My fiance is from Haiti, but he is studying in DR we did everything through Haiti to make it easier on us. Our visa was approved April 2nd , but he has to go back to DR after he picks up his passport with the visa on the 12th because he has finals to take before he comes. My question is can he fly to the states using the visa from DR or does he have to go back to Haiti and fly from Haiti?


Visa is for entering the US and doesn't say from where. So, yes, he can fly from the DR.

I recently changed my phone number and I was wondering if I should let USCIS know about it. I have read that a lot of people receive text messages when their rocesses make any progress. When I sumitted the I-129F I received an email when they notified me about NOA1, but I am still waiting for NOA2.

Please note, your petition will not be adjudicated in Texas. Your petition should have been mailed to the Dallas Lockbox address where they will process the payment and then forward it to either the California or Vermont Service Center. Those are the only two service centers adjudicating on I-129F petitions. Once you receive your NOA1, please update your timeline to include the appropriate service center. This will provide you with an estimate on when your case will be adjudicated and help the overall stats for the rest of us on VJ.

No, you need either tax transcripts or complete tax returns. Complete means with all schedules and w-2's (most likely doesn't aply in your case) and 1099's attached.
On the package itself, it seems a liitle bit overloaded, but that will not hurt. If the CO wants to see something, it will be easy to find.

Also, I agree with the previos poster on current financial support. Remove these 2 items, won't help, might hurt.

HELP!!!!
1. Last March 30,2012 when our 129F petition has been approved we received the NOA2 hard copy but still no email from USCIS that our petition has been approved... No Notice from NVC that our case has been forwarded to Abu Dhabi US Embassy where I will have my interview. Is this something to worry about?

2. According to US Embassy in Abu Dhabi reviews Approx Waiting Time for interview date from when the Consulate receives the package from the NVC is 2 MONTHS...
WHILE IN PHILIPPINES IS ONLY 10 DAYS!!! I CONSIDER ASKING THE NVC TO FORWARD OUR CASE TO MANILA EMBASSY COZ HERE SEEMS TAKING FOREVER... BUT I AM NOT SURE IF IT WILL BE ADDITIONAL HASSLE FOR US AND WILL IT TAKE LONGER????

It's not even 2 weeks since your petition was approved. You need to show a little patience, no one has told you that this is a quick and painless process.
Have you called NVC about your case number? If not, maybe it is time to do so. You can also ask about changing the consulate at that time if you wish.
Besides, 2 month wait time for an interview is not "FOREVER". In fact it sounds pretty reasonable to me. And I do not believe it takes 10 days in Manila, sorry.

so just the extra sheets we added onto the petition.

You're right, these and most other forms in the US will ask for black ink.

They want the supplemental sheets to be dated and signed, but maybe you won't get RFE for this. And if you do, it will be really easy one to fix.

Hi everyone!

I was thinking about forms that I need to get from my medical examination for my K-1 and here are my questions:

1. As I understand, I will be handed a DS-3025 form, which is enough for the K-1 interview?
2. Since I plan on adjusting my status within a year from my medical, I can request for additional stuff so that I can skip looking for and paying the civil surgeon in the US, right?
3. One of these optional forms is the DS-3025 vaccination supplement, right? So I can take my shots and ask to have that form issued after completing the neccessary vaccines with that CS?
4. Will I need I-693? Will the CS back home issue me one if I need it?
5. How many sealed envelopes will I get from the CS? One for DS-3025 for consulate, one for I-693 for USCIS when adjusting status? I read that USCIS accepts I-693 only in sealed envelopes.
6. Do I need extra copies of DS-3025 for USCIS to adjust status? I understand the consulate will take one of them without returning it to me?

I would greatly appreciate getting answers to these questions!

Please read the following documents from IV Unit in Warsaw to better learn about the process at the Consulate stage, including the medical:

At the medical you will get sealed envelope, which stays at consulate.
They also SHOULD give you extra DS-3025 Vaccination Documentation Worksheet for you. If they don't, request it, you will need it when filing for AOS.

Yes, but the OP has booked the hotel. Unless it is a capsule inside the security zone, his fiancee would have to get through Japanese border agents.

K-1 visa is a one way one entry visa. But depending on when your fiancée enters he might get the GC within a month. I know cases of ppl close to me who got it in less then a month. That will probably be his only way to cross the border again. :(

Thanks soooo much for the reply guys! Its very helpful. I am so annoyed I didnt realize this sooner. Ok, so I'm now fully aware that he would not be able to leave the US (unless he'd get approved an AP of course). So here's the thing, I got my first NOA1 dated 2/24/12 and still waiting for my NOA2. Based on the date of NOA1, do you guys think we'll get my fiancee's Adjustment of status done in time for December 2012??

Hi, I am not clear on where you want to get married.

Are you getting married in the United States or in Mexico? Is the wedding in Mexico a ceremony only?

The reason I ask is that the K1 visa requires that you marry in the USA, this means that you will not be able to marry (legal ceremony) in Mexico using a K1 visa.


I think what she meant was that the marriage will take place in the US, but wedding reception in Mexico.

Okay, so it just dawned on me this question. My fiance is from Tijuana, Mexico. We were hoping he'd get his interview for his Visa by this coming October so that he can be in the US at least by November for us to get married legally. The thing is that our wedding is in December 2012 but IN Tijuana mexico! I guess in the back of my head I figured he'd be able to cross the border back to Tijuana since he'd already have his K1 Visa still unexpired. So, does that mean he wont be able to cross the border AT ALL until he gets his status changed to permanent resident??????!! (would that mean that we couldnt have our wedding in December in Tijuana??) :/ I read he can apply for an "advance parole"...but from what I read is that it would take months for that to get reviewed!.....HELP!! I need some clarification/advise!



No can do. His K1 will be invalidated on the first entry into US. Then he can't travel out of US until he has AP or GC in hand.
To be more precise, he can leave of course, but he won't be able to return.

No, it's not necessary that you work full time, but ff you make less than required 125% poverty line amount, you will need a co-sponsor who does (for their houshold size + you and your fiance).

@OP: For I-134 it is based on your CURRENT income. You have to include past tax filings, but what really matters is your current situation. Enclose an employment letter with current salary shown and a few current paystubs.

I don't think he can be interviewed in Italy if he only has tourist visa.
For IV interview to take a place there, he would need some kind of residency or at least work visa.

If she is admitted to US at POE based on her (student I assume) visa, there is nothing wrong with her being here during K1 processing.

ds-230 not for K1 it is for spousal so you don't need to fill up ds-230 and on i-129f you have choice either you put them or not, if her kids are below 21 then they can be her k2 and if you mention them on i-129f it will be easy for them to process the k2, if not it is ok also once your fiancee decide to get them there's another process for that.


This is not true, please don't post if you don't know. US Consulate in Warsaw requires K-1 applicants to fill out DS-230 Part 1.

please help me to understand something.
The form I-129F for K1 / part B ,line 13 says: list all children of your fiance(e).
The application DS-230 Part 1 line 19 says : List Names Dates and Places of Birth , and Adresses of ALL Children''
Well, my '' children'' are 29/30 years old. They are on their own, have own life, condos ect and not leaving country.
Shall we list them or not ? I appreciate your help and quick reply


In Item 29 of that form you should to list ALL your children, no matter what their age and if they immigrate with you or not.
But if the children are not immigrating with you, do not list them in Items 31a or 31b, when asked who will accompany you to the US.

You have to apply at least 2 weeks before your I-94 expires, so in your case you can wait until you have your marriage certificate in hand and apply in your married name.
