Sweetcitywife, Casa cannot outright "deny" a visa. What they do instead is send it back to USCIS for further review. USCIS will look at it again after some time and either reaffirm it or issue a Notice of Intent to Deny, and you'll have a limited amount of time in which to reply to that notice.

I don't have firsthand experience with this, but I'm replying because the consulate's choice of words (telling you it's not denied) may make it sound like you're just in AP. I just want to make sure you understand that, based on the language from the consulate, your husband's interview was not successful, you are not in AP, and you will need to take action now and prepare a rebuttal so you'll be ready when USCIS makes its decision. Best case, USCIS will reaffirm the petition, send it back to Casa, and he'll have another interview after a few months. Worst case, you'll have to rebut a NOID, so you need to prepare for worst case. The pinned "returned petition" thread at the top of this forum is a good place to start (start reading a few pages into the thread). You may want to consult an attorney at this point - since you are married, it is crucial that any rebuttal be successful this time around. Marc Ellis has been recommended by many here who have been in your shoes.

I'm sorry you're going through this and that your husband lost his visitor's visa. You two did the right thing by him not entering the US on his visitor's visa with the intention of adjusting status. They would have looked at you closely anyway because he would have been already married when he entered as a tourist, so it would have been difficult to prove he had no intention of staying when he arrived.

There is one silver lining: since, by the time this is over and he does receive the visa, you will have been married for more than two years, he should receive the 10-year green card, and you shouldn't have to remove conditions.

Hoping some of those folks who have been through this will come along to give you more feedback.

We are trying for a spousal visa to the US, not Morocco. They did not keep his passport, they just cancelled his visitor visa. You cant use a visitor visa to live permanently in the US. We are trying for a permanent resident visa for my husband, a CR1. I hope this clarifies your question.

Hello everyone, my husband had his interview this past week and the co was very mean to him and my husband said they focused on why i have three ex husbands and why i dont have a job and get ssi.
They took our wedding photo and asked another co if it looked fake. Then they said sorry we cant give you any visa and we are sending your case back to the US and they took my husbands passport and stamped cancelled on his ten year visitor visa, this hurt my husband so bad. I tried to call two times they said we have no info that they co still has the case and to email us and we will answer you next week when there is an update. I emailed them begging them to let us give them more proof, and that we have wedding videos and we can get letters from everyone. I told them the reasons why i have three ex husbands, good ones of course and that this doesnt mean i cant meet my husband and fall in love and marry him, you cant stop love. And i told them i lived in Morocco a year with my husband and that im getting ready to return to live with him again, not visit live, that we cant be seperated. And i told them they are welcome to our house for dinner in to visit with us and see how much we love each other. So what you all think? Is there anyway we can keep this case in the embassy? What should i do? Maybe they made my husband think he is denied and they cancelled his visa cause they are going to give him the real spousal on? Im just dreaming maybe. Our visa is th CR1.
I appreciate any help.

Thanks everyone for your help. I am going to send my husband with the photo album. I will also make a book of documents that we sent before and some new ones, so maybe that would help? But should i send him with both books or just the album? Im so scared for my husband and the questions. Please pray for us. Just so you know I have been living with my husband since jan 2011 and I teach at a school in Casablanca fulltime, and we are trying to have a baby and I have copies of the doctor visits to my fertility doctor and the medicines and procedures we are doing. All of this helped us get reaffirmed, but my husband answering the way they want is the scary part.

Hello, wow im shocked we both have the same life! I typed in google the Moroccan government wont let my husband quit his job to live in the US and I found your post! My husband too has his permenent residency and is trying to quit his job and move to the US, but the delegation cant sign his request because they fired the man in the position and now there is not one to sign my husband request! My husband also is a correction officer, can you believe it! When my husband came to the US with his visa last Christmas he became a permenent resident, he got the stamp in his passport, but the green card never came in the mail and is considered lost and we have to file to replace it 450.00. Our situation is a little worse as I think my husbands stamp will expire in December, and he has the money to replace as I dont. I work full time as a Kindergarten teacher but I am trying to find a second job to make it on my own as he is not with me yet. I was reading if it is under one year for him out of the country he can still come or get a transportation letter from the embassy. But if it is over a year after the green card stamp expires than my husband has to get the returning resident visa and that can take five months to process! Ive been waiting three and a half years already for my husband! I like what the one person in the replies said to take the request and find someone to sign it! That is a great idea! My husband did tell me there are 14 requests to leave waiting for a signature. Im guessing the King will appoint someone for the new year! But that is to long! It is so sad that they are making these men prisoners! Maybe our husbands know each other? Anyone im so glad to find someone else in the same situation but sad that we cant have our husbands and fast! And the Moroccan embassy is very hard! I hope they dont give us a hard time if he expires! We already proved we are a real married couple I liked with my husband 2 years and 10 months and i just came back to the US to live in April to prepare everything. I will pray for you and you pray for us that this nightmare will end!

Hello, does anyone know or have experience with the Intent to Revoke process? We are about to get issued one, hasnt come in the mail yet, and i have no idea what im supposed to do? I have called USCIS and they said i cannt ask for an extension as we live out of the country and i need more time to respond as mail can take up to 30 days, the man sorry, no extensions, you must respond in 30 days even if you live overseas. I cant believe that. I hope someone can help me a little to know what to expect.

Some old people get social security but have savings from selling their house, having stocks and bonds, im sure you know all of this, and i dont need to tell my grandmas business but she just sold her house, i hope this answers your question. There is no fraud just my grammy selling her house, i hope that is okay with everyone? If you are renting with your husband, just ask the landlord for a notarized letter stating this fact in Arabic and translate it to English. Also, I provided a letter from his mother who saw that we co-mingled finances on a daily basis. Do you still have a bank account in the US and access to funds? (There is a sample of what needs to be in the letter in the instruction for application of a K-3 Visa or K-1). Lastly, if he is the one supporting you both then his family can write a letter attesting to this fact and have it notarized as well. Good luck and yes they take these letters from family we submitted them with our CR1 request.

Thanks everyone for your help! It is a big help! What if we cant get an apartment in both our names and we just stay in my husbands families home, can his mom or dad or one of our sister n laws write a letter stating we live on the second floor? We dont pay rent though. How does my family write this letter when you live in the family home and dont pay rent? Also, i put my work money in my husbands bank account in Morocco as i cant have an account as i dont have a residency card, should i show a copy of the deposit slip and the bank statement and state i put my money in my husbands account? And should my sister n law state in a letter she sees me give my money to my husband and he puts my money in his account? Is this good or bad? And i should use his atm card at his bank? Also, my husband pays for everything for me, he buys me my meds, food, clothing, doctor visits whatever i need, were married, how can they doubt us. I told them in one letter to come to our house and stay as long as they like they can even sleep in our room, i dont care, just to prove to them they are wrong and to say sorry to us! Sorry, they make me sad, cause they approve bad people and not real people. Just cause were tired from working and didnt show all the stuff they wanted they said were fraud. How can a couple be fraud when we live together two years now?

Your mother-in-law can state in her letter that she saw that her son used your visa/debit card with you thereby proving that you both have had access to the monies. Also, she can state that your husband is the only one working and sole provider or your family. Those are examples of what to put in the letter.

Our letters included my mother-in-laws full name, her ID number, where she resides and what she declared for example a faithful relation between my husband and I and that she had hosted me in her home during our courtship. That she blessed our marriage, when the marriage happened, that she saw us exchange money through western union, that I provided assistance with paying the rent, and that she certified and declared said statement and assumed any responsibility in case of false declaration and put her hand in authentication of the truthfulness thereof.

Hello, how can we show joint ownership of a house or property or lease an apartment if we live in another country not the US? Will they still accept this document if our apartment is in Morocco? And how can you share finances when you cant put your husbands name on any banks or anything like that if he doesnt have a social security number? Im glad no fees again, but im so scared about the interview as i read they dont like admitting they made a mistake. But i hope we do good and it is an easy interview and fast approval. But there is someone in my yahoo group married to a Moroccan and when their interview was cancelled or rescheduled something like that, they just called them after and said come pick up your visa with no second interview, this is why i have this in my head,but im sure that is rare. We will be prepared.

Hello, All:

My husband has his interview scheduled on January 25, 2012 after our case was reaffirmed on November 8, 2011. He was instructed to be there at 3pm. I think that is an unusual time of the day for an interview. i thought that inteviews were typically scheduled early in the morning, not in the afternoon. The woman that spoke to my husband told him to bring his valid passport and some type of baggage to carry back all of the evidence that i submitted because there is a lot there waiting for him. She said that he will need help to carry the documents. I am a bit confused.. It has been almost one year sinc his first interview. I have the following questions.

1. Would they not need another police certification?
2. Would they not need another court certification?
3. Would they not need his certified birth certification/ medical exam?
4. Would they not need another affidavit of support from me? I-864, tax return and pay stubs?
5. By the time he has his second interview on Jan 25, we would be married over two years. So should he not be eligible for thr R-1, CR-1?
6. What legal reason could there be if they issue him a CR-1 instead of a R-1 after we have been married for two years?

Questions 1 - 4, Should he gbring these documents anyway? These expire at least that is what I understand. As many may already may know, getting these documents are not easy when one must travel 8-10 hours each way. I was told after his interview they will tell him what else may be missing?

Please provide your insight.

her income has to earn 125% over the poverty guidelines for herself, her dependents, and the intended immigrant. If she wanted to use assets they must be equal to a lot more than $8000

Hello again, my joint sponsor has income 16000 last year, and we have included her asset of her camper 8000, and we have included her employment letter from her employer of present saying she makes 1600 a month and 19200 a year, so do you think this is all good and they will accept, seeing how she is still going to make the required amount? When we first filled out the papers she was making 30000 but when on umemployment and thats why the tax return is now 16000, but thankfully in her new job she will make 19200, and we are submitting this employment letter.
What do you think?
