It's been so long since we've been on the website, I'm sure I'll screw up the directions on adding the timelines, but sent my wife's N-400 today to Phoenix.

As info, I adopted my daughter a few years back so we were able to use the Naturalized Citizen method to get her approved. Not much different in time or cost, but she was Naturalized as a Citizen on 4/28/2010.

Did u do the adoption before starting the AOS process?

I will have the same issue too since i will go to US as K1 and my eldest daughter as K2. My fiance wants to adopt her so she can use his surname too.

Please guide me with the process.

1. Did u go straight to the court?
2. what documents did u bring and filled up?
3. how much is the total cost of the whole process?
4.How long is the entire process until the final judgement?

Not sure if this is of help, but I adopted our daughter as well a few years back in Illinois. One thing that made it "easier" was her biological Dad died so there was no issue getting his approval. However, my wife was/is the custodial parent and this is what my daughter wanted, which is what the Judge was concerned about. We had to run a name change in the local paper for a few weeks, file for a Name Change/Adoption hearing in Family Court, all of us went (including my son) to the hearing, Judge couldn't have been any nicer, asked her if this is what you wanted, she said "yes", and she approved - simple.

We took the signed Court document and used it to file her Citizenship as a child of a US citizen and sent in the forms and she did not have to take the test, just the swearing in ceremony. Cost was about the same as going the normal route (like my wife is going through), she was 13 at the time and not only an American citizen, but as Americanized as any of her friends.

We enrolled my step daughter in school 1.5 years ago with my last name. Her mother & I were married and wanted to keep everything the same (last name in school) and not have to change everything on the front end of the AOS process and doing it on the backend instead.

We filed and were approved for AOS, I have a Fed Tax ID # for her that I used the last 2 returns (she's 13). Tomorrow, we are going to file for a legal name change, which takes about a month and of course $$, then we will need to send in the document with what form to get her green card re-issued in her new name? Once we have those in place, can get a regular SS# and all should be good for a while. Thanks for the help.


Mike, did you have to officially adopt your stepdaughter in order to make her name change legal?


Howdy Eau & Rebelheart - it appears the process varies from State to State somewhat. We filled out the petition, paid them the $$, running an ad in the local paper for 3 weeks, then have a hearing where the Judge just stamps it and we ae good to go. However, one of the forms in the packet states "XXXX, a minor, has resided in the family of the Petioners, and has been recognized and known as an adopted child in the family of Petioners".

So it appears the by product, in IL, of having a minor renamed is considered adoption. I wonder if now she can go to the head of the line for her citizenship? While we did get a Green Card for her, we didn't do SS yet, because of the name change, so in the interim just using a Fed Tax ID #. Soon as the name change is done, then we get to do new green card (and if I time it before her 14th bday, wave the biometircs fee), then SS card then maybe citizenship?

In our case, my wife & daughter had biometircs done (different days) and we waited quite a while for the interview dates. We rcvd notice of my wife's interview, but never got one for our daughter. When we went to the interview, they asked where our daughter was and we told them she was in school and we didn't get the notice. After our interview, they went ahead and approved our daughter as well, bith subject to a supplemental medical exam from a Civil Surgeon. She never had to go to an interview.

When we had an address change, we did it via mail for both my wife and our daughter (seperate letters). We are also told we had to call them and verify the info, which I did and the case worker asked to to talk to my wife (who was sleeping at the time). I woke her up, lady verified the info with my wife, and that was it - all documents going forward went to the new address.

Hi Guys,

I had the following questions for the I-751 form?

1) For payment, what works - regular check or cashier's check?

2) For the evidence statements from friends that are US citizens, do they need to provide SSN numbers on the statements?

3) Do we need to send passport sized photographs with the I-751 form?

1. Regular check is OK and you can track cashing,
2. SS #'s are not needed, but we added phone numbers.
3. Yup on the photos.

We received our approval 6 months after filing (2/20). Had 1 RFE because they couldn't match up our daughters N-600 with the AOS and thought we owed for another biometrics fee. Once we sent in copies of the N-600 forms & check, approval came in two weeks. Now we are just waiting for the N-600 to be approved for our daughter. Appears that a legal adoption and name change done allows you to skip the Lifting of Conditions, and go straight to citizenship for a child. Time will tell.

Our daughter had a little English in school while in the Ukraine, but was very timid and in awe when she arrived here. We didn't enroll her in summer school soon as she got here, so she could adapt. In our school district (suburb of Chicago) they had special classes for kids who didn't have English as a primary language source. They try to push them along, with the help of other students, to get up to speed and not so dependent on their native tongue. She has done well, and by the end of the year, was in regular English classes (though still take modified tests). We did send her to summer school this year, but for math (it's not the math, it's the comprehension of the math). All in all, she has done well and is now helping a little with new kids who speak Russian or Ukranian in her school of 800 kids.

As info, altough we had CD's to learn and books, plus the library - the easiest way my daughter & wife learned our langauge (well, still learning) was via closed captioning on the TV's. That takes out a lot of the accents & gets them to comprehend more.

Just make sure that on all your docs that you name the child (ie I-129F cover letter) so that USCIS knows you know and are filing for a k-1 & k-2. Our daughter was at the interview (11 at the time) aand they did ask her ??'s, but only because she was there. Good luck.

Varies, my wife's friend who went thru Denver got hers in 4 months, and ours going thru Chicago took much longer (see signature). In both cases, there were no RFE's or snags delaying the AOS interview, just the sheer volume and backlog created the delays.

You will need to add 3 years of tax records to show your INCOME. You have to be above the poverty guidelines as stated in the USCIS tables. If you are not above those levels, then yes they will take other forms into consideration, but you may need to get a co-sponsor if you do not have the right assets.

We made copies, we poked holes, we sent in and was approved. However, if you are told that this particular document HAS to be sent in, then it's going to have some ACCO vents in it for them. My documents were originals from a foreign country (Germany), but copies sufficed, no RFE's, no problems.

I beleive it's standard practice to do both, the arm test and the x-ray for the beneficiary, along with a blood test for STD's etc., but not the dependent if they are a minor under 14. Even when we had the supplemental exam done, we had to re-do it all again, inclusive of the blood test, and bring my wife's vaccinations up to snuff. The daughters vaccinations were done prior to the AOS exam, in accordnace with the requirements for school.

The x-ray shows they do not have any infections visible, despite what the arm test showed. We brought my wife's x-ray with us when they moved and used it for the supplemental medical for AOS, since once again she had a false positive. My daughter had to have a chest x-ray done, since she did not require one prior to the interview in Ukraine being as she was 11.

Also take into consideration that many Europeans have a false positive when they get the TB test on their arm. My mother, wife & daughter all had false positives, but the chest x-ray cleared them.

The X-ray & exam done for the interview is to usually determine if the person as any STD's, AIDS or TB. If they have an infection that is being treated with an antibiotic, it should be no different than treating a flu or similar disease. Good luck.

No time requirement - all this happens fast. Once you land and have passports/visas stamped, you need to get to the SS office and probably after that it's a good iea to get a State ID card as well. Then you still have to get married in the allotted time and once again change the SS card and State ID.

Do your Social Security before the marriage, it will be in her maiden name and match the documents for the Visa. Once married, take your marriage certificate (not the license - anyone can get those) and have the card updated with her marital name, so it matches for the next steps. Good luck.

Might consider giving her a debit card so she can use it for her exam, train tickets, photos for documents etc. We did and took copies of the bank statements to the interview. They didn't really spend much time on this portion of the evidence, perhaps one item filled their need. We also left the card with her parents so we can continue to help them from time to time and the bank only charges us $1.20 per transaction.

Many of us have just the one plane flight to the country of our fiance', since in many cases, they cannot travel to the USA. You guys should be just fine, so don't panic. I did go back twice after we filed our initial petition, but my (now) wife just took those photos, tickets, etc. with her to the interview as additional proof of our relationship. I was also there for the interview, and they also asked me some questions, but all went well and I am sure you guys will do just fine. Good luck.
