Hello Everyone I wish you all best of luck on you visa journey. My case was complete yesterday at NVC.

I had a good lawyer and she helped me through my case. Scroll down to see what she did differently regarding the
documents she sent along I864.

Note to Indian VJer's about the Police Clearance:

First you have to get the clearance receipt and the stamp on the passport from the passort office and
then take it to the city commissioner office and get the real Police Clearance Certificate from them. Just the stamp and
receipt from the passport office is not enough.

and my wife is suppose to receive it. But I did what my lawyer told me to do. My lawyer sent I184, DS230 Part I and Part II
and all supporting documents along with the copy of POLICE CLEARANCE to NVC.

Got RFE: 2008-12-28 (missing document) We knew that we were going to get one because we had only sent the first part of the
Police Clearance (stamp on the passport and the receipt from the passport office) along with I863 to NVC. Well anyway, we got
the second part of the police clearance on 2008-12-23 and my wife mailed it to the lawyer. Well then the lawyer said that she checked
with NVC and they only want the copy and not the original Police clearance. So, she scanned it and email it to NVC. Due to the
holiday season it got little delayed. My lawyer gave me back the original Police Clearance to mail it back to my wife so she can
take it to the interview.

I just spoke to Mr. Williams at NVC and he informed me that the immigration appointments are usually set in the 2nd week

I129F receipt date is (03/11/08).

Current processing time for I129F is 6 months.
This means that they should have completed applicants prior to last six months.
That means they should have completed all applicants before April 19.

I called them today October 22nd and spoke to two ladies.

First lady:
Sir, you definitely fall outside of the processing time, but for some reason my computer is not letting me add an inquiry for outside of processing. Let me transfer to manager (second lady).

Second lady:
Sir, you have to give 30 day after those 6 months. I was like "madame 30 extra days would be March 19th and my receipt date march 11th"
She is like "well my computer is saying that you don't fall outside of processing time. Please call back in a month"

Honestly, I don't know what to do or what to tell time. I am a U.S. citizen. I filed for I130 for my wife too and the processing date for that is Feb. 26 and my receipt date is Feb. 14th. I am suppose to give 30 extra days which would be March 26th.

Well since Feb. 14th, there has been no activity on my I130 file.
And since March 11 there have being no activity on my I129F file.

Well, i don't know why you are so worried. Just look at timelines and see that a lot of people are in you situation.
About the lawyer: I have a lawyer are she is doing whatever she could to find info for me. It all depends on what kind of a lawyer you have. My I130 date is 02/24/08 and I129 is 03/11/08 and i haven't heard from USCIS. My lawyer is using AILA's (www.aila.org) liaisons to find out information for me. The thing with the lawyer is that if in case something goes wrong then you can blame them. Well i know some lawyers are jerk, but i am happy with my lawyer.

Just have patience bro - everything is going to be fine. If you change lawyers then I am sure you will have more problems. The new lawyer is always going to say that the previous lawyer made mistakes. And if you really think your lawyer is not doing anything then change the lawyer because once the time is gone you can never get it back.

New processing dates are posted. This is really pathetic!!!

I130 - date is still the same (26th Feb. 2008)
I129F - date is now(7th Mar. 2008)

I don't rust these date, but here must be some reality to it.

If you call then now they are going to tell you to wait extra 30 working days.

Next week is thanksgiving and I am sure they have couple of days off and after that basically they are going to be more laid back because the holiday season is approaching.

This is not to discouraged anyone, but there nothing we could do. If you guys have any positive news regrading this then please share it with us.

My lawyer contacted AILA (www.aila.org) for help and they are working on my case for last four weeks.
I went to my congressmen and spoke to the people over there. It seems that they are very familiar with this situation and they said they will look into my case.

I am not betting on anything.

I think I am going to book my flight to India to see my wife.

CJ-G, I understand the K3 processing dates really don't make any sense, but if you look at the I130 processing dates then you can make some sense out of it. It seems that they are working on the I130’s at faster pace or just that they have way too many K-3’s petitions than I130.

These are the processing dates for I130:

June 15 = July 02, 2007
July 15= September 03, 2007
August 15 = September 03, 2007
September 15 = November 26, 2007
October 19 = February 26, 2008
November 19 = February 26, 2008

According to these dates, VSC has processed 240 days of petitions in 157 days.

At this rate, by next update (Dec. 19th) the I130 processing date should be April 11, 2008.

I filed K-3 after I130 so my wife could be he here early, but it seems that I130 is going to be processed before K-3. Actually, that would be better for us. We don’t have to do all that adjustment of status paper work.

My receipt dates:

I130 – 02/14/2008
I129 – 03/11/2008

Hopefully, I will get some good news soon.

Thank you - Hopefully, your in the mail too. Just check your mail. Nothing on the website is updated. I called them after my petition was approved and they didn't had any info and they told the that I am still in processing time.

I actually developed this a friendly relationship with the staff at my congressmen's office. Lucky for me, the office is just down my street.

Well I got approved for both I130 and I129F K-3. My files have been forwarded to NVC. I haven't received any conformation on I130 from NVC, but I got a letter stating that my I129F has been forwarded to the consulate in India. My question is that if my wife should pursue K-3 or wait or I130? I was thinking maybe she should go through the K-3 process and get the visa and just wait of the I130 process to go through. Is is possible or her to do that?

I want her to come here on I130 because she would get the greencard. But I don't want her to loose this opportunity of K-3.
K-3 petition is only valid until march. If NVC delays my I130 then she can come on K-3. If she waits for I130 and not pursue K-3 then the time will expire.

So, my question is basically can she get the K-3 visa approval and wait there for I130 visa?

Guys I have an idea - we should advice the people (US citizens) to join the military if they plan to file for K3. If you are in military then your case is their TOP priority. I spoke to one of the US Army recruiter to find out about this and he confirmed that if I was to join the military then they can take care of my file.

use the same uscis receipt number which their parents came on and then try adjustment of status. USCIS has all is information of him
from his parents approval paper, but he couldnt come because he was over age and he is here now on job visa. Can someone answer
this question for him.

I know many of you will say, file with the police anyway to get the document but she is very afraid I won't be able to stay with her. If she won't do this, is there any other way for me to show proof that I was with her for a few months? (aside from my plane ticket to Vietnam and passport stamps?)

Any creative ideas would be great right now!

Dude I am pretty sure that you can go with her to the interview. Just take you ticket, passport and yourself as proof. Just take you wifes accident report of medical bill. Actually, you being there will help the case and not hurt it.
