United KingdomLooking for advice re:co sponsor

One last thing I need to ask. When I saw the experiences of people's interview they say bring an original and copy of police certificate and birth certificate. Will a Photocopy along with the original of both suffice or will I have to purchase a second copy from acro. Likewise will a photocopy of my fiancées first marriage and divorce decree be fine or do I need the originals of them?

1 Original (certified copy) + 1 Photo copy of birth certificate and police certificate.

I imagine just a photo copy of the divorce decree is needed.

United KingdomLooking for advice re:co sponsor

Hi guys!

Thanks for the reassurance- had a great holiday and nothing different from usual happened at the border *woohoo*!!!

I've posted my forms today along with my Ds-2000 and cover letter, medical is booked for Friday the 13th of January. After my medical how long is it roughly until they give an embassy date?

Anyway currently gathering evidence for the interview. I have tons of photos of us over the year at home, Europe and with our families together, engagement photos, flight tickets- 3 of me going to the states, 2 of her coming to Scotland, passport stamps, birthday card, an engagement card from a family member. Literally thousands of emails from daily conversations (how many of these will I need?), skype logs from almost everyday (Again how many?), a photocopy of her marriage and divorce certificate, my original birth certificate, US passport photos. I will have the payment receipt when the time comes.

Is this enough evidence or should I strengthen more.

I also have a few questions about the financials part which I worry about most.

My fiancee's step father i.e my co sponsor has given me a letter from Washington states department of labor and industries. This letter states that he is on total permanent disability that commenced in 2007 and receives x amount per month which equates to around over $40,000. (No dependants). He has also filled out the affidavit of support which which includes the real estate he owns. Should this be enough? I'm reluctant to ask him for bank statements as it is a rather personal request but i'll bite the bullet if I have to.

Secondly does my fiancee have to fill an I-864 as well? She has just incase. She makes just under the limit needed for supporting me alone just now. She is currently self employed and has given me a copy of her publishing contract and 6 payslips from a teaching course she does when she has time. Would we need her tax returns? The problem is that her returns for previous years were filed jointly with her ex husband which contain most of his income and so are pretty useless.

Any help would be greatly appreciated.

Just remember to get a copy of your "long" birth certificate which has your parents names on it.

As for co-sponsorship, I believe that your fiancee will need to fill out an I-864 as well since she is the petitioner. She would fill out how much she made for the past few years despite whether it was filed jointly, the way I understand it is: even if they filed jointly it's still partly her tax return. You will need her tax returns.

So the step-father gets over $40,000 a year in disability? That appears to meet the monetary requirements, so you shouldn't need the bank statements.

have any of you had any luck with TJ/TK Maxx or Marshalls? Everyone I know gets some really nice bits in there, but whenever I go in, I never find anything. I call it the Primark effect. The same thing happens to me in there! Everyone has really nice Primark stuff, but whenever I go in there, its like a bombs gone off in a jumble sale and the only things I see are #######!

I freakin' love TJ Maxx and Marshalls! I just got this awesome pair of Guess jeans for $25.00!

United KingdomWho else is having 2 weddings?

Having been around awhile, I've seen a lot of bright-eyed UK fiancées telling their plans for the big wedding "later". Then later they decide the money is better spent on down payment for a house, a second car, etc or they are ready to move back to the UK because they hate it here.

Immigration just sucks the life out of some dreams..................... :dead: ?

Absolutely! I feel so far behind the eight ball due to all this immigration sh*te it's unbelievable sometimes... but it is worth it and I do mean that.

Now to gear up for the in-law visits, they've never been to the US before... it will be, um, interesting....

From what I've seen on here most people either just have a small wedding or have the small wedding first off and then plan for the big party wedding. Good luck!

The key is to be prepared and you're obviously not a leave-it-to-chance kind of guy. I am sure you will be well prepared and therefor have no problems!

I totally see where you're coming from, if it were me I would also feel more comfortable doing it all from with in the UK. I'm not basing that on anything concrete, just a personal preference-- peace of mind I guess.

Here's the consulate reviews for London: http://www.visajourn...&cty=&dfilter=5

You might be interested in giving them a read, just to get a better handle on what goes on. I know I used to enjoy reading through them before my husband had his interview.

United KingdomBritish perspective on my situation

I've been a member for a little while and I keep posting the odd question here and there. I just thought it would be a good time for me to get some feedback from some fellow Brits that are going through or having been through London recently and can maybe offer some feedback, constructive or otherwise? The information I have already gleaned from the forum has been invaluable. I'm now, rather selfishly, looking for some specific guidance to my issues and concerns.
I'm British and my other half is the USC. I've been pondering the visa process for a little while now and am still no clearer on how to proceed. My fiancée and I still aren't sure whether to get married and apply for the CR-1 or to apply for the K-1 and then marry in the US.

The facts of our situation, and some questions regarding some of the points, are as follows:

  • She's 25 and I'm 32. I have been married before and only just recently completed my divorce (Until I met my fiancée I just hadn't needed to divorce as my ex-wife and I decided that we wanted to follow the 'no blame, divorce after 2 years of separation' route) Is this likely to be of concern to USCIS or the Embassy? There was nothing untoward about the delay in divorcing and my partner has known of the situation right from the start. Is the age gap likely to be an issue?
  • She hasn't worked in a couple of years as she has a daughter, she'll be turning 4 shortly. Her step-father makes 100k a year and wants to be co-sponsor. He's fully aware of the responsibilities he's signing for. Is the fact that my fiancée isn't earning anything at all likely to count against us, even though her step-father is willing to co-sponsor?
  • Is the fact that I spent time working in Libya, pre-revolution, likely to hold things up at all? It's probably a non-issue but I like to have an idea if they pay particular attention to things like that?
If anyone can provide information, either through experience or anecdotally, I would be very grateful. I'd like to think that I have a straightforward case, but I never like to take anything for granted. I would also be grateful if people could weigh in on the practicalities of choosing CR-1 over K-1 or vice-versa? I you need me to fill in any gaps or you need some specifics, just ask away.

Thanks for wading through my little entry and I look forward to hearing what you guys have to say...

Mark

I know for a fact that exact age gape will be absolutely NO issue.

USCIS shouldn't be concerned about the length of time it took you to divorce your ex as long as you have the proper divorce decree/certificate.

I think most people on here will suggest to you the CR-1 visa-- it saves money. The only downside is that after you are married you will have to spend a period of time apart (not living together), you can visit each other during this period of time though.

National Visa Center (Dept of State)so confused with I864

So yes my parents do claim me as a dependent, but I do file my own taxes as well. So with my husband included does this mean that my household is six, or is he not included yet?

Yes, your husband will be included in household size.

I was told in a consultation that the documents I send with the I 130 can be copies, and I just read they have to be originals. Does anyone know about this part?

We sent copies with the I-130 petition.

No, that's the thing. I can't go for 90 days on Esta as I'm basically living there not on vacation. So how soon could I be with my wife when we file I-130?
Really appreciate you help in this mess.

As Penguin said, around 8-10 months you can be with her again. Unless she comes to visit you for a bit in the UK.

No bar, Just that I couldnt stay in US on Esta and needed correct visa. So i need C/R-1 and I-130?

Ohhh, so you could wait a month or so and then just try to travel to the US again for 90 days?

The I-130 is the petition your wife will file for you in order to ultimately obtain a CR-1 visa.

I'm afraid there's nothing else you can do besides file the I-130 and wait. Did they give you some kind of bar on entering the US again?

US Embassy and Consulate DiscussionHELP!! Affidavit of Support I-864
Hi there,

I have a couple questions about the Affidavit of Support--

First off, I never realized while living and working in the UK for the past 3.5 years I was supposed to be filing tax returns, so I just completed those forms and sent them out this week. That said, I do not make enough to sponsor my husband anyway and my income is foreign earned at this point and will there for end when I move back to the US.

I plan on using my father and step-mother as Joint Sponsor and Household Member for our application as we will be living with them once we move and between them they make well in excess of 125% of the poverty guide line.

My questions are these:

1) Do I need to wait for the IRS to process my tax returns and obtain a transcript because they were late, even if there's no way I will meet the monetary requirements to sponsor my husband? Or would it suffice to just bring copies of the returns I filed along with copies of my P-60 (W-2)?

2) I realize that as the petitioner I am obligated to submit an I-864 even if I am unable to meet the requirements such as domicile, I don't meet the requirements but my dad (who has agreed to be the joint sponsor) does. My mail still goes to my parents address (ie. voter/bank stuff), my drivers licence has this address, as well as my passport. Will this be enough evidence that I plan on regaining domicile in the US? Or do I not need to prove much since the joint sponsor is domiciled in the US?

I apologize if this post doesn't seem very concise, I do hope someone can make sense of it though!

Many thanks in advance.

This isn't just a long distance thing-- relationships everywhere get effed up all the time for this or that reason, when someone moves in, when someone gets a new job, ect. The important thing is you've refocused and you know what you both want after all. Good luck on the interview! Obviously she wasn't in the country to try and evade immigration laws since she left.

US Embassy and Consulate DiscussionWho do I complain to get a policy change?
I used to work with a really lovely man from Mauritius. I don't have much to add in the way of advice, however, I know that there are ways to lodge formal complaints. Hopefully someone will be able to point you in the right direction. I completely understand your anxiety of having to travel a long distance to an unfamiliar country (I would feel the same). I really do wish you the best of luck!
