Bonjour,

d'abord je vous explique ma situation. Je suis francaise. Je suis venue aux USA avec un visa J1 d'au pair pour deux ans. Ben et moi nous sommes maries une semaine avant la date d'expiration de mon visa.
Maintenant on rempli la demande de changement de statut et dans les documents a fournir, il faut y mettre un extrait de casier judiciaire. Le mien est vierge. Mais comme tout document fourni, il faut le traduire. Je n'ai pas l'argent pour payer un traducteur officiel et je sais que je peux le faire moi meme et certifier que je suis bilingue dans les deux langues.
J'aimerai avoir une confirmation que c'est possible. Et je me demande aussi si j'ai besoin de donner mon casier judiciaire puisqu'il est vierge.
Quelqu'un parmi vous a t-il ete dans cette situation? et comment l'avez vous fait traduire? j'aimerai trouver un modele quelque part.

Hi,

I am new to the forum and want to introduce myself. I am the French one and I was born in Tours and I have lived there until I was 21. Then I moved to Virginia to be an au pair for 2 years and that's where I met my husband. We dated for 2 years and we got married just a week before my visa expired. It wasn't planned since I was about to go back home and spend Xmas with my family that I hadn't seen for a year.
So now we live in Washington state. He moved from Maryland to Washington where his mom and brother live and that was actually a good thing since he realized he missed me!

I am teaching him some french and he picks up especially the bad words! lol
Now we are filling out I 485 and I 130 for him. and also advance parole, EAD and affidavit of support. All of this is really stressful. Sometimes I wish I had the money to pay an attorney and do the work for me.

So I received the congratulations letter that said I should get my green card within 60 days but I opened another mail and there it was!! That's it, I'm done for a good long time. Is anybody here going for citizenship? I will but in a while because it's another 600$ to spend.

We didn't add any personal pictures for the evidence. I'm sure that the deed and insurance cards, bank statements, are enough. Last interview I made a book with pictures and the interviewer didn't even flip through it. I'll bring our wedding picture books to the interview if we have one.

Man, what a mess. Soooo close, too.

Can someone tell me if I-134 is supposed to be notarized and does it get turned in along with the police report and medical at the day of interview....or does it have to be sent in with packet 3?

I know I should be reading the instructions...and i will, but this flare-up with the (already paid in full) visa agent, has caused some static between my wife and I now as well...I need this info fast to calm her and prove my point...this guy does not know what he's doing and we are sure to be refused if we continue with this bonehead.

More than likely he is reading this...which is good,...maybe he'll accidently learn how to process a visa.

If I’ve read correctly your wife will be applying for an CR1 visa based on the approval of the I130. If this is the case you would have had to send an I864 (Affidavit of Support) to the NVC prior to them forwarding the case to the embassy.

The Embassy’s web page has changed but it used to specifically state that I134’s were to be used for K1 & K3, and I864 for CR/IR1.

If however it’s causing big static between you and the wife, I suggest you say “ok yes dear” and send her a notarized I134.

For DHL tracking try using the word correspondence in the reference line. This will probably not be your files but will give you an idea how long it typically takes. That is assuming the NVC sends everything DHL International Express.

 I would like to know how I can become a Brazilian resident through marriage. If I have my U.S marriage certificate legalized in America and then registered in Brazil, how is the process after that? Also, if the residency process takes more than 3 months, how bad it will be for me to still be in Brazil with a tourist visa?

I sent my 129-F in early December, and got a part time job by the end of December. I recently graduated, so I don't have any listed income for the 2009 fiscal year. I currently am making about $2400/month (after taxes), and have the pay stubs for it. I will find out if I will be employed full time at the end of March, and hopefully will receive the NOA2 by then. Are the pay stubs alone enough for the I-134, or what other evidence do I need?

On a side note, if that isn't enough for the I-134, I can have my mom be a co-sponsor. Her income is roughly $60k/year. What evidence would we need to support that, and is that sufficient, or do we also need to list assets? If we need assets, then what evidence is needed?


The three most important things are:

-Your latest Tax Returns

-Proof of employment letter

-Pay stubs

We have no had our interview yet, but from the many experiences Ive read from other people, these are the three documents you will need.

If your mom helps you, those are the documents you will need to get from her.

I tried to get my wife the tourist visa before we married, but they rejected her because, not even joking, she is "too pretty, speaks english too well, and doesn't have enough reasons to come back home." The goal was for her to see what it was like in the USA before deciding to get married. We met twice before in Brazil and we were kind of forced going through the k-1 route just for her to come here(I say kind of, because we were eventually going to get married anyways). So my advice is, if your fiancee goes the tourist route, tell her not to be pretty and speak very bad English! :P But actually I am serious, because the main thing the officers look for is reasons that you will stay in your country.

I would say the best choices for you now is to get a marriage license here first(whether you have a ceremony yet or not), then you could go to Ukraine and have a ceremony for her family after you get your authorized travel document or green card when applying for AOS. Going there and starting a whole new process through the k-3 after already doing the k-1 is not something your going to want to do. In my situation I just had a ceremony in my wife's country first out of respect to her family before we left her country, but nothing official, just the ceremony. Then we got our official marriage certificate here in America.I would do everything possible to keep her to stay until then. My wife really wants to go back to Brazil to visit her family, but she also know that once we get our Authorized travel document and Green card we can go back to Brazil and visit anytime we want. Everything takes patience!!

Regardless of country, people visiting the United States on tourist visa have to prove to the consulate/embassy that they have ties in their home countries that will compel them to go back.
Owning an apartment and business is good enough. The only trick here is that she is coming to visit her fiance. That might cause suspicion but at the same time she has to tell the truth!!! They might think she's coming here to get married.
I understand you want her to bring the 5 year old son, BUT having him staying behind in Russia would increase her chances of getting the visa.......simply because HIM would be one of the reasons she'll go back home.

Once your case gets to NVC, everything should go by smoothly. If any delays, it will be with the U.S embassy in his/her home country with getting him/her the interview appointment. Your case should get to the embassy in a week or two from today.

It all depends. For moral support, it would be great to be there. At some embassies, they may interview the both of you together. Others may interview the both of you one at a time. And from what I have been seeing here on VJ, most embassies don't even care whether you are there or not.
Being there on the other hand could further prove your relationship!!!
If you have the money, go ahead and be with her at the interview. If your budget is kinda tight, you can stay and use that money for the AOS.
As of my case, once we get approved, am gonna fly to Uganda and be with my fiancee at her interview in Nairobi, Kenya.

She doesn't need to have your marriage certificate at the interview...from what I know. They just need proof of termination of prior marriage(s). If am correct, then you shouldn't have a problem.
Just a simple question:...Is the name on the divorce decree the same as the one you put on the 1-129F and G325A?

If the answer is YES, then don't worry about a thing.
