) that prove all prior marriages contracted by you and the
petitioner have been legally terminated prior to the filing of the petition must be submitted.

m. CERTIFICATE OF NO MARRIAGE RECORD

n. EVIDENCE OF SUPPORT. You should be able to demonstrate that you will not become a public charge
or be a burden on the U.S. taxpayers for financial support. A completed I-134 Affidavit of Support Form
will be useful to the consular officer to evaluate your petitioner’s ability to be financially responsible for
you. You should also submit your petitioner’s most recent U.S. Federal income tax return (Form 1040) and
wage statements (Form W-2). Employment letters stating salaries and bank statements may be included to
substantiate the I-134. Download Form I-134 at http://www.uscis.gov...tal/site/uscis.

o. VISA PHOTOGRAPHS. You must bring three (3) color photographs; two are for the visa and one is for
the medical report. Size and format specifications must be strictly observed: Photos should measure 2 by
2 inches (roughly 50 mm square) with a white background and the head centered in the frame. The head
(measured from the top of the hair to the bottom of the chin) should measure between 1 inch to 1 3/8 inches
(25 mm to 35 mm) with the eye level between 1 1/8 inch to 1 3/8 inches (28 mm and 35 mm) from the
bottom of the photo. See http://travel.state..../info_1287.html for detailed instructions.

This was a nice topic, something I did not think about. I assume if you go through the transfer area with a valid ticket and stay within the airport no other documents were needed.

Having a K1 Visa from the USA {Philippians} is not like having a US passport with its benifits in many countries ?

My future wife will not be flying directly, so i assume I will have to search each countries website for transit Visa information ?

K-1 Fiance(e) Visa Process & ProceduresHELP! COMPLETE change of personality.... :(
If this is how the relationship is now - I can not see it getting any better over time. I am no Dr. Phil..

So... I came here to the Philippines ONLY for my fiance, i've sent the initial I-129 packet off end of Dec, got notification of NOA1 around jan 4 but sad to say i just wasted all my time, money, and effort for her.... almost EVERY DAY we're arguing and she's too damn stubborn to listen or work out or anything..... all she does is run away and she thinsk that's the solution to our probs when it just makes it 10x worse!!! She is even avoiding her own family and doesn't even sleep at home anymore.... and dont even mention to text/call her as she doesn't ever reply to anything even V-day i just stayed by myself.... i even made up a story that i got snatched and you guessed it! she didn't even care and just hungup the phone on me bec she's too damn SELFISH and SELF-CENTERED & only remembers the negative parts of our relationship... really never met a more HEARTLESS girl then her it's quite sad bec before this trip she wasn't like this AT ALL otherwise i wouldn't have invested so much into her.

Anyway...... so needless to say, she doesn't have a copy of the I-129F i made for her.... and she also doesn't have the original receipts i brought.... im THINKING of coming back here in May 10 to surprise her in time for her bday later in the month and as a last resort to fix our relationship as by that time maybe i would already receive notification of NOA2...
i need to know what i should do with her complete copy of all the i-129 papers, and also the original receipts that she should bring to interview, if ever... should i leave them with a trusted person here? or should i bring everything back home with me and play the waiting game.... :/

i even took many pics of us in our few times we hungout together as "ongoing proof of relationship" as required by the NOA2, but didn't make any copies of anything.... including the hotel receipts. I just dont wanna waste EVERYTHING which is why im trying to utilize all my options esp. while im still here.

PLEASE HELP! DONT KNOW WHAT TO DO ....

Another question....What do u think of me including pictures... my fiancé took with my family and pictures of me with his family??? I have heard all of scary stuffs about Nigerian embassy.(dont want them thinking we are married)

Thanks again.

Yes it goes there. Don't forget to label photos, and even provide a brief description of who is in the such as Photo #3 , July 2007 , me and my fiance Suzie Smith visiting her parents John and Mary Smith in Lagos.

I replaced it with that.

Thanks Ryan H.

I would suggest replacing "To Whom It May Concern" with "Dear Sir or Madam." While the former is not incorrect and would not cause you any difficulty whatsoever. It's just my own opinion that the latter has a more personal feel to it.

Again, very trivial, but sometimes it's the little things that can make all the difference.

According to the sample guides here on VJ, where you have put your address on your cover letter is fine.

Best wishes on your journey and congratulations on your citizenship!

Thanks G-A....Replaced it with that....

Thanks.

they want to know how and when you met in person WITHIN THE LAST TWO YEARS...not "how you met". "I visited my fiance in Nigeria in February, 2010" for example, would be fine. Attach copies of evidence you were there (passport stamps, boarding passes and photos for example) Job done. You do not have to describe more than one meeting or the first meeting or the last meeting. Just ONE meeting within the last two years.
