You probably want to post this in the AOS forum, but you typically want to file for AOS soon after you are married and have the marriage certificate in hand. The sooner you file, the sooner you will get your conditional green card. Also note that you can't file for EAD until you file for AOS and without that you can't work legally here.

Technically, you are supposed to file for AOS before your I-94 expires after entering on a K1 visa. USCIS is usually forgiving though of those that file for AOS a little late, though I wouldn't recommend waiting for more than 6 months.

Yeah, just use UNKNOWN if you are unsure. I can't see you getting an RFE over something like this. Even if you put NONE at this stage, it should be fine. Once you get your NOA2, it will most likely have your A# on it.

Hi adins!

There's no need for the extra expense of a lawyer for an uncomplicated case such as yours. You have a great reference and all the help you will need in this site.

For the G325A forms, if you are running out of space, just print out a supplemental sheet with the additional information you need to include.

Label it something like:

"G325A Biographic Information Employment History Supplement"

Just create 4 copies and attach them to your G325A. Also make sure to sign and date each page. This is what I did with my forms and I didn't have any problem.

Welcome to the forum! My wife is also Indian and recently came over on a K1 visa. I filed the I-129F petition in Aug. 05' and she had her interview on Jan. 12th. I went through Texas and got transferred to California like yourself, so you can check my timeline for reference. My wife's interview was in Chennai and went very easily. Which consulate are you going through?

If you have any questions or need advice, please let me know. I know the wait to be with your loved one is difficult, but it is worth it when you are finally reunited :)

I actually made the mistake of sending my original Certificate of Citizenship to USCIS with my I-129F petition. I thought I would have to kiss it goodbye, but to my surprise they sent it back to me after my petition was approved. I guess it was good luck, but I've learned my lesson now about holding onto original documents :)

Thanks again for your replies. We wanted to get church wedding right after i get K1 and before i enter the US for the civil one because we don't want to live together as a couple if we havent had religious wedding first, it's tradition for us, and my parents would disaprove it otherwise, but due to the circumstances, they would have to deal with it.... I understand we're under a special situation now.

I have a new question, if i enter the US and do civil wedding first, after around how long will i be able to come back to my country and perform the religious one?

You can apply for Advanced Parole(AP) along with your AOS application, which will allow you to leave the country and return while your AOS is pending. My advice would be to have a civil marriage soon after your fiancee enters the US and then file for AOS/AP immediately. Usually, the AP is approved within 90 days at which point you can use it to go back to your country and have the religious ceremony.

No, a copy should be sufficient. I would recommend sending a copy of your naturalization certificate as opposed to your passport for verification of your citizenship.

if they chashed the check is sure its coming.. :) they mail the NOA1 to us the day after it was cashed, of course need to wait 2-3 days for mail to be delivered.

We filed on Feb. 14, on Feb. 25 we received NOA1 dated Feb. 16, so it basically took 2 days to arrive to NE, they made the NOA1 the same day it arrived, but they mail it until Feb. 22 so it arrived to our hands on Feb. 25.-

just keep on waiting, its HARD -harder at other times- but Vermont is faster than all the other centers.. so you will get it soon, remember that at times things slow down cos of holidays and all, plus the day of the week they recieved also counts, they usually send the NOA1 after cashing the check/money order.

man its been 20 days, no NOA1 from nebraska.


did you check if they cashed your check/money order?
since monday 20 was holiday, even tho they received our pack on the 16, they cashed money order until the 21 and then mail the NOA1 on the 22... and arrived until the 25.. yours should be close by..

they changed mine too, so i guess they did it with everyone..
but even like that people have been getting theirs in the 60-90 days average, so i am assuming they changed dates so that people dont start bugging them and asking them about why its not there yet -at least in some cases people have to start bugging them by the day 60-

i just hope they speed up.. and dont slow down cos they changed the dates..

What I read here is that people call the National number given I think it's on your NOA1.
It appears some have called the Service Center they are being processed through.

The state is which my fiance lives, Wisconsin, states thatany legal certified documents not in the english language must have attached to it a certified and notarized translation. Who needs to do the certifying and notarizing? Can any notary do it?

I applied on 3/6, they received the petition on 3/7 and I just got the NOA1 in the mail today. Check was cashed on 3/10 and that is also the notice date on the NOA1. I'm at the California Service Center though....hope yours comes quickly! I know "waiting" feeling isn't fun!

Hi All,

Besides my "newbie" post, this is my first post. I just sent in the I-129F petition on 3/6, but one question I have is regarding the submission of my (US petitioner) birth certificate. According to the guideline here, it says a copy of the birth certificate, front and back, OR a copy of the entire passport. This is supposed to prove citizenship. My concern is that I should have sent the birth certificate instead of the copy of my passport. In my passport, I do have two Indian Visas - tourist and business.

Has anyone sent in copies of the passport and not the birth certificate? Also, it's been mentioned that often times the originals should be with the fiance for the interview....well since I submitted my passport, does that mean I need to send my passport to my fiance in India when the interview comes up?

Any info is greatly appreciated.

Well it appears I should have waited until I got home before posting! Checked the mailbox and the NOA1 was there!! In reading other timelines, it appears the NOA2 takes a little longer, so while I wait, I'll just enjoy my three week vacation with the love of my life! Leaving for India next Friday, 3/21, spending three weeks with my fiance! Too darn excited I can hardly stand it.

Hello to the most informational and friendly group!!!

Quick question....I have read on plenty of timelines that people received their NOA1 like a few days after they sent the petition. I thought people said through email, then they received a hard copy in the mail. I haven't received either yet, but I called my bank and my check cleared yesterday, March 12th. I sent the petition on March 6th and they received it on March 7th at 11:13 am.

Any ideas when or how I'll get the NOA1?

Hello,

I hope this is the appropriate place to post. Has anyone ever taken their documents directly to the interview instead of the VFS office in Mumbai? My fiance has an issue with taking the documents 7 days prior as requested to the VFS office. He is getting a new passport delivered to him on the 1st and his interview is the 8th of October. In packet 4, it says that you can bring the documents to the interview itself, but it's strongly suggested to take them to the VFS first. We have an email out to the embassy, but I thought I'd see if anyone has done that before and what the outcome was?

Hi All,

My fiance submitted his docs to the VFS office in Mumbai today. This is a requirement before the interview. However, I realized in looking at the form online, he spelled my name wrong!!! In question #10 - Permanent address in the United States where you intend to live, if known (street address including zip code). Include the name of a
person who currently lives there.

He spelled it wrong.....instead of Jenni Rainer, he spelled it Jemni Reiner......completely rushing it I'm sure!! Do u think this will cause an issue?

Ok, I have looked around the forums and guides, but I still have two questions.

1. For the initial petition I129-f packet, what needs a notarized signature?

2. Has anyone had any problems with not including a supplemental sheet for question 18? Are the few lines on the form ok, or should I do the extra sheet? I assume as someone said, they don't have time for a novel and we will explain in more detail at the interview.

Hate to be the bearer of bad news, but this exact thing happened to me and my fiance. He doesn't speak English and when we came in to the country together (POE Atlanta, GA) they DEFINITELY made us go to separate lines. I had to sit and wait over an hour for him to come out and I didn't know what was going on. The people working at the airport were rude every time I asked what was going on and eventually I went and asked an immigration employee that was getting off of work and he did help me by going back up and asking. After probably an hour an a half I was finally allowed to go up and see him in the waiting room he was in. After that it took about 10 minutes more. I see that I am the only who says this so maybe it's different depending on the airport, but it was not a pleasant experience. Not trying to scare you, I just want to let you know that it is possible you will be separated. You both will survive, but waiting isn't fun...

You'll have to explain and describe the circumstances under which you and your fiance have met in person within the last 2 years on question 18. You'll also have to provide evidence of such meeting.

If you haven't met through a marriage broker, just check NO and add N/A in the box below. For the conviction part (Part C - 2) just check those that apply. If none, don't check anything.

Hello Everyone!

I've been visiting visajourney for a month or so now as I familiarize myself with the whole K1 process. I've prepared pretty much all the materials and am just gathering the last few items together. I have a few questions:

1) I've heard people see this document has to be notarized, that document doesn't have to be notarized, etc. But it seems like everyone contradicts everyone else. For this initial petion (I-129F, G325A, other evidence) petition, what if anything has to be notarized??

2) My fiance and I did not meet through any sort of agency at all. I met her on a train in March when I was still in China. In filling out the I-129F, I indicated this. Will we still be affected by IMBRA?

3) Yes, it seems like everything is being sent from the Nebraska service center to California. I'm from Milwaukee, WI, and Nebraska is my service center, am I still suppose to send it there or send it directly to California?? I assume still send it to Nebraska, but just checking.

I've had a busy day, but I'll share our story will everyone in due time. Thank you all for the help you've already been!! :)

I think you missed this last bit: Also, you'd have to submit documents in connection with the I-134. Be sure to check what is needed so you can be sure that you can get those documents before going to China or while in China.

I'm going to be filing my petition very soon. After filing the petition, assuming I don't have any referrals, is there anything else on my end that has to be done in America?? Or could I go over and wait with her in China?? Because I think this is going to be our plan....I'd go over there to study and be with her during the waiting time.

Hmmmm, for example, if I fill out the I-134 form in August (2006), would it still be valid in say June 2007 around interview time?? Or do I have to fill that out following the approval of the petition or at a later date??

After filing is there anything then that has to be done from America, or at that point could it all be taken care of from China??
