Removing Conditions on Residency General DiscussionOnly one year of joint tax forms!
hi guys, im new to this forum. I was wondering if I should include the tax form that was file independent. My wife came to the U.S. on may 2007 and we were able to file have this joint tax form. As for 2008, we could not because the time to submit the evidence is up in February. So i was wondering what I should do?

If you live in the Western part of New York State, then Buffalo, NY is the most likely location where your interview would be at. If not, then your AOS interview will probably be at another local office in New York State.

Hi, first of all, do you mean AOS (Adjustment of Status) or Removal of Conditions? This forum is for Removal of Conditions and interviews are not that common in that stage.

If you do have an interview, the location will depend on where you live, there are several offices in NY State that conduct interviews: Albany, Buffalo, NYC (Manhattan) and Garden City (Long Island).


oh i thought AOS and removal of condition is the same. I guess i mean removal of condition. blush.gif

Hi guys,

i have a friends uncle who will also have a Removing condition coming up in like 2 month before the 90day window period. His uncle has filed a joint tax return for 2 years without having a W2 form. He gets paid cash and no check. So he has no W2. He filed like almost 20,000 for each of the pass 2 years. So i was wondering will this affect him?

We made the mistake of not sending complete info. Only sent in parts of Tax returns and bank statements showing both names and our address. The want the bank statements (all pages). We ordered tax returns from IRS (received in 1 week) Also found old letters and cards (thank goodness we are kind of pack rats).

Anyway we are DONE!!!

Hi, guys i was wondering if using one tax form enough. My wife came to the US on late Aug 2007. I was working only part time the when she came, because i went back to school. We did file jointly for that year, but it was under the poverty line. We will have 2008 by the time we file for Removal of condition. For 2008 we will be way above the 125%. So I was wondering if i should include the 2007 or not. Also can anyone explain to me what a Co-Sponsor is and what is required from them? Do i need one? thanx guys in advance!

ok. It sounds like you got a customer service representative who answer the phone like a robot and doesn't know how to improvise. They have two boxes on the computer for them to fill in, first name and last name. So the CSR put "Joe Cindy" which are you and your wife's first names on the first box and "Lynn Chen" which are the last names on the second box. I suggest you call them again and may be you're lucky that someone knows how to improvise answer your phone. If you have to deal with a robot again, just tell them "Joe Lynn Cindy" is the first name and "Chen" is the last name OR "Joe Lynn" is the first name and "Cindy Chen" is the last name. That way you won't confuse a robot. Well, not confusing at all to me, I bet a real robot can figure it out but a robot-like-CSR cannot.


i know, so today i just called again and spoke to another CRS. She told me you can have it the way you want since you are paying for it. Man the first CRS was like you said a Newbie robot, lol.

Hi guys, i live in a coop with my wife and my mother. the coop is under my mothers name. so i was wondering how i can get proof of living here. i do have like affidavits of the the coop we have to submit to the office of our income. it has all of our names, signature and is notirized. is this enough proof? or do i need to call the management office for a letter or something. thanks in advance.

hi guys, i was wondering if Junk mail useful for ROC. I mean like billing invoice from magazines we subscribe, credit card mail asking you to apply for their card, cable companies asking you to join them, car insurance company ask you to purchase them such as gieco and all state, etc. Just like usual junk mail you would receive from known companies. They are however only in one of our names. It is mostly my name because I am the US citizen.

I do not see where it says no relatives or you have to be a USC. It does not require you to put your citizenship, only your place of birth.

Please share where you find that it is best for a USC and should not be a relative. I send an affidavit from my son who lives with us. I personally think the more affidavits, the better. Not just two, but three, four, or five. It can't hurt.


I have read some comments of reply to some affidavits questions on VJ and saw a few of them saying its best to have a USC friend and not family member. Hope I misread or can find those post again.

Hi guys, I received a PM from a VJer about what documents I sent in and how I organized my file.

The things I submitted was basically similar to most ROC petitioners:

1- Our Driver Licenses along with her expired GC and passport I think
2- Tax Return Documentations (2007,2008 and 2009 just in time for submission)
3- Joint Bank Accounts (Submitted the first day I opened the bank and then like 2-3 in between of each year)
4- Joint Credit Cards with both of our names and the first page statements of the bills (submitted the first day she became joint with me and then like 2-3 in between of each year)
5- 3 annual Co-op form required to submit to HPD of income and a letter from the Management Office of part ownership with lease agreement with both names
6- Tmobile Family plan first page of bill each month with both our names on it. (submitted the first day of opening phone and then 2-3 in between of each year)Begged TMO CS to change it like that.
7- Two Life Insurance Policy from NEW YORK LIFE with each other as Beneficiary
8- TIME WARNER CABLE bill with both our names on it. Also begged TMC CS to change it like that. (submitted the first day I added her name with me and then like 2-3 in between of each year)
9- 2 Affavadit from our Best Friends
10- Joint Macy Cards with her as authorize buyer. (Also submitted the first day of receiving bill statement and then 2-3 in between of each year)
11- Like 10-15 color photo prints of the wedding and different trips we went

I think thats about it... Hope this helps you guys!

Note: (submitted the first day of statement and then like 2-3 in between of each year) All were done within the month she arrived to the US!

Hi guys,

I just got home a few minutes ago and I received a letter in my mailbox from VERMONT USCIS stating

"Congratulations! Your request for the removal of the conditional basis of your permanent resident status has been approved. You are deemed to be a lawful Permanent Resident of the United States as of the date of your original admission or adjustment of status"

I had my wife pinch me and it was not a dream, didnt expect it to be so quick.

I sent in my ROC package in the end of APRIL 26, 2009 to be exact and approved SEPT. 19, 2009

I would like to thank you all VJ members for all your help, especially Kathryn41. biggrin.gif

Up next is US Citizenship, but I was wondering if she can apply now before she receive her permanent GC, as it states she will receive it within 60 days?
