There was a case last September where a divorced Brit was required to provide a certificate of her prior marriage for London before the visa could be issued:

It prompted me to get a copy of mine but it was not asked for.

I have not used a lawyer and have not had any hitches for my UK fiance/husband/soon to be US citizen. My thoughts are nobody will be as careful and timely and perfect with my case as me. If you are willing to read and follow directions and fill out forms, you can do it. You'll still be gathering the information but paying somebody else to fill in the forms and do the mailing. A lawyer doesn't get to cut in line ahead of those that do their own. A lawyer or even a senator can't keep you out of additional processing time if London chooses to run your name through extra databases. Some think a lawyer is slower because you give them all the info for the forms and mail to him. His assistant types in the form. It is mailed back to you to sign. You notice typos. You call them to fix it. They mail to you again. You sign and mail back to assistant to put in an envelope and mail. Maybe they don't get around to it as fast as you would like but you can't do anything about it. Then again, if you are terrible at reading directions and hate paperwork, a lawyer will do it for you. Kinda up to you.

Your police clearance will not be needed for many months. Those are presented at the final step--interview. Trust me. I know London. Those red flags mentioned are not an issue. It is not as difficult as it is made to seem. It is all paperwork and not a lot of judging of your past marriage or relationship or ages. If you know how you met, where he works, and where you will be living then that's about as difficult as it gets at the London interview.

If you have a chance to keep working for your current airline based out of the US, then a CR1 spouse visa may be better for you. Why? Because as a fiance, there will be a gap of time after entering the US where you can't work or travel internationally until you get authorization. It's at least 3 months. If you want no gap, a spouse visa is better because you are a permanent resident on day 1 and can work or leave the US immediately.

Indeed it does say on the LOndon wesbite I only need police certificates of countries where I've lived for 12 months or more, and a UK police check if I have lived here for 6 months or more since aged 16... so I won't need one for Italy where I Only lived for 10 months right?

It also says married applicants need a marriage certificate? I am DIVORCED since last year, do I need to obtain a marriage certificate now?! That is the first I've heard in that matter!

THe website I quoted, said only places I've lived in my country of nationality I'd need police checks if I've lived there for 6 months or more...for example living in LOndon and MAnchester...... and it also says for OVERSEAS Locations, Ill need police checks for 12 months or more.... does that make sense?

THanks for the info, I never knew it was available. The last criminal record check I needed from BAhrain took me about 6 months to obtain, resulting in my employer grounding me, had to call BAH every single day to chase them, was always lied to about it being almost ready, then they couldnt find my papers... it was awful. So in this instance, I would rather take a vacation out there and collect the police check myself! x

I had to do the same for my airline job. TO get the Italian one I had to go to FLorence TWICE (I lost it in the airport the first time), wait in line for an hour, try and communicate in Italian my reason for needing the "Certificato Penale". TO be honest it was all doable in a morning and FLorence isnt exactly a terrible place to have to visit for a couple of days, however getting the Bahrain one will certainly be an uphill struggle. Rather than deal with the embassy it is far quicker to go over there, pay approx $10 and walk away with the certificate. THanks for the info!

I was reading before at travestate.gov and I pulled this:
What you need:

  • A passport valid for travel to the United States and with a validity date at least six months beyond your intended period of stay in the U.S. (unless country-specific agreements provide exemptions)
  • Divorce or death certificate(s) of any previous spouse(s) for both you and the U.S. citizen sponsor
  • Police certificates from your present country of residence and all countries where you have lived for 6 months or more since age 16 (Police certificates are also required for accompanying children age 16 or older)

Again, it was straightforward from your description. It never hurts to at least do a free consult with an attorney, I did so with my case. I decided to proceed on my own, but the attorney helped identify a few red flags. I was able to self-mitigate the red flags with more evidence, but may have not done so if I had not been aware of them. Wouldn't hurt in your situation to do the same.

DO you mind me asking what red flags do you mean? What sort of stuff do we need to look out for? WHen you see an attorney they're surely trying to get business so wouldnt they highlight minor things and make them out to be red flags? Its hard to trust anyone with "QC" after their name! But yes a consultation might do the trick. We have tonnes of evidence e-mails, skypes,photos, plane tickets (admittedly staff travel ones) and even domestic southwest full fare tickets so I don't think we will struggle in that area.

Welcome ? There are so many great people here who will help you and are able to give you advice that I don’t think you will need a lawyer, you haven’t noted anything that would complicate your petition.

1)You will need to get a police check/ criminal record check for everywhere you lived after the age of 18 for 6 (it might be 12) months or more.
2)Your job shouldn’t complicate things!
3)Your previous divorce will probably come up, make sure you and your partner are both free to marry and you have your divorce decrees.

If I am in correct on any of these points I am sure someone will point me out.

I'm pretty sure I read somewhere I only need police checks from countries I lived in for 12 or more months, does anyone else have any idea? I hope so, I lived in Italy for about 10 months and have already had to get a criminal record check from FLorence before to get my current job.. don't really want to have to go back and do that again! I really don't think you will need a lawyer. You case is very straightforward, and you will still need to gather all this info (including the Police Certs) regardless if a lawyer is used. The UK is not a high fraud country, so thats a plus too. As long as you have a certified copy of the divorce decree (or equivalent), and can get the other paperwork you should be ok. There are some great guides on this website that can aid in the process. It's bit overwhelming at first, but no more so than babysitting a few hundred passengers locked inside a metal tube. Being a flight attendant you should be very detail oriented and probably have more experience with the immigration bureaucracy than most attorneys! I dont think you will have a problem. Perhaps just consult with an attorney to get a feel for the situation.

Hi,

First time on here so be patient!
My partner (from Utah) and I are considering tying the knot. The fiancé visa way seems pliable and fairly straight forward. Just a few questions!

I lived in the middle east for more than a year - I can go back there get a criminal record check that's fine but does it complicate our case, should we get a lawyer? I lived in Bahrain.

I have a crew visa in my passport as I'm a regular visitor to us with my job (flight attendant) and am based in London. Again does this complicate things?

I have a previous marriage to a us citizen from 2008 which was dissolved last year (2011) however no applications to stay over there were made and I've not seen the man since January 2008. I have a divorce certificate from Texas to prove it is all over. Does this complicate our case?

Does anyone recommend we take a lawyer here? I never dreamed this amount of research could be involved!

Right guys so been doing lots and lots of research and I've come to the conclusion, we don't need an attorney to do this for us!

Is this good for the initial petition?

Cover letter, signed by my US fiance,
2 letters from both of us declaring our intent to marry within the 90 days
2 US-specification photographs from both of us, signed and dated on the back
I-129f
2 biographical data forms from both of us
the e-confirmation receipt form
all our collected evidence, boarding cards, passport stamps, receipts, photos etc
the fee 340 dollars

How does that sound, am I missing anything ?

OK, so according to USCIS and the checklist on VJ, it says final divorce decree or certificate, I'm assuming this is the wording they're using to cover both parties assuming that decrees are not available in other countries? I guess everything is different state to state, country to country. I'm pretty sure no one has 'decrees' here in England at least I've never heard of it... obviously I want to get this right first time. I think my stamped official copy of decree will be sufficient. Hey guys,

wonder if any of you could help me on this one? I have a sealed/stamped copy of my divorce decree from the court house in texas where the hearing took place. It is numbered page 1 - 3, and has the official stamp on the reverse of page 3 "True and correct copy" and the date the copy was produced. It is only stamped on the reverse of page 3 though, are there any rules to say it has to be stamped/signed on each page of the decree? I have also a certified copy of my actual marriage certificate from my previous marriage, does this help? It will drive me mad if I have to contact the place in Texas again but I will do if I have to!

ANy advice guys?

Hello again everyone,

Is it correct I have to send photocopies of boarding passes, receipts, etc to USCIS with the initial petition? How has everyone gone about doing this? Photocopying one at a time or doing all of them on one A4? I have about 6 boarding passes from various trips I've taken between London and LAX/LAS. Got all my passport stamps too from many other trips, I just tend to have thrown away boarding passes in the past... I have literally dozens of e-tickets from Virgin Atlantic of the flights I've taken, how do these weigh up as evidence? Do you recommend colour photOcopies of the passport stamps? Other evidence we can get is e-mail receipts from a couple of hotels in San Diego we've stayed at and plenty of Southwest airlines e-tickets (these are not boarding cards though....).

SO basically, I do not send ANYTHING original with original petition? I have my divorce decree too - I just send a photocopy and keep the original for interview stage right?

any help is much appreciated!

Hello everyone,

Well I feel my heads about to explode with the amount of paperwork infront of me! I was thinking of putting everything in a binder and putting individual components (such as cover letter, photocopies of boarding cards, photocopies of e-tickets etc) in one clear plastic wallet so to keep everything similar together. This way, I can kind of assemble it like a school project?! Maybe but dividers? Does this sound logical? My evidence is growing every day - so far I've got copies of boarding cards, e-tickets, hotel confirmations, car hire confirmations, bank statements, credit card statements, my rosters from work to prove my whereabouts (I'm flight attendant), basketball tickets, MLS tickets, Rome colosseum tickets, Rome train tickets, a boarding card from Rome, passport stamp copies (in colour), a US departure record card (which I believe should have stayed in the states, oops) with a bright stamp from LAX on it, 10 screen shots of Skype conversations, numerous e-mails exchanged between us, bla, bla, bla....

Any suggestions for presentation? The binder would be a simple clip one which would be very easy to dissemble for the guys at USCIS...

Also, today I scanned in my boarding cards and printed them off in colour, very high resolution, but they've literally all come out A4 sized! So very easy to read but do they want actual size copies?! Anyone know if they even care about that?!

So my sweetie and I finally ready to mail our package in a couple of weeks (we are waiting till I'm out there) - I know we've got a long wait ahead of us. Does anyone roughly know the sort of minimum time I'll be unable to apply for jobs in the US once we are married? Obviously trying to keep this to as shorter time as possible. Also do you put our electronic notification form on top of the entire package, or shall we put the check as the first thing they see? We've decided to cut out a lot of the skype chats and e-tickets and just send as much primary evidence as we have. Just got my passport copies today in colour and I've got around 12 stamps into the US clearly showing the dates and type of visa, hopefully this will be enough to convince thema along with a few photographs!

Thanks everyone for replying. I might check out good ol Walmart tonight for some suitable bags. Think I'm gonna ditch the Skype logs. Is the reason this petition takes so long to be approved because people mail in these huge packets? Obviously we don't want to submit too little? Are bank statements showing I've been in Utah/Cali neccessary? Only got about 10 pages showing various transactions. I'm just glad we have it ready now and whether it's too much or not we at least know that we have what they are looking for in the package. Very happy we didn't blow thousands on an attorney as well, this site is extremely useful. Thanks again and I'll let you know when we get our NOA1!

Thought I'd attach a photo for some opinions. I'd guess we have about 200 pages (eek, I know). Shall I reduce the amount e-tickets? I know they're not primary evidence and all mine are standby tickets anyway. Also sending 19 colour photos from various locations England, Cali, Italy etc. Also when the guide says put passport photos in a 'bag' what kind of bag is it refering to? Is there something I can buy at the post office tommorow (I'm in Utah at the moment).

With our I-129f we sent copies of both our passports stamps showing entries into us and uk, scanned in copies of bOarding passes, a few e tickets, bank statements from both of us showing we were both in same place at same time and 19 colour photos. Some of the photos were dated on front, others weren't but they were all taken in obviously different locations (London, Las Vegas, San Diego, Rome). 19 photos is probably a lot but it wasn't going to harm us (postage cost around $9 for entire package) and it makes our petition look stronger. Good Morning everyone,

Getting a bit nervous about my flight to see my fiance. Our NOA1 date is June 11th and I am flying out to Las Vegas this Sunday to visit him for a week.

1.I don't have a lease any more so would a letter off my landlady signed, dated and with a contact number be useful?

2.My employer is giving me an official letter to confirm employment (letter-headed)

3.I will have a return flight but this is e-ticketed (no paper ticket) and is on standby so unconfirmed. Anyone think this may cause problems?

4.I have the original NOA1 here in England with me, shall I take this back to the states with me? Or just a copy? Don't trust the man to look after it properly thats why its with me.

5. The letter provided by my company. Can this be used more than once or is it advisable to ask my employer for a new one each time I want to visit the US?

Any help greatly appreciated! I've been through LAS many times before, prior to petitioning I-129F and they do ask about my boyfriend each time but the M word has never been mentioned so far. Does anyone know if the border agents can see on their screen if a K1 has been petitioned? I generally refer to my man as my boyfriend as we have not announced our intent to marry to all our families and friends yet. Is it advisable to keep using the term boyfriend (at least until he puts a ring on my finger, grrrrr)

No trouble at all.... It means nothing to them. Its almost always cheaper to book round trips! The airline will just see it as a no-show. Im sure at her POE they will be more interested in her packet!

Same here. Ours hasn't been touched since June 11th (our NOA1 date!) and I believe you can see this when you log into the USCIS page (not case status) and it shows a date of when your file was last updated....

You'll be fine - bring as much proof of ties as possible! Noa1, noa2, letter off employer, letter off landlord if you are renting, anything you can think of that helps your case that you will return. Have you planned a wedding yet?
