Remember the G-1145 form  is on top of EVERYTHING including the money order $420 for I-130 not $ 340 !!! Also make sure to include  TWO passport photos for each  , I heard that  though they request one photo each , they scan them and get stuck to the scanner and get ruined , so its better to send TWO !!! you may also include a cover letter ! At the interview you can just show them your J1 visa. If you are required to fulfill the two-year Foreign Residency Requirement the box next to the phrase ?subject to the two-year rule? will be checked off. However, if this box is not checked off it does not mean that you are not subject to the rule So the best to do is to  request an advisory opinion from the Waiver Review Division. / advisory opinion is a statement issued by the Waiver Review Division declaring whether or not a J-1 holder needs to fulfill the two year foreign residency requirement. I just got a text/email a minute or two ago.  They request for additional evidence.  I don't know what yet...have to wait for the letter in the mail.  I am happy that there is progress in my case but SAD that I got a REF. I heard from another tread that if I send the additional information in, usually they will likely approved, right?  Anybody has a REF and got NOA2 afterward?  How long did it take after u send in additional evidence and received your NOA2? 

I feel like I want to cry.

CSC is not that fast for some cases.  I filed 1-129F on 7/31 for my partner/fiance, got NOA1 on 8/7/13, still waiting on NOA2.  I sent my I-129F to Texas lockbox, but got my NOA1 from CSC.  I am getting nervous, now.  I was thinking, if I might get a REF or something. If it has been this long, if I did have a REF, I would get a letter by now. I looked at other August filers and some filed after I did and they got NOA2 already. Could it be because of the country my partner's from?  I saw a few cases from Vietnam and Philippines that got NOA2 already.

Ok, update.  I sent her the forms by email. She printed them out, signed, and dated and sent the forms to me via express mail from Laos.  Waiting for the form in the mail.

 

Question, she asked me if she should start getting her passport ready or what else she can do on her side.  Any suggestions or recommendations.

yes you need to have her sign the G-325A but you can fill it out for her then send it.  You can even fill it out and email it to her she can print and sign it and send it back to you by snail mail. 

 

when my husband went through customs all he did was give them the packet at the immigration line then said yes when they asked if he was on a k1 fiance visa.  when he was going through customs they ask him a question and he said "sorry i don't speak english" then they looked through his stuff and let him pass.  he went through san francisco.  as long as she doesn't bring anything illegal she should be fine.  at the most she should know your name and address.

Yes, she will need to sign and date a letter of intent and a G-325A. She also needs to send you a 2x2 inch(5x5 cm) passport photo. You can fill them out and have her sign and date them. Just let her know what she is signing.

 

You can go through the customs line with her, but not into secondary where they take her sealed envelope. Major airports should provide a translator if it is needed when she arrives.

 

Thank you Jay-Kay.  I'll fill out the paperworks for her, to have her sign.  Too bad they can't accept scan copy of the forms via email from her to me, that will speed things up.  Now I have to mail it to her and she has to mail it back, 2-3 weeks there (that if it didn't get lost in the mailing system).  I better get starting.

 

 

Anybody else here from Laos, who is K-1 for their fiance.  Tell me how yours went.

Hi All,

I am new here but I have been reading alot of other threads but I don't recall finding answers to these questions below . I am preparing the K-1 package, I am using the VJ checklist as a guide.  I just want to make sure I am doing this correct and right before I send it off.  I am a US citizen, filing for my same-sex partner in Laos to come to the US. Please help.

 

Question 1:

From checklist, i can't send the package in until these documents are complete.  My fiance needs to certify with a letter of intent to marry in 90 days after arriving in the US and fill out the G-325A form. My fiance speaks very little english so she would have hard time filingl them out.  These two documents, do I need to mail it to my fiance and have these documents fill out and send back to me?  I assume "yes", but just to be sure I rather ask.

 

If yes, can I fill out most of the information and have her sign/date send these back to me?

 

Question 2:

I read in other threads concerning US customs, to be honest, this part make me nervous.  Say, if she arrives at customs, would she need to do or say (she knows little english)?  She will have the documents from the US consulate if she passed the interviews, is that enough?  I plan to go get her after she pass the US consulate interview.

There are two things you seem to be confusing. 1) is proof of seeing eachother in person in the last two years.  2) is proof of a relationship.  Does your passport have passport stamps that prove you were in her country? Then item 1) is satisfied. I can see 2) is satisfied because you showed many other things.

 

Yes, my passport has stamps from her country.  I should be good without the tickets.  Yeppy.

I am in the the same boat.  I am starting my K-1 for my fiance.  She and I have been together for 6 years, went to see her 5 times and each time 2-3 months.  I am VERY worried now, I have read many couples K-1 visa and what they have included in the package for proof of relationship.  I have everything evidence to proof our relationship (itineraries, copies of ALL pages my passport, pictures of each trip, emails, copies of wiring money to her, and phone records) EXCEPT boarding pass tickets and hotel receipts.  I thought this day will never come true for us so I did not kept the ticket passes. 

 

Should I be worried or are the evidences I got sufficent enough?  Please help.  I got my own thread going for I-129F but since this thread is SSM topic. It's closer to home.

The support forms aren't needed with the petition. You will provide them for him to take to his interview. London accepts a different sponsor than the fiancé, meaning you wouldn't even have to fill out an I-134 for London if you had no income. Your dad could provide the form instead. Yes that is a London thing not done at all consulates.

After marriage, the I -864 support form is filed with his adjustment of status. You and your father will both do one. Your part is to answer the questions truthfully. Unemployed. Income $0. They will not reject his application if you have a joint sponsor, even if you are unemployed.

I know it isn't needed for the petition, I just like getting everything together asap :) but seriously, thank you so so so much! This really lifted a weight off my shoulders. I might love you a little bit.

I am so bad at this process, I swear. blush.png So here's the deal. My fiancé lives in London. Obviously I'm getting everything ready for the K1 visa process. I'm almost done with the petition (waiting to get the money to pay the fee and the letter of intent, bio form, and passport photo for/from James), so I want to get everything else ready as far in advance as possible. As of now, I am unemployed (and looking at going back to law school this fall (I'm on a medical leave of absence)), and my parents are paying all of my bills while I job hunt. In other words, I have no income whatsoever. My parents have agreed to cosponsor James, and they know what they need to do for their sponsorship form, but I am at a complete loss as to how to fill MY form out, as I am unemployed, have no income, etc. Any and all guidance is welcomed!

 

Additional details that might help: I worked for most of 2013, I quit my job in August of 2013 to go to law school, and then in September I had to take a medical leave of absence. Since then, I have literally no income; my parents are paying my rent, bills, groceries, etc. (they have agreed to continue to do so until I am either back in school or have a job, even with James living with me (I live in Iowa, they live in Pennsylvania).)

The interview in London is all about him. His birth certificate. The only thing he takes of yours to his interview is your affidavit of support and proof of your income. List of documents for him http://london.usemba..._documents.html (scroll down past the first couple of paragraphs)

You birth certificate (photocopy) goes with the petition to prove you are a US Citizen. It will be in the file that eventually ends up in London, but not really a part of his visa interview.

I know that James will need a copy of his own birth certificate and the original for his interview, but I've seen it implied that he would need the original and copy of my birth certificate as well. Is that the case, or does my fiancé only need HIS birth cert for the interview?

He will pay before the interview. 

Once you send of the initial petition (which you pay for at the time of sending) you will get a NOA. After that it will be sent to the NVC and you will wait for the NOA2 from them. Some get this quickly and others don't - we waited 5 months. After that, your fiancé will receive a letter from the embassy in London telling him the next steps. This has changed since I did it, but from what I gather it's all done with online forms and is far simpler. At this time he will need to send off for a police certificate as he will need this to take to the medical. The cost for this is £45 for standard delivery. He will need to arrange to medical and at that he will pay £235. He should then receive the appointment letter from the embassy and I assume this tells him where he needs to go to pay the next fee (I say assume as I never got the letter and just had to figure it out. Luckily it's straight forward!). He will then take the receipt with him to the interview.

You then don't have to pay anything in regards to the actual visa until you apply for AOS and this is $1070, so it's a good idea to forward plan for that too so you guys don't get stressed with it when the time comes to pay it!

You might be my favorite person on earth right now--I was just about to question the AOS fee (I thought it was waived for some reason...dont know why I thought that!)

 

I haven't sent in the petition yet (although most of my documents are ready to go, except James's letter of intent, bio form, passport photo, I still need the money for the fee), but I've already told James about the police certificate and he is working on getting that now. Thank you so much! <3

He would pay the fee when he actually goes online to do the application?
