K-1 Fiance(e) Visa Process & Proceduresquestion about visa k1
Less than one year ago, you were posting about expediting a petition because your wife in the USA was pregnant and you wanted to come here sooner and help her. A few months after that, you were posting about co sponsors.

You're coming on here telling us now that the entire time your pregnant wife was struggling here in America, you've been chatting with another American woman online, YOU have been paying for long distance calls to talk to her (when you have a wife and child to support in the US), and you have this other woman coming to Morocco to visit you!?

Perhaps you should tell this other woman that you're married to another American and have a child here, instead of trying to scam her by telling her you're eligible for a K1.

You'd never get past the consulate in Casablanca anyway. Go ahead and try all you want.

K-1 Fiance(e) Visa Process & Proceduresk1 what's is considered a large difference in age
It really depends on the cultural norms in the SO's country. I don't think a 35 yo man marrying a 20 year old in Guatemala would raise a lot of eyebrows. It's when you see a 50 yo woman marrying a 27 yo man from Egypt that the whole age difference thing comes into play at the consulate.

K-1 Fiance(e) Visa Process & ProceduresImportance of Staying with current job during k1 processing

Hi all,

Do any of you fellow VJ'ers have any experience or knowledge about the advisability or not of quitting current job (of 10+ years) and starting a new job? I wouldn't quit one without the other lined up and ready to go, btw. Ideally, I'd be quitting one and starting up the other next day. And let's say both jobs kept me above the poverty line according to VJ. What do you all believe about how important it is to keep the established job during this time? (I'm just daydreaming about giving my 2 weeks' notice someday soon. I am SO ready to move on from my present job! Nothing waiting in the wings for me yet, but it's nice to dream)

Thank you everyone.

I don't think they'd give you a hard time about it. Being with a job for 10+ years shows that you're pretty stable. If anything, I'd just have HR at your new job draft a letter stating that you are a permanent employee, and what your yearly gross income will be. You should be fine. Good luck :)

K-1 Fiance(e) Visa Process & ProceduresNow what?

Does it even go to the NVC? I just saw on the Embassy website that approved petitions get forwarded straight to the Consulate.

No, it goes to the NVC, but very rarely stays there for any longer than a week.
KittyPollittFemaleMorocco2011-03-04 21:24:00
K-1 Fiance(e) Visa Process & ProceduresNow what?

How did you know when it arrived in Casa...did they email you? And did Packet 3 come three weeks after the Noa2 email or 3 weeks after arriving in Casa? Also how far did they schedule your interview from the date packet 3 was recieved?

Thanks everyone for all the good information!

The NVC gave me the tracking number for the diplomatic pouch that was send via DHL. I was able to track it on the DHL site. The packet 3 came 3 weeks after the petition arriving in Casa. His interview was scheduled 2 weeks after the time we received packet 3, but I remember some other people with interviews around that time had to wait a month.
KittyPollittFemaleMorocco2011-03-04 12:31:00
K-1 Fiance(e) Visa Process & ProceduresNow what?

Masha'allah...so the NOA2 came in the mail today (was approved 2/24). Now what?
-How do I know if it's been received by the NVC?
-And how long before we can expect Packet 3?
-Do they give an interview date with Packet 3 or not until after you complete the forms and send it back?

I'd appreciate some insight insha'allah. Thanks

I can only speak from my experience. After I got the NOA2 email, it was received by NVC 4 days later. You can call them to confirm it's arrival. 7 days after that, Casablanca had it. It took 3 weeks for us to get packet 3. Casablanca does not issue a packet 4. They send you a list of doctors and labs, tell you to get the medical exam, and the interview letter comes with the packet. They also tell you what other documents to bring to the interview, and you don't send anything in, your fiance will turn it in at the consulate before his interview. For the doctors, I recommend Dr Khadija. They have a lab on site and it's very close to where your fiance will need to get his xray done, in Casablanca.

Good luck!
Sarah

K-1 Fiance(e) Visa Process & ProceduresDo most K-1 visa applications have a tourist visa?
My husband couldn't have gotten a tourist visa. His country's US consulate just doesn't issue tourist visas to unmarried men under age 35. Generally speaking.

K-1 Fiance(e) Visa Process & ProceduresK-1 Questions...Trying to understand...

Hello everyone,

I've been looking around the internet to find answers to my question and have stumbled upon this website, which seems very helpful and friendly.

I have several questions if anyone could help me gain more understanding of the process, I would tremendously appreciate it.

I am currently a university student in KS. I've moved here to the US with my mother via the K-1 visa, I believe, and thus have gained my permanent resident here and in the process of naturalization.

Anyhow, I am in a relationship with a man of British citizen. Although he is from the UK, he is currently living in the UAE using the work visa that allows him to live there under his employment. So basically he's been living there for years now and I don't think he is planning to move back to the UK anytime soon.

We are deeply in love and we plan to get married someday. I'd to be realistic and think towards the next few years since I'd like to obtain an grad degree, so I'd like to know a few things...

1). Since I'm a college student and I have to do student's loans to pay for my education, once I'm out I'd have over 20K in debt which I will be paying. At that time I'd be making pretty close to 20K a year in full-time. I might go for two jobs and try to save up while repaying back the loans. I'm thinking about working a full year before filing for the K-1 visa. Will my school debts be a negative factor when filing for the K-1?

2). We are currently 21-22 years old. So by the time, hoping by age 25 we'll be filing for this. Will our age be a factor in the process? We've met numerous times before and deeply in love, but I fear that they might rethink our situation because of our age.

3). How about his current location? He's a British citizen working the UAE (Middle East - United Arab Emirates)...Will this be a problem? Will he need to move back to the UK after I've filed for him?

4) If I make around 20K income for a year after I graduate, will that suffice the requirement? I know they have to consider for sponsorship to make sure that I have the financial capability to support him. Although if he does get his perm. residency, he can start working, which is what my mother did when she came here.

I would really, really like to get your opinions on this from anyone with experience. We're seeing each other every 6 months and we've known each other for over 3 years, so I'd like to understand the process more and we could do to increase the appeal.

Thank you so much in advance!

1) They don't take debt into consideration during the process.

2) No, your age will not be a factor.

3) He could be interviewed at either consulate. It is up to you both to choose, and put it on the forms. He should interview in the country he resides in at the time of his application.

4) The poverty guidelines change year by year. As of now, at $20k per year, you'd make more than enough for a K1 petition (which requires an income that is 100% of the federal poverty guideline). When the time comes for him to adjust status, you will need to make 125% of the guideline. No one on here can tell you what the guideline will be in 2-4 years.

Good luck to you

Sarah

K-1 Fiance(e) Visa Process & ProceduresToruist Visa...

I may be totally off base now but my fiance was just here visiting me for 3 1/2 weeks. He had no problems at all. It saddens me that there may be different rules for different parts of the world.

It doesn't bother me at all. If it were easier for young Moroccan men to get visitor visas, every Imade, Achraf, and Mohamed would be getting them and overstaying- and that would make things harder at Casablanca than they already are. And I just can't imagine things being any harder than they already are. Not worth it.

K-1 Fiance(e) Visa Process & ProceduresToruist Visa...

Denied tourist visa would have not impact on K1 nor would it be held against them. Seems you were married and then your husband was trying to get a tourist visa that is a different case.
OP is not married or engaged yet - in that case there is no impact.

They won't tell you it has a negative impact. Just like they can't use age as a factor in denying, but they do factor it into their decisions at this consulate- and they will find another official reason to put on the 221(g). Any signs of showing desperation to step foot onto American soil from a young MENA man are going to have a negative impact. Casablanca is not to be toyed with, and much preparation needs to go into approaching them to get an approval. Better safe than sorry, IMHO.
KittyPollittFemaleMorocco2011-03-09 18:44:00
K-1 Fiance(e) Visa Process & ProceduresToruist Visa...
Not to burst anyone's bubble, but unless he's a 40+ year old man with a darn good job, a house, a car, and a big bank account, I wouldn't even bother with him applying for a visitor visa. There's no way he'll get one from Casablanca. Even if he had all of the above, but was under 40, he still wouldn't get one. I haven't heard of a single case of an unmarried man under 40 getting a visitor visa to the US from Casablanca- either from VJ, or personal friends. If he applies and is denied, it may effect the outcome of a future K1 petition.

I really think you need to read up on the specifics of immigrating from Morocco, from others who have been through it here on VJ. It is not an easy road by a longshot. Educating yourself about it now could save you a possible future denial. Good luck.

K-1 Fiance(e) Visa Process & Proceduresk1 interview questions
Be prepared, and know everything about your fiance down to what elementary school they went to. Know the year they graduated high school, the names of close friends and family, how old their siblings are and what they do for a living, details about your fiance's job. Everything there is to know about your fiance, you should know. Casablanca consulate has been known to deny people for not knowing tiny details. This is in addition to the normal questions that might be asked at another consulate, like your fiance's age, birthdate, relationship with their parents. My husband is still able to recite my 3 sibling's names, birthdates and professions, my parent's birthdays, the name of my high school, my best friend's name and birthdate, as well as her children, and he even knew the make, model, and year of the car I drive just to be sure. You can never be too careful when it comes to Casablanca. Good luck.

K-1 Fiance(e) Visa Process & ProceduresMy fiancee is pregnant and I'm about to submit the I-129F
Officially the government doesn't care that she's pregnant. It won't speed up the process, however at difficult consulates, having a child might help the outcome of an interview. Reason being that the "official" mission statement of USCIS is to reunite families. I'm speaking from experience, btw.

Family is important, man. Your Dad is your Dad, he's just as important as a fiancee, and deserves to be able to see this singular moment in his son's life. Think of it this way- you've been waiting about a year to be able to get married. Your father has waited YOUR WHOLE LIFE to see you get married. Don't let him miss out on that.

K-1 Fiance(e) Visa Process & ProceduresGetting started

Yes she is here legally. Thanks for all the information. One last thing. Since I am working in Korea Im not sure how this works. I have to go back and set up housing and a job at some point in the visa process to show I can support her. My parents own properties, so I we have a place to live already and I have a job in my family business when I get back, so everything should be fine on that end. However, we would like to not spend that much time apart when I go back to the States from here (plus Im not 100% sure how her family will react at that point, so I dont really want her stuck in a negative environment back at home for very long while she waits to come over, if it comes to that), so would it be better just to get a sponsor (one of my parents) while Im in Korea to hurry things along? I cant really leave my job here until its time to go home when my contract is up.

I think what another poster was trying to say is that because you are living together in S. Korea (assuming you have S. Korean legal residency), if you were to marry there, you would be eligible to file for a CR1 using Direct Consular Filing (DCF). DCF actually does speed up the process, as the entire petition is adjudicated at the consulate. It averages 2-4 months from petition to interview. For DCF, you'd have to prove domicile in the US (a letter from your parents regarding housing, and a letter from the family business regarding future employment would work fine), and other than that, the requirements are the same as any other CR1 visa.

This is a great option for people in your situation, as there is no separation, and you could apply prior to your contract being up, since the visa is good for travel for up to 6 months. The immigration process has a way of taking the romance out of getting married, you're right. But you have the opportunity to not have to be separated- take advantage of it! Good luck!

K-1 Fiance(e) Visa Process & ProceduresPossibility of more than 1 K1 for the same Fiance?
She has to make a choice. Either she wants to live in the US or not. My husband was not able to get a visitor visa and never visited here before arriving on a K1- he made the choice to come to be with me. If she doesn't want to live here, then live there. What you're implying is bordering on visa fraud, and could cause you issues in the future if you do decide to move here.

Aside from how I may feel about your using the K1 this way, after my family fought so hard to get my husband one- my gut feeling about your idea is that it is not a good one, and you need to rethink your plans.

If you take out all the personal opinions from the previous posts, the advice given is sound. I'd suggest you listen to them.

K-1 Fiance(e) Visa Process & Proceduresk1 visa pregnant benificiary question
I highly doubt they will deny the visa because she is pregnant, but there is a good possibility you will have to pay for a DNA test, which is pretty pricey when dealing with 2 labs on different continents. I was pregnant during the process (I am the petitioner) and I priced out DNA testing, it was over $1500. So it's something you might wanna put a little money aside for, just in case they require it.

K-1 Fiance(e) Visa Process & ProceduresDo we really need a lawyer?

thankyou everyone :) we have observed just 1 problem with our case and that would be the affadavit of support. She is in school right now but graduates in december. she will be a teacher. but right now she dose not meet the requirement of around $18000 a year income. how big of a problem is this?

That could be a deal breaker- good news is, she can use a co sponsor who does meet the income requirement, or she could count assets if she has any. A co sponsor could be any US citizen or legal permanent resident who meets the requirements and is willing to sign. The affidavit of support isn't needed until the interview stage, which comes several months after filing, so there's plenty of time to find a co sponsor :) good luck!

K-1 Fiance(e) Visa Process & ProceduresK1 Visa Expedite and further expedite
I wanted to add-

She is going to need a police certificate from anywhere she has lived longer than 6 months- this includes any cities in Morocco, and Dubai (if she was there longer than 6 months). She may have to go to the consulate for Dubai to get one, or send away for one, which takes time- that's something you could work on now. She'll also need to have a certificate of singlehood, which she can get in Morocco.

You may also want to check and make sure you don't need proof of your conversion to Islam- I'm not sure about this one, as it had no bearing on my situation- but I'm sure it wouldn't be a bad idea to have it.

Where you pregnant at the time you went for the Medical exam? I am assuming you were, but I could be wrong! Did they waive the X-ray because you are pregnant? Can we go get the medical done and the form filled prior to receiving the packet?

Thanks a ton for the information! I checked the consulate review - very helpful! Seems quicker in Morocco than other countries!

My husband was the immigrant in our situation- If you do a search on VJ regarding having the x-ray and (some) of the vaccinations waived due to pregnancy. I think they'll do the skin TB test on her instead. She'll still need to get the vaccinations done in the US before she can adjust status. It wouldn't hurt to send an email to the consulate and ask about it.

The doctor is going to want to see her interview letter before she is seen. You'll most likely have 3-4 weeks to get to the doc between the time she gets the packet to the interview, and the medical only takes one day- so you're in good shape.

My Fiance and I decided it was best to go back to morocco and process the application there. My questions are:

1) Simply contact the NVC and notifying them about the Consulate/address change, is that sufficient?
2) Does anybody have a link to download the packet 3 for the Consulate in Morocco?

1) Yes.
2) Casablanca packet 3 is not available online, it's mailed out once the consulate receives your petition. A list of the doctors in Casa is available in the "Embassy Info" tab here on VJ, for Morocco. If I remember correctly, packet 3 was just a list of what to bring to the interview, as there is no packet 4 from Casablanca. Also the interview letter.

I'd call NVC if I were you, and give them a heads up about your address change. The petition will be there for a very short time.

Have a safe trip. :)

Like I said I apologise for being a little jaded. Thank you for not taking complete offence to that :) I hope that it all worked out for you and I do think even if I am off on the 8 months that you shaved off a lot of time. Anyways, I am glad that you are able to keep your fiance safe, at least there is that peace of mind that she is not stuck in Dubai where she could really get in trouble. Morocco just seems to be a lot more laid back when it comes to their "laws".

There's no law in Morocco that can't disappear with a few dirhams thrown the right way.

I lived with my fiance, unmarried, with a child (obviously Moroccan and obviously his), with no residency card, for 6 months in Morocco and never had a problem at all.

K-1 Fiance(e) Visa Process & ProceduresK1 Visa Expedite and further expedite

Hello Fellow Visa Experts!

I am engage to my fiance, who we found is also pregnant! Unfortunately, this was a little bit of a surprise to the both of us! Anyway, I moved back to the USA and she was still living in Dubai. It is illegal for an unmarried female to stay in Dubai. In her home country, morocco, it is also illegal. She was due for a medical exam in Dubai for her Dubai Visa. This would reveal a pregnancy. She could not stay in Dubai, nor goto Morocco. I went to a US Senators office, and they were able to expedite the K1 visa application via the USCIS.

On May 9th, 2011, I received an email from the senators office that our K1 Visa expedite had been approved. On May 10th, I received a text message notification saying our K1 Visa had been approved. I had to relocate my fiance to Istanbul, to avoid jail, and I have notified the USCIS, the NVC, the UAE Embassies, and the Istanbul embassies of her consulate change and address change from Dubai to Istanbul. I received acknowledgement from the NVC with regards to this. The NVC does not yet have the file from the USCIS.

My question is, what do I do to further expedite this visa? I understand that I have only expedited it at the USCIS level. Would I be correct if I:

1) Contacted the NVC and forwarded the Expedite request to help expedite the matter at that level.
2) Contact the Embassy in Istanbul, and also forward them the Expedite request.
3) Contact the senator and ask them to expedite it at the NVC and Embassy level.

The senator really helped is out. I went on May 5th to the office, and i received approval on May 10th. Our application was submitted on April 10th.

I understand al those out there who have been waiting months and months for approval. We are extremely lucky to have such a good senator to help us with the process. Our preferential treatment was given primarily due to the pending imprisonment of my fiance. I am currently paying a lot of money to have my fiance stay in Istanbul in a safe hotel.

I appreciate any and all input!

Got some news for you- she'd have no trouble getting back in to Morocco. They wouldn't question her. Moroccan women's names don't change after marriage, so they'd have no reason to suspect she's not married. Even if they did stop her in the airport, contrary to what you've been told- it is not illegal to be unwed and pregnant in Morocco. It is frowned upon, but not illegal.

I don't know how you managed to get an expedite at all.

K-1 Fiance(e) Visa Process & ProceduresDo I need a K-1?

Hi all.

First of all, I apologise if I've broken any rules or missed anything as this is my first post.

My Fiance is an American, who is currently going through the process to migrate to Australia on a Prospective Marriage Visa. Once her Visa is approved, we have to get married within 9 months.

We are planning to get married in Hawaii. Being that she is an American, and we plan to marry in the US, will I need to go through the I-129F/K-1 process if we are not planning on migrating to the US? (ie. we plan to be in Hawaii for under two weeks to get married, then return to Australia). My Fiance has called the State Department, and was told that if we do not intend to migrate we should just say we're there for a holiday and not mention the intent to marry. Though, this sounds very dodgy to me so I am looking for some further information.

We obviously don't want to put ourselves in a risky situation, given that after a few years in Australia we might migrate back to the US.

Appreciate any information you might have.

callsignapollo

If I were you, I'd take her Aussie immigration paperwork with you when you enter Hawaii. Seeing her intent to immigrate to Australia might alleviate any suspicions they might have about your intent. Congrats!

Later on for the interview you need to provide evidence of ongoing relationship such as copies of emails, phone/chat records, etc. You can find more detailed info on this on other posts. So, provided you have supporting information, one visit is ok.

This is not true for all consulates, and it's been an issue for individuals at Casablanca, even with pounds and pounds of further evidence. Casablanca is not known for looking at evidence at interviews. Probably not a good idea to give out consulate specific advice, if you're unfamiliar with the OP's consulate.

OP- People have been denied by Casablanca and been told that a single visit was a contributing factor in the denial. Hopefully you submitted a strong enough case to overcome this issue. If you haven't had your interview yet, it wouldn't be a bad idea to have your fiancee join you in Morocco for it.

btw there is actually people in this world that "actually" think outside the box, just a little fyi .

Believe me, I am one of those people. When it comes to a woman from a Muslim family marrying outside of her religion, COs at consulates generally do not think outside the box. You didn't mention before that she would be interviewing in France. If you had, I wouldn't have commented at all. Seeing the Moroccan flag beneath your name implied to me that she'd interview in Casablanca. There, your non Muslim faith would be an issue during an interview. A big one.

Since you say she's interviewing in France, it's probably a non issue, and I very sincerely wish you luck.

Thanks for jumping on me and getting all defensive :D Gives me a rush.

K-1 Fiance(e) Visa Process & ProceduresMy true love from Morocco,

Greetings everyone,

I am new to these forums, My fiancee and I just submitted our application through a website called easyfiacnceevisa.com around april and found out our application was being processed at Vermont center "hopefully we don't get the bad luck of being delayed" Even though we are from 2 separate cultures , her family and mine. "My parents being Catholics and her family being Muslim ... well her grandparents. So we decided to have a neutral spiritual wedding and also decided to be agnostic. I am hoping being prior military and having a Military Clearance with already heavy back ground checks, that this will not cause any delays, also having a long history of being with each other physically and communication wise that our process will not be delayed. Now we just have to wait for the visa to get finally approved and finally move into our brand new home we just purchased.. we are so impatient .. all this waiting is almost driving us crazy.

Your Muslim fiancee is ok with becoming agnostic for you?

Good luck with your interview.

If you're really concerned about it, just wait until you get to the consulate. It can't hurt.
