Agreed to that..That why I suggested the walk-in as another option. Each case is diff and only the petition knows what the best course to proceed with the lowest risks :P

hi all,

I wrote to Congressman but so far no response...I contacted HCMC via e-mail about the status of the case and if I could setup an appointment with the CO, etc.. The replied e-mail said the case is still under review, and there is a time 4pm-5pm every Tues & Wed that a staff member could answer questions from US petitioners only (status of case, submit documents, etc..but no meeting or interview).

Is it a good idea to submit additional and new pictures or proofs to my case? Please advise. Thanks.


You will just have to wait it out when dealing with the Consulate in Saigon.
Another advise is to fly back to visit your SO and go in the Consulate at the time you mentioned above to make an inquiry in person and bring any additional stuffs you may want to show..that may get you the immediately answer you are seeking. It worked in lots of cases before, but like everything..it's not a 100%.

That's right, those pics you submitted with the 129F before the interview won't be return to you when they give you the approval.

more info: she got back all pictures she submitted (the Timeline Report referred to different occasions and these pictures were proofs for them, i.e. Thailand Trip, Wedding, Honeymoon in Ha Noi, getaway trip to Vung Tau, and others). She did not receive anything else.

If they returned all the pictures then that could be a good sign..be patient and hopefully they will follow up with some good news..good lucks to you guys!!

VietnamFRE requesting Marriage Certificate for me and my fiance

I was thinking that if we got to the consulate in HCMC that that wedding party would not be a problem but from the latest comments I am suspecting that I am wrong about that. If we need to start over and file for a CR1 it would be better to start now than get all the way to the interview and then start over.


Hey Tim..for now go with Plan A like you proposed and provide all the docs to satisfy the RFE for USCIS. IMO..hopefully it should be fine.
At the Consulate stage, the 'wedding' photos should not be a significant issue. You will have an opportunity to address it at the interview if it ever comes up. I submitted a stack of wedding banquet photos to show both families participation. The CO went through it in front of me and included it in the file. We have no problem with that issue for our K1 case.
Don't stress out too much..One thing at the time, don't talk about jumping to CR1 just yet...even if it will work..good lucks!!!

At this point, you can do another Congressional inquiry..I doublt it will yield any faster progress..but why not!!
Perhaps, wait for a bit more to see if any news and make another trip back to inquire at the Consulate in person..this may give you more weight and significance..just a suggestion!

Hey guys. I am in Vietnam now and wanted to give you guys a quick update on my visit to the consulate this week. I spoke to a tall white gwntlemen. The look on this guys face was like he totally did not want to be there at all. He had a soft personality so i saw it as an opportunity to get agressive but no luck. He said they had plenty of evidence that Thu submitted the last couple of months. I told him why it takes so long. I told him that they put me in this situation, not me. He said the same ####### tha oh we cannot take your case out of the queue and it goes first come first serve. He flagged my case so they know i am in vietnam in case they want to speak with me.....yeah right.....basically they are no help at all. Getting angry and yelling will not help because they will not review your entire case on the spot. Like i said, when i go back home i will get my 2 senators and 1 congressman involved more heavily. I will drive to their office personaly. I will fight and fight so hard until i get the pink. I will be back in florida next week. Later guys!


I'm glad you went in on those USC hours, but don't put too much hope that it will work right away. It took me two separate times to come in before they pulled my case file to give me an update. It will show great effort on your part to come in..as it will show later on if Thu ever get another interview..they will likely ask about it as they did ask Hang about both times I came in to talk to them, before giving her the visa approval.
Enjoy your time in VN with her..you have one more week left, hope you did some travel with her and take lots more pictures so perhaps Thu can submit later on. Also, I see that you are almost going on 6 months..be prepare for another Medical if they haven't tell you already. I know it sucks, but at least you won't have to go through sputum tests (TB) like us :hehe:

First of all, don't worry about your fiance submitted those "husband & wife" docs..we were in the same situation awhile back and were afraid the same as you are right now..Hang is from the North so in VNese we referred to each other as "Chong" and "Vo" in our communications. The Consulate noticed that in our chat logs, letters in the initial I-129 and also in subsequent documents submitted during AP. The CO did even thumbed through the wedding banquet pictures when I brought it in on those USC hours and did not even questions about the marriage issues...IMO, they probably knows about the VNese traditional cultures well enough to make the appropriate judment and as long as the marriage is only ceremonial and not official, your K1 status is still good.

Being in AP is tough..for those who has being there will know..be strong and supportive of each others. This is the time when not knowing and being far apart create lots of doubt and arguments. Just believe if you're real..you will prevail at the end. When Thu is here with you, doing all the AOS stuffs..you will look back all this with a smile..hang in there & good luck to ya!!!

Hang came in to turn in the PC. They confirmed that they had received the Medical but didn't ask her any question, just told her to go home and wait. I am prepared a new DS230..anticipating a new interview but don't know when..I guess I have to wait for the interview date before fly back :(
ps: to make the situation bad..she lost her cell phone in the taxi when she got dropped off at the Consulate.

She got the letter and I got the reply email telling her to come in to submit the PC and she will get another interview afterward. I do not know if it is another questions session when she comes in or will be a full scheduled interview at a later date. Hang will come in Monday and will find out..This is really frustrating, they're really dragging it out so one thing after the other expired..I feel like we're going in a loop.

Congratz Scott, it's about time!!! Just drop in in ChoRay early in the morning and most of the time they will let you do it. That's what Hang did. She just back to Hanoi to get another Police Cert., and will be ready by the end of September. We're still waiting for the complete Medical, hopefully by mid-October. I plan to fly back in November to bring her over if everything goes smoothly :whistle:

The sputum smear and culture are pretty reliable. The smear can be used to confirm TB pretty quickly. The culture can also produce a confirmation within a couple of weeks. Getting a negative result takes a while because the bacteria grows so slowly. They can't say for certain that there's no TB unless the culture doesn't produce any TB bacterial growth in a couple of months.


Thanks Jim for clarifying the TST procedure. I would definitely want to know the results for certain too but we just went through the same things and was clear 6 months ago. It wasn't fun to go through the sputum collection again, especially for Hang. She could not cough it out for almost 3 straight weeks. They ended up collecting it through her nostril with a plastic tube..ouch!!! :crying:

Yes, that would be nice..the skin test would only take 72 hours for the results to come back, that what I learned. The hospital staffs said the turn around time for the sputum will take approx 10 weeks, so that would be around mid-October for us. Last year, the Police Cert would also take us a month too if it wasn't for someone her Dad knows whom help us expedited in time for the interview. This time, we will try to get it done earlier, hopefully before the results come back. I wonder if her family can pick it up for her if she can't stay in HN for the whole month?

Just talked to Thuy and there were two men from the consulate at her address in HaNoi yesterday asking the building manager and 4 neighbors questions and had them sign affidavits about Thuys living alone. She said she kept 4 copies of the Police certificate as she had them give her 5 when she got it done just in case...


Your case is progressing nicely, at least you know where it's going and not stuck somewhere. Hoping for the good news soon...We still have the Police Cert to redo, which will be expired next month. Hang will fly back to HN for that while waiting for the sputum results...wish they offer the skin tests at ChoRay thou.

Oh man, sorry to hear that Scott..we tried going to the Window a couple times and were told to go home and wait. Then, I got out my passport and went in a couple times to get the CO to pull our files for another review...my Senator's inquiry was going nowhere too..they're not very helpful. I guess Feinstein is not up for re-election so she doesn't care much...should have contact Boxer instead.
ps: Hang has the sputum appt next week, we're looking at another 2-3 months for the results to come back. Our police cert. expired near the end of September, will be very close.

Some good news.. I just got word that a couple who has been in AP 7 months just got word the case is finished.....She went to the consulate to inquire... this could be a very positive thing for the rest of us since they go through alot of cases at the same time rather than one here and another there...lets hope that we see many visas issued soon....

The theory was that the new GC would be there this summer and that they would clear old AP's before he gets there... july was the expected month for this housekeeping to happen... July starts tonight and a I said I just heard of an AP getting cleared and approved which we have not really heard of for some time...
I really think that if Hang was able to get the clean medical they wanted, she would be here already...
Lets stay positive and not let this get to us... :thumbs: Most of the folks in AP last year were only in for a couple of months... most of us now have been in 2 or 3 times that long.. it really wears on us from one day to the next.. but as has been said so many times before.. look at the finish line ahead rather than the pothole we stepped in... or got pushed into by the CO

Hang went back for another medical at Cho Ray this week. They told to come back the next day to pick up results and told her she needed to do the sputum tests again. Oh man, that is another 2-3 months more waiting...
They hold our files until the medical expired then asked for another one, now another sputum tests even the results came up clean just few months ago...
I was hoping she will get the visa in the next couple weeks, but now we are looking at a few more months..and another police certificate.

Same here...I'm still waiting after over 3 months so far. I got a letter from the congressional aid near the end of last month and it said to wait for 4-6 weeks for their inquiry to the Consulate. It took Hang 2-3 weeks to get it. It was very closed to the interview date. She might enlisted someone help to expedite it if I remembered it correctly. If Thuy knows someone to help, it will be faster..
