US Citizenship General Discussionfiling for N-400 next year..
hi guys! This are my doutbs on filing a N-400: I was convicted of Misdeamenor and i am doing my Counseling for Batterer's Intervention Program fro 52 weeks and a probation for 3 years. But i wanted to file my citizenship next year. I am thinking that after i get through with my counseling my lawyer told me i could expunge my name in the system if everything goes smoothly with me which i am very confident that will happened. But anyhow my questions are: In the application it says that i need to gather the paperworks from the court about my conviction: i wanted to know if this are what they want: my conviction papers, the result of my counseling, police report of the incident, thats all i can think of...is this all they need or there are some more papers??? Any help will be greatly appreciatted.thanks...

1. You cannot apply for naturalization until you have been a permanent resident for 5 years as you are not still married to the USC petitioner

2. You will have to add the misdemeanor with all details in your I-751 application: Question 7 on the form says, "Have you ever been arrested, detained, charged, fined or imprisoned for breaking or violating any law or ordinance (excluding traffic regulations), or committed any crime....."
3. If you battered your spouse, I doubt the USCIS would look favorably on your application (just my opinion).

All true statements Mrs_S. Sounds like getting past removing conditions will be hard enough, let alone naturalization, which requires good moral character. (my opinion as well)

Mrs. S and Roi Aggie: About the misdeaminor incident it is not mine. It is my friend who is inquiring that. She came here as an immigrant visa. And now she will be here for almost 5 years. Sorry if i mis lead you guys. But my problem is my own paperwork. Im really thankfull that u guys share your ideas with me. God bless you both and thank you so much. Lets talk about my application: Yes i know my ex-husband's SS # coz it is in our divorce papers. And i am glad that the affidavits is not really that important because i am really stressed about it and i want my paperworks to be completed as what they requested. And before i send this out i wanna make sure that everything is there. By the way about the pictures how did u guys do the pictures since we got a bunch of it from where we started to the end we have pictures together. So did u guys put all the pictures in something to make it neat and clear for them? did u write a little note on each pictures? please i need more advice.

Even the affidavits is not a must...your case as divorce waiver, I would suggest so. Whatever "more" that you can show, especially because you won't have many easy -at-hand information, the better. Don't you know anybody in Hawaii or where you at that knew your husband?

If you were in a joint credit card...you CAN call the financial institution and informed your credit card number and who you are, you will need his SSN, they must probably will need to verify your identity for privacy issues or you just can go to the place where you had your joint credit card/bank statement and explain your situation. Get your marriage certificate AND divorce decree for you.

Sorry, about asking you some questions but I needed so I can help you. Where did you live with him before and how long? Give us a timeline...

My best advice is that STOP thinking what your ex husband can do for you, the chances that he help you are minimal if he just say that he only have the most recent one...BS he can get older ones for a little fee that you can say you can pay. But if he wants you out of the country...I don't know why you think he will help you. Forget about his family...it's amazing but family regardless they know somebody did something wrong/needs help/etc are the least people who will get involve and they can care less about you.

You need more comingled information...you need to show that you TWO life together in the same place as a husband and wife.

Good that you get the pictures, do you have emails from him? old ones? actually even the "chats" that you are having with him, save them. All are evidence. Do you have copy of the utility bills regardless that they are only at his name, your Hawaiian ID should show the same adress..not necessarily everything has to be at both names but you need to show that you share the same address.

I assumed you were married in 05 and live in Hawaii during 05, didn't you file taxes in 05? or at least him? he should apply as married...for that matter, there should be a transcript of it. For 2006 even you were in divorce proceedings...at the end of the year, you both probably apply as married filing separate...does not matter, get a transcript of it. Do you work? If so, didn't you have personal data that showed that you were married in your previous employer? Get that data. You need insurance? Didn't he has health insurance covering you? what about cars? car insurance???

You can PM if you want. Good luck.

No I don’t know anybody in Hawaii coz he only introduces me to his family and its kind of weird he doesn’t have any male friends that I’ve known. I met my husband through online dating. In a www.foreignbride.com website. He was a member and I used to be a member and he emailed me first and sent interest. I don’t have my credit card anymore because before I left Hawaii he asked me to give him back my credit cards, health insurance card. And I saw him cutting those cards into 4’s. I don’t know the account number though that’s why it’s hard for me to do it. I don’t have any information about our account numbers in credit card and personal checking account together. Yes I printed out some emails he sent to me before when we were still talking online. And I also got 1 letter from my friend back in the Philippines addressed to both of us as a married couple. But I don’t have those online talks from a messenger. No I don’t have a copy of our utility bills in Hawaii but do u know if I can request a copy and send it to my address or not? We got married in Oct. 2006. I filed my own taxes for the year of 2007 which I filed last January. Yeah I work starting last Nov. ’06. He has a truck but I doubt that I’m on it though. About the 2006 tax return i dint sign any paper, and other people said here in VJ that my ex doesn’t need my signature filing his tax as long as he knows my SS# which is true. Because we got married in the year of ’06. I hope that this info. Will give u more understanding about my case. Please feel free to give me more advice about this. I really appreciate you help. Thank you so much….

By the way i got here sept. 2006 and its gonna be 2 years this coming sept. since i got here in the states. Do you think if the USCIS needs more info from me, do u think they are going to send me a letter of what they need more from me? I dont wanna send my application if my paperworks is not complete and get denied. plsss more advice..

Removing Conditions on Residency General Discussionneed help in my paperworks..
here are some problems again: i am in a communication with my-ex hubby to send me the joint bank statements from his bank and with our credit cards together, but i dont know if he will really gonna send it to me since he wants me to go back home in the philippines. So now what if i dont have those joint bank account statements, and the only evidence i have for now are: our divorce decree, all our pictures together, my green card,my hawaain ID. I have another questions: about the 2 written affidavits of friends that is required with the USCIS I-751: 1. i dont have a friend here in the US especially in hawaii who can make a statement that we live together, we married in good faith, anything u can think of coz what happened is that he works from M-F then he will take me out on fridays only with him or sometimes his family, since the divorce i dont think his family will make a statement for me, especially that statement will be in favor for my applications, and also the other people known us is my aunt and older sister. So now i am really stressed of this who can make a statement for me, i am thingking to make my own waiver about friends written affidavit and tell them my situation when i was married to him.DO u guys think that would work witn them(USCIS)? My name is not in the house title since he had the house before i got here and the same thing with or utility bills. Before i forget he told me when i chatted with him that he only had the recent statements from our joint bank account and credit card statements as well.Do u think if ever he will send me those statements it will help my application or i need to get a statements during the time we were married? Please HELPPPPPP..... The last but not the least about filing his tax: i got here in sept. of '06 then our divorce was finalized in oct.'07. About his '07 tax can he add me in it even though we got our divorce in oct. '07 and when he file his tax i dint get any paper for me to sign. So i was thinking of me not in his tax thing. What do u think? I am really confused coz he was married to me within 10 months of the year 2007. please give me your adivice....
