Got to be honest here, i was sweating big bullets on this.
First, she does not hardly get any mail sent to her, so we only had like a 10 day notice to get ready.

here is the best advise i can give you.. ***** get on your police report now if you live outside HCMC ******

when she went to her local police office station to get her report they told her 3 months!!
We ended up paying a local "lawyer" $250.00 USD to get her report just hours before her interview.

I will fill in more about that later.

i just want to thank all my Vietnam VJ members for all of your support and help during this very stressful time. some of you have been great with your positive messages and advise.

i will pray for all of you.

You (we) all are very special people. we have love that does not know boundries. our love we have is beyond politics.

Meeting the minimum requirement to get an approved petition is not "The End". They will also need to satisfy the consulate that the relationship is bonafide to get the visa. In the recent past, there have been significant marriage fraud ring exposures dealing with Vietnam. In those cases, The paid USCs took trips to Vietnam to meet the minimum requirements followed by a quick filing of a visa petition. Such a circumstance may rightly be viewed unfavorably by the CO in making his determination of the legitimacy of a visa applicant. I think the OP has a very valid concern, especially with the circumstances surrounding the consulate they will be dealing with.

Let me elaberate a bit more on this:

The K1 visa requirements are simple. You must be a USA citizen. Lawful permanent resident "green card" holders of the United States are not allowed to obtain fiancee visas. Both you and your fiancee must be free to marry. This means that if either of you has been married previously, you are either divorced, widowed or the marriage was annulled. You must have met your fiancee in person within the previous two years. If your fiancee lives in a developing country she cannot legally obtain a visitor visa to meet you in the U.S. This means that you must travel outside the US to meet your fiancee. Finally, there is a minimum income requirement for the fiancee visa petitioner.

I have a question, my fiancé and I have known each other for a year online and then I decided to go see her in person and after we met for a week we got engage. Me and my fiancé have been reading some posting and her friend just fail because they said that the timing was too short how could you make up your mind so fast and they got blue. So naturally it makes me worry because that sounds like our case. Please any input on this matter would greatly be appreciated. And also my fiancé live in the countryside and I would like to go to HCM city a week before the interview do you have any recommendation on what is good Hotel that all my stuff will be safe in?

Please relax brother. There are times when I feel that I am going to blow my load all over this process. I know what you are going through and I am sure others here know what your going through. I wouldn't hold much water to any of the stuff that people are telling. 1) The Hanoi Chief is not working in this department. He doesn't and has no experience in dealing with these types of Visas. 2) Others here recently have been approved using a Co-Sponser. 3) Don't get caught in the endless lifecycle of drama/gossip/stories that people tend to throw out there in Vietnam and in the Vietnamese community.

Look past the garbage talk. FOCUS on what you have been doing. Keep a firm resolve, and your head UP!!!

By the way, his name is J. Craig Fong out of LA. Whatever you do, do not hire him! This is our current situation as sad as it may be. On the 28th, Ngan and I went to Saigon to get her medical out of the way. During that trip, a friend of mine hooked us up with a service to help Ngan get her papers in order and such, he noticed our I-134 amounting to $14,000 and said, no, theres no way they'll take this little. Ngan pointed to the Co-sponsor form that my mother filled out. He looked at us and shook his head, saying that the consulate hasnt taken a co-sponsor since 2005. By the way, the whole time our lawyer knew the dire need for a co-sponsor and even a few months ago I confronted him on that, he told me that the consulate had no choice, if they deny her because of that, that's where he steps in to fight for us. Well, after we heard that news, I shot an email off to the chief consular in Hanoi, who happens to be a good friend of a family member of mine, he replied confirming the services story. Though, he said that if I had a sum of money and a couple prospective employment letters for Ngan that I could show the officer, that should be acceptable. To further confirm, I met with an expat friend of mine for coffee. Along with him he brought his friend, a woman who works as a foreign minister inside the consulate. We talked for an hour about our situation, she confirmed everything and advised we refile for a co1 visa. We came too far to not fight this. Being the genius that I am, I asked my father to fill out a 1099 misc. tax form, stating he employed me in 2006 for the amount of $8,500. My 2006 w-2 from my current/past employer was for $9,500, so combined I now have a total annual income for 2006 of $18,000. Though, I did have to pay $954 dollars in income tax on that. Now, I have a brand new I-134 with a 2006 income which is suffice to the federal poverty line and her and I are now just hoping and praying that the officer will accept it without difficulty. I also have a couple prospective employment letters for her that are in the mist of being fedexed now. I'm also planning on attaching a letter explaining in detail why my 2006 income from my current/past employer was low for the year. The reason being that I was in Viet Nam with my fiancee for 6 months out of it. I still can't help but be nervous as hell. If the lawyer would have known anything about immigration, he would have informed us 7 months ago so we could have just done a co1. If all fails, I'm moving here full time to teach english. ###### America.

I've been filing US Income Tax since 1980 and have no idea what a Tax Transcript is. You get your W-2, you fill out the 1040, you stick it in the mail and you get your refund check in the mail. I have no offical document from the IRS indicating that I have ever filed a tax return in my life.

How do you get a Tax Transcript? What is a 1722?



There is a 1800 number (Someone else have it?), I don't know what it is off hand because I am at a clients now. Just call then, and they will send you a transcript of the year you request for free.

I am just curious how can someone fudge something on the 1040 when W-2 has stated how much someone makes in a year and how much taxes he/she has paid. I am assumed that the HCMC US cares about how much you make in year and do you meet the income requirement.



I can produce a 1040 right now showing that I make 1000000 a year, sign it and send it off to my fiancee. Just get the ol quickbooks together and roll with it.

Now the transcript is a direct reflection of the checks and balances of the IRS. It comes from the IRS. If you fudge on the 1040 and submit that to the IRS, good luck with that on your chest when they come pounding on your door to take your new stainless steel grill away. They verify all the data you submit with what the W-2s and from what the employer has reported. Hence, the checks and balances the computers do automatically to catch this stuff.

Original Affidavit of Support Form I-134 and the specified financial documents. Form I-134 must be signed by the sponsor and notarized by a Notary Public no more than one year prior to the date of interview and include tax records for the past year and an official letter of employment (on company letterhead) signed within the past year or a valid business license. Submit one photocopy of the I-134 form for each applicant in your family. If you require a joint sponsor, the joint sponsor must submit all documents listed above plus proof of citizenship or LPR status, such as a U.S. birth certificate, naturalization certificate, or green card.

I have noticed throughout the forums people making silly mistakes. Not paying attention to the details of the instruction packets. I will give a perfect example below.

A lot of people have problems or claims that the consulate denied them or gave them a green/blue because of insufficient income. But if you take a closer look at the instructions it states the following:

Notice the keywords that I highlighted. Reading the instructions quickly, I may have blown by the word "might". But looking at the instruction and breaking down the sentences, I come up with what occurred to one of our VJ members.

Basically it states that the consulate "prefers" the tax transcript over any other documentation that you provide for income. But you can submit the W-2 and/or federal tax income return by themselves if you want to wager with the consulate and play the lottery because they "might" accept only those. I think the consulate prefers the tax transcript because it comes from the IRS and it would be an easy task to create/modify your own W-2 and/or federal tax income return.

This goes for the other instruction within the packet. My fellow Viet Nam VJers, please break every sentence down and analyze it in detail. Even after the 1000 time I have read the instructions, I still find something new to send my fiancee.

You can avoid simple mistakes just by reading a bit more critical of the instructions that the consulate gives you.

A perfectly good example of people blowing by sentences and not reading exactly what is says is a little test below:

Why do we hate NC? Because the food is #######. The cities and towns are spread out over zillions of acres. There is a lack of culture. No asian markets (well, there is one a full town away, but it is small). No movie theater worth anything within an hour drive time, etc. etc. etc. It's just ####### here. I made a mistake trying to come down here. Oh well. We will leave as soon as we can.

I wife is not from Thailand, but I would venture to say that Vietnam has the longest waiting time of most countries by looking at the statistics pages from this website.

I would say number 1, don't listen to people that have a negative outlook or give negative comments like that. That will only bring you down. The truth is, is that you will be waiting, but how long, nobody knows. Keep your head up and glaze over on the posts that display negative comments.

hello all

just put my 2 cents in:Only 1 trip to vietnam for 20 days, and we took a 3 day trip to BKK. dont know if that was a factor or not. But I work for a college and summers is my only vaction time. When i got back to my college, had a story of my trip published in the local college paper and then sent a copy to her, and the interviewer was very impressed with the newspaper item and read it all. The other item they were very impressed with is her educatin and current job position. Those 2 items they spent some extra time on. They still did not give me a go slip right away, they ask for more tax info about me, which i got to her in under 12 hrs. at which time they gave the go ahead. So there is many paths to success and many paths to failure. have faith in yourself, dont give up and dont get mad. It is my belief that they have a quota system to meet, so many pass, so many fail, so many need more work. they need numbers in all columns to prove they are doing there job.

It amazes me that people can get angry over a post. I mean, I am seeing real hostility here, much of it from people in review (despite the fact that I am in no way responsible for that) and despite the fact that I never said you have to go to Paris and Germany to be accepted or any other such nonsense. I simply pointed out things that greatly help a case move forward to being approved. I pointed out stuff that the CO who interviewed my wife mentioned. I pointed out OBVIOUS stuff that has continued to be overlooked by many many hopefuls here.

People can deny all they want, put there heads in the sand, throw tantrums at their fellow members whatever. If this forum is only good for certain types of views, then I think I will not waste my time here anymore.

I can tell you that I could have done without reading these forums, but then again, I couldn't have. These forums are a double-edge sword when it comes to getting information. Some information is purely good, other information is just so damn wrong it is a crime. These forums have confirmed several times throughout my process that I have been doing the right thing, but they have also confirmed that what I was doing was wrong. I cannot tell you how many times I have just exploded and freaked out just because I read something on these forums that have indicated what I was doing has been wrong all along. Not everything on these forums is correct. There is good advice here, but you must have the capacity to understand and wade through the bull along the way. Not everything written down is true. This was the belief in the 1800s in newspapers, but this is not the case now. The only way to come close to what can be factual is testing and measuring what you know (common sense), to what others know as a whole, not just what one or two individuals say. Isn't this how cults start by believing in what one or two people say?

To sum this up in a sentence:
Non-Critical thinking skills need not apply.

Another question...

Do I have to move back to the US to file? It looks like I will have to have some type of job in place so that I can show support requirements. If I can file while still living in australia, what office would I send the forms to? Looks like doing away with the DCF has made a mess for people like me who happen to be residing in a foreign country.

I do not have a permanent residence in the US; however, I have used my daughter's address to keep my driver's licence current in Utah.


I think it depends on if the consulate there has DCF (Direct Consulate Filing). You may need to check the "Embassy Info" link if it states that or not.

Hello everyone! I hope I can get some good advice on how to start this procedure!

First let me give you some background info. I am American, married to an aussie husband. I am a permanent resident of Australia and have lived in Melbourne since November 2003. We just recently celebrated our 3rd wedding anniversary! woohoo!

Anyway, now we are seriously considering moving to the US because my father who is 75 years old is in declining health and it would be nice if I could be closer, plus the fact that my adult children are having and raising beautiful grandchildren that I am unable to see . Two new babies have just been added to the family in the past 6 weeks.

What is the best way for me to go about moving back to the US and being able to have my husband be with me and not have to be seperated?

Thank you folks. Even though I feel like I am playing the lottery, I feel somewhat sure that she should get it. I thank most of you here for the knowledge that I have gain, and with that knowledge you have possibly…No wait…You have definitely united two people together who love each other as equals.

I don't recommend this process to the faint hearted. In the past other would see me as an A$$hole at times. Others see me as a resolved person in my own thoughts and mind. For those that know me personally, you know who I am. I can honestly say that I have learned life lessons within the confines of these forums. These lessons I will take with me on the rest of my life journey on this earth.

I took one piece of advice to heart from one member that I disagreed with a few times "Just relax and as I kept saying: stay focus, get your visa and remember: payback is a $@%@#".

Don't take heed in anything anybody says on this site. Listen only to the information that is directly related toward forms and other evidencial factors. I'm going to say this one time, so listen up: THE INTERVIEW PROCESS IS EXTREMELY SUBJECTIVE!!! Disagree if you will. If you're an American, go to the interview, let your presence be known. Write a letter for your fiancee to give to the officer, if for some reason you can't make the thousand's of mile's of a trip. Sign, notorize the letter. Let them know you're here, or there, and you'll fight the decision if it's a negitive responce. If you're a green card holder, good luck, you're in a lose, lose situation; write a letter to submit and hope for the best. The odds will be against you wheather you're a US citizen, or a green card holder, prove them wrong! Fight it before they make you fight for it! Get everything in order, show your face/writing. I passed with a $9,500 dollar 2006 income...What can I say? My fiancee fought for it, I fought for it. If you're indeed real, don't take their ######. Get it together and do it right! My point is this: Don't listen to the stories writen on this site. Some may want 'official' tax transcripts, some may want your 2006's, because the 2005's were not good enough, some may want a video of you talking in Vietnamese....Get what I'm saying? IT'S SUBJECIVE! It's all up to the interviewer and his/her attitude that day. Don't worry yourself sick because someone else failed who was in the same situation as you. He may fail and you'll pass. Good luck to everyone else and thank you for the support.

you're giving me flashback of someone we've seen on VJ.... I hope this is strictly just your opinion of the whole Visa process, based on your own experience which ONLY applies to your case alone and has absolutely no value to others who do not have the same or even similiar case. Be humble and grateful that your case passed without any issue. Move on and focus on the next transistioning phase!

Good luck and thank you for sharing your personal opinion. Subjective it may be, but what can you do to increase or reduce the risk of that subjective matter from affecting your case, that's the question!
