In that case, I'd be sending it to them come early next week and then follow up later in week by phone to ensure its all ok.

The web site used to have the instructions for the medical exam as well -not sure if you got them. They want an x-ray and also STDs check. It had the names and contact info of a couple of physicians in Warsaw and I think 1 in Krakow.

The one thing that was a question for us was that the instructions in Polish wanted the affidavit of support notarized while the English version did not. I did just in case but other couples had reported they did not an had no problems.

Interview was very short, 5-10 min, and they didn't look at any documentation at all. Only 3 questions. It seemed they had already decided.

Yes, all the information is on the website. What concerns me is is it true that everybody just wait(ed) for the letter/packet from the Embassy?; is it really impossible to learn over the phone whether our case is already there or not?

Takes more than 3 days for them to register the delivery. back when we were at this stage (2 years ago roughly), I did call and was told to just download the packet 3 from the website. Used to be ther, but I seem to recall than a few months back I was looking for it for another post and it had been taken down.sleepy.gif

 

Given that there are holidays in Poland these days, I'd think your petition is sitting somewhere until next week.

 

I would give them another call mid to late next week. Yes I know the wait is unbearable, but a few days more might be neded.

FYI, packet 3 was a couple of pages that listed the docs you would need for interview and it was a 'confirmation' (once you send it back) that you had them all and an appointment can be made. But not sure if this is changed procedurally.

 

I know, it's all there, I downloaded it weeks ago from the website, and I have everything ready and prepared. The only thing I need now is to schedule the interview and do the medical exam. I think I called too early. Though the woman sounded like she was from a different planet :P

I called the Embassy in Warsaw, Poland today (the infoline number) to inquire whether my papers from NVC have arrived. If I tracked the delivery correctly by DHL, they were delivered on Monday (3 days ago). The lady on the other end of the phone told me she doesn't have such information to give me. She was also very shocked when I mentioned tracking the delivery by DHL. I learned nothing about the status of my case and was told to wait for instruction packet. Is this really the only way it happens? Not possible to learn over the phone? Or did I have ill luck? Or maybe I called too early, becuase they might not have our case entered to their system?

I would appreciate any input in this.

Hello I am filling out the DS-156 for my fiance for the K-1 visa. Her interview is May 15, 2013 so trying to wrap things up. For Question 31, "Have you ever been refused a U.S. Visa." She applied for a tourist visa back in March 2012 and was denied because she didn't have evidence to support her coming back to the country. Should we put Yes here and explain when, where, and what type of visa?

 

Yes, that's exactly what their asking for here.

 

For Question 36, "Has anyone ever filed an immigrant Visa Petition on Your Behalf.? Her brother back in 2007 applied for a some type of visa for her and there parents to migrate to the USA since he was already a citizen in the USA. Plans didn't go through because their mom passed away. Should we put Yes for this question too and just put that the Brother filed for her.

Does answering yes to any of these question raise any concern with the embassy and could we be denied for it? I am not sure so thought I ask. Thank you for your time.  

 

They can check it on their own, because they know they denied a visa application. If you lie on the application it's much worse than the fact that she was refused a tourist visa. Having been denied a tourist visa doesn't mean K1 visa application will be put in a negative light, but a straightforward lie will do that. Just be honest. Good luck.

yes i have some advice... DO hire an attorney... Do not try to file independantly!! Yes the cost is around $500-$1,000 for the fee and then of course the costs to the USCIS for filing and all the other costs that go along with a petition but i have been reading VJ for about 2 months now every night to stay updated and the info i gathered (someone correct me if im wrong) is this....... most applicants if not all that are represented by an attorney have less wait times and their journey is much smoother. I have yet to see anyone represented by a law firm or attorney get an RFE, slowing their petition down. I also have observed many many filers waiting 10-12 months before being adjudicated without an RFE but the ones reperesented do not wait more the 8 months tops! I asked USCIS today while speaking to a tier II rep, why this happens. She laughed a little and responded by saying the petitions are much better put together by lawyers!! She also indicated that the chance of one's petition being looked at by an ajudicator is greater if the file is correctly prepared. If they see the slighest of error (not even large enought for an RFE) they set it back down and move on to a better prepared petition. This is why the petitions do not come out in the same order they are recieved. I have used the easy fiance visa attorneys and im impressed with their dedication and they are in contact with USCIS weekly! They are from California and even have personal relationships with employees. not that they give preference to their clients but they dont set a file down from them once they open it. They prepare the petitions very well and just the way an adjudicator likes to see them making their job easier and faster. Most attorneys, much like the Easy fiance law firm, also guarantee processing times to be withing an 8 month time frame.. and approval.... or your money back in full! and they stand by it! They are more then helpful and certainly help to ease any stress. They answer questions USCIS wont, and they assign one attorney to you for the entire process so your not talking to different people.. you get to know them on more of a personal level. i would highly recommend anyone to get an attorney. and if the fee of $795 is to high, how will you support your fiancee anyways? idk y more people dont get an attorney or legal represenative. Don't listen to this. Anybody can do it on their own! There is no need for a lawyer. Why would there be? You have to fill out forms that ask about YOUR biographical data and YOUR relationship. What do you need a lawyer for??? Plus those are lies. Folks who hired lawyers don't wait shorter, they waste the money that they will need anyway later on, and they get RFE's as well. I read many stories here on VJ about people listened to their attorneys who said "You don't need to send letter of intent" or "All you need to submit is the form I-129F". Well, guess what? -- It means those bastards didn't read instructions! Everything is in the instructions, guides and here on VJ.

I filled out and printed the form DS-156 about four months ago. Now I noticed on the Embassy's instructions that it should be filled out using capital letters only. I didn't do that. Plus, after I went to the online form I noticed it's a new version and it says previous versions obsolete. What should I do? Should I fill out and print this again?

I guess I'm just looking for a little sympathy. We both transitioned from our jobs in Greenland 2 wks ago - me to the US, him to Denmark. I'm already working and he was going to come over and visit for 90 days while we wait. We have enough savings for this and I make enough to cover our expenses. He had a return ticket, but it was at the 85 day mark. The border agent felt that it looked too much like he was trying to illegally immigrate since he didn't have a job in DK, so they are putting him on a plane tonight back. We are late January filers so it may be a while. I guess I'll be traveling to DK soon...


That stinks :/ But if you're in an enough comfortable situation to travel to Denmark, you can be sure they won't deny you entry there.

Not exactly. I had the same experience too and after 2 days, they changed it to notice for an RFE.

It's possible that it may be an RFE or an approval.

 It's highly unlikely as chami123's NOA1 is from April 29.

If you would have read other posts about RFE updates, you would know it's perfectly normal, because first it's just an online update that RFE is requested. The second notification shows up when they actually sent the hardcopy to you. It's not a double RFE. You should receive the letter explaining what they want from you within +/- 7 days (counting from May 1st).

That's what I thought but the lawyer requested more than 1, so I was confused... Here is what the attorney's checklist showed about this:

 

Provide the following:

  • Two (2) color passport photos of you and four (4) of your fiancé(e). There should be no hair over the ears, no earrings, and no shadows. The background must be white or off-white only.  We have enclosed a sheet that details the color photo specifications.  Do not cut the photos, and print the names on the back of each passport photo.

 

 

Because this is what you get when you hire a lawyer. What for??? Is your case complicated? Did any of you had legal issues in the past? If no, then it's a big waste of money that should be saved -- you'll need it at later stage of the process for sure! 

 

Do it yourself and you'll be in full control of what's going on with your petition. That's my honest advice and I'm sure many many folks here would say the same.

Hello everybody, I am new to the K1 visa process and I need some help.  I already send my petition and I receiced NOA1.  I just find out that I also need other forms to be filled out during the process but I don't know at what stage of the process and where I have to send it or take it.

 

1. The form ds156 and ds156K and when do I have to send it and if it is before or after the NOA2

2. Form ds 230 when do I have to send it

3.  Form I 134, affidavit of support do I have to send it here in US or take to the embassy the day of the interview.

 

Will USCIS or NVC let me know when I have to send all this forms?

I also would like to know if I am missing any other Forms that may need for K1 Visa, please let me know.

Are you the petitioner or the beneficiary? These forms mentioned above are needed at the interview stage. The foreign petitioner will have to have them when he/she shows up at the Embassy for their interview. He/She fills out DS 156 (x2) and DS156K and DS 230 and the USC fills out the I-134 Affidavit of support and gives it to the beneficiary.

Ok, so if that is the case then, obviously, my cosponsor would leave blank the second part about "spouses" or "children" that are being brought along too....because my fiancée will be coming just by herself.

 That the Financial Sponsor is sponsoring the foreigner entering the country on the K-1 visa....and NOT the American (me).

As it says later on in point 4. "This affidavit is made by me for the purpose of assuring the U.S. Government that the person(s) named in item (3) will not become of public charge in the United States". Of course it means you put the Beneficiary's name there.

 

If she has no children then you put none.

we are confused here ????  my fiance sent in the RFE weeks ago,and she just received a letter,official,notice of action I 797.it says petition approved in the small print,and in a box it says approval notice valid from 2nd may to 1st sept,so are we at the approval stage and does it mean that things have been sent to the embassy ? how will i know if i have a case number and to start making arrangements for the medical and send off the police check forms ? do we wait now or what, please advise we just dont understand where we are at now ?

 

You entered NOA2 on your timeline already and you read on the hardcopy that the petition is approved so it means it's approved!

Actually, it's been forwarded to NVC. After two weeks from your NOA2 you may want to start calling NVC to ask about your case: has it been assigned a case number yet? They will tell you. NVC forwards your dicumentation to the proper Embassy.

Yes, each of you writes a letter of intent to marry and signes it. We respected rules of proper correspondence and put our names and addresses.

 

As to the timeline, I don't see why it would be bad. We simply wrote 4-5 sentences giving facts and dates of our meetings.

Sometimes people write that they came across an officer who wasn't familiar (hadn't dealt) with K1 visa before and wasn't sure what to do and had to call on their supervisor. But I'd assume this may happen at any Port of entry. It's rather logical to choose the airport the closest to your USC fiance(e)'s dwelling place ;)

Thank you all for your input. I've found it very help and, coupled with the guides I've digested, it has helped to clarify most of the process for me.

 

 

A few additional questions mostly relating to the K1:
 
1.) I have a question about "intent". What exactly constitutes "immigration fraud" in this case? For the K1, does it mean that the beneficiary is not able to know, prior to entry into the US, that engagement will occur? For the K3, does it mean that the beneficiary is not able to know, prior to entry into the US, that marriage will occur? If so, to either or both, is it reasonable for them to insist that there be no prior knowledge of intent to be engaged/married? They insist that it be a surprise? If I'm not understanding this correctly I ask that someone please help clarify.
 
2.) Is there any case, with any type of marriage visa, where the non-US citizen can come to the US (from Canada), get married, stay through the process of waiting for the approval, go back to their country for a very short period (however long to do the interview at the consulate and receive the visa), and then return?
 
3.) How long can the non-US citizen fiance/spouse (from Canada) stay in the US after engagement/marriage during the visa application process? Does any particular thing affect their ability to stay (ie: filing of I-129F/I-130, approval of either, etc.)?
 
And a few questions about the K3:
 
4.) The comparison page states for the K3: "This option has the benefit that the I-129F for a K-3 Visa will often be processed faster than the 'underlying' I-130. This means that the time waiting for the Non-US Citizen Spouse to enter the US may be less." Does this mean that the I-129F processing time is faster under the K3 than under the K1? Or does it mean that the I-129F is just faster than the I-130?
 
5.) Also stated under the K3 on that page: "Alternately, if prior to filing for AOS the K-3 Visa Holder has their underlying I-130 petition approved by the USCIS they may instead (of filing for AOS) choose to return to their consulate abroad to interview and obtain an IR-1 / CR-1 Visa. In this case they would abandon their status as a K-3 Visa Holder and re-enter the US as a IR-1 / CR-1 Visa Holder." If this route is taken, how long will the non-US citizen (spouse) be required to stay in their home country (Canada, in this case) to wait for the consulate interview and approval for the CR-1?
 
6.) What's the time frame for obtaining an EAD once the K3 is approved and the spouse has applied for it and the social security card?

And engagement doesn't result in an immediate marriage. You can propose to your girlfriend while she is staying with you in the US (as a tourist) and enjoy it, but if you go and get married right after that and try to adjust her status it would be a fraud. You can get engaged, file the petition for fiance visa and wait as much of the process together (without being separated) as it's allowed for her to stay. Then she would go back to her country to finilize the process (medical, interview) and come back to get married in the US, stay with you and apply for AOS etc. :)

Not quite right, Laurka. Canadians can stay as a tourist up to 6 months in any 12-month period, and don't receive the I-94.

 

Sorry about that, wasn't sure for how long they can stay as tourists, but that's even better for them ;) Although I read stories here that Canadian citizens were denied entry to the US when the petition for fiance visa was already pending.

The beneficiary doesn't sign the I-129F form.

 

The beneficiary has to return to their country before their I-94 expires (which is the form given upon entry to the US). If the beneficiary visits on VWP they can stay up to 90 days. 

 

The I-129F petition packet can be completed and sent off while the beneficiary is with the petitioner in the US. It makes the waiting (at least just the beginning) more bearable).

 

Interview takes place in a US Embassy. There are no US Embassies in the US, so no, it can't take place in the US.

The time frames for I-129F petitions for K1 visa are about 6-8 months now but it varies.

I have the same question. I am currently unemployed because I have just graduated and an aunt is going to co-sponsor. What do I put in the form? Unemployed? I currently live with my parents do I just say that he will be staying with my parents?

Feeling nervous is a normal reaction, but panicking in advance and imaging worst scenarios is not. Best thing the beneficiary can do for themselves is to relax the day before the interview, not to skip breakfast in the morning before heading for the interview and breathe and keep calm. Body language speaks volumes. If the beneficiary is extremly tense, nervous and sweating, how would the consul interpret it? Just keep your calm, go, answer the questions honestly and straightforwardly and EVERYTHING WILL BE FINE! :) :)
