Orthodoxly, the two are NOT, and I repeat NOT, allowed to meet before they are married. They are allowed that initial meeting BEFORE they get engaged. When I said that they met earlier, they didn't go on dates or anything of that sort, they just happened to be at the same place at the same time. In Aug 2007, they were both at my wedding in England and it is even possible that they didn't see each other or talk to each other then.

These statements confuse me.

First: The claim of them 'meeting' at all is based on them both being in the same location at the same time, but they may not have even seen or spoken to one another? I don't even think this qualifies as a meeting. I've been in Chicago Union Station at the same time they filmed a movie, that doesn't mean I've MET any of the stars, or the director, or anyone else who was in the building at the same time. :blink:

Second: Highlighted portion. It's one or the other. They are either allowed to meet, or they are. Which one is it?

We just wanted to know the options. As I stated earlier, the two met more than two years ago so that trip might not work, which is why I asked the question regarding the type of hookup they had.

They will have to meet the qualifications for the application BEFORE filing it. If they do not meet the qualifications as of the date they file, then they will likely be denied. That means they will need to wait until after the July visit to file in order to have met the qualification of having met in person in the last two years.

It is very difficult to get USCIS to waive the requirement for meeting. I do not believe you have a situation where you stand a chance of being able to justify a waiver for the meeting requirement.

Do they let us know if is everything correct, I mean about the forms. Do they ask for us to correct or not? Do they ask us for more proof if they think is not enough what we sent? I want to know if is from this NOA 1 that we know all these things.

I'm not sure of all the reasons for a packet getting rejected, but usually it seems to be odd abbreviations in place names, an expired version of the form, or an incorrect payment amount. These seem to be the things that would cause you to have the packet sent back and not get an NOA1.

The NOA1 itself doesn't mean that your paperwork is correct. All it means is that it was accepted and is in their system. They may find something later and will contact you using an RFE to request more information. This could be fixing a mistake on a form, adding more evidence, etc.

Just to chime in with what some of the others have said, it may not be about the evidence you sent. Maybe some field got accidentally left blank, or some other minor mistake. You won't know until you get it and see exactly what they're asking for. Most of all, just turn it around quick and I'm sure you'll see your approval soon.

TX lockbox received my I-129 packet Monday morning along with G-1145 form. Based on reading everyone's posts, it seems like it takes 5-10 days for everyone to receive their NOA1. Since I turned in G-1145, will they e-mail/text me as soon as they approve NOA1??

Actually, they seem to send out the e-mail a few days after the actual NOA1 date. For instance, my NOA1 date was a Friday, and I didn't get the e-mail until Tuesday morning, and the hardcopy until the following Saturday.

Hey Everyone,

So, my application came back in the mail today, rejected for 2 reasons.

1. Don't ask me why, but I wrote 12/31/2011 on the check. That's my dumbass fault

2. More importantly, the forms me and my fiance used were outdated. I don't know where she found them, but I'm hoping someone can verify a link of the most up-to-date forms. I'm also curious when they were changed.

Sorry about the trouble. I just hope we can get this sent out again soon. My Filipino baby is very frustrated right now.

Yes, that's your NOA1 receipt letter.
Your case is to be processed in Vermont.

It doesn't mean that 'everything is okay' by technicality.
It simply means you have the correctly dated forms, paid the correct amounts, and there is nothing /immediately/ apparent to someone who isn't an adjudicator that would cause them to send it back (abbreviations, missing fields, etc.)

If you are missing something, or they need more information, they will send you an RFE.

OKAY, so my frustration lies in the fact that my fiance has sent me a package containing all the forms that he needed to sign along with his passport style photos two and a half weeks ago... I guess there really isnt any question here, but I was wondering if some people found this to be normal.. I know I should get some patients, since once we send out the petition i will be waiting for a MUCH longer amount of time... but I would rather be waiting on that knowing that we are getting some where then waiting on the post office to deliver the last things i need to get moving forward.. is this normal?? my fiance lives in Jamaica, it took one week exactly for my things to get to him, he sent it in that same day and I am now on day 17... I figure i will send out another package with all the same forms, but I didnt know if I should still have my hope up on this package getting to me... anyone have similar situation?

also I just was reading that in some cases while the petition is being reviewed you cant visit your fiance... is this entirely true?? or only for some countries? I have been planning a trip to live with him in June till late August.. should I be cancelling?? (I sure as hell hope not!)

I can't comment about the shipping times. We chose to fill our paperwork out together so we didn't have the issue with shipping back and forth.

As for visiting, if you are the US. Petitioner, you shouldn't have a problem although you may need to get a visa in order to do so.

If they plan on visiting you in the U.S. they will need a visa, which might be difficult to get after the I-129F is filed due to the application showing immigration intent and the visa requiring proof of strong ties to the home country.

I have been using the information from this site for some time but I have never posted. Thank you all for your knowledge and experience... My question: I should be receiving my NOA2 by the end of February. I am very excited!! I want to travel to China to be with my fiancee during her interview for support. Is there enough time to arrange travel from the time my fiancee receives notification of her interview date and time? What are some of your experiences???

What I did is go to Immigration Timeline.
Then to View K1 Visas [ Advanced View ] .
Then I filtered it by China.
Then sorted by Packet 4 Received date. (which should be your interview letter)

Looking at those, it appears to be anywhere from 2-6 weeks between Packet 4 being received, and the actual interview date.
I'm not sure how well that answers your question.

It looks to me like they are asking for a specific document: the certified divorce decree.
I'm not sure sending them the same thing a second time, even with the backup support you have, will satisfy that.

As I mentioned in my post, the major thing I see as a difference between the judgement sheet you have, and the divorce decree I have (keeping in mind that the states are slightly different), is that yours doesn't seem to include the actual divorce agreement paperwork. The pages that include your names, addresses, assets, division of assets, grounds for divorce, etc.

It is really hard to keep track of things because this is spread across multiple threads.
It is my understanding that your timeline is this:

1. You get first RFE requesting Proof of Dissolution of marriage
2. You send in your JUDGEMENT OF ABSOLUTE DIVORCE which I believe is this document.
3. You are sent another RFE requesting the "same thing".

My question is, what /EXACTLY/ does the RFE say?
I'm having trouble tracking this across the threads and I'm not sure if you posted it or not.

My understanding, again from other threads, is that you went to the courthouse and asked for a CERTIFIED COPY OF THE DIVORCE DECREE and you were given the "same thing" (the JUDGEMENT OF ABSOLUTE DIVORCE). Is this correct? Are you /SURE/ that you asked specifically for the right document?

Now, I'll admit, I'm from another state, so some of the documentation is different, I'm sure. However, that document appears to be the final page of a divorce decree. What you are missing are the actual divorce documents. These are the ones that were signed by the two ex-spouses and included information such as names, ages, addresses, grounds for divorce, division of assets, etc.

When I got my CERTIFIED COPY OF THE DIVORCE DECREE here in Illinois, it included the original paperwork filed with the divorce, as well as a final sheet which has the same sort of 'outline' for what was agreed to, and was signed by a judge. Both the original paperwork, and the final page have stamps/seals from the clerk's office with the date I got the certified copy, and the final page has a large raised seal as well.

If you are sending through the US Postal Service, you use the Dallas address. The Lewisville is for things like UPS, FedEx, DHL, I believe.

You would list her children, even if they are not accompanying her. The question says "List all children of your alien fiance(e)". It doesn't specify adult, so you list /all/ of them.

Hello everyone and thanks in advance for anyone who answers. Im applied for a K1 Fiance Visa. Already at the last steps, before recieving the interview date at the U.S Consular in Montreal.

1. What is exactly an '' Intent to Marry Letter'' ? What does it have to include exactly in it?

2. Evidence of Engagement to Your Fiance? What in the world is that? lol

3. They ask if I intent to work or study in the U.S? What is that about? Mine is not a work or student visa. I dont have an employee or school address for now there. I don't need one to move to the U.S. I dont have a 9-5 job. Do I have income coming in? Yes. Do I have money to pay for expanses in the U.S? Of course. Do I have a degree? Not yet Im back to school now working on that. Will I go to school there? Online probably and probably another degree and continue on the one im working on now. Will I have a job there? I might invest on something or do some real estate or get another job.

Any advice or questions you may have dont hesitate.

So here I am sitting at school, searching about Visa's online, when I came across this site. And I want to know if there are people like me, or who were in my situation once.

I'm 17, living in the U.S. I met my boyfriend online, and he lives in Australia. We've been together for 7 months already, and I can't tell you how happy I am. I wish to meet him and move him to the U.S. in the future. I don't have a specific question to ask really, I just want to know, if and when the time comes, how does one even START to apply for a Visa? How much money does it cost? Etc, etc. Or could I have a couple links to direct me to a starting point?
I also want to know how to get a passport to eventually visit him sometime.

So much to say in response to this...

My first suggestion is that you don't rush too much into things. Not only is meeting in person a requirement to the whole process, but it's something that will really be beneficial to the both of you. No matter how well you know someone over the internet, there's always a chance that there is something that just doesn't work in reality.

The first step? Set up a trip for him to meet you, or you to meet him. If you're both young, you may want to make sure you involve your parents. Introduce your parents to each other over the 'net if you haven't already and have them talk over the phone to get them comfortable with the idea of the two of you meeting. It's very scary for a parent to have their child go halfway around the world to meet a total stranger. I'm in my mid-twenties and my family /still/ worried when I went overseas to meet the soon-to-be inlaws.

Once you've met, and you're /sure/ this is something you want to persue in the future, DOCUMENT EVERYTHING. Save trip itineraries, receipts, boarding passes, photos, and anything else that can prove that the two of you met. Take a look through the guides on this site, as well as the instructions for the various forms you need to fill out for the process. Keep in mind that you will need to prove that you can support your spouse when they come to the US, so you will want to look at the poverty guidelines and find out if you have the income for it. Since you are only 17, you will almost certainly need a co-sponsor, so getting your parents involved at an early stage and getting them to be okay with you dating someone from another country will be important.

Others have already talked about the costs, so I won't reiterate that.
Just take your time, understand the process and what you'll need to do.

This is from the I-864 instructions (under 29. Total Value of Assets), not the I-134, but I believe this is what most people quote about using assets.

In order to qualify based on the value of your assets, the total value of your assets must equal at least five times the difference between your total household income and the current poverty guidelines for your household size. However, if you are a U.S. citizen and you are sponsoring your spouse or minor child, the total value of your assets must only be equal to at least three times the difference.

I have heard (but not certain) that when using assets, you need 3x (whatever amount isn't covered by income).

They suggest you have an updated letter of intent re-affirming your intent to marry. (ie. not the original one sent with the petition), but I don't know if it's strictly required. You could ask in your regional forums if anyone has been asked to show it.

Hello everyone, I'm new to this board and I have a question about the income requirement. well, I quit my job 3 years ago and since then I've been traveling. Now, I met someone(Guatemala) and I want to start the k1 process, but I have no proof of income. I was wondering if I can use my cash and assets in lieu of the w2 income? I have a significant amount of cash available and I own my home mortgage free.

I doubt it very much if I can find a job before the start of the interview to use.

My problem is with the form I 864 because I really don't know anyone that will take on that type of responsibility for me and my siblings always ask me to co sign for items for them and I always tell them no, so it's unlikely they will do it.

Hi! I was browsing through topics, and came across the thread for expedite request...

Beau will be in another state next month for a 2 week military training, and another 2 weeks or so in May at a different state; he said its a war simulation program. With the mention of "war" I of course, got worried but he said its a pre-deployment training. Upon researching the net however, there had been a lot of critics about the said program, and was repeatedly referred as deployment. He isn't sure whether they will be given passes, communication access, or other "luxuries" or if it will be a locked out training.

I'd like to ask if military activities such as the above mentioned can qualify for an expedite? With the delay in processing at Vermont, and their unit's frequent pre-deployment trainings lately, I am fretting that ours will come when they are just about to be deployed already :crying:

This is jumping the gun, but if the war simulation exercise is indeed a deployment w/in US or that we would not have any means of communication during the exercises, would it be possible to send a new cover letter stating the above condition?

Any help will be very much appreciated.

1. Click on Immigration Timelines on the top of the screen.
2. Click on K-1 Visas [ Advanced View ].
3. From the drop down at the bottom, select Costa Rica.
4. Click Find.
5. Find the column marked Interview.
6. Click the downward arrow to sort by most recent interview date.

Look to the right for the column that says I-129F NOA2 to Interview.
This should give you an idea of the wait time for your consulate.

When did he file the last petition?
There is a filing limitation that you cannot file two I-129Fs within a two year period without a waiver.
If his last petition was less than two years ago, you should send them a letter requesting a waiver of the two year filing period requirement and explain your situation.

I'm ready to scream. it's been 5 months exactly since I got the receipt.

Called NCSC support line, followed the menu tree to where I was supposed to enter my receipt number. Entered it, and then it told me I didn't enter enough digits. I'm sorry, I did enter enough digits dammit!!!!!!! This is exactly the same number I use to access my case status online. I listened to all the rest of the menus. There seems to be no way to get a human being to talk to about my case.

What can I do? This has all the appearance of a classic IT SNAFU, the kind you don't want to be caught in the middle of. Please help!!!

My only thought is that perhaps there is some state-specific law that the adjudicator is concerned about applying to a particular case.
Something like age of majority, which is different in different states?
(There might be other examples/possiblities - this is just a guess/my first thought.)

As far as I'm aware, this isn't something you're required to state as part of the petition.

Ok, I updated my timeline, so it should be correct now...

I have tossed around the idea of pushing back the wedding. My parents are huge sticklers to us having a formal, traditional, huge, white wedding. :wacko:

I checked my updates on the USCIS website and it says my case hasn't been touched since 11/15/2010!! :(:(:(:( This is like worse than bad news. I have no idea what to do anymore.


Right now, your timeline says:
Based on timeline data, your I129f may be adjudicated between March 29, 2012 and April 13, 2012*.

Of course, this isn't exact. You really never know when you'll get an approval.

You might want to check how long it takes for your consulate between NOA2 and Interview.
That will give you a better idea of how tight a timeframe it is.

Right now, though, I'd hazard to say that you're looking at a pretty tight timeframe.

You have a couple of options:

1. Wait and hope you get it in time. Knowing that if you don't, you have to choose between option #2 and #3.
2. Push the wedding back to a later date and continue the K-1 process.
3. If you can't push the wedding back, choose to get married on your chosen date, and abandon the K-1. Your spouse would have to go back to their home country and you would have to file a CR-1/IR-1 spousal visa and start the waiting over again.

Hello... I received NOA1 on November 5th, from the California Service Center. My fiance is in El Salvador. I have a few questions...

First of all, our wedding date is June 4th, 2011. DO YOU THINK I HAVE ENOUGH TIME??? We still haven't received NOA2! :(

Second, I look at everyone's timelines and it says "Touched" on some of them. How do you guys know your case has been touched?? This is driving me literally crazy. I haven't heard ANYTHING since November...

And lastly, is there anyone that has experience with the El Salvador Embassy? Can anyone give me advice as far as that's concerned??

First:
You may want to update your timeline. You actually have 03-05-2011 as your NOA1 date instead of 11-05-2010.
This is throwing off your timeline estimates.

Second:
In general - you should never make firm wedding plans until you actually have the visa in hand. Right now, California is taking about five months to approve petitions. That means you may get an NOA2 sometime in April-May maybe? I'm not 100% sure of the timing, but you're running the risk of being way too close to your planned date, especially figuring you still need to go through the embassy steps.

Third:
On the USCIS site, you need to have a login/password (click the sign up for account link).
Log in using your login/password and add your case #.
Under 'Last Updated (mm/dd/yyyy)' you will see a date.
That is your last touched date.

Make sure you update your timeline with Vermont as your service center.

Right now, Vermont seems to be a bit behind. I believe the last date they published processing was August 21st, but they have had a few September applications get processed recently (you can see what cases have been proved using the Immigration Timelines link above, and checking Igor's List under Vermont).

Most of the time, you would want to try calling the service number and asking for a tier 2 representative, telling them you are outside of the published processing time and you are asking for a service request.

People haven't had much luck with it lately from Vermont, however. Usually, they are told to wait another 30 days.

I see that your account has been "touched" twice but we filed 9-23-10 and that last "touch" was 10/3/10. So this Thursday is 5 months no matter how you cut it. We are just frustrated and want this over. Any advice other than.....just keep waiting?


My case is actually at California, so I can't really speak to what being touched even means over there. There have been a lot of strange activity on that side of things.

Right now, Vermont is just starting to process September, so hopefully you should hear something soon. Just based on what I've heard from other Vermont filers, I wouldn't hold much hope on getting a service request put in until after six months.

Last week we passed the 5 month wait time for our K1 visa. We sent our packet to the Texas Service Center (avg. wait is 5 months). We still haven't heard anything from them. I have read on this site that a follow up letter is a good idea once the wait time is expired. Where do I send this letter? To the Texas Service Center or is there a different (or better) place to send the letter? Any and all help is most welcome. I am tired of waiting for my Fiancee and I am ready to start our life together.


First, let me clear up a misunderstanding that you're having.
You didn't send your petition to the Texas Service Center.
You sent it to the Texas Lockbox.

Note the difference in the two names. They aren't the same thing.

The lockbox location forwards your petition to either California or Vermont.
If your case # starts with WAC, you're at California.
If your case # starts with EAC, you're at Vermont.

My mom was recently diagnosed with a terminal illness and I'm afraid she may not be able to make it to our wedding if we waited until July. (July is the expected month my love should arrive in the US)

Do you think this would qualify as a valid reason to file an expedite?

First, let me say that I am so sorry to hear of your mother's condition.

I have heard of at least one person here on VJ who had a mother with such a condition and they were able to get an expedite on those grounds. I noticed their story when I saw them getting an early approval at some point in the past few weeks.

Make sure you have the medical documentation to back up the situation.

I've finally sent out the I-129F and it was received by the Texas Service Center on February 28th. Does anyone know how long we can expect to wait before my Canadian fiance receives his Visa?


Welcome to the process!

Just to clarify, the address you sent to in the instructions is actually the Texas Lockbox facility.
It isn't the Texas Service Center.
The Lockbox facility just receives petitions, processes payments, and forwards the petitions to either California or Vermont.
If you included the G-1145, you should get a text/email telling you which service center you were sent to.
If not, it will be on your NOA1.

The two types of petitions are sorted entirely differently.
So it really doesn't apply.

Sorry guesses are not allowed. You have to have the facts. Feel free to call USCIS right now and confirm what I have told you. The OP,s case is an example. There have been many posts here about this time and time again. I'll search out some threads and let you have them.


No one here is an expert, or a lawyer, or a spokesperson for USCIS (unless they state otherwise).
You asked me why it was done that way (sent to a sorting facility).
I am not a spokesperson for USCIS, so all I can do is /guess/ at why.

As I said, I have yet to see a K-1 which does not fall under this sorting method.
I will not argue with you further on this. I am simply passing on information.

The current instruction form only have the lockbox address and no regional assignment like you have listed. You can't just automatically assume that it has to be the same service center. If that was the case then it would defeat the purpose of sending to the lockbox first. Can you tell me why you have to send your petitions to the lockbox first, when you could have sent it directly to the service center? I have asked a Tier 2 level CSR who confirmed this. So, what other explanation is there for the OP's case. My K-1 was processed through Vermont, but my spousal is through California now while my address remains thesame. They do not want one service center very busy while the other is not. You can confirm this by calling USCIS to speak with a Tier 2 CSR.

All petitions are sent to the lockbox.
However, I have yet to see a K-1 petition that varies from what was outlined above.
So, as far as I am aware, this is still the way that K-1 petitions are split.
The OP's petition falls neatly under this, as well.

As for why it is done that way:
My guess is that too many people were sending petitions to the wrong service centers.
To save themselves time sending petitions back and forth due to mistakes, they have them all sent to one sorting location.

The I-130 and the K-1 (I-129F) are two separate types of petitions.
They are handled two separate ways.
They are sent to two separate lockbox locations, and sorted two different ways.
I am speaking ONLY of the K-1 (I-129F).

I am sure you did not send the petition directly to Vermont. What they have been doing is make you send it to a lockbox facility, where it is sent to whichever service center that is less packed. This is to ensure evenness in workload so that one service center does not get chocked/backlogged while the other gently cruises on.

It's actually sent to a service center depending on what state you live in.

Previously,petitions were sent to the service center directly based on your state (it was in the instructions), now the lockbox forwards to the service centers. But it's still the same split up as before.

According to the state department website at this link. Underneath the "What is a Fiance" section it says that "Both the U.S. citizen and the K-1 visa applicant must have been legally free to marry at the time the petition was filed and must have remained so thereafter."

Where you sign the I-129f form it says in the YOUR CERTIFICATION section that "I am legally able to and intend to marry my alien fiance within 90 days of his or her arrival in the United States.

So is it okay to sign the I-129f before your previous divorce is final but not file it until after you are legally free to marry. Since what you signed said that you would be able to marry within 90 days of your fiance's arrival.


This may seem like a stupid response to your question but...

Why can't you wait and sign it afterwards?
It makes a lot more sense, especially if you're not going to file it until later anyways.

Besides, I wouldn't sign/date it before the date of the divorce.
It's bound to raise eyebrows.
