CanadaMailing out I-130 packet from Canada

I am positive I saw a post regarding mailing the I-130 packet from Canada on here but I have spent the better part of the day going over all this stuff and I can't find that post to save my soul.  Hubby and I got everything together while I was in Fargo on the weekend and then realized that a document was up here.  And then there was the blizzard...and our timing went out the window.

 

I am back in Canada and he had to go out to the oilfields for a month, so I have our packet all ready to go.   I am sure someone on here said you can mail this from Canada but my confusion sets in where the address is concerned.   He is from North Dakota, so if it were mailed from there it would go to Phoenix, AZ.  Now, there are two addresses for this : one for USPS deliveries, and another for non-USPS deliveries.   I would GUESS that this would be a non-USPS delivery, but then I read a post that that is for courier companies.  Canada Post, I am sure, is not a private courier company.   THEN, I read an address for OUTSIDE the US which is a Chicago lockbox.  I am confused now because I am not sure if that means if the petitioner lives outside the US, or if it's just the packet coming from outside the US.

 

If you all understand all this, I commend you.  My question is simply...which address do I send it to from Canada?   My brain is mush, I apologize...

Happyfeet....although you probably wouldnt be here if you hadnt already figured out how informative this site is, the forums get very full quickly and there are hundreds of them that are sometimes hard to keep up with as they branch out and out and out....but there are folks here with a vast wealth of knowledge (and bruises!), but there are also some very strong opinions so keep an open mind! A couple more thoughts on your original post.... With 22yrs of marriage, taxes, etc, consulting an atty may not be a bad idea....I actually did that before I got started just to get opinions. I did free consults with three of them to make sure I understood the parameters of my particular case, then I did the research myself....also bought a couple of "immigration made easy" books from Barnes &Noble.

Hi.  My husband and I have investigate a lawyer (who spec.  Specializes in not only immigration, but guides everything down to exit tax)  It seems he really is telling us what to do, referring us to tax people, examining all our paperwork...$3000 (immigration form fee not included), plus another 4000-8000 for whatever else...I know many of you have done it on your own...is it that difficult, or can we do this.  We have our I-130 plus 325A ready to go.  We have followed the checklist.  Do we need any other forms to include other than the (email form).  Thank you. You can call NVC  @  603 334-0700   to get your case number.  Our petition ( I-130) was approved on July 30 but no case number until now.  Took  almost a month for NVC to received our papers.

WE HAD PHOTO'S TAKEN, WHEN I GOT HOME NOTICED THEY STAMPED ON THE BACK COMPANY, ADDRESS, DATE AND A PLACE FOR GUARANTOR SIGNATURE (LIKE A PASSPORT).  THE 1-130 DIRECTIONS STATE TO HAVE JUST THE NAME LIGHTLY PRINTED ON THE BACK, DO I NEED TO HAVE THESE RETAKEN?  IF THE BACK IS BLANK W/JUST NAME, HOW DO THEY KNOW IF IT'S PAST 30DAYS.  THANKS.

I see in the instructions where you see that. But each one of those 6 items is an or. You need to show once piece of identification so use passport or birth certificate. Nothing else is needed. Millions of us can't be wrong you need not chase down and consular officer for anything.

Hypnos is correct, just follow the instruction for I-130. I only used a copy of my passport as proof of citizenship.

Do you have a naturalization certificate? No. Insert an "or" after every point in that instructions. If aren't convinced, read point 6. 'if you do not have any....."

I have read many forms before, this one said these are the proofs needed, it didn't say choose 1 or 2.  I was just concerned about them denying or postponing because of not having "a consular officers verification".  I have a thousand other documents, birth cert, marriage cert, mortgage receipts of spouse and I, children's report abroad, school records, us work history from us government, sscard, etc.  Are you a lawyer?

With your I-130 you show proof of being a US citizen either a birth certificate ( a copy will do) or all pages photocopied of your passport. One or the other no one has to validate anything.

Why does it say on the 1-130 direction of proof of status I need and "original statement from a US consular officer verifying that I am a US citizen and my passport is valid? Is this because whom ever is reading at Lockbox has a verification of myself and passport.  So if I submit without this, they won't hold up my paperwork.  Thank you so much for your help.

I have only begun my 1-130 for my spouse.  I am a born US citizen w/birth certificate and US passport.

 

My question, if anyone can help, it say I need to provide an original statement from an US consular officer verifying that I am a US citizen and my passport is Valid.  How crazy.  If I send in a copy of my passport, with all my other documentation, is this a necessary step, or will they put it on hold until I send this in with it.  I only ask, because the consulate is a long ways away and you can only see them by prebooked apt over the internet, they only have appt. on Tues and Thurs and appt. not available til Feb.  I need to send this package in soon to get the process going.  Thank you.

if you did not make enough to file taxes then you write a letter saying you didn't file because of  XX reason ( didn't make over the foreign exchange amount, unemployed etc.. whatever the reason is.) 

 


You may however need a joint sponsor if you are the petitioner.  It's harder to prove the beneficiary will be supporting the family.  The only way is if they file the I-864a to your I-864 and shows that their income will continue in the USA.

We are early in the process.  I have been told we will need a lawyer for the whole process.  I have not reported taxes since the first year I lived/worked here.  I was told by the US IRS in 1994 I did not need to report because I didn't make enough...had to make at least 12,500k.  Now I am told when it comes to the affidavit of support, I have to show my tax returns.  So does anyone have any suggestions how I tackle this.  I have made about 13,000-16,000 a year for the last couple years.  Part time worker/mom.  My husband has a good pension, so it will not be necessary for me to get a job, so he will be the one supporting us.  Thanks

i just filed my taxes 10-11-12......and sent them to NVC with AOS i sent paystubs for 2013 and my contract  because it dont have w-2s yet...i called them and they said that would be fine.

I looked into an accountant from H&R and other services. $350 a yr for them to submit x 3yrs, plus if I have any RESP's (child school savings) I have to report it to the Treasury at $350 PER form x 3yrs.  Total cost they told me, a little over 2000.  This is why I am trying to figure this out myself.  Many good people have given me the 1040/2555 for 2010, 11, 12 & 13, I just need to sit down an use my head and get some answers from you all.  just wasn't sure if I needed a letter to the IRS.  typically one would file and extension but that's too late.  thank you again.

Hopefully, you filed a G325a for each of you, not just one.  You seem to be asking a tax question.  That's not the purpose of the IR1/CR1 visa forum.  Ask a tax professional what is needed for your tax situation, as the answer will depend on your personal circumstances not wise to disclose here.

Your affidavit of support will be submitted to NVC.  National Visa Center.  Time to learn the process.

 


thank you.  I am learning slowly and very intimidated!  I have filed our I-130 & 325A, my next step was to get my back taxes up to date in the US and wasn't sure if I needed some sort of lead letter attached to my very late 1040/2555.  I understand the affidavit of support, just not there yet and I am not savvy on the short immigration abbreviations yet.  thank you, bare with me.

The three tax returns you need for the affidavit of support will be 11-13.  NVC needs to explanation for late filing.  IRS doesn't either unless you're asking them to do something more than accept and process them.

The NVC needs an explination?  (sorry who is the NVC?  and I don't need any sort of letter attached to my 1040's to the IRS explaining why I am submitting a couple years late?  thanks so much

Received our I-130 email, saying it is has been accepted and sending to Nebraska and they would send the I-797.  When updating my timeline it asks the date if it is a I30 RFE, 130 NOA1 or 2, is it considered anything.  Maybe this is nothing still yet at this point for me to update on my timeline yet...already is a small victory.

Hi.  Myself (US born citizen), living in Canada for 22yrs with two children (landed abroad w/papers) are moving back to US this July (sold our home).   My husband, who has recently retired after 32yrs of service, is in the process, we are filling out the affidavit of support and would ask your advice.  I will not longer be working as of June, (so I guess I will mark retired), and show my last three years taxes. 

 

Where it asks Sponsors Income #5 (current individual annual income, mine is $0 at that point, but it say if I am using from any other person, do I put in my husband's yearly pension amount?...I would have paperwork to verify this, or do I just leave it as $0 and where I put Person 1 (beneficiary/spouse) his current income, put the amount. 

 

What would I put for #10 (my current annual Household Income?  My husbands (who will be supporting us) yearly income, or $0 (me retired w/no pension).

 

My children, they have all their US paperwork/passports.  Do I need to put them on the affidavit under my name, or just on the affidavit of my husband? 

 

Do I need to fill out Affidavits for each child or are they under the (exempt rule..."Any intending immigrant who will, upon admission, acquire US citizenship under section 320 of the Immigration and Nationality Act, as amended by the Child Citizenship Act of 2000 (CCA)?

Hi,  I am the sponsor filling out the I-864 (for my husband).  I am returning to the US after living n Canada w/husband for 22yrs.  I worked part time.  He will be the main income provider.  I have to send a copy of my taxes (the whole thing or just couple pages)?  I don't have any W2 (US), do I send a copy of my Canadian (T4)?  I am filling out a I-864A for my husband (income provider), it asks for the last 3 yrs.  Do I send in copies of his T4's and his full tax return (15 pages).

I-864A is needed if you're husband is already in the US and would be using his (continuing) US based income. 

 

Read the instructions. 

Hm, it says if I the sponsor does not meet the poverty line, than another person needs to qualify with a I-864A.  We were going to show his guaranteed retirement amount and our assets.

anyhow, it is what it is. 

 

as for your taxes: 

 

1) I'm hoping you filed with the IRS for all these years you were in Canada. the IRS requires US citizens to file with them even if you're not residing on US soil. Canada, France, the moon, even Mars...no matter where you are, you need to file with the IRS. 

 

2) your Canadian income is not considered. So a T4 will not be accepted. fact is, the taxes you files with CRA are meaningless to them. 

 

3) You'd need to show US side financial strength: if you don't have a job in the US, you can either ask for someone to co-sponsor your hubby (that someone will need some sort of steady US based income), or you can use your Canadian assets (real estate, RRSP, savings) in lieu of income.

US citizens do not fill out the form.

If anyone can help.  It says complete this form for yourself and each member of your family who will immigrate with you.  I am a US citizen, so is this form for only my husband (whom I am sponsoring) to fill out?  My children are US citizens (we are currently living in Canada til July 10, then we move to US).  Do we need to fill out this form for each child and myself (or are they not considered immigrating).
