IR-1 / CR-1 Spouse Visa Process & Proceduresuscis touches
QUOTE (ppb @ Nov 28 2009, 11:56 AM) <{POST_SNAPBACK}>
is it normal not to get your case touched? I've checked online for two months now, with no touches since the NOA1.

I'm starting to worry.

Haven't had a touch since Sept 28. I assume that is when it was logged and assigned to an adjudicator. Even had to send correct sized passport photos which they received on 16 Nov and still nothing.

I used the 2555EZ to calculate the exclusion and send to the husband. For the ID requirement for the W7 the easiest is to send a copy of the passport but it must have an Apostille to verify (if the country your spouse is from is a signatory to the Hague Convention).

'Americanise' his name as there is place on the I-130 to write his name in his 'native' alphabet.

IR-1 / CR-1 Spouse Visa Process & ProceduresIncluding personal photos with I-130 petition?
This is what we sent:-

The petition (of course)
G325A
1 x affadavit from his Mother
Divorce decrees
Marriage Certificate
Passport style photos
Copy of passport biographic page for me
Copy of his Military ID

We made sure that we sent ALL the required documents, though. Had we had joint bank A/C, lease etc we most likely would have sent that too. We have plenty of photos but I'll keep that for the interview stage (if we ever get there).

Don't bother with the K3 now. It is way too late. Besides, they're processing September petitions at the moment. There are a few of us from September who have just received our approvals and hopefully, the rest will follow within in the next week.

Good luck ... :star:

IR-1 / CR-1 Spouse Visa Process & ProceduresMy wife had another kid, what now?

you are breaking the law and it's going to be very hard to get your wife and her children to the US with your name on the certificate.

The way I read it, the OP only recently found out he is not the biological father and may not have known at the time of the birth. The only law breaking would be if they proceeded as is in the hope the Consulate does not ask for DNA testing.

I'm not familiar with child custody rulings in the Phillipines, but wouldn't the permission of the bioligical father (if known) be required as well?

as long as its not 5 - 10 years like we were previously told! neither of us could cope with that!
thank you :)

Well, if your husband wasn't a USC then yea ... it could take that long. We are among the lucky ones even though it doesn't feel that way right now.

On average it is 3 months at the moment for an I-130 approval from USCIS. NVC times are really dependent upon the submission of the paperwork by the petitioner and the beneficiary, scheduling of the interview by NVC at your Consulate can be 4 weeks and up to 9 months or even longer for some Consulates. Bear in mind the 5 months processing time is only for the initial approval from USCIS not the whole process (although it is possible in some cases).

VJers in the UK forum will be able to give you a better idea on the wait time for an interview in London so your question on timelines may be better posed in the regional forum.

Best of luck and my sympathy for your loss ... :star:

Why did they resend me a bill for the $70? Is that normal? Even tho it shows paid?

That I cannot answer because if you have an approved petition for a child they will send you a bill but link the cases and you only pay the $70 once.

Hopefully this bump will get you answer from someone else who may know ... :star:

No, the cover sheet for the $70 goes with the Affadavit of Support package (I-864). DS-3032 goes on its own.

I would go with option # 3, but send chuck Norris to NVC and then to USCIS!!!

I enjoy your thinking ...

Send in a new I864, filled out correctly. Add the barcoded cover sheet. Add your own cover sheet. And add the missing bank statement documents.

Good luck!

Thanks, lady. I know you've been here too but sometimes ... I do want to kick him in the head!

IR-1 / CR-1 Spouse Visa Process & ProceduresPre-empting an RFE for AOS

I forgot to send passport photos - I didn't wait for an RFE, but printed a new cover sheet and sent them overnight just as soon as I realized it, with an explanation that I had inadvertently forgotten to send them with the original package. The NVC operator actually told me not to wait but to send them in ASAP. Waiting for them, could take forever.

Thanks, Christi. That is what they told me too but you never know with the operators ... !

IR-1 / CR-1 Spouse Visa Process & ProceduresPre-empting an RFE for AOS
So this has probably been asked before but ... I found an error on the I-864 and my dear (read idiot) husband forgot to include the bank statement for our term deposit :bonk: even though he included the balance in the assets. My Q's are:-

1. Knowing there is an error, do we wait for NVC to pick it up and send the RFE?

2. Can we amend the form now and include the missing bank statement with a cover letter explaining the reasons or will this confuse the issue?

3. Is it possible to have Chuck Norris go around to his (dear husband) house and roundhouse him in the head?

All responses would be greatly appreciated ... TIA!

IR-1 / CR-1 Spouse Visa Process & ProceduresI-864 for CR1 and CR2

Were you able to talk to a supervisor and get a clarification?

OMG I tried but now I know why I couldn't get through - the whole April NVC thread were ringing for interview dates!!

I figure that must be it because her I-864 is currently filled out the way you suggested and the way I thought would be correct. Household size = 3, her - him - and me (as a spouse) ... so if that is incorrect and after reading the instructions technically I'm not a dependent yet because he hasn't claimed me on his taxes.

I can't figure out why she is RFE'd on household size and I'm not?
Deb+SteveFemaleAustralia2010-04-13 04:57:00
IR-1 / CR-1 Spouse Visa Process & ProceduresI-864 for CR1 and CR2

I read that wrong... Hers should be three. One for sponser one for wife and one for child. Hope that helps

Thanks for the help!

We weren't RFE'd on mine for household size so I'm thinking that is what he must do for the CR2 (I actually read all the instructions again and I think I know where he went wrong).

Part 2 - her info
Part 3 - #8 Yes
Part 3 - #9 leave blank
Part 3 - #5 total is 1
Part 5 - total is only 2 (1 for immigrant and 1 for sponsor)

I know I'm his spouse but I'm not a dependent (yet). So he will overnight this today and then we will see if that fixes it. I will have him prepare an updated I-864 for both of us for the interview anyway. Wish me luck ... :star:

IR-1 / CR-1 Spouse Visa Process & ProceduresI-864 for CR1 and CR2

If that is the case that you got RFEd for your daughter's I864 only, then yes, your form is 2, hers is 3 for the household size.

Hey lady - I know, but her household size is 3 and the RFE reads that is incorrect. The total in 21h does not equal the sum of line numbers 21a through 21g.

IR-1 / CR-1 Spouse Visa Process & ProceduresI-864 for CR1 and CR2
So, I'm sure this is in a topic somewhere but the search does not answer my Q's. I get the 2 x petitions = 2 x I-864. This is where we are confused:-

CR1
Q9 - do not include any relative listed on a separate visa petition. So I leave this blank?
Q10 - Enter total number of immigrants. So that makes only 1.
Q21 - 21a = 1, 21b = 1. Add them together makes the household size only 2. Is this correct because there is no provision on the I-864 that I can see where I can list my daughter.

CR2
Same as above which makes the household size 2 again.

Very confused. Anyone who has completed an I-864 both CR1 and CR2, your assistance would be greatly appreciated ... :star:

IR-1 / CR-1 Spouse Visa Process & ProceduresBeneficiary Change of Address
I am the beneficiary and I moved just after we received our NOA2. I rang NVC and updated my address with an operator before we paid the IV fee bill and the DS-230 was mailed.

It never caused a problem for us. All correspondence is via email once the NVC has your email addresses on file.

IR-1 / CR-1 Spouse Visa Process & ProceduresHow do I get the NVC my email address

Deb+Steve no I have not joined the NVC April thread, I think my journey thruogh the NVC begam in March however :)
So with them asking for the DS 230 stuff does that mean that they have approved my AOS I864 that I sent in?

No, it doesn't. It means the IV bill has been paid and the beneficiary can now actually apply for a visa and that is the DS-230. The two are completely separate. If there is an issue with any of your packages, NVC will email a checklist (RFE) with what is missing/needed.

IR-1 / CR-1 Spouse Visa Process & ProceduresHow do I get the NVC my email address
Yes, you can expect them to email all correspondense to your wife. Your wife can log into the payment portal as well and click on appolicant document processing which will step her through the DS-230 package requirements.

Don't forget - for the DS-230 she will also need to send you 2 x passport style photos with NVC casde #, name & DOB written on back. Have you joined the NVC April thread? :star:

could anyone please tell me, how you guys get the AVR? I tried to call NVC number, but always got the operator.

Hey Ken - if you listen to the options, as follows -

2 (non Haiti immigrant visa)
1 (english)
1 (immigrant visa)
2 (NVC case #)

If you wait before hitting 5 when it prompts to speak to an operator, it will ask you if you know your CIS receipt # or NVC case #. :star:

We received our NOA2 for I-130 from USCIS and they already forwarded them to NVC. I am just confused about the AFFIDAVIT OF SUPPORT that my friends told me. Does it include ITR, payslip, and other finance resources? We already include the ITR in our I-130 application b4. Do we really need to send it again? thanks!

Yes, you do. It goes with the AOS package (I-864). Have you received your NVC case # and given the operator your email addresses yet?

IR-1 / CR-1 Spouse Visa Process & ProceduresDS-3032 email advice????

Hello,

I mailed the DS-3032 and they got it last Monday, but I have still not got the IV fee bill or email from NVC yet.. I decided not to email the DS-3032 since I was going to be mailing it with the barcode copy they sent me.. Now, it is over a week later and nothing.. Should I go ahead and email the form to them now or would that just complicate things for them??? or would it get processed quicker??? I have everything ready to go just waiting on the IV fee bill to pay... thank you

Just email it. Still take them at least 3-5 days to accept it.

IR-1 / CR-1 Spouse Visa Process & ProceduresBiographic forms sent from the NVC?

I had the same question. But i am not sure if i still understand what happens to the original certificates.

Do i understand it correctly that DS230 part 1 goes to the NVC with all the original certs, and NVC then transmits the same originals to the Consulate which are then returned to the applicant at the time of interview. Is this process just for cr-1/ir-1 cases or does Family 4 (F4) follow the same route.

DS-230 Part 1 and Part 2(unsigned) is returned to the NVC with all originals + copy of each. Yes, the NVC sends to the Consulate. The originals are returned at the interview. I assume this is the same for the F4 if you're completing a DS-230.
