Thanks for all the suggestions. After speaking on the phone today, getting names, a reference case number and building a paper trail, I was transferred to a USCIS Tier 2 representative. They admitted to a "USCIS Human Error" and will email me the correct RFE. Still cannot imagine what it can be but will look it over when I receive it. Also looks from their feedback that the case can be expedited. I will provide an update when I find out more, thanks again to everyone for your advice!

Thanks again Mari for all your information. Some questions for clarification:
1. No, I do not have the USCIS Dept Head's name & email yet. What is the best way to get that, call the California Service Center?
2. Is the ultimate purpose of the email to get clarification from USCIS before I send in the informational response (proof) via snail mail or can the email replace the snail mail response USCIS has requested?
3. I did not scan all the pages of my passport (petitioner's)but will do so now. Getting a scan of all pages of my fiance's (beneficiary's) passport will be a bit more problematic. How critical do you think it is for me to have hers?
4. My submission is a I-129F

Wow, I just looked at the RFE attached to the I-797E, Notice of Action. The I-797E has the correct Receipt # but the RFE has a totally different number (it was under the staple). They have sent me the wrong RFE!

By the way, from this point on pleaes remember to send USCIS an email requesting reason for Brazilian evidence when your petition clearly states your Fiance is from Ukraine. Then, make the call in addition to that but take notes of who and when you spoke to them. Then, you can attach any information given to you, in black and white to them (to verify what you say is true and correct and the possible error by USCIS). Everything in writing and good documentation from you, OK? :thumbs:

Call USCIS and ask to speak to a Tier 2 officer. It's possible they have you confused, and also possible they lost your eividence. They lost my photos I sent.


Thanks for the quick response, I will do that on Monday and see if I can gather what is going on.

Exactly what I was thinking, neither of us have been to Brazil and I definitely did not mention anything about Brazil.

This is so damn frustrating, hopefully someone can give me some insight. I receive the RFE today after 5 months at USCIS. The RFE states the following items:
*All foreign language documents must be submitted with complete word-for-word English translations. The translator must certify that the translation is complete and accurate, and that he or she is competent to translate. [This is EXACTLY what I did]

The petitioner is advised to submit a copy of the front page of the passport showing name as well as the pages of stamped entry into Brazil [Problem with that since my fiance is Ukrainian and neither of us have ever been to Brazil] If the meeting took place at another location please provide evidence (passport entries) indicating both parties were at the same location at the same time. Provide photos if available. It goes on to say REQUIREMENT THAT PETITIONER AND BENEFICIARY HAVE MET IN PERSON: Circumstances of Meeting and Last Personal Meeting [I supplied how we met, my passport copy with stamps of entry and exit from Kiev, boarding passes and ticket stubs, photos of us together with clear background of common sites in Kiev, lodging receipts - essentially everything the RFE is requesting]

What am I missing here? The fact they talk about Brazil, can they have our package confused with someone else's file? What is the best way to proceed? Any assistance would be greatly appreciated, thanks!

Well I finally got to speak to a Tier 2 ISO who was actually quite helpful. She informed me that our I-129F has been approved by USCIS and forwarded to the NVC. Finally progress!!!! Thanks to all for your input, it is greatly appreciated.

Thanks for the follow-up info on how to speak with a Tier 2 person. I just got this sinking feeling that they have screwed something else up again like on the first RFE. I will follow you suggestion and see if I can gain any understanding of what they are trying to send me.

No, it was more like a Tier 0 person at the USCIS number above. Am I reading the notice wrong? It almost seems to be referring to delivery of a Green Card or other document. Since they sent the wrong RFE last time I never know what to expect from these people. How do you contact a Tier 2 person at CSC? Last time, the only way I got to them was by being referred and transferred over from USCIS.

Is our experience typical or are we just unlucky? It starts with a RFE notification 5 months to the day that our I-129F was submitted. Receive the RFE and it makes no sense whatsoever. After much time on the phone with USCIS they determine that I was sent the incorrect RFE. Wait two more weeks to get the correct one. It finally arrives requesting proof of our meeting in person asking for pictures and picture/signature page of my passport(keep in mind I previously submitted boarding passes, entry/exit stamps from passport, multiple pictures of us together with unique Kiev sights in the background and copies of lodging receipts on the original I-129F). I immediately send copies of all pages of my entire passport and pictures of the two of us again. At this point I figure it is a little bump in the road and things should move along quickly now. Wrong!

Now a month later, I receive a status notice of an undeliverable I-129F document and the need to call USCIS. I moved two weeks ago and supplied the forwarding address to the post office and filed change of address online with USCIS. Why would this be undeliverable? All my other mail is getting forwarded to the new address! So I make the call to the USCIS phone number as the notice requests. It is impossible to get any information from them, they just read off a script exactly what the status page says. Incredibly frustrating and totally useless, I give the rep my new address again and she informs me it will be another month and I will have the document delivered. She cannot tell me anything about the nature of the document. So a month from now it will be 7 months that our I-129F package is in USCIS and I still don't know if they have approved it to send on to the State Department.

Questions: 1) Is there anyway to get a real status on our case and the nature of the document they are trying to deliver? 2) Are approvals or denials sent via registered mail, is that why it was returned? 3) Out of all the documentation required, the proof of our last meeting in person seems the most straight forward requirement of all, USCIS should have had everything they need on the original submission, what am I missing here?

Any perspective or answers to the above on this would be appreciated. I am really feeling like we received a bogus RFE and are getting the run around so that the CSC does not have to show processing times longer than their 5 months target. Thanks in advance for your input and any suggestions!
