K-1 Fiance(e) Visa Process & ProceduresSimple Step by Step Guide for filing a K1
I won't get into the visa-specific part of this.
But I did want to say, I feel for you. I was in a very similar situation and I know how hard it is to have to choose between love and family (traditions etc.). I was disowned by my father (for many reasons but mainly because of my going off living on my own and then finally marrying an American boy, oh the shame! ). All I can say is, follow your heart but don't be impulsive.
I feel like I've been through hell and back but I came out stronger, so much stronger and grown-up. If you ever feel like talking, send me a PM.
Good luck to you, whatever you decide to do. (L)

It doesnt matter how long - just stipulates that you've MET..no time frame is given there.
Whatevr you do, don't put yourself in harm's way - I know you're not a child per se and Im sure you love your family (and they love you) but I am slightly worried you and your man will try something crazy. Rememebr he's still very young, and you wll need a co-sponsor unless he has an excellent job.
You also need to think of practical things like, where will you live? How will he support you? How will you pay for the AOS (after marriage) which isn't cheap..and food, rent, medical bills..
Can you cope with your family possibly cutting off contact with you over this?
I DO wish you luck..but please make sure you are fully informed and aware before you take steps. :) (F)

Thank you for this post, Jaylen. (F)

K-1 Fiance(e) Visa Process & ProceduresHit the WEEEEEEED and go to your Visa interview...

One of my fiancees is terrified that the medical exam she took in Canada is going to reveal that she hit a tiny puff of the chronic a couple weeks ago. Is that cool, or are they gonna take her down to china town.

Many Thanks in advance for the input... :P

P.S. I told her there's no way they're going to waste their time "weeding" out folks that are just trying to be cool and get a little bit high  , but then again, they might, so... ideas?

Fingers crossed that one of your other fiancees will pass with flying colours.

Sad to say, I know how you feel. I was a lurker long before I joined and I didn't register until right before my interview at the embassy because of this.

They might request your fingerprints. They seem to go pretty easy on USC who commit light crimes but not so easy on the foreigners who commit light crimes. I think it might just depend on what you did. Shoplift $20...meh. Kill some one...prolly so. Good luck and let us know please for future people who come along and are in the same position.

IR-1 / CR-1 Spouse Visa Process & Proceduresservice center question... help please
Your case will most likely be sent to the California Service Center. The lockbox will send it to the right place. Once you get your NOA1 (I-797C) in about 2 weeks from when they receive your petition in Chicago, you will know where it was sent to. Or, if you sent a check with your application, on the back of your check it will have 3 letters followed by numbers. The check will be processed before you receive your NOA1. If the letters on the back are WAC then it is at the California Service Center.

Best of luck on your journey!

IR-1 / CR-1 Spouse Visa Process & ProceduresSome basic ?'s
1. It is optional but if the USC can attend, this is a good idea.

2. Here is a good guide as to what will happen during NVC/all of the documents that are needed (make sure to check your consulate for your country specific documents) : http://www.visajourn...he_NVC_ShortCut

3. Every case is a little different as far as how much more this is going to cost.
The AOS (I-864) fee is $70 where the IV (DS-230) bill is $400. Then you have the expense for the medical exam. You can get a better idea of how much that will cost by asking people who have gone through the medical recently or checking the consulate website. Around $200 generally. The other fee is the courier fee that the consulate will have you pay after you get your approval notice from them. I don't know how much it is for your consulate. This as well should be on the consulate website.
As you said, there are the other expenses like sending the mail and documents and travel and all of that good stuff.

Best of luck on your journey!

IR-1 / CR-1 Spouse Visa Process & ProceduresJULY 2010 NVC PROCESSING...
No problem Baille!
What S&ET posted about "Christine's current processing times" is not current. Those times change a lot. It looks like NVC is slowing down and instead of taking 7 days (this is how long it took me and other people around me) to get your case number, it looks closer to 2 weeks. I hope this time goes back down again. The other times are not current as well. The best predictor of how long it will take is to look at the time lines of people who are NVC now to see about how long it will take to get things done.

Every time that I have called, the system asks you questions and then gets to "If your case number begins with.....press...." for this option, press 4. 4=WAC. Then it will ask you to enter the numbers after WAC on your receipt.

Sorry that they told you 10-15 days. It could be there sooner. I would just call every day to make sure. They tell you 10-15 days so that if it does take them that long, you can't call and complain :P. I hope you can get the number soon!

IR-1 / CR-1 Spouse Visa Process & ProceduresFILLING FOR CO SPONSOR
For her property, she will have to send in info that shows when she purchased it, that she is the owner, a recent appraisal (who much it is worth now), show any proof that she doesn't still owe money for the purchase of the property- or if she does, show how much she still owes.

What apeters said about the 3 last years and employment letter is correct. It is optional. But, I would rather be prepared with that info and have it sent in instead of having them decide they want that info later and not having it ready.

As for your case number, I hope they will give it to you next week. If not, NVC usually asks you to send them a copy of your NOA2 receipt. I hope you can get the number soon!
BigSighFemalePeru2010-07-11 08:53:00
IR-1 / CR-1 Spouse Visa Process & ProceduresFILLING FOR CO SPONSOR
Ces- As far as I know, he will need:

-his tax transcripts from 2009, 2008, and 2007. If he didn't fill those out, he will need to do that now or write a letter stating why he didn't need to file taxes for those years. If he sends in the IRS tax transcripts (which he can get for free either in the mail or have faxed to him by calling 1-800-829-1040) then he doesn't have to send in copies of his W2's. If he sends in copies of TurboTax filings or something similar to that, he has to also send in copies of his W2's and whatever else applied to him during those years for each year.

-The AOS bill paid coversheet ( from the online payment portal)

His mom will have to send in her:
-last 3 years of tax transcripts

-an employment letter saying how much she makes and that she is in good standing and has been working there for however long she has been working there.

- Last 6 months worth of pay stubs

-She will also need to send in proof that she is a US Citizen or LPR and proof that they are related.

-Something proving that they share the same residence (bill or something or driver's license with the same address)

-If she is using assets to meet the 125% poverty guideline, she will need to submit proof of ownership, date that she purchased the asset and a recnt appraisal of the item (minus what she still owes on the item if anything).

I hope that is everything/correct information for you. I'm sure someone will come correct it if wrong. Best of luck!

IR-1 / CR-1 Spouse Visa Process & Proceduresquestion for couples...
Yeah seperation sucks. This last year of marriage we were together for 20 days. We have yet to celebrate a birthday together or Christmas (our daughter's 1st X-Mas was not spent together) or New Years. We missed our daughter's 1st birthday (which is a BIG deal in Peru) and our 1 year anniversary. This year we went be together for our birthday's again (in Sept.) I'm hoping we can be together by X-Mas. The last time my husband saw our daughter in person, she could barely hold her head up (3 1/2 months), now she is running and saying words and feeding herself and singing.

I certainly remember the days back before our daughter when we weren't married yet and I would bawl and bawl for ever after I had left him at the airport (and at the airport). I can't do that now.

I know that everyone's journey is hard on them in their own way. Hopefully they will all be over soon!

IR-1 / CR-1 Spouse Visa Process & Proceduresquestion for couples...
Dj's baby- I left Peru when I was 8 weeks pregnant (Aug. 2008) and when we realized that he wasn't going to be here any time soon, I went back to Peru 32 weeks pregnant (Jan. 2009) and had the baby there with him. It sucked and I felt like I wasn't even pregnant (except for the obvious things). It was nice for him to get to feel her move in my tummy and see her on the screen finally. It was also nice to have him there for the birth.

My daughter and I left Peru last July 6th (when she was 3 1/2 months) and that was the last time we have seen each other in person. It is really hard for both of us but I block all of my emotions so that I don't cry every day just thinking about how much it sucks that he hasn't seen her since she could barely hold her head up and now she is running and saying words and singing and doing all kinds of stuff.

We talk on the phone some times and not online some times. We used to talk more but he works from sun up to past sun down so when I am putting our daughter to sleep, he is getting off work.

I would send a the original plus a photocopy to the NVC of everything that they are asking for. The NVC may or may not have the documents that were sent to USCIS originally.

Hello.

Yep. The NVC requires an original/certified copy and a photo copy of the foreign spouse's birth certificate, original/certified copy and a photo copy your marriage certificate, and a photocopy of the foreign spouse's biographic page (where it shows your name and picture) of their passport.

Best of luck!
BigSighFemalePeru2010-07-11 09:49:00
IR-1 / CR-1 Spouse Visa Process & ProceduresOriginal copies
Along with our I-130 petition, I sent in our original birth certificates, marriage certificate, divorce decree and passport-type photos. Will I get them back before our interview? Or will they get forwarded to the Embassy in Kiev?

You weren't supposed to send originals to USCIS. They should (this is a key word) get sent from USCIS to NVC and then from NVC to the Embassy. The originals are asked for during the NVC stage (as well as a copy of the original). When you eventually get a case number from NVC (about 7-14 days from when you get your NOA2), you could talk to an operator and see if they still have your originals from the I-130 package. If not, they will be requested again.

What does SIF stand for?

SIF stands for Sign In Fail. This comes at the NVC stage when they are all done with processing your case. Then you should call their number and make sure that the "voice" gives you a Case Complete. This is a good thing! :).

IR-1 / CR-1 Spouse Visa Process & Procedureshubby in usa now but have a question!
Congrats! As for the stamp, that is what is supposed to be there and is good for 1 year. He should get his green card within a month from now. The Green Card makes the stamp not good any longer. The Removal of Conditions is the next step which should be completed 90 days before the 2nd year of entry (the date on the stamp).

I wonder if you would've waited until after July 26th if they would've given you the IR1 instead. Does anyone know? Not that it matters now.

I know that someone else will come along and correct me if wrong.

I hope you have a long and happy future together!

IR-1 / CR-1 Spouse Visa Process & ProceduresConfused, what to file and what order?
If you are filing for CR1, you will need to submit:

Here is a link: http://www.visajourn...tent/i130guide1

-A cover sheet with the contents of your I-130 package (you can find different examples of a cover sheet by searching on here)

-The petition fee of $355

-The I-130 form

-G325A for you

-Passport picture of yourself with your name on the back (in a plastic bag and paper clipped to a blank piece of paper)

-G325A for you wife

-Passport pic of her with her name on the back (in a plastic bag and paper clipped to a blank piece of paper)

-Proof of your US Citizenship (copy of your birth certificate or ALL pages of your passport)

-A copy of your marriage license

-A copy of your baby's birth certificate

-Proof of your marriage (optional but some think it is a good idea to send in some of this right now)
-Pictures
-Joint bank account
-Joint property deeds or what-have-you
-Western Union type receipts
-Call logs
-Chat logs
-E-mails
-Cards
(There is a whole bunch of things that could be sent. This will also be needed at the interview stage.)

If the K1 visa isn't addressed now or during the NVC stage, it will definitely be brought up during the interview.

I would wait until at least Monday for some solid answers to the other issues in your case. Best of luck!

IR-1 / CR-1 Spouse Visa Process & ProceduresConfused, what to file and what order?
Good luck to you. It sounds like there are some different issues to be addressed here. The main one is the not filed AOS which I believe would've made your wife out of status and in the country illegally. As to how long she was here for and all of that good stuff, depends on what the paperwork you were to send in said.

I'm sure some one will come along and help you out. Congrats on your baby and best of luck to you!

Hello. Congrats on the case complete! The interviews for August are being scheduled at different times depending on your country's embassy.
