Just following up....I guess it was my mistake by not investigating it more. I guess everyone in my situation needs to go through to remove this condition for the green card. It was a REALLY expensive mistake, one I'm sure won't happen again.

After going through the AOS stuff, I got lax in thinking the hard part was over. I though all we had to do was wait it out, until she is up for citizenship. BIG MISTAKE.

SO let me ask, what do i do next? We will file the I-751 in the next couple of days. What then, and what future steps should I be taking?

For all others out there, don't do what I did...stay on top of things and continue reading on what to do next. You may be missing something...

Ok, quick story to bring you up to speed.

My spouse is from Mexico. We married in Sept.17 2004 (she entered the US on Fiance Visa)
We've done everything up to getting the "Green Card". She's had the Green Card for a year, and it is about to expire. So we filed the I-90 to replace the Green Card. (Sent the $290 and they cashed it VERY quickly) Received a receipt and appointment for Biometrics for this morning. My wife just called and said that they told her we filed the wrong form. Apparently we were supposed to file the I-751 to remove conditions. I had never read anywhere we had to remove some kind of condition or file that form anywhere on the USCIS web-site. So she was denied the biometric appointment and we lost the money?

I just read the Step by Step guide on filing the I-751 here on the web site. It states;

"At the time you obtain conditional resident status through admission to the United States with an immigrant visa or through adjustment of status, the USCIS will notify you of the conditional basis of your status, the requirements for removal of the conditions and what will happen if you fail to file a petition to remove the conditions.

The USCIS does not send a second reminder to conditional residents to petition for removal of conditions. During the 90 days before the second anniversary of the date you obtained conditional resident status you and your spouse (if still married) must file to remove the condition."

We never received notification of the conditional basis of our status, so we didn't know about filing to remove such conditions.

Her GC expires sometime in Feb. so we can file the I-751 within the window allotted. But my concern is, why did they NOT return the form and money once they knew it was the wrong form? They will not refund the money ($290) or credit it towards filing of another form which now costs "$465 (plus $80 biometric service fee)".

So they accepted our money and went ahead and started processing the wrong form, didn't allow my wife the Bio Metrics appointment and won't return or credit our money.


mad.gif Seems fair. ...How do I sign up to work there?

Am I wrong to be so upset with this process? They don't want illegals here, so why does it cost SO much and complicate our lives SO much to do this the right way?

Hey eau_xplain, yes, we were successful in getting the stamp on my wifes passport. Though the stamp expires when the passport expires. But the guy said it was no problem to come back and get the stamp once we renew my wifes MX passport. (That will be another battle unto itself...)

I need to gather all our paperwork to fill out the dates correctly. And I couldn't do it last night, as I was trying to get information...

Thanks for your advice. For what it's worth for anybody else in my predicament, getting the stamp is probably the easiest part of this process. All that was needed was the GC, biometric appt. letter, and passport. All in all it took maybe 10 minutes. First time we got something without having to PAY for it first! good.gif

Hello all.
Just to bring you up to speed, we filed the I-751 to remove conditions on my wife's GC. We have recieved the NOA for my wifes biometrics appointment, but no NOA with an extension letter. My wifes GC has now expired, so she is out of status.

I called the customer service (service...ha jest.gif ) line and they told my wife that they have 90 days in which to send out the extension letter. Or we can make an InfoPass appt. and get the I-551 stamp in her passport.

We have the appointment for tomorrow morning, but I need to know what we should bring. Of course the NOA with the Biometrics Appt., her expired GC and Passport... but what else.


Has anyone else been in this situation?
-Trying to get an I-551 stamp without an extension letter?

-Going to a biometrics appt. with an expired GC?

Thanks for posting your experience, xsoldier...we just sent my husband's paperwork in yesterday (via USPS express mail), and I know that Nebraska received it and signed for it at 11:00 this morning--thank God for "track and confirm"!

We have been sweating this a bit, as we applied REALLY close to the expiration of his green card--which is this Saturday.

My husband is very nervous about being out-of-status, so it's nice to know that we could apply for the passport stamp if we don't hear about the extension soon!

They won't. One form of government-issued ID (such as a driver's licence) will do just fine.


Perfect advice! It was the easiest thing to recieve during this whole process. All that was needed was the Passport, GC (expired or not) and the biometrics appointment letter. They stamped it and we went on our merry way. The guy also told me, going to that biometrics appointment without the extension letter will not be a problem. So sjb1221 you can relax a little. He also stated that they can take up to 90 days to send you the extension letter.

Hopes this helps someone else out there.

Well, the heart rate is slowly climbing back up. We received an NOA on Mar 5th stating her biometrics appt. is on the 18th of this month. No NOA extending her already expired GC has shown up. Has anyone else been in this predicament?

Should I be on the phone with customer service inquiring about the extension? What happens if she goes to the biometrics and they see the expired GC? Our AOS was "lost" for over a year, until we contacted our congressman and talked to his aide. Suddenly the package was found, and still took another 120 day before we heard anything. Wondering if I should strike up that "friendship" again.

Ok, maybe I mixed up the acronyms. We received a Notice Of Action (I-797) ASC Appointment notice. I thought this was the NOA1?

This NOA is stating she has an appointment (biometrics) on the 18th of this month. We never received and extension letter. No where does it state on this NOA that there is any extension for her expired Green card.


Did I miss something here? We were supposed to receive that, right? Was there something else I needed to file to get that?

That's a good sign, right?

Does this mean they are moving ahead and have accepted the application to remove conditions? I guess I'm looking for some confirmation that everything is proceeding as planned.

Can we go ahead and make an appointment to get her Passport stamped, as her GC is expired?

I am going to post our attempted explanation letter we sent with the packet:

Dear USCIS examiner:

I am attempting to send this letter to explain why we are sending this I-751 Petition to Remove Conditions on Residence form outside of the required 90 day window prior to my wife’s (Name) Conditional Status expiring.

On July 7, 2007, we mailed the N-400 form and packet for Citizenship, but unfortunately, we had miscalculated the time line for submitting that package. We received the rejected package back on Nov. 10, 2007.
Then we submitted the I-90 for replacing the Permanent Resident card on Jan. 14, 2008. We received the receipt for the I-90 on Jan. 18, 2008. (Copy of receipt is provided.)
On Jan. 28, 2008 my wife received an appointment slip for a biometrics appointment for
Feb. 8, 2008. We were thinking she would be receiving the stamp to extend her Green Card at that time as that was the date her Green Card expires.

Upon going to that appointment we were informed we had filed the wrong form and to immediately submit the I-751 with this explanation letter attached.

Enclosed also please find the following documents to verify the times and forms we have submitted:

• Copy of the application N-900 with rejection stamp.
• Copy of the rejection letter from the N-400 packet.
• Copy of the web page receipt of e-submitting the I-90.
• Copy of the receipt and biometrics appointment slip for form I-90.


You may feel free to inquire at any of the sources of enclosed documentation for validity of their statements. Please advise me if you have any further questions or problems related to this petition.

Here's hoping this will be enough to allow them to proceed with this I-751. We were 3 day after the 90 days in which to file, so we'll see. (Man, there's a lot of paperwork to get together. Coordinating people to sign the affidavits was the worst.)

We submitted the I-90 form as my wifes GC was about to expire. After waiting and waiting, we got a biometrics appointment in Boston today. Turns out we filed the wrong form, we needed to file the I-751 to lift the conditional status of her current GC. (We didn't know about that, and honestly we thought the hard part was over after the AOS. We thought we just had to renew the GC and wait until she can file for citizenship.) Big mistake on my part.

I've got a serious problem. Because we waited for this biometrics appointment and because we filed the form to replace a GC (mind you, we were thinking we submitted the correct form as her card was expiring...) Turns out, her card expired yesterday.

What kind of trouble are we in? Should we go ahead an send out the I-751 packet to Vermont and hope for the best? I'm kind of scared now, after reading we might have to go to a hearing.

Please let me know...I don't think I'll be sleeping tonight because of this.

I'm also in the same boat as you. My wife received her Biometrics appt. letter for her appt. scheduled for the 18th. We're still waiting on the extension letter. My wifes GC is now out of status, and we need to go to her biometrics appt. with that expired GC and no letter of extension.

I don't know if this is solely a VSC issue or now, but we seem to be the ones this happens to more often that other places.

To you question about the I-551 stamp...no, they will not stamp an expired passport. My wife and I just went in for the stamp, which they did stamp, but only until the passport expires. My wifes Mexico passport expires in July 2008 and that I-551 stamp is only good until then. The guy told me once we re-new the passport we can just go back in and have the stamp re-applied.

Not entirely sure about Nebraska, but here in Boston those are two different places. We had to get an Info Pass appointment to get the Passport stamped. The Boimetrics place is in a different part of the city, and they seem to be just contractors that only handle the biometrics stuff. I'm sure they will look cross-eyed at you if you ask for an I-551 stamp for your passport.
Our Service Center is actually pretty good about InfoPasses being open, I would try and schedule on the same day as the biometrics appointment. Again, not sure how Nebraska is, but if there is enough time before hand it should save you the time of making yet another trip into town.

Both the biometrics and getting your passport stamped should take about 15 minutes each.

The stamp costs nothing, only maybe 10 minutes of your time. BUT....you must have a valid passport. That is the only place they will put the stamp.

My wife and I had to get the stamp and they were able to stamp it, until the expiration date of her passport. Once we renew the passport we need to go back and get the I-551 stamp.

Hello all!

My wife has a job in sales. After working there a few years, her new boss has put her on a "90 day" program. Where-as if her boss doesn't see noticable improvements in her sales numbers, she will no longer be working for that company, if you know what I mean.

My question is, can she file for workmans compensation if she does get released?

I am really wondering because of her status. We are waiting for her removal of conditions, and I don't know if workmans comp. is for citizens only?

I've searched our .gov site but it doesn't state anywhere about this. Wondering if anyone out there has been in this situation?
