IR-1 / CR-1 Spouse Visa Process & ProceduresTranslated Documents for NVC
QUOTE (jurod16 @ Mar 19 2009, 12:08 PM) <{POST_SNAPBACK}>
Just curious if I already have translated documents, they are stamped "Certified Correct Translation" and signed by the person who translated the documents, will this be good enough to get through to NVC? If not, what else is it I need to do to make sure they are good to go? It's the same translated documents I used at VSC. Just curious, thanks in advance!

you need to notarized them too..

IR-1 / CR-1 Spouse Visa Process & ProceduresTax transcripts AND W2s/1040s?
QUOTE (champi @ Mar 24 2009, 05:32 AM) <{POST_SNAPBACK}>
Hello VJ friends,
I just got off the phone with NVC. The operator told me that Tax Transcript itself is not sufficient and that I've to send W-2s and 1040s. Is this true? I thought sending tax transcript was sufficient. Even the I-864 form says either/or "You must provide either an IRS transcript or a photocopy from your own records of your Federal individual income taxreturn for the most recent tax year."

I've both and I can send both. I just don't want to get RFE for sending too much information. Has anyone just sent the transcript and got the case completed?

When calling the NVC for advice - I recommend calling two, three, four times - every operator will tell you something different...

Generally, we called four times for each issue and followed the advice of the majority.

By the way - we sent in transcripts without W2s, etc and did not get an RFE.

Hi all,

For I-130 application, do I ever need to get the birth certificate for the beneficiary? Also, do I need to travel to my wife's (beneficiary) home country (China) to gather police certificates for all the city she has lived in or is there an easier way?

Thank you.

Please note that for the I-130 application, police clearance certificates are not part of the required documentation...

IR-1 / CR-1 Spouse Visa Process & ProceduresI am confused about the locality of Police Certificates to get
QUOTE (maisflocon @ Mar 26 2009, 11:41 AM) <{POST_SNAPBACK}>
Hi all,

My wife's I-130 just got approved, and I am working on getting her police certificates now.

According to what I researched,

"If the applicant lived in a different part of their country of nationality for more than 6 months after and was 16 years or older, THEN the applicant needs a
police certificate from the police authorities of that locality."

Does that mean if my wife has lived in Shanghai, Guangzhou and Beijing, she would need a police certificate from each location? Does she need to travel to those locations again? I have heard conflicting suggestion from other people that she only needs to get it from her "hukou" (registered residence), which will pull in info from all of China.

Has anyone have to deal with getting multiple police certificates before?

Hi Catie,
Thank you very much for response smile.gif I emailed Chennai consulate last night and their response was same as yours. We do not need police clearance from the District Police Office from all 3 places, just the present one. I am so glad. I've emailed back asking if police clearance from passport office from Bangalore is valid or not or does he have to go to Surat. Here is what Bangalore passport office site mentioned:

http://rpobangalore.gov.in/frm_pcc.asp
How do I apply for a Police clearance Certificate (PCC) ?

* Apply using Form-2 (Miscellaneous Services).
* Apply using Form-2 (Miscellaneous Services).
* If the passport was issued from any other passport office, then produce proof of residence in Karnataka & furnish a set of Personal Particulars forms.

This gave us impression that Bangalore passport office clearance would be ok. Let's see what answer we get back. I am 50% relieved now smile.gif

Your husband actually needs to get a PCC from every place he has lived since the age of 16. How recently was his passport issued? If its less than 6 months old, you should be fine with only a Banglore Local PCC and a Passport PCC.

1. He lived in his hometown till 12th.
2. Then he moved to Gandhinagar for college.
3. Then he moved to Bangalore for job

His passport was made in Surat.

So he needs police PCC from 3 places + passport PCC from Surat or Bangalore?

I lived in many places as you husband live including bangalore.

I gave only one Local Police Clearence from Sonepat haryana, may permanent address.
And PCC from the passport office.

this what NVC website says: http://travel.state....ocity_3582.html

Indian Police Clearance Certificates should be obtained as follows:

* All Indian IV applicants aged 16 and above, residing in India, should obtain police certificates from the local Passport Office. These are usually more dependable than those obtained at a local level and indicate that the subject had no serious criminal convictions on record at the time of passport issuance. Applicants whose Indian passport was issued within the past six months may present just the Passport Office Police Certificate, and need not obtain additional police clearances.
* Applicants over age 16, whose passports were issued more than six months previous to visa application, must also obtain a police clearance from the District Police Office serving the applicant's place of residence.
* Indian passport holders applying for visas outside India should obtain a statement from their local embassy or consulate confirming they have no criminal record.
* Non-Indian IV applicants residing in India should obtain police certificates from the District Police Station serving their area of residence.
* Indian police certificates are not available for foreign (non-Indian) applicants applying outside India.

IR-1 / CR-1 Spouse Visa Process & ProceduresDo not have Birth Certificate - What should I do???
A thread from NVC website for India http://travel.state....ocity_3582.html

Birth Certificates

Available. Prior to l970, the reporting of births was voluntary. Birth certificates of Europeans, Anglo-Indians, Armenian Christians, Jews and Parsis born prior to l970 may be obtained from the State Registrar General of Births, Deaths, and Marriages. No standard or uniform certificate is issued by the authorities. In addition, acceptable certificates may often be obtained from the municipal and rural registration records, which are maintained under the state laws. Europeans, Anglo-Indians, and Indian Christians are usually able to obtain church baptismal certificates.

Under the Registration of Births and Deaths Act of l969, births are required to be registered in almost all of the States and Union Territories of India. Birth certificates are available to any applicant born on or after April l, l970, upon payment of a nominal fee to the appropriate authority.

In cases where birth certificates from the authorities are unavailable or contain insufficient information regarding the birth or the parents, a sworn affidavit executed by either the parents, if living, or other close relatives older than the applicant, may be submitted. It should set forth the relationship between the deponent and the applicant, how well the deponent knows the applicant, date and place of the applicant's birth, the names of both parents, and any other related facts. Such an affidavit, when a birth certificate is unavailable, should be accompanied by a document from a competent governmental authority confirming that the certificate does not exist, or no longer exists.

Hi All

Well I am from India. In India, most of us need to submit our Original Birth Certificate while getting an Admission into a School. On passing School, i.e passing Std X / Xth Grade, the Mark Sheet given by the School, clearly mentions the Birth Date. In India, this Passing Certificate is considered valid enough for Birth Date Proof.

However, for the NVC Process, we need to submit the Birth certificate. Since I dont have one, is it ok if i get an Affidavit for the same? Does anybody ahve a format of Affidavit for Birth Certificate? Should i also send a copy of my X Grade Passing Certificate?

Please Help.....

NVC need Birth certificate from municipality or u need to give a no record certificate if they don't have your records (only for indians).

do some research before ask a question. http://www.visajourn...h...=173187&hl=

QUOTE (ao_cons @ Mar 30 2009, 10:45 AM) <{POST_SNAPBACK}>
OK, now we're getting to the final leg, I have some questions.

First, I've heard that there is a separate fee for the actual visa, besides the ones we paid at the NVC stage. If this is true for CR-1, how much does it cost and how is it to be paid? We're in Thailand. I tried calling the USEM but they only referred us to one section after another, and I ended up with an AVR saying they won't entertain phone call inquiries. Only email with our case number in it. Our case hasn't been forwarded to the USEM yet so there's n use sending an inquiry that way. I would like to know from people here in (preferrably) Bagkok how they have paid for their visa if there is indeed another fee. And is it paid before or after the interview?

Next, the medical and shots. What if I have no record of my shots? Is it mandatory that we take them all again? How long is it going to take? Will I have to stay here for much longer? I hope not!

Please clarify. And good luck to all of us. smile.gif

There is not other fee require by embassy if you have paid in NVC for CR1, for I129f it does because NVC doesn't charge anything to assign the case No.

with CR1 the next fee is Removing condition in USA $700 before 2nd anniversary.

I got all the vaccine again because i didn't have any records. (only 3 vaccines) Medical nearly 5000 Rs. Indian currency

Well... I don't agree with that....USCIS approves ur petition and sends it to NVC. It is then NVC who checks for ur dates. If it is not current, they keep ur file with them until ur priority date gets current. And this mostly happens with the ppl of green card applying for their spouse, USC applying for their brothers and sisters and few more categories.

Sonia

Is there anyone who spend six months to 2 years in NVC (Not in USCIS)?

My friend applied for his brother 10 years before and than last year USCIS approved their case after 10 years and than they got the case in NVC. And they did NVC almost in 2months.

NVC only look for priority dates for Interview, a open slot schedule given by local embassy. Now when nvc match the priority date with embassy's schedule than you get an Interview

From my understanding, if u r applying for ur spouse and u r permanent resident not a US Citizen, u r given a priority date when ur visa is available to issue. It may be 6 months later or may be 2 years. U have to wait until ur priority date gets current.

So the thing is, if u r a US citizen, and applying for ur spouse, u don't have to bother about that clause at all, cuz ur priority date is ur date of NOA1 received, which is current and ur visa is available right after NVC recieves the approval..

Sonia

This part is done with USCIS not with NVC, USCIS don't send your papers to NVC until your status is Current. When you get NOA2 from USCIS your are current.

For persons between 17 and 65 they are:

• Tetanus and diphtheria toxoids
• Varicella
• Mumps, Measles, Rotovirus (MMR)

I thought the "R" in MMR was for rubella? Are rubella and rotovirus the same thing??

IR-1 / CR-1 Spouse Visa Process & ProceduresCase Complete 12 Mar at the NVC
QUOTE (OKC_German @ Mar 24 2009, 05:22 AM) <{POST_SNAPBACK}>
How long does it take the NVC to ship our case to the Embassy? It was completed on 12 March, but the automated phone still has the message, "your case was complete on blah, blah, blah..." How long does it take for them to say its been mailed to embassy and get an appointment? I've read they use DHL which normally takes 3-5 days, it should be there by now. Just wondering if anyone else has any light to shed on this. Thanks.

Well, your interview won't be scheduled until the second week of April (NVC assigns interview dates the second week of every month.) But I don't know about when the NVC will forward your docs to the embassy. I would assume they kept the docs until the appointment was scheduled...but maybe they don't. Does anyone know?
