I went at the interview all by myself, but as you know...others had their respective fiances with them and the result was the same: we got approved. I think the US immigration lawyers are used to really difficult cases or high fraud countries where you never know what one can expect from the Consular Officers (OK...and some lawyers have no idea of the entire process altogether). You will get out of the Consulate door with a big smile on your face, no doubt.

i guess im just needing to vent,, im under so much stress this afternoon, i been with my husband since 2007 and finally alhamdillah in 2 weeks we have our interview inshallah, but i think to myself ,, my god the life is so short and how can strangers decide if my husband and i and the kids can be together in usa, ugh, i know i sound like im whineing or something but someone that we dont even know is gonna decide in 15 mins if we are a real couple or not? i just want this to end, i just want us to get approved get the visa and go home! im missing the kids so so muchhhhh :crying: :crying: :crying: i want a simple liffe, im tired of this journey, i just want to focus on whos gonna take the trash outside or worry in should i cook chicken or roast for supper?are we going to take the kids to the movies friday or saturday night? just normal things in life!!!every year i keep comming back to egypt to be with hossam and everytime i leave him here it gets harder and harder :crying: im sorry for this breakdown its just stressing, do they even realize how stressing this is for all of us? like when i was in hospital doing my surgerys and chemo for my cancer ,, i wanted my husband with me and when i woke i had my kids opening the laptop so we could open cam s and me and my husband talking through mic, him asking are u ok baby? wish i was there with you and so on :crying: to sit and watch the fireworks on the 4th of july and look to the right, pretending its hossam sitting there and saying happy 4th baby :crying: so many events i cant even count that we missed in our lifes,
i unders stand that usa has a job to protect its citizes from fraudulant marriages i get it, but damm this hurts :crying:

We're getting married in June in Thailand. So I guess... after that my timeline will look a little more legit. HAHAHAHA And I am still figuring out the difference between K-3 and CR-1. To my understanding when you file the I-130 it sort of defaults to the CR-1?


I understand of course, it's just that timelines help members to give specific advice and/opinions that need info like beneficiary's country or USCIS office you'll file to etc. K-3 is dead as far as I know...CR-1 is the way to go. Best of luck :thumbs: .

I'm curious as to how many of you used a lawyer to help with all the filing of forms and visas? And if so, do you think having an immigration lawyer even makes a difference? Or is it better to do it on your own? Do you think it's a waste of money to hire one or a good option?


usually it is recommended to hire a lawyer if you have a difficult case (overstay etc.) or the beneficiary's country is considered "high fraud"...Otherwise, it's a waste of money. Most of us here applied without the help of any lawyer...You'll find this website extremely helpful every step of the way.

It is indeed good for moral support, but it's not a must in Bucharest. The consuls are nice and pleasant; with a real marriage and if you put together a good file you should have no problem at all. My now husband could not afford another trip to Romania, especially so close to starting our life together, so I went by myself at the interview. It's mostly a matter of personal choice, not a consulate requirement and it will not affect the outcome in any way. Good luck at your interview next month!!! :thumbs:

is it a good idea to mention to the director of the national benefits center that i am going to take the case to the court? my case is still pending ( two years ) and i wrote a letter to the director and mentioned all my medical issues and requested expedite but i mentioned at the end of the letter that i am going to take the case to the court if they don't resolve my case within 30 days . a friend of mine tried it and his case was approved after she was stuck in the name check for almost two years , they approved her case two weeks after she sent the letter to the director of the service center . is it a good idea to mention court or not? should i write the letter again without mentioning court or leave it the way it is? thank you

that's an estimation for when you might get the NOA 2; after NOA2, your file goes to NVC for a week (sometimes less or more), then to the Consulate...It usually takes another 30-50 days until the entire process is done. So, NOA2 around Nov-Dec, visa in hand Jan-Febr... Best of luck and, as our fellow VJ members posted, make sure you read the guides! It's all in there...

the processing estimates on your timeline says you might get approved around Oct 27 - Nov. 2. That's an average, but it's good enough to keep it in mind. I'd say anywhere between late October to mid-December. Good luck!

If you are due in January, it means that in Nov. you will be 7 months pregnant, right? Normally, you would be allowed to fly, but it would be great if you could have your interview earlier than that. Have an easy pregnancy and delivery :thumbs: .

I'm confused about whether my divorce decree needs to be presented by my wife at her interview, or if I provide the documents first. Am I supposed to send my divorce decree to my wife so that she can present it at the interview? I assumed that the consulate, where the interview will take place, would already have all documents pertaining to me via the I-130 Packet I will be sending out. Please clarify, and thanks in advance.


We had applied for K1 and my then fiance did give me certified copies of the divorce decrees to present at the interview. There is another Romanian Vjer here who was delayed in getting her CR1 visa because her husband hadn't sent the certified divorce decree. The effort is minimal and so worthy it if you guys want to be together as soon as possible. Best of luck! :thumbs:

I think you should use your current, not last year's income. what if you had a raise since last year?. You can back that up with a letter from your HR and pay stubs. You still need last year's tax return though...

the answer for c. is 0, not 1 ; you counted your wife already in "persons sponsored". Do not count her twice ;) . paragraph C is for sponsors who are not married to the sponsored immigrant; for example in-laws that sponsor their son's/daughter's wife/husband . Good luck!

Yes, I anticipate I will have the same problems in Romania. The first thing we need to do is register the marriage in Romania and we have 2 options:
1) we do it in Romania at the Civil Registrar (but I heard that they ask for the marriage certificate in ORIGINAL, whereas we would not have it, since in the US the marriage certificate is a certified copy)

2) depending on where you are living, contact the Romanian Consulate (NY, Chicago, Washington DC...and I think there is one in Los Angeles too). Also, find the Consulate's website (I myself checked the website of the Consulate in Chicago) and you will find ways of how to register your marriage in Romania. They will practically do everything (including obtaining the new passport for you), but you need to provide the papers. Make sure you do have your new (married) name on some documents (SSN card maybe? GC?)

I'm still to decide which of the options to choose... Probably the latter, but I need to make sure I gather all the papers I need, cuz I have to apply in person (yep, can't do it by mail :bonk: ) and it's not like Chicago is 5 mins away from home... :blush:

About the employment history part of my wife, how I should proceed. Here is the situation.
She got graduated in June-2007 and worked for following periods:
July-2008 to Nov-2008 and
Feb-2009 to May-2009
She does have the experience letter from her employer. However as she worked as a guest faculty (Teacher) in a college she doesn't have a proper(formal) employment letter in India. In such situation should I not mention any employment history at all or write something like this

June 2009 - To date - Not working (decided not to work)
Feb-2009 - May-2009 - Name of the Place she worked
July-2008 - Nov-2008 - Name of the Place she worked
Jul 2007
- June 2008 - Unemployed


yes to the part in bold. don't leave any gaps in employemnt timeline. my employment timelines were very similar to yours and I wrote "unemployed" when it was the case. Good luck!

If so, then we also have a "touch" with a Memorial day date. I wish it meant we'd get NOA2 (but obviously since we just got NOA1, that's not happening). Hope it doesn't mean an RFE is on the way.


Yes, a touch is an update, but it doesn't have to mean you are getting RFE. It simply means that your file was checked, but your file can be touched several times before approval. We only got touched once so far, on May 21, and no RFE (thank God!). Good luck!!!

Hi Merejen,
Your fiancee will receive NOA1, hopefully in a few days. All you can do for now is wait till you get NOA2 (approval notice) and in the meantime you can start collecting proofs of ongoing relationship (phone bills, emails, plane tickets, boarding passes, photos), as you will need them at your interview. We sent our I-129F petition on May 24, 2010 to the California Service Center, certified mail. USCIS CSC received our package on June 1, 2010. We have not received an NOA1 yet. Looking at other couple's time lines it seems like we should have had our NOA1 by now. They haven't cashed the check yet either.
Is anybody else in this situation or our we being impatient?


we sent our petition on May 11 and we got the NOA1 in mailbox as late as May 22 (11 days), even if the the date on NOA1 was May 14. The check was cashed on May 21. Don't worry...you'll get your NOA1! have a smooth k1 journey ;)

First of all, CONGRATS!!! :dance:
Secondly, the CO must have told your fiancee what the next step is; if she didn't get the visa on the spot, they will probably mail her the passport and the packet that she should NOT OPEN. When she gets to the Port of Entry she will present that packet and the passport at the Immigration line. Those guys will open the envelope, ask her some basic questions (just like at the interview) and that's it. Good luck!

A quick question here... doing lots of reading before filing for our K1.

We currently live abroad in the UK.... and realise we need to file the I-134 - the affidavit of support. As a US citizen, am I meant to fill this out? Even though when we relocate I too will have no job and no house as we're picking up everything and going. Or shall a family member of mine fill this out on my fiance's behalf...?

As far as I know, you are still the main "sponsor"; so, even if you didn't have an income in the US and you have no assets there, you still need to file the I-134. In the meantime, find someone to co-sponsor and check the "poverty guides", as the co-sponsor has to prove that he/she can afford to financially sustain both his/her own family and your fiance.

yes, that's correct! the visa fee is $350...that is what your finacee will pay for. The petitioner pays $455 for filing the petition (thus covering the uscis and nvc expenses with your case -- like paying the officer etc.) and the fiancee pays the $350 visa fee, covering the expenses the Consulate has with your case (like mailing the packets 3 and 4, biometrics etc etc).

I am filling out the G-325A form for the k-1 visa, there is one filled out for me and one for my fiancee.
Now they ask for our parents information first, what happens in the case where the parents are no longer alive do we include them still?

yes, you have to give all the information you are asked for


The next question you are ask current husband or wife, former husband or wife?], What exactly do we write there. Are they asking if we have a current/former spouse or the current/former spouse of our parents?

That section refers to current spouses, so write NONE

The address don't completely fit on this form should i attached a extra page writing the complete spelling of address?

I would surely attach a page and would write "SEE ATTACHMENT"


Finally, I had read that the fees for the K-1 visa had be decreased, is it now $350 or is it still the $455 (US Currency)

The fee the petitioner has to pay is still $455; the beneficiary will have to pay $350 at the interview

My girlfriend is wondering about how my current marriage situation will affect the K-1 VISA processing. My divorce process will be completed in November (hopefully), and at that time we will start the I-129F process. We have been living together for the past few years and have been in a long distance relationship for three years before that. i.e. technically we have been having an affair until the point I separated from my wife (about a year and a half ago).

Does anyone see any VISA issues with the fact we have been living together (adultery?) or that we were having an affair before I got divorced?

I am wondering about issues with the V.O. or VISA process and not whether I am a schmuck for cheating on my soon-to-be-x-wife in the first place ...


I don't think USCIS or the Consulate will be concerned about the moral issue here; all you have to prove is that the relationship with your fiancee is real. Also, you will have to write a letter of intent in which you are stating that you are free and able to marry your fiancee within 90 days after her arrival...so I am thinking you might want to wait till November to file the petition?

For approved applications/petitions, post-decision activity may include USCIS sending notification of the approved application/petition to the National Visa Center or the Department of State. For denied applications/petitions, post-decision activity may include the processing of an appeal and/or motions to reopen or reconsider and revocations."

Does this mean we will be receiving our NOA2 soon?

I think pay stubs are meant to show current employment (backing up the letter from the employer), while tax returns are filed until April. The gap between April and interview at the consulate is filled with pay stubs...

Hello again everybody , now im here with a really difficult question . . when i was 20 years old i find in my left breast a little cyst . . im 29 now and i went to the doctor many and they said i have something really normal in woman but of course i need to take care of it . .
As almost all of you now for the interview when are going to get a chest x-ray and im worried for that . .
What IF i have something bad on me? . . i can be denied even if is not a contagious disease??
Of course my fiance knows about this and he told me even if i have something he want to be with me in all of this . . sorry im really so confuse now and scared . . maybe with out reason but just im wondering what can happen . . i can go to the doctor and find again if i have something BUT can i get a k1 visa if im sick??

Hola! I am a bit surprised to hear that your doctors say it's normal and let you live with the cyst instead of removing it :bonk: , but if I understand correctly it is not life threatening, right? One cannot see the cyst at an X-ray. You will pass your medical with flying colors, 'cause the doctors look for contagious, dangerous diseases, tuberculosis and alike; therefore, if you are anemic, your blood pressure is high or have a benign cyst...you will have no problems at all. my fiance received a letter saying notice of receipt, that includes the amount of checked used to pay for the fiance visa and it says it is being processed... is this what they call NOA1? Please enlightened me. It has a receipt number and everything...

K-1 Fiance(e) Visa Process & Proceduresnot willing to seperate..

Well, basically, me and my fiance have been together over a year...we met in person in the UK (I'm american but I'm legally allowed to be here). We live together and have for the past 6 months, but now I want nothing more then to go home to California. He'd also like to live there having visited in Dec with me for 2 weeks right before we moved in with each other. My question is...if I want to apply for a fiance visa so I can get married at home, how do I go about doing so?? Am I allowed to apply for the K1 without being in the US..and if so...what happens when I need to show that I can support my fiance?? Im just a bit confused because it seems that everyone is seperated while applying...and seeing as it takes so long ...we wanted to make sure that being seperated for however long it was...isnt the case..help!?
