US Embassy and Consulate DiscussionHoliday Effect on Visa Process
I think the fact that we filed just after Christmas is working on our favor. Too many people busy with the Holidays and not many filings through January. We received our letter from the NVC and now we need to file packet 3 and schedule the Doctor and Police. Attorney we are using says the wait for interview is about 30 to 45 days. Anyone have experience on how long they are waiting for the interview date?

I'm looking for anyone out there where there Visa was not denied by an embassy but instead put on administrative review. Not with the NVC but with the embassy itself. My Fiance interviewed on August 27th and they gave her a paper that said Administrative Review. They would be in touch. Anyone else out there in the same boat?

They didn't ask for anything, only that they would be in touch with her. When she asked how long they said they did not know.

No, they gave her a paper with multiple items that could be checked. Everything we needed was there. The last box "other" was checked and the words administrative review wriitten in. They told my fiancee they would contact her.

I'm not sure how long it takes. My fiance Joy went for her interview today and they told her they would be in touch with her. Not sure what that means but I was so counting on her getting approved today. Has anyone else experienced this?

I just received my first response from the Bangkok Embassy saying that the immigrant visa unit is still processing the case. As soon as the processing is complete they will let my fiancee know. I hope this is a good sign.

From everything I read, it pays to use an attorney. Those that don't often have something wrong in their paperwork which delays the Visa.

It means that you must have been with her in the past two years. If you haven't then you must visit again. Here is the best resource for information about Visa's.

http://travel.state....types_2994.html

Let me give you a word of advice. Use a reputable Visa company. If you look ove this web site you will see all the delays in the process occurred due to errors by the applicants. I am still awaiting our approval, but we are getting closer and so far there are no delays.

Hello All,

At 3:30 PM Bangkok time, Joy recieved her K-1 Visa. Thank you all to those who listened. Now begins a new Journey of Marriage and a new life. This was the most difficult thing I have every done. I have lived through tragedy and death but the not knowing for such a long time was the hardest part. Now I have a new lease on life and I intend on making the best of it.

A question for you learned people. When last I wrote I was headed to Thailand to see my fiancee who had decided she did not want to follow through with the K-1 visa. While there I extended my trip an extra week and after a few hassles with papers the Amphur's office wanted we got married. I know how difficult it is to get a tourist visa and probably even harder now that we are married as the will probably think she will come here to stay illegally on that visa. But I do want her to come here and meet my parents, grandkids, my kids, etc.

So any suggestions on any other kind of visa I can get to get her here for 30 days or so other than a K-3 now? I'd hate to go through all that process just to get her here for about a month only and then go back to Thailand. I still plan to move there in 2-3 years when I retire again. And yes, I wish she would have agreed to finish the fiancee visa, come here for 4-5 months and then she could have gone back to Thailand. But that's not an option now that we are married.

Thanks!!

I would move forward with the K3. You never know when you might want to go back even if it's a for short time. Health benefits or a relative getting sick. Yes it will take you quite a while but I would think you would want her to travel back and forth with you should you need to return.

i need a little help, so i have finally compiled the aos papers, gotten through the medical exam hurdle etc. turns out my husband threw out the copies of the birth certificate translation and the copies of the papers from the visa so no copy there. anyone know a reasonable translator for thai docs preferably nor cal? least expensive quote i got was $150+notary and delivery fees (not local). i am trying to track down the lady in thailand who did the original but haven't heard back. *sigh* a bit annoyed w/ hubby right now

I use these folks for writing letters in Thai. Just write them at info@thaienglish.com. $.05 per word. If it's legal documents it may be a little more expensive. They are very nice people to work with.

Hi, I am new to this web site. What does NOA and NVC mean? I just got back from Thailand a week ago and am starting the K1 process. I met my TG in July 2008 (e-mail & telephone) and met her in person during my two week trip (Aug - Sep 2008). Will immigration look negatively about the short relationship? I know it says you have to only meet one time in two years. I have pictures and kept my boarding passes for proof. She had applied for a student VISA and was denied in Aug 2008. Will they hold that against her? How long is the process? Thanks for any information.

It's a long process and one that I am not sucessful at yet. My fiance is waiting to hear from the embassy early next week. You can read my story if you click on my name. If your in a rush and don't want to make serious mistakes I advise using an attorney. If you not in a big rush then it's really not hard to do yourself. Here is the website with most of the information. http://travel.state....types_2994.html If she was married she'll need her divource decree and you will need yours. Many people here can help you. I do recommend one thing regardless of what anyone tells you. Go to the interview with her. Keep in touch and good luck. Right now the longest wait is the clearance from the uscis in California. Ous took 5 months to get approved. If you live closer to the east cost it will take you less as you will use Vermont. Good Luck. Please update your timeline. It will helps eveyone to have hope.

My fiance just received a call from the embassy, they told her to return to the embassy on friday and to bring all the proof of relationship documents back with her. So hear we go again. I wil keep everyone updated as things unfold .cross your fingers for us...thanks

Goodluck Hilton. My fiance was told they would contact her in three weeks which is coming up this Tuesday. Let me know what happens.

I just want to say thanks, and to give the list a further update... My Fiance was asked to return she was interview for over 2 hours... the main focus was where she worked over 2 years ago. she said they were very nice and polite about everything they had her write a statement about what she told them was true.. when the interview concluded they gave her the standard paper wth OTHER checked and administrative processing below that, gave her passport back and told her when they call her back in to bring that paper. They did not give a time line on when they would call her. so... thats the short and skeinney of it all to this point.... still in the holding pattern.

My Fiance had two interviews. THey kept her passport on the second one and told her they would contact her in three weeks. I intend on going to the embassy to talk to the consular. Bald man. It seems that he has done this with several candidates. I think a personal visit may help. I want them to understand how much I love my fiancee and to please grant her a Visa so we can start a new life. I too will keep you posted.

Good Morning

Well I received a phone call from my congresswoman this morning. She made contact with the embassy on friday this was her secound inquiry with them. She told me not to expect much but it couldn;t hurt. I was told that the embassy informed her that our case is still in admin review however they did not require any further information from my fiance
or myself and that they could not give a time for the completion of the admin review. I hope the fact that they kept her passport and the fact they require nothing else from us means that it might be something as simple as a name check, because she has a common Thai last name, I've heard that this can produce "false hits" of which they (the embassy) is required to look into. Sooo... a little bit of info is better than nothing. I'll keep everyone informed.

Birch/Beer

Please keep us informed as to what you incounter when you arrive at BKK. because if I don't hear something in a week or so I'm planning on heading over there around the 23rd of Sept. Thanks and good luck

I have a question. Do they have your fiancee's passport all this time? Or did they return it to her.

I'm in the same boat as you. I had posted my issues a while back. Well, my case is on AP for almost 6 months now...Sep 12th will be exact. I already had my congresswoman notified the embassy twice and still got same reply. I had email the embassy 7 to 8 times as well and still the same. Hopefully, I will hear something from them soon.

K-1 Fiance(e) Visa Process & ProceduresQuestion regarding proof of on-going relationship

You need to send picture of you and your fiancé, and write on the back : who is on the picture, when, where, what was the activitie.

You can ask someone (family or friend) to write that they see both of you in the same time (same room). dont need to be certified.

One think is good to do, Keep a copy of every thing, you will maybe dont need it but it's better to have just in case.

K-1 Fiance(e) Visa Case Filing and Progress ReportsMy interview experience
Interview day was exhausting not because of the embassy just because we were super nervous...

1. my fiance come with me - YES IT WAS REALLY HELPFUL.
2. We got there around 7:15 am, and our appointment was at 8:45 am and there was already tons of people on the line (specially relatives, families, we didn't see any other american or couple which made me doubt at the beginning if it was necessarily for him to come.
3. A lady was putting the line in order and pull us out the line, put the number 9 in our appointment letter, and took as to another line, which was shorter, it was the line for american citizen.
4. we passed the regulation controls, they keep your cellphone in the door made you take out your jackets and belts (by this time there we saw lots of people getting in the embassy)
5. we follow the arrows to another open area, there were lots of people waiting, another guy who worked there saw us, asked for our letter appointment, and told us to get in this inside area, there were only 8 people inside (mostly old people who were grandparents, relatives of the people who was in the USA), my fiance was happy because it was really cold and he didn't wanna wait outside, so we were sitting in this little sofas waiting for our turn inside.
6. we were the 3rd calling to the window( i was expecting to be the #9 and i was supper anxious because i could here tons of people were called outside), actually they called my name, and my fiance and i when to he window, they just asked for my DS 156 copies and my pictures then told me to wait to pay the fee
7. Around 9am they let in lots of people and by that time a lady on the other window called my name again (my fiance stood up with me) and she asked for the rest of my documents, and my medical exam (which is open in front of you) she asked him how did we met, he said where (his accent is kind of difficult) and i could tell the lady had a difficult time understand it she asked me in Spanish if how did we met, i told her, also asked in Spanish if he speak Spanish  ( i was translating to him all the time - I MADE HIM PART OF THE CONVERSATION) he said no, just a little, he said "poquito", she smile, and also giggle about an anecdote we told her about our beginnings, she though it was cute, she said: "desde jovencitos, que lindos", when i talk about how me met i also said he came to peru several times after the first time i when to USA (when we met) and then he propose and met my family and met my mom and talk to my mom. for the consul seem to be funny or nice he had to talk to my mom, cos she start making jokes about it like saying, "claro que tienes que conocer a la mamá", i translate that to him and he said yeah. I was afraid of the i-34 but she didn't even look at it, also didnt asked for evidence, i had to tell her, here are my evidence (it because it cost me a lot to put all those pics together on a nice folder and everything, with conversations, etc) and she said oh ok, give it to me and pass it trough the window. she said we should wait a little to pay our fee ( the lady on the cashier was running late)and then we were gonna be call for a consul. This lady is Peruvian, they made the whole interview in Spanish but know some words in English and understand English. She also makes you put your fingerprints from both of your hands (wish was hard for me cos i was nervous so my fingertips where little watery)
8. after 10 min, the cashier came in we pay 240 in dollars and that was it we were told to wait again, by this time there was lots of people inside but not near us.
9. and old lady came in and made us do an oral commitment that says we were filing for a visa and that everything we said its true in Spanish, she was american.
10. after 20 minutes and after one person get into this other room area (its a whole white room, look like the tv prison shows where you have to talk trough a glass to the other person with 2 chairs)we were called, well they called my name.
11. we get into this white room, there was this lady (the same  lady , american who made our commitment)with a pink file with my ds 156 forms, and my documents, the first thing she does is to put ur finger prints on this little machine to check if its you - lol - then she asked my fiance if he speaks spanish he says no, and she asked me so we are doing this in english and i said yeah, so she is like ok then lets start. She check the file she had and asked for my dhl confirmation, i gave it to her, and she asked how did we meet, we talked here, we were more interactive, she laugh about our starting as a couple (because we weren't or start dating when we met, actually start dating after  9 months or a year)then she asked where i was gonna live, and if my fiance lives along (he said yeah since 21) she said  i speak really good english, my fiance talked there and said she was better lol - then she said, well for me you are approved, and she close my file, she said oh here are your evidence (pictures and all the stuff like conversations, mail, etc)i didn't check on it, but ok let me check it really quick (she did, meanwhile i was talking trying to connect the pics with the anecdotes we told her)she saw it really quick, and give it back to me and she said well you are still approve, we smile, then she said, oh i forgot to asked you, but i think they asked you this already, do you have kids, have you being divorce before (while she was asking this we were both nodding, and then i and he said no kids but planning on, maybe a year, but not now, she said ok good, well you are approved and told me about how i have to keep my x rays with me when i get to USA for the immigration office (she gave me a paper that says congratulations u are approved, and said you have to  sing in for a dhl place to pick up your passport)
12. after that we actually asked some questions, about marriage and the other form or next step, she was nice to answer us.
13. my fiance says the lady in the window (who asked for all my documents and medical exams) is the one who approve us, and that's why the second lady was so nice, i also think the first lady is the one you have to convince and she needs to known u have all your documents with you.

*For us was really good, and the fact he when with me, help me to be more "relax", because we were talking and jocking around just being ourselves, in my experience with  USA interview ( i had student visa before) you can get any counsul, maybe one can asked u for evidence, other only like to hear you, others just want to see you financials, etc SO YOU MUST BE PREPARE AND BRING EVERYTHING WITH YOU. Another important thing is that you talk about ur experience  make ur fiance get involve int he conversation, i've read lots of times that the interview in the window is in spanish (true) so they just talk to the beneficiary (kinda true) if you involve ur fiance the consul would let you. For me the prove of fire is the lady or guy in the window he or she asked u for all ur forms, and if she things something is weird shell re asked u again.

That's it , good look to everyone! :D
