IR-1 / CR-1 Spouse Visa Process & ProceduresHelp I am in dilemma!!
Sorry I just wanted to say I know a lot of "Professions" don't transfer well. A Dr in the Philippines will not be able to just be a Dr here. Many jobs like that aren't. Just a thing to consider but I think Jonah has a very good point and it's what I tell my wife. No matter how bad of a mistake in this, it's better then being apart!

QUOTE (Jonah VD @ Dec 17 2008, 02:26 PM) <{POST_SNAPBACK}>
I feel for you. I am also worried about my husband. I currently have a job and i am petitioning my husband but i am scared that he will not be able to find a job right away with this economy. He has a very nice job back in the Philippines, a job that he really loves. He had earned a lot of experiences in his field and yet he is willing to sacrifice it for me and our son. I know that he will be so depress if he wont be able to find a job here and I know that it is something that he can not handle because he's responsible and a real provider.

But eventhough i have this fears, i also believe that we should be together. We will find a way to cope-up with this economy.

I told him that he can look for a job in any state, and i am willing to sacrifice my current job for him. Since i've been here in the US before him, i'll adjust.

Have faith ms. island1902, men just wanted to be men. They wanted to be the provider and they wanted to be trusted. He may be intimidated with your status and the laid-off is depressing for him too. Just go for the best option.

Me and my husband always argue about those stuff too (economy, job, etc. ) but come on like they always say to married couples "for better or for worst". He's only reason maybe is he wanted to be with you.

In a lighter note...you had good education, job experience and some job offers, so why fear of not finding a job? smile.gif You will be fine, i mean we will be fine. There's a solutions to every problem. I dont have it though but just so you know we can get through this. Let's stay positive.

IR-1 / CR-1 Spouse Visa Process & ProceduresHelp I am in dilemma!!
My wife and I were considering me moving to Peru as well because of the economy. I think both should consider the option of moving. If you move here will one income be enough? if he moves there will one income be enough. The other thing to consider is the economy is not doing well right now but if you follow the trend it will go back... eventually. How long it takes is up in the air. Gas prices have come down from $4 to $1.40/ gallon if that's a precursor to what has driven the economy up then maybe it's just enough to help it out.

My wife and I decided that my job with the airlines was stable enough (yes I know) for her to come up here. Our expendable money will go a lot further in other countries where we plan to make investments buying property.

Actually I am changing from K3 to CR1. I sent the I130 Wed the 12/5/2008 and they deposited the check after a week but still no NOA1 (week 2 today). I really appreciate what you said. I had heard it before but didn't research until you posted that information. I'm still working on changing my time line info to read CR1. Thanks for your help!

Ok so the interview is actually in Peru. And it is then it gets approved or not.

It most certainly did. I was reading all the timelines for the CR1. I know by the interview process she will be in the US but at what point do they let them come over? Is it after the NOA2 from the I 130 or, I'm assuming, after they approve the CR1 at the NVC. Also I'm guessing that you have so much time from then to do the interview so do you have to time it just right so she is legally here or do they give you a fair amount of time? Thanks.

My wife and I decided to keep her name the way it was and so we filed it with all 4 names. Milagros Melody Alarcon Casafranca. On the NOA1 it says Benificiary: Alarcon Casafranca, Milagros. Is this how it's going to show or should I have them change it to have Melody in the Beneficiary?

Hey Mark... I feel for you man. I spent my holidays in a hotel across the street from the airport and worked ALL day. I'll be rooting for you. Which way are you going though to get to Lima? LAX make sure you get your Frequent Miles in as I know with One world 2 trips makes you elite! My wife is in Calloa not to far from the airport down there. I get to head back down on the 12th of Jan. When are you going to go? Salud!

IR-1 / CR-1 Spouse Visa Process & ProceduresI got my Christmas Present Early
Since the 18th of Dec. We have been snowed in here in Spokane WA. The Post Office was closed for a couple days and our road was so Treacherous they went around us. One of the great guys on our block with a tractor plowed our road But alas... we had a 3-4ft snow berm about 5ft deep all the way to the mailboxes. There was no way for me to get the snow out of they way so I just made stares http://i121.photobuc...82/S4021098.jpg. I found our NOA1 on 12/22/2008.
I know we aren't close but this is the ONLY thing I wanted for Christmas. I wont be able to be with my wife for the holidays so have been working at the airport trying to help others be with there loved ones. I hope no-one here has been effected by the weather. Remember "Breath in..., Breath out..., Move on!" For whatever holiday you and yours celebrate I wish you all the best and have a very wonderful New years!

IR-1 / CR-1 Spouse Visa Process & Proceduresopening bank account
Yeah 99% of banks wont but there are ways around it. You can get a paper from your SS office saying she was denied a SS number. Then visit the IRS office to get a Tax number. You must have proof of her not being able to get an SS # then once you have got the Tax ID # she can open an account. I've found there is an easier way. Next time you visit her and you get something... hotel, or buy something they usually give you a receipt. Have them put both of you names on it. Save travel information as well. I made a copy of all pages of my passport to show I've been going down once every couple months! Hope this helps biggrin.gif

A year ago they may have held back the I-130 but things have changed. They treat them as 2 separate visas which basically they are.

Ok because since I've sent it I haven't called or anything. I was getting kinda scared that by me not telling them I had changed coarse they might be waiting for the next set of papers to do anything. I figure the less time on the phone the more time on my papers. They even got rid of my wife's middle name (According to the NOA1 not showing it). We figured it doesn't matter what they call us if it doesn't delay the NOA2.

We were going to go about the same route K3. We decided that with most of the people not getting the K3 approved until around the same time as the CR1 we would just file for the CR1. Best of luck with that. I wouldn't sink too much money into the K3 if the CR1 is already almost done.

What visa are you filing for? K1,K3, or CR1?

NOA2 is Notification of Action or when they have made a decision on your I130. Your past that and into the councel it sounds like (If it's already been approved by the NVC). According to this http://www.visajourn...r1cr1historical they are processing from Jan 30th. It might be time to give them a call and make sure they got it.

Are the immigration time lines reading accurately according to the recent transfers from the VSC to the CSC? It seems like the CSC would be slowed down from all the transfers but the time line still shows drastically declining times for the I130.

IR-1 / CR-1 Spouse Visa Process & ProceduresIs it fair for the Jun - Dec CSC filers to be by-passed?
I said the exact same thing a few weeks ago. It's great to see people getting approved from the VSC that have been waiting so long but how can you call it first come first serve when VSC are waiting 30 days?

I can also understand the frustrations with not getting any touches. 2 months and nothing. Give me something to know it's getting processed. 2 months and nothing is just killing me. I was told that because I work at the airport and have already cleared an FBI background check that I will probably have quick and easy file check.

PLEASE CSC PLEASE give me some hope.

Another thing. I think it's messing with the Time lines.

Huh? How is it that VSC files were transferred to CSC??? Can somebody fill me in please....

I believe that because of the delays many VSC filers were transferred to the CSC. The VSC is kinda messed up because they are just sporadically approving I130s rather then first come first serve and the people at the CSC are getting put on hold while they are processing the VSC to catch them up.

IR-1 / CR-1 Spouse Visa Process & ProceduresDoes the I-129F slow down the I-130 ?
QUOTE (SteveColo @ Feb 11 2009, 04:18 PM) <{POST_SNAPBACK}>
Hi gang,

Just wondering if anybody knows anything about this. When you look at the Immigration Timelines (like today), the K3's being processed at the CSC are at 11/08 ... whereas the CR1/K3 at the CSC are at 10/13.

Does this mean the the K3 slows down the processing of the CR1?

Also, we have decided to pursue only the CR1 and not the K3 ... any special we need to do? I'm guessing after the I-130 NOA2 is received and you start sending back the required info, they pretty much can tell you are going for the CR1 ... but I could be wrong.

They are treated like two separate things so the I-129F does NOT effect the speed of the CR1. None of the times are set in stone... they are a VERY rough outline of when people are seeing responses.

You pretty much have it right. You hurry up and wait for the NOA2 after you file the I-130. It looks like the K3 as of right now are getting approved only about a month before the CR1's

But bear with those of us who go to the mountain for the first time. My wife who has had her I-130 approved, works in Ukraine, and because she is not here yet, I am sending along with the 1040 and the W-7 that goes to Texas, a letter of choice that states she wants to be treated as a resident for tax purposes. All of this so we can file jointly. Do I include any of her income and how would I do it?

I am sure that if her income is not taxable, the IRS will want to practice stupidity as they do, and at least report her income on one document, and show it to be excluded on another, but if it is to be taxable, how do I report it with a 1040 filing jointly?

I want to be correct as the State Dept will have a record of her employment for the last ten years and hopefully a copy of this completed tax return.

Thanks all

According to Publication 56 page 26 you HAVE to list her income if you are filing jointly. The other way is to file as married filing seperate with the W7. You can claim her as an exemption IF she has never had any taxable income in the US, has no accounts in the US, and has not been to the US in the year of 2008. This last one is the easier way
