Yeah, I learned from dealing with immigration (practically all my life), you have to be patient. If you are within the "target" time frame for processing of your case, they will not be in a hurry to get it done any sooner.

Hello everyone,

After seven months and a half of my initial I-130 filing, I was notified my case has been transferred (from NBC) to the Nebraska Service Center (for faster processing!).

Anyone knows, if this means another 6 - 8 months of waiting?

 I got NOTHING. But I had filed for electronic notification, so my case status shows online, still in "Initial Review". I have decided to just be patient and I will not call USCIS Customer service until 3rd or last week of October. I see other Feb. filers got their NOA-2 seven months after NOA-1.

But in your case, because you are not able to see your case status online, I suggest you call USCIS to inquire. Please let me know what they tell u, I'd be curious, since we have the same priority date.

Looks like the NVC is taking longer than the I-130s used to take to process. 

 

My NOA1 is just over the 6 months threshold now.
kmg617 got his NOA2 seven months after NOA1, so yeah maybe I-130 are now taking a bit longer.

If patience was sold by the pound, I'd buy a Ton ranting33va.gif

From what I gather - reading posts here - tier 2 is the guy who is supposed to know more than the tier 1 guy, but usually doesn't. He is programmed to say things like: "wait 2 more weeks", or "your 6 months are not up yet".

Acording to those who entered their dates in VJ Timelines:

 

14 Approvals (Feb Filers) in June.

Only 3 lucky Feb Filers who recieved NOA2 in July

We are hitting mid August - So far 2 in August

 

Sad!

We got our NOA1 on Feb. 22nd, have not recieved anything else and online still shows initial interview. Will call when I get home from work to check where it is at.

 

I am in same situation as you. Please let us know whet they tell you. All I know is that normal average waiting time from NOA1 to NOA2 is 6 months.

WOW! Thanks for the link. The last to be approved (NOA2 on 6/15) was sent on Feb 21st, with NOA1 on Feb 28th.

Gives me hope I may receive my NOA2 within the next 2 - 3 weeks.

This goes against the info I received previously from someone else that ALL I-130 files are transferred to a field office (which I doubted). NBC retains the file until approved, then it goes to NVC for post-approval processing.

Since August 2012, all petitions have gone to NBC (instead of other service centers, like CSC or VSC), and from there the vast majority have been sent out to local field offices according to the zip code from the address listed on the I-130.


Huh! thanks for that, I did not know. That would make Chicago my field office then since it has to be the closest to Moline, IL. The Online case status shows it is still in "Initial Review". Will it show it has been transferred to a local office when they do actually transfer it? And do you know, how long it would take for a NOA-2 afterwards?

I do not expect my application to be sent to a local office, since my wife is not applying for Adjustment of Status (she is not in the US yet).

I had to wait 197 days for my NOA2.


Thanks for clarification. Yeah 197 days (6 - 7 months) sounds about average waiting time for filers like us from within the US to a lockbox.

Why are you thinking they got preferential treatment?


I was being sarcastic. Overseas filers typically get NOA-2 in less than 2 months. Again, I do not know why or how that works. As far as I know, they file the application to a US Consulate and not mail it to a lockbox in the US. I filed my I-130 by mailing it to the Chicago lockbox.

A couple of people on here already show they have NOA2 and filed at the end of Feb. as well.


Yeah I've seen that, they filed from overseas (DCF?). Somehow, they get preferential treatment :angry: ... I don't know how that works. Had I known, maybe I would have filed my I-130 at US Consulate in Hong Kong if I could.

Hey everyone,

Almost 14 months after NOA-1 and a transfer to Nebraska, I received SMS yesterday that My I-130 petition has been approved (I am the USC).

Can anyone help answer 2 questions I have:

- What will happen next and how long from here to Consulate interview for my wife in Hong Kong?

- If my wife leaves Hong Kong (she is getting a new job in Canada and will move there around July), can I change interview consulate from HK to Canada and how much delay will that cause?

My 2 cents:
The I-130 application does not call for including this information. See what the lawyer's opinion is.
I am going to guess this will be brought-up during her interview though, as it indicates she has been making a sustained effort to immigrate to the USA by establishing a relationship with a citizen.

For the most recent 15, they all received NOA-1 in June 2012, or first week of July 2012, and then received NOA-2 in February 2013. This makes a typical wait period of between 6 months and 1 week and 7 months and 3 weeks.
Only one couple (Hubby and Hope) were lucky to have NOA-1 (in October 2012) to NOA-2 of only 3 months and 26 days.
I am tempted to think the month of the year you file in, has an impact on how long it takes. A big number of petitioners in the summer (june - July), much less in October.

Darnell, I went through your list of bona fides. I cannot come-up with everything you mentioned, but I will do as much as I can.
But I really like your idea of submitting a letter of attestation on the prior marriage and a letter of evolution of relationship. I will do that. I also have two affidavits from my wife's friends who attended the marriage ceremony. However, the 2 affidavits are not notarized, just signed in person, do you think that matters a lot?

Hello everyone,
New to the board, but not new to marriage to a foreign national. In 2004, I married a Russian lady and applied for a K-1 visa for her, which was granted, we got subsequently married, divorced and she ended-up leaving the US and going back to her country.
Now I just married a Filipina lady and would like to file a I-130 for her (in fact, I have all paperwork ready).
I am USC, 54 years old, she's 26 years old. We married in Hong Kong where she lives and works (legally).
While browsing the internet, I came across the Adjudicator's Field Manual - Redacted Public Version \ Chapter 21 Family-based Petitions and Applications. \ 21.3 Petition for a Spouse and
in section (H) Interviewing Petitioner and Spouse .
It says:
Some indications that a marriage may have been contracted solely for immigration benefits include:
- Large disparity of age;
- Petitioner has filed previous petitions in behalf of aliens, especially prior alien spouses.
I am worried as I fit the two criterions, though my previous petition was for an alien fiancee, not spouse.
I would like to seek your input and advice. Has anyone gone through the I-130 process where there was a "Large disparity of age"?
Sure,I will expect a long grueling interview, but what are the chances of getting an approval at the end?
