I'm not sure about the house situation but if he continues to receive income from it while in US he would have to report that income in you guys' tax return for 2011.

As for traveling? Just make sure he has all his immigration documents (green card, stuff from the embassy, etc.) on hand when he's traveling. You wanna have all that information available to immigration officers.

Attached lots of evidence backing up everything i said. Since my son has been born in jan 2009. Weve only seen hubby 4 weeks total due to high cost to travel. We submittted the four weeks of memories we have together.

Thats correct. It may take some time for it to get there and then depending on how many they have in the que, a bit more time for them to actually adjudicate it. When its approved they will notify the Embassy and they will contact you to come in for the VISA, if denied they send a denial notice.

Please clarify how long spouse overstay was, if over 180 but less than a year it might not be 10 year bar bare


Hi it was actually more than a year so it's the 10 year ban. I emailed the embassy today and they said that it goes to Department of Homeland Security. They actually said today that they needed $40 from us because the waiver fee has increased from when we initially submitted the waiver to them. They then stated that the case would be complete and it would be sent to DHS for APPROVAL.

They didn't say a decision would be made. They actually said APPROVAL. Should I be getting my hopes up?

Hey Guys,

To get my story you can read my signature. So the Embassy (in Barbados) received the updated I-864 and hardship letter (HSL) that they wanted on Tuesday (2/15/2011). I was under the impression that the I-160 waiver and HSL are then sent to the USCIS in the Dominican Republic (since they have jurisdiction over Dominica and all the neighboring islands). is this right or is it the consular at the Embassy in Barbados that reviews the waiver and decides its approval or rejection? :unsure:

With everything that's occuring over there right now things have probably slowed up even more. However, they should have at least told you the status of the case. At the very least they should have told you that you are under administrative processing. It is a very frustrating thing to just go through each day not knowing and wondering what's happening with your case. I'm going through the same thing with hubby as his waiver is being sent of to DHS to be reviewed. I pray that everything will work out for all of us. I find some encouragement in the fact that I'm not the only one in the world going through a similar situation or a situation even worse than mine for that fact. So hang in there.

I think it still means the same thing that he is still going through AP. When I call the Dept of State sometimes they will say my husband is in Administrative Review other times they will say he is in Administrative Processing but what ever term they use it means we still have to wait.

With AP it usually means they are working on your case. They are doing security checks on it and when they are completed they will issue the visa or ask for additional documents if something has expired.

If u anticipate that u may be denied and asked to do a waiver, u should fill the suspected waiver out aheaqd of time. U can have it with u at the interview and if the consular requests one u can submit it along with the fee for it.
Hubby and i suspected that we would be asked to fill out a I-601 waiver due to his overstay (see signature) so we had already filled out the waiver and had the fee money in case. As we suspected he did have to do the waiver so we simply submitted it and paid the fee. We got to do the waiver interview the same day with the same consular so it saved us some time.

A white paper stating what? What process are you currently trying to or are considering going through Fiance visa,etc.? I think we need more details. And yes over 1 year is grounds for a 10 year bar from entering the US. Depending on your situation you may be eligible for a waiver, but we would need to know the circumstances to determine that.

our i601 waiver was approved in vermont we had filed it in montreal in june 2010,all this was possible only because of this attroney her name is lizz
cannon without her this would have never been possible,she charged us very reasonably,and her service is great she is very organised hardworking and professional ,she supported us all the way even i had thought of giving up the process but she always encouraged me.thanks to lizz cannon.

But even I have some low days. Like today. Not in the highest of spirits. Feeling really lonely. I make enough to qualify as a sponsor and support hubby but rent is so high here in the VirginIslands I can't even afford a 1 bedroom apartment and have money left over each month for food and transportation. So I've been living at home with my mom. I want so badly to be independent...to be out on my own with hubby. That's why everything is hinging on this waiver approval. Once he is approved he can come up here work and we can afford a place together.

I'm just so frustrated with that among other things and i need him here to support me. We talk almost every night and his words are great encouragement and support for me but at the same time we are both getting tired of this immigration process. We're so ready to move on together as a family. :blush:

I130 in august of 2008. We are still in this long visa journey (see signature for story). We have no choice but to wait pray and hope that his waiver is approved. I find strength from God and my husband and our 2 year old son. Its a very depressing situation but i kinda find comfort in the fact that im not the only one in a similar situation. U have my support. Stay strong. ;)

Do not trust the USCIS website and the big dots. I did the same mistake.I checked it for 2 years for my I-539 and till today it still shows "initial review". When I called them I found out that was denied almost 2 years ago and never got the denial letter trough mail. CALL THEM.

I agree as well. The embassy in Barbados sent out my hubby's I-601 to USCIS Santo Domingo on Feb 28 and they got it March 28. I only found this out by calling USCIS Santo Domingo directly. Up to now I have not received a reception letter of any kind, but the attendant i spoke to said to call back in two weeks.

It's better to call and speak with someone who is actually looking at your case. :thumbs:

Awesome.Well hubby already started working on updating things. He updated his immunization records (only needed a couple of shots). He got some birth certificates and certified marriage certificates in case they ask for one and so he can have them once he immigrates. All that's left is the police certificate and saving up for the big trip to barbados and to pay that the medical and IV app fee.

I already sent him all the other docs they requested. :)

I called the Dr and was told that mines was approved as well. I called the barbados consulate like DR told me and Barbados told me tht I need to send an updated police record, my passport and return prepaid method.

That's cool. But we have to wait on the letter from Barbados listing what all we need to send in to them. It's been over a year since hubby did his last medical and police certificate so we know that those things have to get done. But to be on the safe side we are waiting for the letter.

I tried to get the lady to tell me what all he needs to do but she said that the letter listing that was sent out July 15th. It'll take about 2 weeks to get to hubby so we will see what we have to get done by the end of the month. :thumbs:

thats sounds about right my husbands exam expired 2, lawyer told us that they will call so he can get them done again if he gets approved. but why so long? exams take 2 weeks and passport also well in santo domingo.

I kinda splurged some money to visit him with our son so we're in the process of saving up for the trip. His flight to Barbados is around $350, his hotel stay will be about $350, the medical exam is $170. We also plan to have him stay there for the week so he can get his visa in hand and then come straight to St.Thomas from Barbados. So before he leaves Dominica he has to ship his stuff up to me which costs about $130 dollars. So we have a few things to save up for.

I-601 was approved on 3rd June

Just to update on my own topic...Hubby's I-601 waiver was received on March 28th...and APPROVED on June 13th. :dance: I just got back from visiting him for a week in Dominica and called first thing Monday morning and they said that it got approved. They instructed me to call Barbados for further instructions and info. I called Barbados that afternoon and they said that a few things expired over the year such as the medical exam and his police certificate. So they sent a letter to hubby's address as well as my address listing what he needs to turn in when he goes back to Barbados to do a new medical exam.

So right now we're just saving for the trip he will have to take down there and waiting on the letter. The goal is to have him up here by the 2nd week in October to be the latest.

This is the beginning of the end for us. SOOOO EXCITED!!! :star: :star: :star: :star:

Just to update for anyone that cares or anyone that my have to go through USCIS:

My hubby's I-601 waiver application package was sent from the Embassy in Barbados to USCIS in Santo Domingo via airmail on February 28th. I called USCIS today April 8th to inquire about his waiver reception and it's status.

They said that it was received on March 28th and it is still pending. The nice lady on the other line said that I will need to give them 2 weeks. I asked if it was okay to call inquiring again after two weeks and she said yes. :dance: :dance: :dance:

So all that hubby and I have left to do until then is wait, hope, and pray. I intend to call on April 27th so wish me luck. :star:

thanks for the advice. The guest house we have in mind is one me the cheapest. Plus transportation to and from the clinic and
to the embassy are included in the price. He may be able to find a friend of family to crash with so that 350 can be used to pay that fee.

I just called the national visa center and they said that i paid the immigration visa processing fee and if i hadn't paid it then it would not have gone to the embassy. He stated that there shouldnt be any other fee but i should speak directly with someone at the embassy.

Hey Guys,

My hubby's interview at the Barbados US Embassy was in May of 2010 and he was told that he needed to get an I-1601 waiver. Due to some technical difficulties with finding a joint sponsor. The I-1601 was not sent to USCIS in Santo Domingo until February of 2011. Before the waiver was sent to USCIS the embassy sent me an email requesting that I send my updated affidavit of support and 2010 tax return documents and the $40 dollars since the waiver fee had increased from when we initially paid it back in May 2010.

Ultimately hubby's waiver was APPROVED on June 13th. So I sent an email to US Embassy Barbados inquiring about what hubby needs to have done over or resubmit in order for him to receive his visa. Here is the email that they sent back to me just now...

Dear Applicant(s):



ONE YEAR HAS PASSED SINCE YOUR IMMIGRANT VISA APPOINTMENT AT THIS OFFICE. IN ORDER TO COMPLETE THE VISA APPLICATION YOU MUST RETURN TO BARBADOS WITH NEW POLICE CERTIFICATE(S), MEDICAL(S), PHOTOS SPONSORS 2010 FEDERAL TAX WITH W2 FORMS AND NEW APPLICATION FEE, ($404US). :blink:





AS SOON AS YOU ADVISE THE EMBASSY THAT THE ABOVE DOCUMENTS ARE IN ORDER, WE WILL SCHEDULE THE APPLCANT FOR THE EARLIEST POSSIBLE APPOINTMENT FOR AN INTERVIEW WITH A CONSULAR OFFICER.

Well you asked this question on the right day! My husband's waiver was received by them March 28th this year. I called them today to find out the status and they said that it was approved on June 13th!!! SO HAPPY AND EXCITED!!! So yeah it took us a little under 3 months. :dance:

@ Sergi9: Yeah well I disputed the fee but they said that since the last time we was there was over a year ago (May 2010) that we had to pay the fee again. Also some of the documents expired such as the medical exam and police certificates. Either way he still has to travel to Barbados to conduct the new medical exam. :thumbs:
