IMBRA Special TopicsHow long does the appeal process take?
I know this is an old topic but I wanted to put some encouragement in here in case anyone ever searches this topic. Our appeal was sent off in July of 2012 (we were denied due to lack of co-sponsor) and we hired a lawyer, we send our appeal off and early October we received an Approval on our appeal and was issued an EAD card just a few days later. So about 3 months of waiting for the appeal.
I hope this encourages others...I know I was scared it would take YEARS to get our appeal...even our lawyer suggested we just re-file but we chose to appeal and if nothing heard withing 6 mo we would refile...Im glad we chose to appeal!

wow!! sve najboje za vas!!!! :( a good lawyer is a good idea. I think both you and the USCIS have made some kind of mistakes in this case...and the mess up of USCIS might work in your favor....hire a lawyer because if say..... you wait the 2 years for your wife to get her Citizenship...you might risk getting caught and put in deportation proceeding which may limit you being able to come back....
better to get your case going by the lawyer and straighten it out...you have time and circumstances on your side....

US Citizenship General DiscussionDisheartening Boston Cititzenship Interview

I think the blame should be on people. I am wondering if each one of us filed a complain against these unprofessional officers, would they exist anymore!! I doubt it, trust me some of them they think that they control the peoples' life, and that is why you see some of them they do everything in the interview but being professional. To all of you who are saying they have the right to question everything, I agree but in professional way, please go over this quote from USCIS in regards of the how the IO should be.

So for me if I faced such a situation, I am not gonna think twice about filing a complain to the field office director, nobody should be scared to do so thinking that the officer might deny your application, which he can't cos your file will be reviewed twice.

and it says dont bully-------um they bully......big...time!!!!

US Citizenship General DiscussionDisheartening Boston Cititzenship Interview

I've crossed the border thousands of times (literally) as I am a dual citizen and one thing I learned is that different CBP agents have different tactics to see how you react. Some of them act like the officer you talked about and other times they try to act buddy-buddy and then turn answers against me. Some play dumb, some act like they don't care. In the end it always turns out okay even if it seems like they have been out to get me. They just have these weird tactics to try to work on people. I suspect everything will turn out okay and the officer was trying to make you uncomfortable on purpose to see how you would react. Some people under pressure like that will just give up or confess to something they have been hiding. Although it may see ridiculous to you, if the officer has seen it happen before then they know it works and that becomes their method. Anyway, just a though.
Good Luck!

Very very true!!! They do that as like a test...some intimidate, some are sweet and bubbly (like ours-thank god) and some are rude....some are just plain mean...I have heard so many horror stories of IO......our friend had one who was so mean and sarcastic.......he made our friend the wife (immigrant) cry...he told her to even 'hold it together or this interview will be over'....they are sick!! Too bad we cant report/omplain about them....they get paid to be asses....i still count my blessings that we had a sweet one!!!

Removing Conditions on Residency General DiscussionI-290B processing time
I know this is a semi old topic but I know that I have searched for answers when I applied for my husbands appeal and was discouraged when I saw that waiting times were 6mo-2years....I just wanted to shed some light and good news....we were denied our i485 due to not having a co-sponsor....we got our sponsor and hired a lawyer....our appeal was sent end of July 2012 and in October 2012 our appeal was approved and we received our EAD just s few days later...it was just about 3 months wait...I hope this helps some people that were in the same boat!

Removing Conditions on Residency General DiscussionCSC is delayed two months due to Obama Dream Act

I support Obama 100%. The principle of immigration reform makes sense to United States; however, they need to create more processing centers to deal with applications too. Otherwise, it will cause more backlogs. My 2 cents.

IR-1 / CR-1 Spouse Visa Process & ProceduresExpedite process due to medical issues?

You heard wrong.

Getting knocked up only demonstrates that you don't use birth control, and does not demonstrate that you qualify for an expedite. An expedite is essentially taking someone else's spot ahead of you for yourself.

http://www.uscis.gov...00045f3d6a1RCRD are USCIS' expedite criteria.

A high-risk pregnancy, where either the mother or child's life was at risk, would qualify for an expedite. A normal pregnancy (i.e. most women's) would not.

thanks for the clear up!

19 and 20 January rescheduled 04 February
21 and 25 January rescheduled 05 February
26 and 27 January rescheduled 08 February

If your address has changed, please inform the National Visa Center by phone, 603-334-0700, or e-mail, NVCINQUIRY@state.gov. If you have already been interviewed at the Embassy, or you had an appointment for January or February, please be sure to update your new address by sending an email to PaPCons@state.gov or by contacting our call center CIVA.

***U.S. Citizens seeking assistance to help non-U.S. citizen family members travel to the U.S. should not come to the Embassy for services on their behalf. Information about filing Immigrant Visa petitions for eligible family members is available at www.travel.state.gov and www.uscis.gov. ***

Q. What about family preference cases?
A. We will be prioritizing the issuance of Immigrant Visas to the spouse, children and parents of U.S. citizens. However, family preference cases with currently available visa numbers will also be scheduled as expeditiously as possible.

Q. Will applicants with important civil documents lost in the earthquake be able to provide alternatives?
A. Some civil documents are required by law and regulation for the issuance of an immigrant visa. In the case of a immigrant visa petition that has already been approved by USCIS, the Embassy will work with people who are unable to obtain birth registration documents and the Embassy may recommend DNA testing as an alternative to documents in order to establish parent-child relationships if birth registration documents are unobtainable.

Q. What should I do if I haven’t filed a petition yet for my relative?
A. You should consider filing your petition now. The U.S. Citizenship and Immigration Services adjudicate petitions for family members to immigrate to the United States. Please visit http://www.uscis.gov for more information.

Q. Will Nonimmigrant Visa (NIV) services open as well?
A. Not at this time. We continue to focus on services to U.S. Citizens and now, immigrant visa applicants. We will announce the resumption of NIV services in due course

K-1 Fiance(e) Visa Process & Proceduresk1 visa
Hello to all,

Here is the situation, my fiancee is from HAITI but resides in the Dominican Republic. He has been living there for 4 years now. (Yes, he is legal there). He went to Haiti last week to get his passport, medical exam, and to go pay the fees. Yesterday, he was supposed to go pick up his medical results and go to Haiti Messager to submit the papers, test results,etc.. but due to the terrible catastrophe that happened in our country, everything is now put to a screeching halt! Now, my question is, can he get the visa from Dominican Republic? He is after all a resident there.

K-1 Fiance(e) Visa Process & Proceduresjust a doubt
it depends because it's the same situation with me, my fiancee is haitian but lives in DR except that he was not a permanent resident there. He only had a visa. When I filed my paper work last july, they sent the case to haiti, so now he is in haiti waiting to go for his interview. I believe that if you are a permanent resident there, they will send your paper work to DR.
